PROPERTY DESCRIPTION: Legal: The West%of the Northeast%of the Northwest%of the Northwest%of Section 26,Township 29 North, Range 9 East, except for the Court Street Right-of-Way. General Location: A parcel of land located along the south side of West Court Street between Roads 49 and 50 (Parcel #119 541 023). Property Size: Approximately 4.78 acres (208,010.89 square Feet). 2. ACCESS: The site has access from West Court Street and an undeveloped Marie Street ROW 3. UTILITIES: Water is available via 8' lines in West Court Street and Road 48 through the undeveloped Marie Street ROW; Sewer is available in a 12" line in Road 48 through the undeveloped Marie Street ROW. 4. LAND USE AND ZONING: The site has recently been annexed into the City and has been designated R-S-1 (Suburban) zoning,which differs from its former County zoning designations of "0" (Office) along West Court Street and RS-20 (Suburban) on the south half of the parcel; the site is vacant. Surrounding properties are zoned and developed as follows: NORTH: "0" (County) Nursery; SFDU EAST: RS-20 Church; Vacant Land; SFDU SOUTH: RS-20 SFDUs WEST: RS-20 (County) Farm; SFDU 5. COMPREHENSIVE PLAN:The Comprehensive Plan designates the site for Mixed Residential (top half) and Residential uses (bottom half).Volume II of the Comprehensive Plan, specifically pages 30-32 pertain to Capital Facilities and their placement. The Plan encourages the setting aside of adequate lands for public facilities (Goal CF-3). Goal OF-2 suggests the City ought to maintain land use flexibility in regard to placement of infrastructure for public and private utilities. Policy OF-2-A encourages the sound management of all energy and communication utilities through coordination and cooperation dealing with construction of such facilities. 6. ENVIRONMENTAL DETERMINATION:The City of Pasco is the lead agency for this project. Based on the SEPA checklist, the adopted City Comprehensive Plan, City development regulations, and 1 other information, a threshold determination resulting in a Mitigated Determination of Non- Significance (DNS) has been issued for this project under WAC 197-11-158. The wireless communication tower must be painted a neutral color to achieve minimum visibility of the facility. ANALYSIS The applicant, TCA Architecture, has submitted a Special Permit application for a Wireless Communications Tower to be located at the site of the recently permitted City of Pasco Fire Station#84;a parcel of land located along the south side of West Court Street between Roads 49 and 50 to the east and west, respectively, and Court Street and Marie Street to the north and south, respectively(Parcel#119 541 023). The proposed tower would be used to increase radio coverage in the vicinity. There would be two antennae mounted on the tower. As per PMC 25.165.080 such structures may be permitted by a Special Permit when located with a publicly own facility such as a fire station. Applicant has proposed a location that would be screened by multiple buildings and fences between the fire station and the storage building to reduce the visibility of the tower from Court Street (see proposed Site Plan). There is a 6' high sight-obscuring fence along the property line to the south and west. There is a 9'-0" equipment fence to the north of the tower. Applicant has submitted a tower design constructed with steel with a galvanized finish. The galvanized coating would prevent the tower from rusting and reduce maintenance. The proposed galvanized finish is a light silver color. The PMC special permit review criteria for wireless facilities are written as follows: 25.70.075 WIRELESS COMMUNICATION FACILITIES. Wireless Communication Facilities are permitted under the following conditions: (1) Such structures shall be permitted in all industrial or C-3 zoning districts provided the location is 500 feet or more from a residential district.Any location closer than 500 feet requires special permit approval. (2) Such structures may be permitted by special permit in all other zoning districts provided said structures are: (a)Attached to or located on an existing or proposed building or structure that is higher than thirty- five(35)feet,or (b) Located on or with a publicly owned facility such as a water reservoir,fire station, police station, school, county or port facility. (3)All wireless communication facilities shall comply with the following standards: (a) Wireless facilities shall be screened or camouflaged by employing the best available technology. This may be accomplished by use of compatible materials, strategic location, color, stealth technologies, and/or other measures to achieve minimum visibility of the facility when viewed from public rights-of-way and adjoining properties such that a casual observer cannot identify the Wireless Communication Facility. (b) Wireless facilities shall be located in the City in the following order of preference: i)Attached to or located on buildings or structures higher than 35 feet. ii) Located on or with a publicly owned facility iii)Located on a site other than those listed in a)or b). 2 As noted above, the facility meets the second order of preference (Located on or with a publicly owned facility) but does not meet the first(Attached to or located on buildings or structures higher than 35 feet.). In addition to the fact that no buildings on site will be 35 feet tall, cost has been cited as the justification for not following the first preference. The tower would also be required to comply with the 2015 IBC, IFC, IMC w/Washington State amendments, ICC A117.1-2003, 2015 UPC w/Washington State amendments, Pasco Municipal Code (PMC), and Washington State Administrative Code(WAC).According to the Mitigated Determination of Non-Significance (MDNS) the wireless communication tower must be painted a neutral color to achieve minimum visibility of the facility. INITIAL STAFF FINDINGS OF FACT Findings of Fact must be entered from the record. The following are initial findings drawn from the background and analysis section of the staff report. The Hearing Examiner may add additional findings to this listing as the result of factual testimony and evidence submitted during the open record hearing. 1. Public notice of this hearing was sent to property owners within 300 feet of the property and posted in the Tri-City Herald on May 29, 2020. 2. Applicant has submitted a Special Permit application for a Wireless Communications Tower. 3. The proposed tower would be co-located with the City of Pasco Fire Station#84. 4. The proposed tower property is located on the south side of West Court Street between Roads 49 and 50 (Parcel #119 541 023). 5. The proposed facility does not meet the first (Attached to or located on buildings or structures higher than 35 feet.). 20. No buildings on site will be 35 feet tall, 21. Cost has been cited as the justification for not following the "Attached to or located on buildings or structures" preference. 22. The tower would be required to comply with the 2015 IBC, IFC, IMC w/Washington State amendments, ICC A117.1-2003, 2015 UPC w/Washington State amendments, Pasco Municipal Code (PMC), and the Washington State Administrative Code (WAC). 23. According to the Mitigated Determination of Non-Significance (MDNS) the wireless communication tower must be painted a neutral color to achieve minimum visibility of the facility. CONCLUSIONS BASED ON INITIAL STAFF FINDINGS OF FACT Before recommending approval or denial of the proposed plat the Planning Commission must develop findings of fact from which to draw its conclusion (P.M.C. 26.24.070)therefrom as to whether or not: 1. Will the proposed use be in accordance with the goals, policies, objectives and text of the Comprehensive Plan? a. The Plan stresses the importance of siting necessary facilities in appropriate locations and the protection of life and property. The site is located within a developed and growing portion of the community and on a major arterial, which provides excellent access to the surrounding neighborhoods. 2. Will the proposed use adversely affect public infrastructure? a. The proposed tower will generate no demand for water and sewer, and will generate no traffic. The utility demands of a wireless communications tower are minimal; lower than many of the infrastructure demands generated by uses permitted in the R-S-1 zone. 3. Will the proposed use be constructed, maintained and operated to be in harmony with the existing or intended character of the general vicinity? a. The general vicinity is commercial and residential in nature. As a conditional use, the tower may be subject to additional site and elevation design regulations to promote an aesthetically pleasing environment that will complement the appearance of the residential and commercial development in the area. 4. Will the location and height of proposed structures and the site design discourage the development of permitted uses on property in the general vicinity or impair the value thereof? a. This proposed tower is 40 feet tall, which exceeds the 35' allowable height of structures in the R-S-1 zoning district; b. Applicant has proposed a tower location that would be screened by multiple buildings and fences between the fire station and the storage building to reduce the visibility from Court Street (see proposed Site Plan). 4 c. Though tall, the tower is not expected to discourage future residential and commercial development. 5. Will the operations in connection with the proposal be more objectionable to nearby properties by reason of noise,fumes, vibrations, dust, traffic, or flashing lights than would be the operation of any permitted uses within the district? a. The proposed tower will not generate noise,fumes,vibrations,dust,traffic,or flashing lights. 6. Will the proposed use endanger the public health or safety if located and developed where proposed, or in any way will become a nuisance to uses permitted in the district? a. It is expected that the proposed wireless communications tower will not cause harm to public health and safety and that the associated activity will not become a nuisance to permitted uses in the vicinity.The proposal will locate an emergency service facility in a rapidly-growing area of Pasco that has an increasing need for emergency services. APPROVAL CONDITIONS 1. The Special Permit shall apply to tax parcel#119 541023 and any subsequent subdivisions thereof; 2. The site shall be developed in substantial conformity to the site plan and building plans submitted; 3. The proposed wireless communications tower facility must comply with all FCC and FAA regulations; 4. As per the MDNS the wireless communication tower must be painted a neutral color to achieve minimum visibility of the facility. 5. The tower, and all its associated ground equipment and appurtenances must be removed within 90 days of discontinuation. 6. The Special Permit shall be null and void if all necessary building permits have not been obtained within one year of special permit approval. These parks are generally small in size (3-7 acres) and are intended to serve a radius of about one-half of a mile. In residential areas where densities are two to three units per acre the service area can be expanded to a one mile radius. From the Parks, Recreation & Forestry Plan, the most applicable policies and development criteria for neighborhood parks are as follows: 1. A neighborhood park should be provided when the area it serves reaches a 60% development level either by land mass or population. (This park is intended to serve the Madison Park/Northwest Commons plats. In land mass and population these subdivisions are past the 60% development level.) 2. A neighborhood park should not be less than 5 acres in size if it is to be located without any other amenities. Where practical neighborhood parks should be co-located with elementary schools. The proposed park is just shy of 4 acres, but is connected to a linear park that spans the Madison Park/Northwest Commons subdivisions diagonally from the southwest corner of the subdivision 1,951 feet to the north edge of the park and will continue towards the northeast corner. 3. In neighborhoods where the densities are 2-3 dwelling units per acre the service area for neighborhood parks should be extended to a mile radius. 4. At least 50% of the park site should be flat and usable. (The proposed park site is fairly level.) 5. Appropriate facilities for neighborhood parks include: a. Practice fields for softball, soccer,youth baseball etc.; b. Children's playgrounds; c. Unstructured open play areas; d. Paved game courts; e. Picnic areas with shelter buildings; f. Trails systems; g. Trees; h. Natural open space; and, i. Drainage corridors 6. The location criteria suggest neighborhood parks be central to the area they serve, be adjacent a green belt or trail system, be within walking distance of the area they serve, avoid the need to cross major streets or physical barriers and be readily visible from adjoining streets. The proposed location of the Madison Park Subdivision Park meets the development criteria for a neighborhood park. There is an existing gas line located in an easement north of the site. It will not impact the development of the park. The adjacent properties are residential to the North and West. A church is located to the South. Installation of the park should enhance the area by providing recreational opportunities. 2 Traffic impacts will be low until future soccer fields are installed,at which points,impacts will be intermittent. The Pasco Municipal Code (PMC)9.100.050 prohibits the use of the park by patrons between 10 pm to 7 am. PMC 9.130 prohibits any sound to exceed 55 dBA and to be audible within 75' of a residential zone. The tallest proposed structure is a 12' high pavilion, constructed of galvanized coated steel. The site is bordered to the south by Porto Lane and to the east by Sana Cruz Lane. These secondary roads connect to Sandifur Parkway/Burden Road and Road 44/Road 52. A Right-of-Way Permit will be required for walking path connections to City Sidewalks. Detailed playground design documents shall be required as a condition of special permit approval.
