ROLL CALL: Members present were David Squires, Dorothea Jones, G.V. handerville and John Koster. Clark Daniels did not attend. Hearing was conducted by David Squires. APPROVAL OF ITINt1TFS : Motion made by Pa,nderville, seconded by Jones, to approve the minutes of the Regular Meeting of November 20, 1973, as written. Motion carried. PUBLIC HEARINTG - lst Conerepational Church, 927 W. Henry Street - File No. 74-1 Chairman Squires directed the secretary to read the application as submitted by the First Congregational Church. Request is for variance of the iraximum 25' building height in the R-1 Zone to permit the addition of a belfry on top of an existing tower. The Board was advised that no corrmunication had been received concerning this application. Chairman declared the Public Hearing open and asked if anyone wished to speak in favor of this request. Don Cooper, 1114 W. Park, stated that he is a member of this church and is a member of their building committee. He stated that the church was erected in 1954, but due to lack of money- at the tirre, some of the items on the original plans was not done. Their program is to complete the church, as planned, as monezr becomes available. At present there is a 4.0' high brick tower attached to the building, to which then would like to add a 9' belfrzr, and later add a 17' spire. Total height would he 661 . The belfry is constructed of copper covered steel and the spire will be tubular copper with a cross. The belfry will contain a 40" bell. Bruce Whitemarsh, 1327 N. Bead, stated that he is a long time member of this church and that he is in favor of this variance as it would permit them to complete the planned development of this church. There being no one else wishing to speak either for or apainst this request, the Public Hearing was closed. Discussion of the Board members and !Tr. Cooper followed where it was learned that the belfry ras already been erected. No perr+it had been obtained as it was erected with volunteer labor. The request should have, but didn't, include the 17' spire which will be added within the next five years. Other churches in the area of similar construction are the Eatholic Church, Episcopal Church and the Church of 'Nazarene. After due consideration, motion was made by Koster, seconded by Jones, to grant the variance as requested to allow the total height of 661 , with the belfr,r being added immedi.atel?r and the spire to be added within the next five gears. Motion carried bar the following vote: Manderville, No; Jones, Yes; Koster, Yes; Squires, Yes. PUBLIC HEARINP - Tri Cities Group Homes, Inc. . 524 N. 8th Avenue - File Mo. 74-2 Chairrran Squires directed the secretary to read the application as submitted by the Tri Cities Croup Homes, Inc. Request is for a Special Permit to operate a home for 8 teen-aged girls from broken homes on a 24 hour supervised basis. Following communi- cations have been received concerning this request : letter from Querita Cowles, 931 W. Sylvester, no objection; letter from Petterson, Tavlor & Day, Attorneys at law, representing Mr. & Airs. Robert h;artinolich, 502 RT. 8th Ave., opposed; and three (3) petitions objecting to this Special Permit were handed in ,just prior to the start of the meeting. Signatures on these petitions are as follows : Louie J. Bongers, 505 F. 8th; Fury C. Homers, 505 N. 8th; Madge Alexander, 512 rT• 7th; Agnes C. Vannatter, 731 W. Yakima; Evelyn Biedel, 727 W. Chairman declared the Public Hearing open and asked if am*one wished to speak in Favor of this request or to explain this program. Joyce Pararie, 2920 W. Hood, Kennewick, stated that she is the director of the local Group Homes which is under the sponsorship of the Atomic Citi Kiwanis Club. This is a statewide program to help girls in the 14 to 17 Tear are bracket who are having troubles at home or are wards of the Court. The program started with a Federal Grant of $37,202 and the State pays for the ca,•e of the girls at a set amount per day. Prior to State licensing, the location must be approved by local planninr* and zoning. The structure must also meet State housing standards. According to law, it must be integrated, however, there are few blacks in the prograr as generallir this race takes care of its own, through rela- tives. Girls are referred to the home and must be accepted according to the programs criteria. For the Most part, the girls are referred because of conflict between child and parents, incest, single parent guidance. The home is staffed by house parents and she supervises the home and councels the girls and refers them to other oraanizaticns should the-, need treatment of an- kind. A bore such as this has operated in Fennewick for several morths and so far there have been no problems. Girls are not apt to commit crimes such as boys, but seem to be more self-destructive. House rules have been set up an? the girls have to live h.r them or thev are returned to the Court to be placed elsewhere. This dwelling, if permitted, will be renovated to meet State and City codes. They are presently planning a new home in the Citv of Richland that will cost in the neiphhorhood or $157,OOn. If approved, a five year lease will be signed on this house. Due to the type of proFram where the girls are being rehabilitated, it is necessary to have a home- tirpe setting with house rarents .rather than an institutional type setting. No drugs are permitted on the premises and the {girls are prohibited :from using them. Ther have looked at other sites and found this to be the best location as it is within walking distance to the Senior High School. Average length of stair in the home is two to three months, at which time the girls are either returned to their own homes, a relative's home, a foster home, or referred back to the Court. The girls are permitted to date, but must be in by curfew. Statewide, the program has been operating for 8 or 9 years and there has been no history of neighborhood resentment. Chairman then asked for questions from those in attendance, which Mrs. Pararie would answer at a later time. Jessie Blanton, 526 N. -th, stated she was not completely opposed to this home, but was not in favor of a five year lease. She would also like to be assured that her driveway would not be blocked by a large number of vehicles being present next door, and wondered how much traffic would be generated in this area. Frances Campbell, 514 N. 8th, stated that there are several widows in the immediate area and the-, have fears of being overrun by voung bogs who would hang around the area. She was also concerned with the traffic and parkine problems that would develope. Robert Martinolich, 502 N. 8th, asked if this program was paid by the Federal Govern- ment or State and questioned the profit motive. I?e also requested that this matter be tabled to a later date so that City Ordinances could be checked to see if this :,could he a violation. These questions were then asked of TRrs. Pararie and she stated that the five year lease is to protect their original investment due to remodeling costs, However, she would accept this Special Permit even if it were issued for onlv one rear as she thinks the abutting property owners would not ob;ect to the home once it was operating. The girls are not allowed to have cars or driver's license and the only, vehicles that would be there would he a van, ttrpe vehicle for transportation ar.d possibly the house parent's personal vehicle. Boys are restricted to certain visiting hours and generally they Uralk to the house or ride bicycles rather than drive. Their original grant expires in July, at which time they will be granted an additional $25,000 to operate the remainder of the ,year. The sponsors are now collecting $5,000 local share of matching funds. Eventuallv the program will become self-sustaining through State allowances for care. Board of Adjustment -3- 1-22-74 She has written letters to all propertir owners within the 300 foot radius and thus far has received no response. Property devaluation was discussed and it is felt that there would be no devaluation due to the operation of this house, and if ani,thing, property values could be enhanced due to better maintenance of the property. The home would he better suited in a residential area than commercial since the home is patterned after normal familir living. Mary Burgess, 3417 Road E5, stated she and her husband, Jerry Burgess, purchased this dwelling and have agreed to lease it to Tri Cities Group Homes as thev have worked with children for several years and understand the problems that some girls have. She has contacted some of the immediate neighbors regarding the operation of this home and feels that something of this nature is needed in this area. There being no further questions from the audience, the Public Hearing was closed. Discussion by the Board followed, where it was determined that 53 notices of the public hearing had been mailed out to property owners within 300 feet of this parcel. Petitions had been signed bTT residents of 15 households in this area. Motion made by Manderville, seconded by Koster, that this request be tabled from 30 to E0 days, during which time the Tri Cities Group Hones people could contact the persons that had signed the petitions to explain their program. After contactinp these people, the City should be notified 15 days prior to the next hearing so that all persons could be notified of the hearing. Pararie stated that she would make contact with the property owners and be ready for a public hearing at the February 26 meeting. PUBLIC HEARPIG - Johnnv Hatt, 1.00: W. Margaret - File Fo. 7L�-3 Chairman Squires directed the secretary to read the applica-Lion as submitted Ily Johnny Hyatt. Request is for a variance of the minimum 25' front yard set-back in the R-1 Zone to permit him to add an 51x16' dining room to the front of his home. The Board was advised that one phone call had been recieved concerning this request, the lady was seeking information as to the proposal, and after learning the details stated she had no objection. Chairman declared the Public Hearing open and asked if anyone wished to speak in favor of this request. Johnnv Hyatt, 1005 W. Margaret, stated that he recently purchased this home and it does not have a dining area large enough to seat his family of four children. He also has custody of 2 daughters from a previous marriage and they will he moving into the home with him in the near future. The houses alone this street are staggered 4 to 5 feet in some cases. He cannot build to the east as the living room and a hallwair are in this area. There is not enoueh room to build on the west side. To reduce the addition to four feet would not gain him the root^ needed. Llo7rd Graham, 1039 W. Margaret, stated that he did not object to this variance. He had lust received notice of the hearing and attended for his o m information. Juanita Davis, 1004 U. Nlar�Eraret, stated she had no objections. Her home is to the east of the Hyatt home, but faces Aurilia Avenue, and has less front yard than his on the Margaret Street side. Kay Stutzman, 1024 W. Margaret, stated he had no objections as he has the same problem and would like to extend his dining area in the future. During questioning, 'Mr. Hyatt stated that this would be a brick: and wood with aluminum siding addition with a flat roof and a 2' shake mansard. He would do some of the work himself, but hire journevrnen for the specialized worn. He would expect to complete the job within 30 to 45 da--s after starting. There being no further comment from the floo-, the Public Hearing was closed. After some discussion by the Board, motion was made by Jones, seconded by Koster, to grant an 5' variance of the front vard requirement as requested ry the applicant. PUBLIC HEARITTC - Tri Cities Croup Homes, Inc. , 524 N. 8th Avenue - File No 71F--2 Chairman Mand erville asked if any correspondence had 'been received concerning this group home since the last meetinr. Secreta.r-- advised the Board that a letter containing petitions had been received from Yrs. Prairie. Petition #1 - "Not Opposed", signed by A.L. EcKibb in; Petition 72 - "In Support", signed Inv Jose Alonzo,L.J. PTuttin, Audrev E. Johnson, Ida Craw- ford, Curt & Leona Briggs, R. Keith Adams, and Arleen Miller. Petition 43 - "'liithdraw OT,jection" , signed l;,zr Ellen R. Everett, Madpe Alexander, The letter froTM ITrs. Prairie compiled the opinion of the neighborhood as she saw it. Secretary noted that 54 notices had been mailed out to propert�r o,.rners within the area and the original petition protesting the group home contained 1_7 signatures. Chairr,an Nanderville then opened the hearing to the public and a31-ed for imput from the floor. Joyce Prairie stated that in compiling her list, she did not consider, or contact, those persons who had signed the original petition that lived outside the immediate area of this property. I.rs. Blanton advised the board that she is definatelir opposed to this group home being located next to her home. Stan Taylor, representing Robert Miart inolich, stated that this is an older area of the CitNr, is classified for single famil,r dwelling units and mostl?r elderly residents live it this area. Stated that there are other areas throughout the cit- that would be core adapted to this type use. A child care home in this structure was turned down by the Board of Adjust- ment within the past -rear or so. He also thought that the Nixon Street residents shouldn't be involved in this bearing hecause of the distance from this property. Shirleir Shepard stated that she lives nearl-r and :could welcome this group home next door to her. Stated that these are not girls that are in serious trouble and the group home gives them a home-bvpe atmosphere. Stated that the home in Kennewick has experienced no problems since it was opened. Mrs. Yann stated that she is opposed to this group home being located near her. In response to questions from the 9oard, Mrs. Prairie stated that the home would be provided with full time adult,' supervision (man & wife); the girls are in the 13 to 18 age bracket; are victims of abuse rather than having: committed any crimes; are referred to the home by the Juvenile Court; most of the neighbors contacted in this area could care less whether or not the group home were located here, while others who lived alone were fearful and some questioned the value of the program and the spending of Federal funds; there would be a maximum of two cars parked at this hone and the driveway would be improved so that these cars could be parked off the street; the girls would not be allowed cars and the boys who visit the girls usually- walk or ride bikes. Mrs. Blanton stated that she was not fearful of physical harm, but was concerned with devaluation of her property. The public hearing was then closed and the board members discussed the application. It was determined that 54 propert• owners had been notified of the pending; Special Permit, 17 had signed petitions opposing this use (at a later time 2 had taken their names off this list and 1 had been added on), 7 neva signatures indicated their -rare in support and 1 was not opposed. Board of Ad jt3tment -2- 2-2E-71, -'otion made by Jones, seconded by Daniels, to grant a Special Permit to Tri Cities Group Homes, Inc. , to establish this home, as proposed, at 524 N. 8th Avenue, for a period of one (1) year. Motion carried by the following vote : Squires, No; Jones, Yes; Koster, Abstain; Daniels, Yes; Nanderville, Yes. SIDETRACK TAVERN FAPFING LOT: Letter from City Attorne- was read to the Board concerning the leasing of other lots to be used for parking for the Sidetrack Tavern for a period of 120 days, during which tire the presently approved lots are to be upgraded. Pischel, 1423 TT. Oneonta Ave. , - File No. 74-4 Chairman Manderville requested this application be read by -the secretarZr. Application is for a Special Permit (Conditional Use) to permit a Chiropractor' s Office to be located in one of the arartrent units at 1423 N. Oneonta Ave. The Poard ;arcs advised that no corres- pondence had been received concerning this request, either for or against. The hearing was then opened to the public. Dick Smithson, 107 F. 7th, Kennewick, stated that he was L, set up office in this building?. Ile had nothing to say concerning the person seeking? the request, but would answer anv questions the '3oard mipht have. It was determined that he would like to open the office on T,ia- 1, 1974, there would be no changes made -to the 1-)uilding, and the owner would be able to provide six (E) off-street parking spaces for his patients. There was no one else in the audience to speak for or against this proposal, so the public hearing was closed. After some discussion, motion was made by Koster, seconded b�- Jones, to approve this Special Permit to establish an office at 1423 TT. Oneonta Ave. as requested. PIIBLIC HEARING - Gene Hiner, 2004 r,T. 22nd Ave. , - File No. 71: Chairman MEa.nderville requested that this application be read by the Secretarv. Application is for a Special. Permit (Conditional Use) to permit an 80 unit retirement apartment build- ing containing living quarters, dining*, arts and crafts, lounge and laundrv, and a waiver on the twenti,r-five (25) foot maximum building height requirement to permit a three (3) storv, 33 .foot high building to be erected. The Board was advised that no correspondence had been received concerning this requist, either for or against this proposal. The hear- ing was then opened to the public. The Chairman asked for comment from the floor and Cene Miner pave a recitation on what the-, had planned and asked questions from the audi- ence. Edward Phillips, 2215 W. Pearl, then h.added the Chairman a petition containing E9 signatures of propertv owners who oppose this proiect. Bob Brodie, Wenatchee, stated that he operates a similar retirement center in :Jenatchee and it is an asset to that Citv. Fdward Phillips, 2215 W. Pearl, stated he is against the building height. L.W. Parrott, 1744 22nd, stated he is against the Special Permit. Bonnie Phillips, 2215 W. Pearl, would like to see this propertzr developed into single famil7r houses. John ILackev, 2303 W. Pearl, stated that if this use is permitted, his neighborhood would he completely surrounded by commercial_ 'businesses. Pete Felsted, 1.17 Road 3P, stated that he owns property in this area and is in favor of development as it would at least clean up some of the vacant propertv. Yrs. CraV, lives on the corner, stated that she oh..iects to the traffic that wov.ld be generated. The public hearing ti-,,as then closed. After some discussion, the Board agreed unanimously to continue this hearing until P-00 parrs., Mav 28, 1971.;., to give all concerned a chance to learn mere about this proiect. ADJOURNMENT. REGULAR 14EETING The Regular Meeting of the Board of Adjustment was held at 8:00 p.m. , Tuesday, lay 28, 1974, in the Council Chambers of Pasco City Hall. ROLL CALL: Members present were John Koster, Dorothea Jones and David Squires. Absent : G.V. Manderville and Clark Daniels. PUBLIC DARING - W & H, Inc. , 2307 E. Lewis Street - File No. 74- Vice Chairman Squires requested this application be read by the secretary. Application is for a six (6.) month temporary permit to operate a fiberglass molding manufacturing plant in the C-1 Retail Commercial Zone. The Board was advised that no correspondence had been received concerning this permit. Public Hearing was then declared open. Cene Wright, owner of the building, stated that this building had been occupied by the Firestone Tire Recapping Plant for several years, but had been vacant for about three (3) ,years, and that he was unaware of a zone change that would make this type operation illegal. Chuck Nighbert building tenant, stated that he is manufacturing fiberglass forms for the nuclear reactor that is under construction, stating that they use a preformed fiberglass mat in the pro-- cess and therefore there are no loose fibers discharged into the atmosphere. He is seeking a six (6) month Temporary Use Permit for this operation. There being no further comment from the audience, the public hearing was closed. After some discussion by the Board, motion was made by Koster, seconded by Jones, to grant this Temporary Use Permit for a six (6) month period. Motion was carried by unanimous vote. PUBLIC HEARING - Gene Hiner, 2004 N. 22nd Ave. , - File No. 74-5 Vice Chairman Squires stated that since this was a continuation of the Public Hearing held on April 23, 1974, and that everyone was familiar with the request, there was no need to read the application. Public Hearing was re-opened. Charles Mathews, 1728 N. 23rd, stated that he was for this proposed request. Gene Hiner, 2004 N. 22nd, stated that this request was for a height variance from 25' to 331 , but actually the building would be less than 321 ; and was for an 80 unit retirement center. He stated that this center has to be close to a nursing home due to its nature. The present traffic flow is mostly to the apartment complex to the north of the nursing home and no great amount of traffic will be generated by this proposed use as only about 30% of the residence will have cars. Spence Jilek, owner of Crescent Drug, stated that this facility is needed in this area and he is for its location on 22nd Ave. Elwyn Phillips, 2215 W. Pearl, stated he is against the height. Earl Ransom, 2219 W. Pearl, stated that already have sewer problems and this will cause more problems as well as devalue the property. John Manke, 2303 W. Pearl, asked if this would change the zoning in the area and was advised that it wouldn't. He also stated that they have sewer problems and the streets are in need of repair and the added loads would make things worse. He thought that a cottage 11-ype cet, - ilnr %ould be more desireable. Carl Maier, 1740 N. 22nd, complained of street damage, present and future. Luther Parrott, 1744 N. 22nd, stated that Mayor Linton was supposed to provide them with a traffic survey of this area.. Spence Jilek stated that when he built his store in 1959 there was nothing else in this area and he feels that the area has turned out nicely. Elwyn Phillips complained of the traffic from the LDS Church. Earl Ransom stated he would like the keep the area nice. Gene Hiner stated that he can change the building; to where it will effect 10 homes rather Board of Adjustment —2— May 28, 1974 than 2, but he doesn't want to. He stated that between him and the City the swwer and street problems can be solved. He would also clean up the area and do some landscaping to beautify the grounds. Elwyn Phillips stated that 69 persons had signed the petition against this proposed use. At this time a petition listing 12 signatures was handed in, stating they were for the project. Luther Parrott stated there would be additional traffic noise. Mrs. Phillips stated that a recent zone change was approved by the City to increase the size of a trailer sales lot. Frmncis Forrester, 2207 W. Pearl, stated that Leola Street has been bacated and the church now uses the alley at the rear of his house as a thruway. Carl Maier could not see why this building had to be three stories in height. Myrtle Forrester stated that when they bought this house, they were required to sign a paper to agree that no house in this neighborhood would be built more than one story in height. Since there was no new information being brought out in the hearing, Vice Chairrra n Squires declared the Public Hearing; closed. After some discussion by the Board, it was agreed that this hearing should be postponed to a later date as the vote should be by the entire Board. BOARD OF ADJUSTMENT une 11, 1974 Pasco, jdashington C ONT IRTIJED NITT INC The Continued Yeeting of Mav 28, 1974, of the Board of Adjustment was held at 8:15 p.m. , Tuesday, June 11, 1974, in the Council Chambers of Pasco City Hall. POLL CALL: Members present were John Koster, Dorothea Jones and Clark Daniels. Absent : G.V. Manderville and David Squires. CHAIRMAN: Due to the absence of both the Chairman and Vice-Chairman, Clark Daniels was elected to chair this meeting. APPROVAL OF MINUTES: Motion made by Jones, seconded by Koster, to approve the minutes of the May 28, 1974, and the April 23, 1974, regular meetings. Notion carried. PUBLIC HEARING - Gene Hines, 2004 N. 22nd Ave. , - File No. 74-5 Chairman Daniels stated that since this was a continuation of the Public Hearing held on May 28, 1974, and that ever-one was familiar with the request, there was no need to read the application. Public Hearing was re-opened. Secretary read a letter addressed to the Board from the Tri Cities Chamber of Commerce requesting this request be given an affirmitive vote, signed by Boyd Southwick. Gene Hiner, 2004 N. 22nd, presented a drawing of the project and outlined the services and activities provided by this type facility. Carl Maier, 1740 N. 22nd, complained of the excessive traffic that would be generated, especially during the morning and evening rush hours. He stated that it is alread impossi- ble to exit from this area. Francis Forester, 2207 W. Pearl, stated that he was against the proposed height and was concerned that the low section of the building might be built higher in the future. Frank Thomsen, Manager of the Pasco Chamber of Commerce, addressed the public and stated that these is a great need for a facility of this type in the Tri City area, that the building can be legally constructed to a 25' height and the additional 61 that is requested will not make that much difference to the neighborhood. He also stated that the amount of traffic cannot be controlled, but that vehicular traffic can be controlled by traffic engineering. John Nanke, 2303 W. Pearl, stated that he is not against the retirement center, but doesn't think 80 units will be ample and therefore thinks the facility should be built where it can be expanded in the future. He doesn't think this area should be used for regular apart- ment buildings and will fight their approval. Carl Maier stated he likes the present invironment and thanks that if this facility should be near a medical center, perhaps the medical center should be built near the existing elderly housing units on First Avenue. Spence Jilek, owner of Crescent Drugs, stated that this is a modern concept whereas medical attention will be available on a 24 hour basis, meals will be provided, activities scheduled and various aid given the residents. Stated that the nearest facility of this type is on the coast and some of the elderly have already left this area to live there. Uohn Manke asked if these apartments would be available to ,young pe6ple and was advised by Hiner that a person had to be 65 ,years old or disabled to reside there. Dr. Joseph L. Greenwell, 702 W. Clark, stated that he has encountered ma v patients that are in need of this t-7pe housing as regular apartments do not have items built into them that the elderly require. He supports approval of this facility. Bonnie Phillips, 2215 Id. Pearl, stated that all the local residents are opposed to this use. Mary Ann Dobbs, Kennewick, stated she is a visiting home nurse and from her experience the elderly are in need of a facility of this nature. John Manke agreed that there is a need for this facility, but was concerned that the other nearby vacant lots would be rezoned and apartments built on them. Board of Adjustment -2- June 11, 1974 Bonnie Phillips stated that she has talkad to several realtors who advised her that thic use would devalue their property, and in fact could possihl.;r make it unsalable. They have advised the neighborhood to vote against this use. Carl I'ia,ier stated that he intends to fight the building of a.pa,rtmients in that area as it tends to devaluate his property. Olive Lear, Social Services Director, stated that the elderly are a -past of the societ.r and shouldn't Ili forced to move away from their town, friends, relatives and familiar shopping areas. These people still have a useful life to live, but at a slower pace. Luther Parrott, 1744 N. 22nd, stated that he knows several people that were in rest ;,omes and have died front the heckling given them by social workers. Francis Forester stated that in the past homes were handed down from farther to son but today people are taxed out of their homes and this is no longer possible. He stated that when he bought his property there was a covenant on it regulating building height. and businesses. lie stated that the local residents fear being surrounded by apartment houses. Elwyn Phillips stated he was born and raised in Pasco and bought a house here because he intented to stay. He also required that the house be located in an R-1 zone as assurance -that no apartments would be built there. He finds that this is no longer true. Gene Hiner restated to the audience that he was not requesting a zone change, that this request was within the limits of the zoning regulations, and that three stories were necess- a.ry to minimize the distance that the elderly would have to walk to get tub the activities center. Carl haier stated that the tower at the end of the building was a fire hazard and he didn't think this was the proper design for a building for the elderly. Gene Hiner stated that this building would be one-hour fire protected, completely sprinkleret and the fire escapes (towers) would be smoke proof enclosures with automatic closing doors. Mary Dobbs stated that mose elderly people would rather remain in a familiar area and she thought they should be able to do so if they wished. Since no further constructive information was being brought before the Board, the Public Hearing was then closed. After some discussion by the Board, and an explanation to the residents by Koster, Koster made a motion, seconded by Jones, to grant the conditional use permit to erect the 80 unit retirement center, and to grant a waiver on the 25 foot height limitation for this building, as requested in the application. Diemond, 711 N. 3rd Avenue - File No. 714-7 Chairman iia.nderville requested the Secretary read the application, which was done. This request is to grant a variance of five (5) feet of the front ,yard requirement on this prop- erty to allow Mr. Diemond to construct a dwelling unit between the two wings of his apart- ment complex and to have the front walls of all three buildings in line. The Board was advised that this notice had been properly distributed and only one phone call had been received regarding this matter. That person was not in objection of this proposal. Muscatell, 1907 Riverview Drive - File No. 74- Chairman Ma.nderville requested the Secretary read the application, which was done. This request is to grant a variance of two and one-half (21) feet of the front yard requirement and three (3) feet of the side ,yard requirement so that a carport and awning can be erected. The Board was advised that this notice had been properly distributed and no inquiries had been received. Seven letters had been returned marked 'Not at this address' . The Public Hearing was then opened and Howard Bean of Tri City Aluminum (contractor) stated that this structure has already been erected and there was a misunderstanding between him and the property owner as to who was to obtain the building permit and that he had been advised by the owner that approval had been granted to erect these structures at their present location He stated that the awning projects 6 feet from the front of the house and is 262 feet from the sidewalk and lines up with the house on the corner to the south. The carport supports are two feet from the side property line, the posts being in the center of the hedge, with the roof overhanging the posts by two feet. The house to the south has a. 10 feet sideyard which would 'wive them 10 foot separation of buildingsk This carport is 15 feet wide and the house is 30 feet wide. The driveway slopes to the street. Roof drainage can be con- trolled by gutters. There being no one else in the audience to speak either for or against this request, the public hearing was then closed. Allen, 1910 Riverview Drive - File No. 74-9 Chairman Manderville requested the Secretary read the application, which was done. This request is to grant a variance of four (4) feet of the side yard requirement on this property to allow a carport to be erected to within one (1) foot of the side property line. The Board was advised that this notice had been property distributed and that one phone call had been received requesting information on the request. When advised of the circum- stances, the called stated that she had no objection to the variance. Four letters had been returned marked 6Not at this address". The Public Hearing was then opened and Barbara Allen presented two letters from neighbors indicating approval of this variance. Letters were signed by Donald & Betty Perkins, 1905 Riverview Drive; Mrs. James Bunch, 1912 Riverview Drive; and O.J. & Dorothy Cobb, 1916 Riverview Drive. She stated that the car— port, which is already erected, was put up by the Home Improvement Products Company of Yakima and they were supposed to obtain the building permit, but failed to do so. She is a widow and has installed the carport and new siding and now has the house sold. The new owners would like to leave the carport as is. Arnold Haag suggested that the Board grant this variance if there were no complaints from the neighbors. Mrs. Allen stated that she thinks the contractor is at fault for not obtaining* the required permit and she has talked to him and he is willing to change the carport if it becomes necessary. There was no one else in attendance to speak either for or against this request, so the Public Hearing was then closed. After discussion by the Board, motion was made by Koster, seconded by Squires, to grant the variance as requested on condition that a gate be put in the fence at the rear of the carport, and further provided that this carport not be enclosed in the future. Sylvester - File No. 74-11 Chairman Manderville requested the Secretary read the application, which was done. This request is for a Special Permit to construct an office building in an R-3 Residential Zone. The Board was advised that proper notice for this request had been made, with one notice being returned as "unable to locate", and Jim Lahtinen, owner of a nearby vacant lot, had called by telephone for information on this request and then stated that he had no objec- tions. The Public Hearing was then opened. William Uhling, Manager of Monad Federal Credit Union spoke in favor of this Special Permit and submitted plans for the building that he intends to construct. The building will be brick veneer, with a height of 18 feet, and will provide parking for 16 cars. This request is for a Special Permit to construct a Neighborhood Facility building in an R-1 Residential Zone. The building is to be located just north of Kurtzman Park on S. Wehe Avenue. The Board was ad#ised that this notice had been properly distributed and that no communication had been received on this request. The Public Hearing was then opened. Ben Rea,.Pasco Planning Director, spoke in favor of this request and presented drawings of the proposed structure, stating that this building will contain offices for various public services as well as a library and gym. The Board was advised that due to the conflict of having two meetings (City Council work- shop and Board of Adjustment) on the same date at the same time, it had been suggested that another meeting date be designated for the Board of Adjustment in the future. It was found to be agreeable with all members that this meeting be set for the fourth Wednesday of every month.
