A RESOLUTION OF THE CITY OF PASCO, WASHINGTON,
AUTHORIZING THE CITY MANAGER TO SIGN AND EXECUTE
SUPPLEMENT NO. 5 TO THE PROFESSIONAL SERVICES AGREEMENT
WITH J-U-B ENGINEERS, INC. FOR LEWIS STREET OVERPASS PROJECT.
WHEREAS, the City of Pasco, Washington and J-U-B Engineers, Inc. (the project's
Engineer of Record) entered into a Professional Services Agreement No. 30-18-020 on February
5, 2018, in the amount of $1,364,800 to provide design services with respect to the Lewis Street
Overpass Project; and
WHEREAS, the City of Pasco, Washington and J-U-B Engineers, Inc. entered into
Supplement Nos. I and 2 to the Professional Services Contract in the amount of $258,200 to add
right-of-way tasks, a right-of-way sub consultant (Universal Field Services), along with various
design revisions; and
WHEREAS, the City of Pasco, Washington and J-U-B Engineers, Inc. entered into Supplement
Nos. 3 and 4 to the Professional Services Contract in the amount of $489,920 to add construction
support services and ongoing on -call engineering support during construction; and
WHEREAS, the City of Pasco, Washington and J-U-B Engineers, Inc. desire to enter into
Supplement No. 5 to the Professional Services Contract in the amount of $223,410.00 to provide
additional ongoing on -call engineering support during construction; and
WHEREAS, the City Council of the City of Pasco, Washington, has after due
consideration, determined that it is in the best interest of the City of Pasco to enter into Supplement
No. 5 with J-U-B Engineers, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PASCO, WASHINGTON:
That the City Council of the City of Pasco approves the terms and conditions of the
Supplement No. 5 between the City of Pasco and J-U-B Engineers, Inc. as attached hereto and
incorporated herein as Exhibit A.
Be It Further Resolved, the City Manager of the City of Pasco, Washington, is hereby
authorized, empowered, and directed to execute said Supplement No. 5 on behalf of the City of
Pasco; and to make minor substantive changes as necessary to execute the Supplement.
Be It Further Resolved, that this Resolution will take effect immediately.

Description of Work
This supplement provides for ongoing on -call engineering support during construction and extends the
services one year. This supplement includes additional design services requested by the City.
The Local Agency of
desires to supplement the agreement entered in to with J-U-B ENGINEERS. INC.
and executed on February 5, 2018 and identified as Agreement No. JUB No. 30-18-020
All provisions in the basic agreement remain in effect except as expressly modified by this supplement.
The changes to the agreement are described as follows:
Section 1, SCOPE OF WORK, is hereby changed to read:

Section IV, TIME FOR BEGINNING AND COMPLETION, is amended to change the number of calendar days
for completion of the work to read: End Date Extended one year to December 31, 2024,

Section V, PAYMENT, shall be amended as follows:
The total estimated cost of Supplement 5 is $223,410.00 including $20,310.00 of management reserve. June
30, 2023 WSDOT approved J-U-B Indirect Cost Rate is 182.64%
as set forth in the attached Exhibit A, and by this reference made a part of this supplement.
If you concur with this supplement and agree to the changes as stated above, please sign in the Appropriate
spaces below and return to this office for final action.

We have accepted your firms FYE 2022 Indirect Cost Rate (ICR) of 182.64% of direct
labor (rate includes 0.96% Facilities Capital Cost of Money) based on the "Cognizant
Review" from the Idaho Transportation Department. This rate will be applicable for
WSDOT Agreements and Local Agency Contracts in Washington only. This rate may
be subject to additional review if considered necessary by WSDOT. Your ICR must be
updated on an annual basis.
Costs billed to agreements/contracts will still be subject to audit of actual costs, based
on the terms and conditions of the respective agreement/contract.
Any other entity contracting with your firm is responsible for determining the
acceptability of the ICR.

Exhibit A — Scope of Services
PROJECT NAME: Lewis Street Overpass Construction Support

PART 1 - PROJECT UNDERSTANDING
J-U-B's understanding of this project's history and CLIENT's general intent and scope of the project are
described as follows:
The City of Pasco awarded the Lewis Street Overpass construction contract March 1, 2021 to Cascade
Bridge LLC. Whereas, J-U-B provided the design and is the Engineer of Record for this project. The
CLIENT wishes to supplement the agreement for engineering support during construction to include
additional Request For Information (RFI) and Submittals. Full time construction management is contracted
with a separate Consultant which J-U-B has no contractual relationship with for this project. J-U-B will report
only to the CLIENT as requested.
PART 2 - SCOPE OF SERVICES BY J-U-B
J-U-B's Services under this Agreement are limited to the following tasks. Any other items necessary to plan
and implement the project, including but not limited to those specifically listed in PART 3, are the
responsibility of CLIENT.
J-U-B will coordinate with subconsultant(s) as needed. For budget purposes assumed budget has been
included for subconsultants to assist in tasks representing their design responsibility.
A. Task 010: Project Management — No Change
Even though the schedule has added an estimated 12 months to the project, we are under
budget on Project Management Task.
B. Task 015: Conformed Contract Documents —No Change
C. Task 020: Preconstruction Meeting — No Change
D. Task 030: Site Visits — No Change
E. Task 040: Request For Information and Submittal Review
1. Cross Sections — The City directed J-U-B to produce cross sections for Contractor Information.
2. Design/Sidewalk Grades — The City directed J-U-B to produce design grades for Contractor
information. Design grades were revised to meet the City's desired 1.50% typical sidewalk grade.
3. Assumptions:
4. RFI and submittals extended to March 2024. The budget estimate accounts for the Managerial
Reserve established in Supplement No. 4 mitigates a portion of the added costs. The resources
going forward is assumed to be estimated as 9 months. The budget assumes a 30% level of
reduction in resources as the project approaches completion.

1. BNSF Water Service Redesign — The City directed J-U-B to revise the BNSF Water Service to
include a RPBA and heated enclosure for the above ground system. J-U-B hired electrical
subcontractor D Hittle and Associates to design the electrical service requirements.
2. Traffic Phasing — The City directed J-U-B to develop detailed phasing plans. Prior to the traffic
phasing plans, the City requested J-U-B develop scope and fees for designing a geosynthetic
wall to promote the Contractor method to build the entire W6 under the phase 1. The City later
changed the direction to allow the closure of Lewis Street for a three week period. The City
directed J-U-B to develop additional phasing and traffic control plans sowing a new phase of full
closure and detour.
3. Basement Redesign — During construction a void under the existing sidewalk at the southeast
corner of 2nd Ave and Lewis Street. This void turned out to be the adjacent building basement
extended under the public sidewalk.
4. BNSF Bridge Sign — The City directed J-U-B to design a bridge sign for BNSF that will attach to
the structure over the BNSF mainline.
5. Assumptions:
a. J-U-B has completed the design related to these three change orders. The hourly
estimate includes an additional 10% to account for any further design refinements that
may result during the change order development process.
G. Task 060: Project Closeout — No Change
H. Task 070: Subconsultant(s)
1. Assistance from subconsultants involved in the design and contract preparation as required to
assist CLIENT. Subconsultants use include:
a. GeoProfessional Innovation (GPI) which is the Geotechnical Engineer of Record to
provide reviews of submittals and RFI's as needed. As a result of buried foundations
discovered on site, the City requested GPI on -site observation and recommendations for
mitigation. This work was over GPI budgeted amount.
b. UFS — provided right of way documentation during design. After bid and award, the City
requested their involvement in obtaining an updated construction easement.
c. KPG-PSOMAS provided design revisions due to the basement change order.
d. D Hittle & Associates was used to provide the electrical design for the BNSF Water
Service change order.
PART 3 - CLIENT -PROVIDED WORK AND ADDITIONAL SERVICES
A. CLIENT -Provided Work - CLIENT is responsible for completing, or authorizing others to complete,
all tasks not specifically included above in PART 2 that may be required for the project including, but
not limited to:
1. Construction Management
2. Railroad Approvals and Coordination
3. Inspections and Resident Project Representative
4. Material Testing
5. Construction Surveying QC
6. Construction Documentation and Funding Agency Coordination
B. Additional Services - CLIENT reserves the right to add future tasks for subsequent phases or
related work to the scope of services upon mutual agreement of scope, additional fees, and schedule.
These future tasks, to be added by amendment at a later date as Additional Services, may include:
1. Design for the removal of existing top of underpass and railroad track replacement.
2. Assisting CLIENT with audit reviews and requests for design documentation.
3. Assisting CLIENT with Right of Way or Environmental Issues.
4. Assisting the CLIENT with railroad coordination.
5. Assisting the CLIENT with Utility coordination.
