A RESOLUTION AUTHORIZING EXECUTION OF THE PASCO
WATER REUSE FACILITY (PWRF) AGREEMENT WITH APOLLO
CONSTRUCTION (CONTRACTOR) FOR THE REPAIR OF THE PWRF
POLLUTION CONTROL FACILITY PURSUANT TO RCW 70A.210.110
WHEREAS, the City of Pasco (City) owns and maintains the PWRF a pollution control
facility within the meaning of RCW 70A.210.020; and
WHEREAS, the City of Pasco, consistent with 70A.210.110, has sole discretion without
regard to competitive bidding requirements, to construct, reconstruct, and improve the PWRF; and
WHEREAS, an embankment located between the 8MG pond and the 35 MG pond has
failed and its repair is time sensitive to allow for adequate operation of the PWRF during winter
months; and
WHEREAS, the City has conducted an assessment on the failure and designed the
reconstruction of the embankment at PWRF; and
WHEREAS, the Contractor is familiar with the site and has proven successful at similar
work and has assisted the city with exploratory work pertaining to the assessment of the berm
failure; and
WHEREAS, the Contractor has identified the projected cost of $631,449.81 to include
repair of the embankment, installation of a new overflow pipe and HDPE liner, and liner testing;
and
WHEREAS, the City Council of the City of Pasco finds this cost to be reasonable
considering the scope of work required to successfully complete this project, and the importance
of this project for the successful operation of the PWRF.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PASCO, WASHINGTON:
That the City Manager for the City of Pasco is authorized to execute the PWRF
Embankment Repair Contract with Apollo Construction Incorporated, a copy of which is attached
hereto and incorporated herein by as Exhibit A; and take all necessary steps required to complete
this transaction.
Be It Further Resolved that this Resolution shall be in full force and effect upon adoption.

The undersigned declares that he has carefully examined the project site for the Foster Wells
Pump Station located at 525 N. 3rd Avenue, Pasco, WA 99301, and its associated Forcemain
Improvements to the (PWRF).
Base Bid — This project is an emergency repair to mitigate and repair an existing dike failure
and includes furnishing, installing, and compacting 400 tons of structural fill, installing one
overflow pipe through the dike fill, 67 LF of 24 -in. diameter ductile iron pipe, and patching
17,425 square yards of pond liner with 60 -mil HDPE liner.
In accordance with the terms, provisions, and requirements of the foregoing, the following prices
are tendered as an offer to furnish the equipment, materials, appurtenances, and guarantees,
where required, and to perform the work in place and in good working order.

The undersigned hereby agrees that the City Engineer for the City of Pasco shall determine the
actual amount of quantities and materials to be paid under the Contract for which this Proposal
is made and that all material furnished and all work performed shall be strictly in accordance
with the plans and specifications.
The undersigned agrees that if awarded the contract, he will commence work on the date
indicated on the written Notice to Proceed and that all work should be completed within
30 calendar days. The undersigned further agrees to pay as liquidated damages for each
consecutive working day thereafter as provided in the current Standard Specification for Road,
Bridge, and Municipal Construction Section 1-08.9.
The undersigned Bidder hereby certifies that, within the three-year period immediately
preceding the bid solicitation date for this Project, the bidder is not a "willful" violator, as defined
in RCW 49.48.082, of any provision of chapters 49.46, 49.48, or 49.52 RCW, as determined by

Industries or through a civil judgment entered by a court of limited or general jurisdiction.

PREVAILING WAGE RATE REFERENCE
The State of Washington prevailing wage rates applicable for this public works
project, which is located in Franklin County, may be found at the following website address

Based on the bid submittal deadline for this project, the applicable effective date for
prevailing wages for this project is September 1, 2020, and subsequent corrections
