HomeMy WebLinkAboutInternational Union of Operating Engineers (IUOE) Local 280 - MOU Temporary Upgrade Reassignment 2021Memorandum of Understanding (MOU) Temporary Upgrade/Reassignment Request i f This Agreement made and entered into and effective this �) S .l day of o by and between IUOE Local 280 and the City of Pasco hereafter referred to as parties, who are i ntified as follows: Local Union #280 of the International Union of Operating Engineers, (hereinafter referred to as the "Union", which represents the bargaining unit employees within the Public Works Department's maintenance and operations divisions and the bargaining unit employees within the Facilities Division responsible for the parks, golf course, and cemetery.); and The City of Pasco, Washington, (hereinafter referred to as the "City") Relating to Temporary Upgrade/Reassignment Request; and Whereas, Jason Etzler has been identified as a probable temporary replacement in the absence of the Maintenance Division Manager; and Whereas, The City of Pasco and the UNION have determined that it is in the Cities best interest to have Jason Etzler perform these duties while the Maintenance Division Manager is out of the office; and Whereas, the UNION and The City of Pasco agree that this MOU is not precedent setting and all other terms and conditions of the CBA remain in force; and Now therefore, the UNION and The City of Pasco agree to the terms and conditions hereinafter: 1. Jason Etzler will be able to perform any and all job assignments and tasks associated with the UNION and The City of Pasco. 2. Jason Etzler will not be able to hire, fire or perform suspension of employees employed under the UNION bargaining agreement. 3. Jason Etzler will perform corrections of behavior and performance as needed. 4. Jason Etzler will perform employee reviews of employees employed under the UNION bargaining agreement. 5. Jason Etzlerwill continue to accumulate seniority in their former seniority group. 6. Employees who are temporarily upgraded from the bargaining unit will continue to accumulate seniority in their former seniority group provided that the employee does not exceed one hundred and eighty (180) calendar days outside the bargaining unit in any twelve (12) month period. Should the employee exceed one hundred and eighty (180) calendar days outside the bargaining unit in any twelve (12) month period, the employee's seniority shall be extinguished unless the Employer and the Union Representative mutually agree to extend the one hundred and eighty (180) calendar day time limit.
