The Byrne JAG Grant Is primarily utiti:ed for funding the legal secratory pasltbn and portions of the Metro Commander and Metro Serseent's position. The HIDTA funding W, primarily bmm utll *d for conftmtlal buy funds, petwnel overtime. and training reimbursement. The DEA has proviotd amt, space and eNctrontc egutpment. Until 2018, the Byrne JAG Grant had adegwlely funded a legal secretary and portions of the Commander and Sariiesnt's positions. In 2018 the --at funds were received late which necessitated the first Addendum to the Wito Interlocal Agreement to cover the temporary shortfall through June 30, 2019. In 2019, the Byrne JAG Grant funds" were received did not provide sufficient fund ingto cover the costs of those positions, which were reflected In the adopted budget for the 2019-2020 Metro budget cytie. The parties do not expect to receive JAG Grant funds M 2020 or thereafter. Additionail;4, the HIDTA fundic* has not been available since 2018, which must be made up through additional contribWons by the Metro members. Begtnnir July 1, 2020, the legal secretary position was changed to an administrative assistant position. it is the partlee intent to agree to the foiowing to address the funding shortfalls resulting from the decrease in available grant funds to Metro for Nle period January1, 2021, through December 31, 2024. THEREFORE, IN CONSIDERATION of the mutual ends-tz contained herein, the parties 2 to amend the Metro interlocal Agreement as follows: SECTION 2 � r ENOMEV,' Sarna 3. Seventy percent (75%) of any Byrne JAG Greet funds or HiDTA funding received in 2021 or later shill be applied as a credit towarads any invoice to Benton County until the balance of those funds has been exed, (2) Until December 31, 2024, Franklin County shall pay quartet for 25% of the cost of the administrative assistant provided by the City of Kennewick plus $12,500 annually ($3,125 quarterly) for confidential buy funds. WHEREAS, RCW 39.34, INTERLOCAL COOPERATION ACT, authorizes political subdivisions to jointly exercise their powers, privileges, or authorities with other political subdivisions of this state through the execution of an interlocal cooperative agreement; and, WHEREAS, the City of Pasco has participated in the Metro Drug Task Force for nearly 35 years; and WHEREAS, the City of Pasco entered into the most recent Metro Drug Task Force Interlocal Agreement with the City of Kennewick, Washington, City of Richland, Washington, City of West Richland, Washington, Benton and Franklin Counties in 2017; and WHEREAS, Pasco City Council approved the first Addendum to the 2017 Metro Drug Task Force Interlocal agreement in March 2018 to satisfy a budget shortfall; and WHEREAS, the City Council of the City of Pasco, Washington, has after due consideration, determined that it is in the best interest of the City of Pasco to continue its affiliation with the Metro Drug Task Force by signing Addendum No. 2 to the 2017 Interlocal Agreement with the participating jurisdictions to continue these services and cover a budget shortfall due to the recent loss of grant funding for the program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON: Section 1. That the City Council of the City of Pasco approves the terms and conditions of Addendum No. 2 to the 2017 Interlocal Agreement between the City of Kennewick, Washington, City of Richland, Washington, City of West Richland, Washington, Benton and Franklin Counties, Washington and the City of Pasco; a copy of which is attached hereto and incorporated herein by reference as Exhibit A; and Section 2. The City Manager of the City of Pasco, Washington, is hereby authorized, empowered, and directed to sign and execute Addendum No. 2 to the 2017 Metro Drug Task Force Interlocal Agreement on behalf of the City of Pasco. Be It Further Resolved, that this Resolution shall take effect immediately. The Byrne JAG Grant is primarily utilized for funding the legal secretary position and portions of the Metro Commander and Metro Sergeant's position. The HIDTA funding has primarily been utilized for confidential buy funds, personnel overtime, and training reimbursement. The DEA has provided office space and electronic equipment. Until 2018, the Byrne JAG Grant had adequately funded a legal secretary and portions of the Commander and Sergeant's positions. In 2018 the grant funds were received late which necessitated the first Addendum to the Metro Interlocal Agreement to cover the temporary shortfall through June 30, 2019. In 2019, the Byrne JAG Grant funds that were received did not provide sufficient funding to cover the costs of those positions, which were reflected in the adopted budget for the 2019-2020 Metro budget cycle. The parties do not expect to receive JAG Grant funds in 2020 or thereafter. Additionally, the HIDTA funding has not been available since 2018, which must be made up through additional contributions by the Metro members. Beginning July 1, 2020, the legal secretary position was changed to an administrative assistant position. It is the parties' intent to agree to the following to address the funding shortfalls resulting from the decrease in available grant funds to Metro for the period January 1, 2021, through December 31, 2024. THEREFORE, IN CONSIDERATION of the mutual covenants contained herein, the parties agree to amend the Metro Interlocal Agreement as follows: SECTION 2 - AMENDMENT Section 1. Addendum No. 1 dated March 30, 2018, is superseded hereby, and subsection (e) of Section 5 of the Metro Interlocal Agreement is hereby replaced in its entirety and shall, effective January 1, 2021, read as follows: e. In addition to the personnel contributed by the parties to Metro, financial assistance shall be provided as follows: (1) Until December 31, 2024, Benton County shall pay quarterly for 75% of the cost of the administrative assistant provided by the City of Kennewick plus $37,500 annually ($9,375 quarterly) for confidential buyfunds. Seventy-five percent (75%) of any Byrne JAG Grant funds or HIDTA funding received in 2021 or later shall be applied as a credit towards any invoice to Benton County until the balance of those funds has been exhausted. (2) Until December 31, 2024, Franklin County shall pay quarterly for 25% of the cost of the administrative assistant provided by the City of Kennewick plus $12,500 annually ($3,125 quarterly) for confidential buy funds. Twenty-five percent (251) of any Byrne JAG Grant funds or HIDTA funding received in 2021 or later shall be applied as a credit towards any invoice to Franklin County until the balance of those funds has been exhausted. (3) Until December 31, 2024, any funding shortfall for METRO for costs other than the costs of the administrative assistant and the County contribution for confidential buy funds as agreed to above shall be split as follows: Benton County —18.18% Franklin County —18.18% City of Kennewick —18.18% City of Pasco —18.18% City of Richland —18.18% City of West Richland — 9.10% (4) Unless mutually agreed upon through a future addendum to the Metro Interlocal Agreement, effective January 1, 2025, and thereafter all funding shortfalls for METRO shall be split in the same manner outlined in subsection (3) above. Section 2. All other terms and conditions contained in the Metro Interlocal Agreement dated May 16, 2017 not specifically amended above shall remain in full force and effect.
