George Court, Pasco,WA 99301 On behalf of TRI-COUNTY PARTNERS HABITAT FOR HUMANITY, the owner of the above-referenced property, an Administrative Exception is being requested for the rear setback of a single family dwelling unit proposed at the above address. Findings of Fact: 1) The dwelling conforms to all other standards outlined in PMC 25.36 for lots zoned R-3 (Medium Density Residential). 2) The PMC states that the dwelling's setback from the rear property line shall be at least equal to the height of the dwelling. The height of the dwelling, according to the PMC, is defined as "the vertical distance from grade plane to the average height of the highest roof surface." 3) The plans for the subject dwelling indicate that the height of the dwelling is 11 feet, which subsequently requires a rear setback of at least 11 feet. 4) The site plan of the proposed dwelling indicates a rear setback of 10 feet. 5) The lot in question is 5,500 square feet in size and irregularly-shaped. 6) Though the lot conforms with the PMC's zoning standards, the developer is experiencing placement issues due to the unique shape and character of the lot. Conclusions: 1) Chapter 25.84 of the PMC, provides the opportunity for applicants to pursue exceptions via the Hearing Examiner if the non-conforming measurement is one foot or less. 2) PMC 25.84.0 20 (E) Administrative Exceptions states, "An administrative exception not to exceed one (1) foot of any dimensional standard pertinent to front yard, side yard, rear yard, flanking street, and building line may be granted by administrative action of the examiner without public hearing and without posting or public notices." 3) Permitting a one foot exception to the set-back requirements of the PMC in this case is reasonable and justified, without public hearing and without posting or public notices.
