Change order #2- Ecology required an off -gassing system to be installed after the project was started. After removing the bottom liner in the 35 MG pond, it was discovered that the process water saturation point due to the leak of the native soil was enough that an off - gassing system needed to be installed to keep the gasses from building up under the new liner after installation. Change order #3- Upon inspection, it was discovered that the overflow pipe from the 115 MG to the 35 MG reservoir had some voids around the pipe similar to the cause of the failure of the overflow that happened provoking this project between the 35 MG to the 8 MG reservoir. Change order #4- After the liner was installed in the 35 MG reservoir, Ecology required us to leak test both the 35 MG and 8 MG reservoir. The 8 MG reservoir failed and was necessary to remove and replace the bottom liner. Change order #5- After the completion of the project, we had estimated quantity overages and this change order reconciled the overran bid items. The 2 bid items were: Embankment/Structural fill incl. Haul and Textured 60 mil. (Staff & equipment cost) • City of Pasco Engineering staff began project management of the embankment repair. ■ Design Consultant selection began on July 10. PACE Engineers was awarded on July 16. Scope and fee negotiations began immediately. AUGUST 2020 ■ Professional Services Agreement (PSA) with PACE $44,473 Engineers executed August 13, 2020 for initial Assessment report and 10%conceptual design. SEPTEMBER 2020 ■ Frequent meetings with Washington State Department of Ecology (Ecology), Dam Safety and Water Quality Divisions, were held for guidance on the expectation and procedure to obtain approval for the repair of the embankment. ■ PACE PSA Addendum #1 Executed September 23, to $33,810 perform geotechnical and environmental exploration, including borings and laboratory testing of samples. ■ Initial Assessment report received September 25. The report identifies the cause of failure and embankment current condition. It proposes a conceptual solution for the repair, recommends field investigation to confirm assumptions. ■ Geotechnical and Environmental Investigation. Performed 6 borings to a depth of 25ft and 50ft to assess geotechnical condition of the soils in the vicinity of the embankment failure. Occurred between September 23 and September 29. OCTOBER 2020 ■ PACE PSA Addendum #2 executed October 1 for $49,335 preparation of Geotechnical and Environmental Engineering report, based on geotechnical and environmental exploration. ■ Receipt of results of soil samples tested by laboratory to be used in geotechnical design efforts for embankment reconstruction. Page 1 of 4 City of Pasco Embankment Repair Timeline ■ Contract with Apollo (General Contractor) for exploratory work: removal of the liner, grading and minor work to allow borings and design to advance. ■ PACE PSA Addendum # 3 executed October 20. Addendum expands scope of work to prepare plans and specifications for the repair of the embankment. Draft Geotechnical and Environmental Engineering report identifies condition of existing soil and its capability to support the repaired embankment. It recommends the most suitable methodology for the repair and identifies the standards applicable for adequate construction and inspection. Also addresses water quality concerns and BOD in the soil in the vicinity of embankment failure. Draft report completed on October 28. ■ Plans and specifications (PS&E) for the construction of the repair (PACE's PSA Addendum #3 were developed concurrent with the geotechnical report. NOVEMBER ■ Completion of contract documents, including Plans and 2020 Specifications for the project on November 6 ■ Plans and specification submitted to ecology for review and approval on Nov. 6 ■ Proposal received from Apollo on November 10 ■ Award letter issued to Apollo on November 18 ■ Ecology's review comments on the PS&E received on Nov. 20 ■ Responses to Ecology's comments submitted on Nov. 25, including revised plans and specs. DECEMBER ■ On December 2 Ecology Dam safety communicate to the 2020 City they were ready to issue a "preliminary Conceptual Approval for the Pasco PWRF Embankment repair project" and provided further comments on the design documentation and the preparation of a Construction Inspection Plan. ■ Execution of contract with Apollo for repair work on Dec. 3 ■ Notice to proceed issued on November 30, 2020. Page 4 of 4 RESOLUTION NO. 4107 A RESOLUTION OF THE CITY OF PASCO, WASHINGTON, AUTHORIZING THE CITY MANAGER TO SIGN AND EXECUTE A FIFTH CHANGE ORDER TO THE CONSTRUCTION CONTRACT WITH APOLLO, INC. FOR THE PROCESS WATER REUSE FACILITY (PWRF) EMBANKMENT REPAIR PROJECT. WHEREAS, City staff on June 27, 2020, discovered a failure of the internal embankment between the 8MG pond and the 35MG pond at the City's PWRF; and WHEREAS, the City and Apollo, Inc. entered into a Construction Contract on December 3, 2020, pursuant to RCW 39.04.280(1)(c), to provide repair work for the PWRF Embankment Repair Project; and WHEREAS, the City and Apollo, Inc. has executed four Change Orders to the Construction Contract to accommodate regulatory requirements and changed conditions; and WHEREAS, Change Orders Nos. 1 through 3 to the contract were authorized under the authority provided to the City Manager and Public Works Director; and WHEREAS, Change Order No. 4 in the amount of $143,633.96 (including Sales Tax) required Council approval and received approval on April 19, 2021; and WHEREAS, Change Order No. 5 in the amount of $134,965.02 (including Sales Tax) exceeds the City Manager's authority and thus requires Council approval; and WHEREAS, the additional expenditure associated with Change Order No. 5 is reasonable and after careful staff review will fulfill the intent of the original contract entered into on December 3, 2020 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON: Section 1. WHEREAS, the work performed by Apollo, Inc., under contract for the PWRF Embankment Repair project, has been examined by City of Pasco staff and has been found to be in apparent compliance with the applicable project specifications and drawings; and WHEREAS, it is the City Staffs recommendation that the City of Pasco formally accept the contractor's work and the project as complete. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON: That the City Council concurs with the Stars recommendation and thereby accepts the work performed by Apollo, Inc., under contract for the PWRF Embankment Repair project, as being completed in apparent compliance with the project specifications and drawings; and Be It Further Resolved, that the City Clerk is hereby directed to notify the Washington State Department of Revenue of this acceptance; and Be It Further Resolved, that the final payment of retainage being withheld pursuant to applicable laws, regulations and administrative determination shall be released upon satisfaction of same and verification thereof by the Public Works Director and Finance Director.
