WHEREAS, the City and KPG, P.S. entered into the first Amendment to the Professional Services Agreement No. 19032 on 3/21/2019 to add additional time of performance; NOW, THEREFORE, this agreement is amended to allow KPG, P.S. to provide additional bid support, additional construction support, and add additional time of performance as described below. Scone of Work: See Exhibit A. 2. Fee: The compensation for this amendment is based on a Time and Materials Basis is not to exceed the amount of X99,982.00 for a total contract amount of $769,706.00. Page 1 Scope of Work KPG Construction Support Services November 2020 City of Pasco 16041 Peanuts Park Restoration Project Project: CP5.PK.8R.16.02 A. BACKGROUND EXHIBIT A This scope of work includes architecture, engineering and urban design support throughout the bidding period and the construction phase of Peanuts Park. This scope also includes additional services and lump sum prices in Task 3. Support Duration (December 2020 to September 2021: 10 Months) Bid Period Support and Construction Support Services: • These services are intended to assist the CITY bidding period and in responding to events related to the design intent of the Contract Documents that occur during the construction. These services are based upon the understanding that the CITY will contract directly with the Contractor and the CITY's Construction Management Consultant, and will be actively involved in the construction process to make decisions, provide approvals, perform inspections and perform other actions necessary for the completion of the construction. • At this time, punchlist walk through and preparation of Record Drawings during the Project Close Out period is not included in this scope. • The CITY will provide the Resident Engineer (RE) and Inspector for the duration of the project. B. KPG ASSUMPTIONS Consultant personnel have no authority to exercise any control over any Construction Contractor or other entity or their employees in connection with their work or any health or safety precautions. Review submittals will be in compliance with the requirements of the contract for construction. Such review will not relieve the Contractor from its responsibility for performance in accordance with the contract for construction, nor is such review a guarantee that the work covered by the shop drawings, samples and submittals is free of errors, inconsistencies or omissions. Work Provided During the 165 Working Days • The CITY provides inspection services, RE, and administration/document services. • The CITY (or onsite construction representative) will provide KPG with the Contractor's City of Pasco KPG Peanuts Park Rehabilitation Project Number 20022 Construction Support Services Page 1 of 7 November 2020 construction schedule to assist KPG in prioritizing submittals, RFIs, and substitution requests. KPG will provide the equivalent of one full time personnel THREE days per week (for the 165 working days) in the managing of the subconsultants, review and response of RFIs, submittals, substitution requests, and/or attending construction meetings as needed and in conjunction with the above blended team. Design Engineer (KPG) and Subconsultants (Tres West and Lund Opsahl) support is anticipated as needed for bidder question support, submittal reviews, RFIs, substitution requests, and other tasks as identified in the Scope of Work. KPG main project personnel includes the Project Architect of Record (AOR), the Engineer of Record (EOR), Project Landscape Architect (PLA), and Urban Design Manager (URB). It shall be understood that additional staff may be utilized in support of the main project personnel during submittal review, RFI response, and substitution requests. Close Out No project close out support is included at this time, such as punchlist items and preparation of Record Drawings. KPG assumes all design revisions will be tracked via redlines by the City, City's onsite construction management team, and the Contractor. KPG assumes these revisions will be provided to KPG at closeout should the City request Record Drawing services from KPG. This scope and budget includes bid assistance to answer bidder questions during the bidding period, issuing up to one addendum, preconstruction meeting attendance, submittals, RFIs, substitution requests as identified in Task 2. Services not included in this scope and budget are site visits, punchlist walkthrough, change order support and documentation, design revisions associated with change orders, Record Drawings, Community Outreach and Public Meetings, Ribbon Cutting Ceremony, claims analysis, surveying, services during shutdown periods of non -working days, and services for extended working days are examples of possible additional services. KPG assumes site visits shall be upon City request. A price per site visit per person for KPG is provided under Additional Services. KPG assumes City or City's onsite construction management team will perform final acceptance walkthrough (no KPG attendance unless requested by City). C. SCOPE OF WORK TASK 1.0 — BID PERIOD SUPPORT 1.1 KPG, or subconsultants, will respond to up to ten (10) bidder questions. Should design revisions or clarifications be part of a bidder question response, the revisions shall be prepared and included with the addendum package as part of Task 1.2. City of Pasco Peanuts Park Rehabilitation Construction Support Services Page 2 of 7 KPG Project Number 20022 November 2020 1.2 Bidding Assistance: This work is for assisting the City's ACS Director & Project Support Specialist, CIP Manager, and Construction Manager in preparation for an addendum during the bidding period. The Consultant shall revise the bid package based on the Memorandum (Memo) provided by MacKay Sposito, dated 08/07/2020. The following items will be updated as part of the addendum package and provided to the City: • Review and update Division 1 for inconsistent City GSP and WSDOT Special Provisionsfor consistency. • Review and update Section 2-02 Removal of Structures and Obstructions to provide additional clarity for demolition items in both the Special Provisions and Bid Proposal. • Update plans and specifications per the Memo's recommendations. • Updated transformer location as per decided upon by the City, Franklin PUD, KPG and Tres West. • Correct overlaps and gaps between the architectural specifications provided in CSI format and the site work specifications provided in WSDOTformat. NOTE: The City shall review and update as needed the inserted paragraph "Pasco Municipal Code 14.08.010" located at the end of the Introduction to the Special Provisions page with references to the City of Pasco General Special Provision, APWA GSPs, and WSDOT Standards Specifications specifying year or updating to current editions. The City will provide KPG with a new Boiler Plate Introduction to the Standard Specifications. KPG will update the Contract Documents. If updating the City code is infeasible due to time constraints, KPG will provide recommendations on how to revise the statement for Contract Documents to minimize the City's risk. 1.3 KPG will attend the preconstruction meeting virtually. A formal request for in person attendance shall be made by the City. Should the City request in person attendance this effort will include travel time. Task 1 Deliverables: • Prepare responses for up to ten (10) bidder questions (electronic copies) • Up to one (1) Addendum Package based on MacKay Sposito Memo and bidder questions. • Preconstruction meeting virtual attendance and meeting notes TASK 2.0—CONSTRUCTION PHASE SUPPORT 2.1 The Consultant shall provide continuous project management of design team during the construction phase to the City for the project duration (estimate 8 months plus 1 month for project start-up and 1 month for project closeout). 2.2 The Consultant shall prepare monthly progress reports identifying work completed in the previous month, work in progress, upcoming Tasks, and reporting of any delays, problems, or additional City of Pasco KPG Peanuts Park Rehabilitation Project Number 20022 Construction Support Services Page 3 of 7 November 2020 information needs. These reports will be submitted with the Consultant invoices. 2.3 Formal Construction Meetings: Attend up to one, one-hour, construction meeting per month. KPG will attend virtually unless specifically requested to attend in person by the City or City's onsite construction management team. Additional meeting attendance shall be provided at the request of the City PM and/or City's onsite construction management team and is provided in Task 3. KPG Assumptions: • Virtually attend up to one construction meeting per month. 2.4 Submittal/Resubmittal/Shop Drawing Review: Receive, review, and comment on technical submittals, shop drawings, material samples, and construction plans transmitted by the Contractor to the City. Submittals shall be reviewed for conformance to the contract documents and coordinated with City staff for review. The Consultant shall compile written comments and transmit to the City/Contractor upon completion of the review process. Intake of initial submittals and shop drawings will be performed by Others. KPG Assumptions: Review up to forty (40) submittals for site/civil features and urban design elements, including but not limited to: • Cement Concrete Pavement • Colored Cement Concrete Band • Colored Cement Concrete Edge Band • Cement Concrete Sidewalk • Hot Mix Asphalt • Water System Components • Sewer System Components • Concrete Paver • Decorative Precast Paver • Sponsor Bricks • Infiltration Trench • Site Lighting Electrical Package. The Consultant shall receive, log, and provide written response to formal Requests for Information (RFls) received from the Contractor via the City. They shall prepare requests for quotation (RFQs) and review proposals, review proposals. The City PM will be included in the reviewerchain. The City PM will be included in the reviewer chain. Intake of initial submittals and shop drawings will be performed by Others- KPG Assumptions: • KPG assumes this is a minimum effort required by KPG to assist the City's construction management team. It is understood that the City may request additional, or reduce, the amount of reviews during construction. Design revisions associated with RFI responses are included in this effort. Design revisions associated with change orders are not included with Task 2. Review and responses to up to (25) RFI's and assuming up to (10) substitution requests. Task 2 Deliverables: • Submittal Reviews (up to 60 total) • RFI and RFQ Responses (up to 25 total) • Substitution Reviews/Requests (up to 10 total) • ASIs (up to 1 total) TASK 3 —ADDITIONAL SERVICES Additional services may be requested and authorized by the City.
