SUPPLEMENTAL EMPLOYMENT AGREEMENT
(Retirement Deferral)
BY THIS AMENDMENT NO. 4 to the Supplemental Employment Agreement and the
First, Second, and Third Amendments thereto, entered into this 20 day of January, 2021,
between the City of Pasco, Washington, hereinafter referred to as "City," and, Chief Robert Gear,
hereinafter referred to as "Chief," together referred to as the "Parties."
WHEREAS, the City of Pasco and Robert Gear are currently parties to a Supplemental
Employment Agreement for the City's Fire Chief position; and
WHEREAS, the Parties entered into a First Amendment to the Supplemental Employment
Agreement on March 31, 2018; and
WHEREAS, the Parties entered into a Second Amendment to the Supplemental
Employment Agreement on February 4, 2019; and
WHEREAS, the Parties entered into a Third Amendment to the Supplemental
Employment Agreement on July 1, 2019; and
WHEREAS, it is determined that it is in the best interest of the City to provide additional
compensation to the Fire Chief in exchange for performance of a limited scope of duties and
responsibilities beyond the customary expectations of the position of Fire Chief. NOW,
THEREFORE,
IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN,
the Parties agree that the Supplemental Employment Agreement shall be amended as follows:
Section 1. That Section 3, "Compensation," shall be and hereby is amended and shall
read as follows:
3. Compensation. As additional compensation, the City shall pay to the Chief the
following:
3.1 Monetary Compensation. Compensation shall be at the monthly rate of $14,750
commencing on the first day of the first pay period of 2021 and increasing by an
amount equivalent to the Council approved cost of living for management
employees as applied in January of 2022.
3.2 Participation in the Annual Merit Pa Program. am. Effective January 1, 2019 through
the term of this agreement, the Chief will not be eligible for consideration of merit
pay as provided for in City of Pasco Administrative Order 205.

3.3 Benefits. Chief shall be entitled to the following additional benefits:
3.3.1 Uniforms and uniform maintenance on a basis consistent with current
practice.
3.3.2 Educational leave consistent with current practice.
3.3.3 Eligibility for overtime when working in a position compensated by state or
federal reimbursement.
3.3.4 Participation in incident management assignments and training.
Section 2. That Section 4, "Additional Duties", shall be and hereby is amended and
shall read as follows:
4. Additional Duties. Chief shall provide oversight and management over the
following ongoing projects during the term of this Agreement:
4.1 Assist in negotiations per IAFF (leading the language discussion pertaining to
working conditions) relating to COVID related issues and establishment of a Spill
Response Team.
4.2 Coordination and collaboration with the CED and Finance Departments and
consultant in the development and effective implementation of the ambulance
utility rate update, development and establishment of SEPA mitigation for planned
fire stations, and Fire Impact Fee.
4.3 Develop Fire Master Plan Update.
4.4 Develop and implement a comprehensive strategy and options to maintain the
City's WSRB Class 3 community rating.
4.5 Oversee design of Station 85 and planning and acquisition of sites for Stations 86
and 87.
4.6 Represent the City in collaboration with community partners in addressing the
impacts of homelessness and mental illness in the community.
4.7 Collaborate with Community and Economic Development Department in
evaluating how the Building Permits & Inspection Services Division and the Fire
Department can improve effectiveness and community safety.
4.8 Continue development of the burn training site and inclusion of Franklin County
Fire District #3 in the operations and maintenance expense of the site.

4.9 In partnership with the Pasco School District, utilizing a Fire Protection & Safety
grant, develop and track the effectiveness of Fire Safety Education of Elementary
School Aged students.
4.10 Examine opportunities to improve ambulance billing in North Franklin Hospital
District, Franklin County Fire District #3 and Walla Walla County Fire District #5.
4.11 Develop, train, and implement a marine spill response plan and team through
Department of Ecology funding and industry partnerships.
4.12 Update the City Emergency Response and Continuity of Operations plan to reflect
lessons learned during the COVID incident. Explore possibility of a City
Emergency Management position.
4.13 Continued leadership related to the COVID pandemic regionally and within the
organization, including oversight and administration of the CBC COVID Testing
Site, and pandemic response, including vaccine distribution.
Section 3. The effective date of this Amendment No. 4 to Supplemental Employment
Agreement shall be January 1, 2021.
Section 4. All remaining terms and conditions not inconsistent herewith shall remain
in full force and effect.
