The Regular Meeting of the Board of Adjustment was held at 8:00 p.m., Wednesday, January 28, 1976, in the Council Chambers of Pasco City Hall. ROLL CALL: Members present were John Koster, Shirley Zahn, David Squires and E.L. Suhadolnik. G.V. Manderville was not present. APPROVAL OF MINUTES: Minutes of the Regular Meeting held November 26, 1975, were approved as written. PUBLIC HEARING - Special Permit - Comm-Home, Inc. , 527 W. Bonneville - File No. 75-19 Chairman Squires requested the secretary read the application as submitted, which is a request for a SpeciAl Permit to continue operation of the Tri Cities Work and Training Release Center (Comm-Home, Inc. ) located at 527 W. Bonneville Street. After public notice had been made, the only correspondence received was a phone call from R.O. Hall stating he had no objection to this use. Public Hearing was then opened. Police Chief Tebaldi stated that he is the Secretary for Comm-Home, which opened at this location in April 1972. Since then 113 men and 1 woman have been processed through this facility; 89 have completed the requirements and are now paroled; they have had 10 escap- ees and 10 have committed new felonies and these men have been returned to prison; and they show an 89 ' success figure. 80 to 85'0 of the people that go through Comm-Home are local residents. Mr. Wilkes, Comm-Home Director, states that these men work at local jobs and pay room i and board and therefore the service is self supporting. During his two ,years employement at this location, there have been no complaints from the neighborhood. There being no further comment from the floor, the public hearing was closed. After discussion by the Board, motion was made by Suhadolnik, seconded by Koster, to grant a Special Permit to Comm-Home, Inc. for operation of this facility for a five (5) year period, at which time the Board will reconsider bperation of this facility at this location. Motion carried by the following vote: Zahn, yes; Koster, yes; Suhadolnik, yes; Squires, ves. PUBLIC HEARING - Front yard variance Cloverlead Lanes 28th & Lewis - File No. 75-20 Chairman Squires requested the secretary read the application as submitted, which is a request for interpretation of front .rard in accordance with P.M.C. 22.16.050, and if necessary, a variance of 121 of the 15' yard requirement on the north side of the Bowling Alley to allow construction of an open entrzr porch. After public notice being made, no correspondence had been received. Public Hearing was then opened. There was no comment from the floor concerning approval of this request. Fay Rombough, 620 N. 18th, asked if a liquor license was being sought for this location and he was advised that this would be handled by the State Liquor Board, but it was thought that the license had already been issued. Mrs. Rombough stated that she was against liquor being served in a place that catered tos.younger people. There being, no further comment from the floor, the public hearing was closed. After discussion by the Board, it was unanimously agreed that the north side of the property (Irving Street) would be considered the front yard since the majority of the activity will occur in this area. Motion was made by Koster, seconded by Zahn, to grant approval of a 12, variance to the required 15' front yard to allow construction of an open entry porch. Motion carried by the following vote: Suhadolnik, ves; Zahn, yes; Koster, ves; Squires, yes. Board of Adjustment —2- 1-28-76 l PUBLIC HEARING — Lawrence P. Locati, 1844 W. Brown, Special Permit — File No. 76-1 1 Chairman Squires requested the secretary read the application as submitted, which is a request for interpretation of P.M.C. 22.36.040(7) to determine whether a business that rents foliage for off—premises use would be considered an office or a retail sales; and requested a Special Permit to construct an office building in the High Density (R-3) Residential Zone. After public notice having been made, no correspondence has been received pertaining to this request. Public Hearing was then opened. Larry Locati, 1924 W. Yakima Street, stated that he is the owner of the property at 1844 W. Brown Street and is presently operating a beauty shop there under a Special Permit. He would like to add 1,100 sq. ft, of rental office space to the exikting building. The property is large enough to permit 7 off—street parking spaces to the west and another 4 spaces to the south. He also stated that he has lost the lease for the Rent—A—Plant business, so no longer needs this interpretation. There being no further comment from the floor, the public hearing was closed. After dsicussion b7:the Board, motion was made by Zahn, Seconded by Suhadolnik, to grant a Special Permit to Mr. Locati to erect an 1,100 sq, ft, office building on the property known as 1844 W. Brown. Street within the limits of the Building Code. Motion carried by following vote: Koster, yes; Suhadolnik, ves; Zahn, yes; Squires, yes. PUBLIC HEARING — Special Permit, Day Care Center, 19th & Park — File No. 76-2 Chairman Squires requested the secretary read the application as submitted, which is a request from the Educational Institute for Rural Families for a Special Permit to operate a short term migrant day* care service at the Presbyterian Church located at 19th & Park Streets. The Board was advised that after public notic had been made, inquiry had been made by one of the church trustees in behalf of one of the church members who opposed this operation. No other correspondence had been received. The Chairman noted that another request, File He. 76-3, had been filed by the applicaht for the same type activity at the Church of Our Savior, 1215 W. Court Street, and he felt that both requests could be handled at the same hearing to avoid repetition. Public Hearing was then opened. Phyllis Maltos, Educational Institute for Rural Families, stated that this program is sponsored for the children of migrant workers by Federal and State monies through the Department of Social and Health Services. It is an educational and day care service for children from the ages of 22 to 5 years. The service runs from April 15 through June 30 at the Presbyterian. Church and from April 15 through September at the Church of Our Savior. Hours of operation are from 5 :00 a.m, until 3 :00 p.m. Each class will consist of approx— imately 49 children and one staff member for each 4 children. The children will be bussed from Lakeview Trailer Village and back home again. Two adults will ride the bus with the children and the others will arrive at the church at various hours by private transporta— tion. ransporta— tion. Dorothea Olson, co—ordinator of the program, spoke in favor of the Special Permit. Virgie Robinson, 824 N. 18th, stated she is a public school teacher and is interested in the childrens welfare and also spoke in favor of the Special Permit. Mrs. Wergeland, 1003 N. 19th, stated that she objected to this use since generally a temporary use becomes a permanent use and once it is started there is no end to it. She also obiected to the extra traffic ,venerated and the noisy buses at that hour of the day. Mrs. Rav Rombough, 620 N. 18th, stated she objects to the traffic and noise that will occurr at such an earl = hour. Joseph March, 1704 N. 18th, stated he owns some rental units in this area and objects to the traffic and noise on behalf of his tenants. 1 Ralph Smith, 1720 W. Margaret, objected to the traffic and noise. Mrs. Rombough stated that Herschel Crose, 1216 N. 19th, could not be here for the hearing, but requested that she speak for him in objection of this use. Pastor Hegg, Presbyterian Church, stated that the parking lot for the church is on the Board of Adjustment -3- 1-28-76 south side of the property, awa7r from the residential housing, and that he didn't think the traffic or noise would be sufficient to disturb anyone. Bettv Ammann, 1724 W. Margaret, objected to the traffic and noise that would be created, especially when you. add 10 to 12 private vehicles in addition to the bus. None of these people would object so strongly if the hours could be changed to those of the nearbv public school. Randzr Boyd, Green Giant Company, stated that most agricultural workers start at an early hour and therefor the children must be taken care of during the parents absence. No one spoke in opposition of the Special Permit for the Church of Our Savior. There being no further comment from the floor, the public hearing was closed. After discussion by the Board, motion was made by Koster, seconded by Zahn, to deny the Special Permit for a migrant day care center at the Presbyterian Church , 1730 W. Park Street. Motion carried by the following vote: Suhadolnik, =res; Zahn, yes; Koster, yes; Squires, no. PUBLIC HEARING - Special Permit, Day Care Center, 1215 W. Court St. ,- File No 76-3 Chairman Squires waived the reading of the request for Special Permit submitted by the Educational Institute for Rural Families regarding the Church of Our Savior, 1215 W. Court Street, since it had been discussed dtrring the preceeding hearing, and asked for a motion from the Board. Motion made by Suhadolnik, seconded by Zahn, to grant a Special Permit as requested for the Church of Our Savior, 1215 W. Court Street. Motion carried by the following vote: Koster, yes; Zahn, yes; Suhadolnik, yes; Squires, yes. PUBLIC HEARING - Off-Street Parking Requirements Russ Dean Ford - File No 76-4 Request was made by Mask L. Pence, Architect for the new Russ Dean Ford new car sales building, to determine the number of off-street parking spaces required for this oper- ation in accordance with P.M.C. 22,84.040, stating that they have set aside 25 parking spaces for their customers in addition to their requirements for new and used cars and their regular employees. After discussion, the Board determined that this number would be sufficient for this type activity. Motion was made to this effect by Koster, seconded by Suhadolnik, and carried by unanimous vote. ADJOURNMENT : There being no further business before the Board, the meeting was adjourned at 9 :32 P.m. APPROVAL OF MINUTES: Minutes of the regular meeting held January 28, 1976, were approved as written. PUBLIC HEARING r76-5 Fence Height Variance, R.L. Smart, 1804 W. Sylvester St. Chairman Squires requested the secretary read the application as submitted, which is a request for a variance from the fence height requirements in a front yard and would permit a six foot high fence around the patio areas in the front =lard of a new four—plex apartment house. The Board was advised that public notice had been given and no correspondence had been received either .for or against this request, and that five letters had been returned by the post office as unable to deliver. Public Hearing was then opened. Mr. & Mrs. Rav Rombough, 620 N. 18th, stated that then had no objection to this fence and felt that it would be an asset to the neighborhood. No one else spoke either for or against this request. The public hearing was then closed. After discussion, motion was made bzr Zahn, seconded bir Koster, to grant the variance as requested for fences around the patio areas as indicated on the drawings submitted. Motion carried by the following vote: Koster, yes; Zahn, ves; Squires, yes. PUBLIC AEARINC #76-6 Fence Height Variance, Rov Rice, 1703 W. Yakima St. Chairman Squires requested the secretary read the application as submitted, which is a request for a variance from the fence height requirements in a front yard and would permit a six foot high brick spall in the front yard area along Yakima Street. The Board was advised that public notice had been given and no correspondence had been received either for or against this request, and that five letters had been returned by the post office as unable to deliver. Public Hearing was then opened. Roy Rice, 1703 W. Yakima St. , stated that he had started building a brick serpentine wall about ten years ago. He recently acquired two vacant lots to the west of his propertv and would like to continue this wall around these lots, but finds that the code has been changed in the meantime and will not allow this will to be over 42 inches in height. Henry Landon, 1632 W. Yakima Street, stated that he is in favor of this fence being built. No one else spoke either for or against this request, so the public hearing was closed. After some discussion, motion was made by Koster, seconded by Zahn, to grant this variance as requested. Motion carried by following vote : Zahn, ves; Koster, yes; Squires, yes. PUBLIC HEARING #76-7 Lot Coverage Variance Reuben Neuberger, 1724 W. Bonneville 5t. Chairman Squires requested the secretary read the application as submitted, which is a request for a variance to increase the lot coverage from 30% to 32z% to hermit a six foot extension to be added to an existing carport. The Board was advised that public notice had been given and no correspondence had been received concerning this request either for or against it. Public hearing was then opened. Board of Adjustment -2- 2-25-76 Pasco, Washington \ Reuben. Neuberger, 1724 W. Bonneville St,, stated that he would like to increase the size of his carport 6 feet by 24 feet in order to pet his boat under cover, but found that he would be in violation of the lot coverage requirements br 2j%. Due to his present lay-out, this addition would not create a fire hazard nor cut access to his property. No one else spoke either for or against this request. The public hearing was then closed. After discussion by the Board, motion was made bir Koster, seconded by Zahn, to grant a variance of 22`$ lot coverage on this property. Motion carried by following vote: Zahn, les; Koster, yes; Squires, yes. OTHER BUSIATESS: Changing the meeting day from Wednesdav to increase attendance by the board members was discussed and it was determined that Wednesday was still the best possible da7r for the majority of the members. PUBLIC HFARUTC !{76-8 Nigrant Dav Care Center, Presbyterian Church, 1730 W. Park St, Secretary read the application for Special Permit as submitted by the Educational Institute for Rural Families, 110 N. 2nd Avenue, Pasco, and advised the Board that notice of the public hearing had been made by mail to all property owners within the area within 400 feet of the church property. Six of these letters had been returned by the post office as 'unable to deliver' . Letters from the Educational Institute for Rural Families, American Association of University Women and the Church of Orin Saviour, all indicating approval of this request weEe read. The Board was advised that a phone call had been recieved at 4:40 p.m., 3-24-76, from Mrs. Albert Mills, 1730 W. Nixon, and she stated that she had talked to Avery Casteel, 1727 W. Sylvester, Katuri Kimmel, 1003 N. 19th, T`,rs. Ralph Smith, 1720 W. Margaret, Mrs. Mason Raz, 1719 W. Margaret, Mrs. Edgar Miller, 1803 W. Pargaret, and they all had no objections to this use but would not be able to attend this meeting. Public Hearing was then opened. Dorothea Olson, Educational Institute for Rural Families, stated that after the last application she had talked to several people in the area that told her they would have come to the meeting to support this use, but felt that it would pass without their support. This prompted her to resubmit the application. Chairman Squires then asked the people in attendance that had attended the previous meeting and voiced an opinion against this Special Permit if they had changed their thoughts regarding this request. Mrs. Wergeland, 1003 N. 19th, Ray Rombough, 620 I'. 18th, Joe Marks, 1704 Y. 18th (speak— ing for his tenants at 1718, 1720, 1722, 1724 W. ITmxcn), Bob Berndt, 1807 W. Park, and t%attie Seybold, 1803 W. Park, stated they had not. Pars. Olson stated that these children would be bused to the church and put down for a nap until breakfast was served at 7:30 a.m. They would be inside the building except for a short time around ll :CC a.m., and 2:00 p.m. Ted Begg, Pastor of the church, stated that the church had made a survey of this neighbor— hood and also around the Episcopal Church and asked Al Ackerson, Chairman of the Governing Board to present his statistics. h"r. Ackerson advised the Board of his findings and presented a map of the area indicating the feelings of the people living nearby. Louise Oustofson, stated she does not live in this area, but supported this program and stated the problems involved in locating a facility for these children. Reta Rombough, 620 N. 18th, advised the Board that Mrs. Mills owns an apartment house in the area but does not live there, and therefore would not be concerned with the traffic and noises. There bein;� no further comment, the public hearing was closed. After discussion b7r the Board, motion was made by Koster, seconded by Zahn, to deny this Special Permit. One of these letters had been returned by the post office as 'unable to deliver . Letter from the Educational Institute for Rural Families was read. The Board was advised that Mrs. Butcher had called by phone several days ago and expressed approval of this special permit. Public hearing was then opened. Chairman Squires advised Mrs. Olson that there was no need for her to go over the program again as everyone was familiar with it. No one in attendance spoke against this request. The public hearing was then closed. After discussion by the Board, motion was made by Zahn, seconded by Koster, to grant approval of this Special Permit as requested. Their request; is to use this prope-rt-r for :anufacturing as well as retail for a sir, month period. They are looking at some industrial property and should have their shop built on it within the six month period. There being no further comment, the public hearing was then closed. The- stated that this neig7h'rorhood is mostly older residents with the exception of about four .families with children. From street cur'r to sidewalk is 24. feet and their fence is 1; -Peet behind the sidewalk and they feel that this provides an ample field of vision. B.r not bein-7 able to fence this 15 foot area, they would have no place to park their carper and would lose the use of a portion of their -,ard. The-r need a high Fence to keep their children and doh in the Trard and without the fence they have lost 2 dogs and other items through theft. ADJOURNM-777 : There being no further husiness before the Board, the meeting was adjourned at 9:30 p.m. Respectfullir.submitted, /S; Lar' BOARD OF ADJUSTMENT May 26, 1976 Pasco, Washington REGULAR MEETING The Regular Meeting of the Board of Adjustment was held at 8:25 p.m., Wednesday, May 26, 1976, in the Council Chambers of Pasco City Hall, ROLL CALL: Members present were David Squires, Shirley Zahn and John Koster, APPROVAL OF MINUTES: Minutes of the regular meeting held April 28, 1976, were approved as written. Motion by Zahn, seconded by Koster, PUBLIC HEARING #76-10 FENCE HEIGHT VARIANCE - 801 W. Park Since this hearing was continued from the last meeting, Chairman Squires dispensed with the reading of the application and declared the public hear- ing open. Secretary advised the Board that no new correspondence had been received. Chairman then asked the Lunders if they had come up with a proposal. Earl Lunders, 801 W. Park, stated that he has removed the bush on the corner of his property and had set a post six feet from the side- walk and another post eleven feet south of the alley. By parking his car with the bumper at the sidewalk, he has a clear view down the sidewalk of 67 feet. There was no more discussion to be added on this subject, so the public hearing was closed. After discussion by the Board, motion was made by Zahn, seconded by Koster, to grant this variance to allow this fence to be built to a 6 foot height to within 6 feet of the sidewalk on the north property line, and to within 11 feet of the rear lot line. Motion was carried bythe following vote: Koster, yes; Zahn, yes; Squires, yes. PUBLIC HEARING #76-11 SIDEYARD VARIANCE - 832 W. Marie Secretary read the application for a variance from the 15 foot required sideyard as submitted by George A. Grant, 832 W. Marie Street, and ad- vised the Board that notice of this public hearing had been made by mail to all property owners within 300 feet of this parcel. Four of these letters had been returned by the Post Office marked 'unable to deliver'. No other correspondence had been received. Public hearing was then opened, Mrs. George Grant, 832 W. Marie, stated that she proposed to remove the existing patio cover and erect a family room in its place. A plot pian of the property was submitted and this was discussed by the Board. Theee was no one else to speak either for or against the request, so the public hearing was then closed. After discussion by the Board, motion was made by Koster, seconded by Zahn, to grant this request as submitted. Motion was carried bythe following vote: Zahn, yes; Koster, yes; Squires, yes. Board of Adjustment -2- 5-26-76 Pasco, Wn. PUBLIC HEARING #76-12 FRONT YARD VARIANCE - 1508 W. Yakima Secretary read the application for a variance from the required front yard set-back as submitted by Ted Johnson, 1508 W. Yakima Street, and ad- vised the Board that notice of this public hearing had been made by mail to all property owners within 300 feet of this parcel. Five of these letters had been returned from the Post Office marked 'unable to deliver'. Three other notices had been returned by the recipients with comment of approv- al. These were from Elizabeth Gladden, 1507 W. Yakima, Henry Bidstrup, 505 N. 15th, and Bill Woods, 1527 W. Shoshone. Public hearing was then opened. Ted Johnson, 1508 W. Yakima, stated that his front porch was too small to be used safely and he proposes to enlarge it by extending it out 22" and turning the steps to the west. He would also add a flat roof over this stoop and a sight screen on the street side. He presented pictures and drawings to the Board for their information. There being no further comment, the public hearing was then closed. After discussion by the Board, motion was made by Zahn, seconded by Koster, to grant this variance as requested. ROLL CALL: Members present were David Squires, John Koster, E.L. Suhadolnik and G.V. Manderville. APPROVAL OF MINUTES: Minutes of the Regular Meeting held May 26, 1976, were approved as written. PUBLIC HEARING #76-13 SIDE YARD VARIANCE - 1904 W. Irving St. Secretary read the application for a variance from the 5 foot required side yard as submitted by George Love, 1904 W. Irving Street, and ad- vised the Board that notice of the Public Hearing had been made by mail to all property owners within 300 feet of this parcel. One of these letters had been returned by the post office as 'unable to deliver', and no other correspondence had been received. Public Hearing was then opened. Dale Young, Kennewick, stated that he was a friend of the family and had assisted them in screening in an existing covered patio. PUBLIC HEARING #76-14 FRONT YARD VARIANCE - 404 N. 19th Ave. Secretary read the application for a variance from the 25 foot required front yard as submitted by James V. Wolf, 404 N. 19th Avenue, and ad- vised the Board that notice of the Public Hearing had been made by mail to all property owners within 300 feet of this parcel. Ice Harbor Drive, Burbank, representing the Baldwin Sign Co. and Columbia Memorial Gardens, presented pictures of the proposed sign, which is a star like effect, stating that for the full effects the display would have to be as high in the air as possible. Secretary read the application for a variance from the required 15 foot front yard in a Commercial (C-1) Zone as submitted by Hosts of America, Inc. , for the Holiday Motel at 720 W. Lewis Street, and advised the Board that notice of the Public Hearing had been mailed to all property owners within 300 feet of this parcel. Three of these letters have been returned by the Post Office marked "unable to deliver". A letter from Grigg's Department Store, indicating approval of this request, was read to the Board. No other correspondence had been received. The Public Hearing was then opened. Bill Allred, representative for Hosts of America presented the proposed plans for an additional 22 motel rooms to be erected to the west of the present motel, explaining that they will need to place two of the required off-street parking spaces and a stairway within the required 15 foot front yard. Frances Thomas, 2821 W. wernett, submitted a plot plan and elevations of the proposed buildings, stating she has contacted many of the surrounding property owners regarding this use and found them all receptive. Earl Warren, 120 S. 26th Ave., had called by phone seeking information on this request and had not made any statement either for or against the request. Mrs. Larry Barrett, 815 S. 10th Ave., had called to state her objections by phone and also wrote a note stating "This is next door to us. We do not want it. That is all we need to five the neighborhood trouble. Drunken husbands looking for their wives." Arthur and Loretta Greenwood, 828 S. 10th Ave., also wrote in stating "We are absolutely not in favor of your proposal as mentioned in your letter of October 18, 1976. " No other correspondence had been received concerning this request. Public Hearing was then opened. Lt. Don Anderson, Salvation Army, spoke in favor of this request, stating that s survey had been made confirming the need for this type facility and that the Salvation Army would back the project financially and assist in the operation.
