HomeMy WebLinkAbout4661 Ordinance - FLU W Court Between 19th Ave N 14th Ave (CPA2022-016)ORDINANCE NO.4661 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, ADOPTING THE WEST COURT STREET, BETWEEN N 19TH AVENUE AND N 14TH AVENUE (CPA2022-016) FUTURE LAND USE AMENDMENT TO THE COMPREHENSIVE PLAN OF THE CITY OF PASCO PURSUANT TO THE GROWTH MANAGEMENT ACT CHAPTER 36.70A RCW. WHEREAS, the Growth Management Act authorizes the City to, among other things, amend the Comprehensive Plan on an annual basis; and WHEREAS, the City initiated proposal to amend the Future Land Use Map from Commercial to Mixed Residential and Commercial impacting parcels as shown in Exhibit A was submitted for consideration with the 2022 Comprehensive Plan Amendment Docket; and WHEREAS, the proposed amendment addresses a deficiency in the Comprehensive Plan correcting a mapping error; and WHEREAS, the Planning Commission conducted workshops and public hearings pursuant to legally required notice on the proposed amendment to the Comprehensive Plan and recommended approval to the City Council; and WHEREAS, the City Council considered and discussed the proposed annual amendment to the Comprehensive Plan; and WHEREAS, the City Council desires to amend the Future Land Use Map of the Comprehensive Plan. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Future Land Use Map amendment to the Pasco Comprehensive Plan, as shown in Exhibit A, changing the designation of the land use from Commercial to Mixed Residential and Commercial is hereby adopted. Section 2. The City Council finds that the amendment has met the decision criteria contained in PMC 25.215.020; that the amendment is consistent with the Comprehensive Plan and the goals and policies of the City. Section 3. The Pasco Comprehensive Plan, adopted pursuant to Chapter 35A.63 RCW, is amended consistent with Section 1 of this Ordinance. Ordinance — FLU (CPA2022-016) - 1 Section 4. Severability. If any section, subsection, sentence, clause, phrase, or word of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, phrase, or word of this Ordinance. Section 5. Corrections. Upon approval by the city attorney, the city clerk or the code reviser are authorized to make necessary corrections to this Ordinance, including scrivener's errors or clerical mistakes; reference to other local, state, or federal laws, rules, or regulations; or numbering or referencing of Ordinances or their sections and subsections. Section 6. Effective Date. This Ordinance shall take full force and effect five (5) days after approval, passage and publication as required by law.
