THIS MATTER having come on for hearing in front of the City of Pasco Hearing Examiner on
October 13, 2021, the Hearing Examiner having taken evidence hereby submits the following
Findings of Fact, Conclusions of Law, and Decision and Conditions of Approval as follows:
I. FINDINGS OF FACT
1. On August 2, 2021, the Hearing Examiner approved a Special Permit proposal (SP 2021-010)
for a City of Pasco fire station (Fire Station 985)to be located along Road 100 between
Chelan Court to the north and Maple Drive to the south(Parcel 9119 541 023),with
Conditions of Approval.
2. The design team had originally prepared several alternatives for the site layout including a
couple with access on the north side of the property (one of which was approved by the
Hearing Examiner) and one with the access on the south side of the building with the
extension of Maple Dr.
3. A layout with access on the north side of the property was originally selected and the
Conditional Use Permit application was filed based on that location, and ultimately approved
by the Hearing Examiner.
4. However, due to new utility considerations for water and sewer the site plan has been
"flipped" along the east west axis of the site to relocate the access to the south with the
extension of Maple Dr.
5. The site plan reflects the contemplated changes. The building location has shifted on the site
to accommodate the revised street location. However, the building footprint, height etc. are
the same as before.
6. The Hearing Examiner hereby finds that the current revised site plan is in conformance with
the Examiner's August 11, 2021 approval.
7. Public notice of this hearing was sent to property owners within 300 feet of the property and
posted in the Tri-City Herald on September 24, 2021.
8. Applicant has requested the site plan be "flipped"along the plat east-west axis.

9. With the modification, the fire station facility will be located at the northeast corner of Road
100 and Maple Drive.
10. The revision would allow Maple Drive to continue eastward along the south property line.
11. The lot to the south is Lot l of Short Plat 92-04(see Short Plat 92-04 Sandlin).
12. A note pointing to a strip of land along the north property line of Lot 1 of Short Plat 92-04
specifies "30' RESERVED FOR FUTURE ROAD".
13. Note #9 of Short Plat 92-04 states "LOT OWNER(S)SHALL AGREE TO PARTICIPATE
IN FUTURE LID AND/OR RID FOR ROADS, DRAINAGE,CURB AND GUTTER,
STREET, LIGHTS, STORM SEWERS,WATER AND/OR SANITARY SEWER".
14. The extension of Maple Drive will coincide with the reserved road ROW on the south
neighboring property.
15. The extension of Maple Drive will facilitate utility considerations for water and sewer to the
site and to future development to the east of the site
16. An open record public hearing was held on September 8, 2021 via Zoom videoconferencing.
17. Admitted into the record were the following exhibits:
17.1 Ex. A Revised site plan;
17.2 Ex. B 30' reservation for future road map;
17.3 Ex. C Application,area maps,and site maps;
17.4 Ex. D Staff report;
17.5 Ex. E SP 2021-010 file of record.
18. The Applicant did not appear at the hearing.
19. The following member of the public testified at the hearing:
19.1 Mike Bishop. Mr. Bishop lives immediately south of the project site. His primary
concern related to the intersections of Maple Drive and related safety issues. His
concern was that the City of Pasco would sell the back portion of the subject
property. He argued that his road easement should not apply to this project. He stated
that his property access is off Road 100. He objected to Maple Drive being extended.
20. This site revision complies with all of the Findings of Fact, Conclusions of Law, and
Conditions of Approval set forth in the decision related to SP 2021-010.
21. Any Conclusion of Law that is more correctly a Finding of Fact is hereby incorporated as
such by this reference.
II.CONCLUSIONS OF LAW
1. The Hearing Examiner adopts all of the Conditions of Law set forth in SP 2021-010.

2. Any Finding of Fact that is more correctly a Conclusion of Law is hereby incorporated as
such by this reference.
III. DECISION
Based on the above Findings of Fact and Conclusions of Law, the Hearing Examiner APPROVES
Application SP 2021-016, subject to the following Conditions of Approval.
IV. CONDITIONS OF APPROVAL
1. The Hearing Examiner adopts all the Conditions of Approval set forth in SP 2021-010 for this
revised project.
