HomeMy WebLinkAboutWater Right Solutions, Inc - Water Rights Change Applications for City through Franklin County Amendment No. 1 (Agreement No. 20-025)AMENDMENT NUMBER 1 to PROFESSIONAL SERVICES AGREEMENT Water Rights Change Applications AGREEMENT NO. 20-025 WHEREAS, the City and Water Right Solutions, LLC entered into a Professional Services Agreement on 7/21/2019 to provide engineering services with respect to the Water Rights Change Applications project, and WHEREAS, the scope of work for the Water Rights Change Applications includes varying degrees of effort due to the number of irrigation wells involved and due to the complexity of water -use records and place of use at each individual well, and WHEREAS, the above referenced scope of work provides for a range of Water Rights Change Applications to be processed, and WHEREAS, the City is in need of additional water rights -related work; specifically the preparation of a final Proof Report of Examinations for the north and south portions of water rights Permit S3-28876P(A), and WHEREAS, the level of effort for this additional water rights -related work is expected not to exceed $2,000 and can be integrated with the Water Rights Change Applications scope of work, and WHEREAS, the total contract amount will not change. NOW, THEREFORE, this agreement is amended to allow Water Right Solutions, LLC to provide additional professional services as described on Exhibit A and extend the time of performance. Scone of Work: See Exhibit A. 2. Fee: The Contract amount remains at allot to Exceed $50,000.00. 3. Time ofperformance: The time of performance is extended such that all services shall be complete on or before 12/31/2021. CITY OF PASCO: CONSULTANT - 0��4-a Water Rot Solutions, LLC Bill Neve, 4,�vner Amendment No. ] to Professional Services Agreement Page 2 Water Rights Solutions, LLC Water Rights Change Applications EXHIBIT A SCOPE OF WORK WATER RIGHT PROOF REPORT - 53-28876(A) CITY OF PASCO NOVEMBER 733, 2020 wRs WATER SOLUTIONS, LLC PURPOSE Water Right Solutions, LLC (WRS) will complete the Proof of Appropriation Report of Examination for purposes of obtaining a final water right certificate for S3-28876P(A). The Report for the south portion of the property has been largely completed, but the remaining portion —just east of Lowe's — remains to be finished. Water has not yet been put to full use on these acres, and so the final report has yet to be completed. It is expected that the land will be under full production and water put to full beneficial use for the 2021 irrigation season which will allow establishing use of water for this portion and thus certification of the entire water right. SCOPE OF WORK The primary tasks, together with time estimate are as follows: 1. Conduct on on-site field investigation documenting/confirming the irrigation system, irrigated acres, and crops grown. Verify that permit provisions have been met. 2. Conduct an analysis of aerial and satellite photographs to delineate irrigated area within the place of use of Permit S3-28876P(A). 3. Calculate estimated water use based on crops/acres grown, irrigation system, power records and/or water meter records, if available. 4. Prepare a final Proof Report of Examinations, documenting findings and making recommendations as to the attributes of a final water right certificate — this is to include both the north and south portions of S3-28876P(A). 5. Provide a review copy to the landowner(s) for review and comment. Meet with staff to discuss, answer questions, if necessary. Upon landowner authorization, submit to Ecology for review. 6. Respond to questions/concerns from Ecology, provide any follow up information which may be required. COST ESTIMATE The not to exceed cost estimate for this project is $2000. Unforeseen complications can extend the hours necessary for completion of the project, should issues arise which could delay or extend the project, approval will be obtained prior to proceeding.
