REMOTE MEETING INSTRUCTIONS:
To best comply with Governor Inslee’s Emergency Proclamation regarding the

CALL TO ORDER:
The meeting was called to order at 7:00 p.m. by Blanche Barajas, Mayor Pro
Tem.
ROLL CALL:

Meter Reading Services Agreement
To adopt Resolution No. 3955, approving a five-year Professional Services
Agreement with Columbia Meter Reading, Inc. for meter reading services and,
further, authorize the City Manager to execute the agreement.
MOTION: Mr. Maloney moved to approve the Consent Agenda as read. Mr.
Serrano seconded. The motion carried by unanimous by Roll Call vote.
REPORTS FROM COMMITTEES AND/OR OFFICERS:
Verbal Reports from Councilmembers
Ms. Roach commented about a Hanford Communities Board approving an
amendment to the interlocal agreement allowing for a qualified third party to
administer the Hanford Communities Operating Contract and TRIDEC was
approved and a qualified third party. Ms. Roach also commented about a recent
community web meeting she attended along with Mayor Martinez and noted
that rapid testing for the novel coronavirus was coming to the area.
Mr. Alvarado commented on a recent virtual meeting he participated in with
Washington State Good Roads Association.
ORDINANCES AND RESOLUTIONS NOT RELATING TO HEARINGS:
Speed Limit Ordinance - Chapel Hill Blvd
Mr. Worley offered to answer questions related to this item as there was no new
information to share from last week's workshop.
MOTION: Mr. Maloney moved to adopt Ordinance No. 4488, establishing a
speed limit on Chapel Hill Boulevard, between Road 84 & Road 68 and,
further, authorize publication by summary only. Mr. Milne seconded. Motion
carried unanimously.
*Street Vacation: A Portion of E. Pueblo Street (MF# VAC2019-006)
Mr. White stated that the vacation of a portion of East Pueblo was dispensable
to the City of Pasco's use. Mr. White also described the future use of the
vacated property.
MOTION: Mr. Maloney moved to approve Resolution No. 3956, setting 7:00
P.M., Monday, May 18, 2020 as the time and date to conduct a public hearing
to consider vacating a portion of E. Pueblo Street. Mr. Serrano seconded.
Motion carried unanimously.
*Street Vacation: Vacating Portions of E. Adams Street and N. Rainier
Avenue (MF# VAC2020-002)
Mr. White stated that the proposed vacation was of portions of East Adams and
North Rainier Avenue within the City's Light Industrial Zoning area. The owner
will be dedicating almost same amount of land as part of the development of
the property.
MOTION: Mr. Maloney moved to approve Resolution No. 3957, setting 7:00
PM, Monday, May 18, 2020 as the time and date to conduct a public hearing to
consider vacating portions of E. Adams Street and N. Rainier Avenue. Mr.
Alvarado seconded. Motion carried unanimously.

NEW BUSINESS:
*April 27, 2020 Council Workshop Cancellation
Mr. Zabell reiterated the Governor's directive through Proclamation Nos. 20-28
and 20-25.1. Mr. Zabell stated that staff was recommending that the April 27,
2020 remote Council Workshop be cancelled as there are no actions scheduled
for that workshop that are necessary and routine.
MOTION: Mr. Maloney moved to cancel the April 27, 2020 remote Council
Workshop meeting, observing the directive mandated within Governor Inslee's
Proclamation Nos. 20-28 and 20-25.1. Mr. Serrano seconded. Motion carried
unanimously.
MISCELLANEOUS DISCUSSION:
Mr. Zabell stated the May 4th Council meeting will be a remote meeting
because the Governor's Proclamation No. 20-25.1 remains in effective through
midnight on May 4, 2020. Mr. Zabell also provided a COVID-19 update which
included:
• Readiness levels are high at the City and absenteeism due to illness
remains low.
• Staff has adjusted well to remote work stations, but like much of the
community and nation, the isolation is starting to wear on staff.
• Organizationally, the City's response to the COVID-19 crisis has been
able to lessen allowing for more time to attend to routine City business
and special projects.
• Looking forward, within the next two weeks, the Continuity of
Operations Plan (COOP) staff has started planning for a phase opening
of City operations.
• Workplace protections for staff will include: appropriate Personal
Protection Equipment (PPE), safety training, sanitation protocols,
screening procedures and separations protocols.
• Protection for public within public areas will include: screening
protocols, signage, queue management and monitoring capacity
procedures.
• These plans are flexible due to fluidity of daily and weekly updates with
COVID-19.
Lastly, Mr. Zabell provided Council with Mayor Martinez's thoughts and
comments while he was away due to family matters. Mayor Martinez
participated on a statewide call from Governor Inslee over the past weekend
and the major themes from the call included:
• Back to business - with proper precautions -most particularly those
industries where social distancing and Personal Protection Equipment
(PPE) is available to protect the workforce.
• Consideration of some recreation such as low contact sports like golf,
fishing and where social distancing can be largely maintained.
• Expressed concerns about consistency on how businesses are
responding to COVID-19 outbreaks within their specific operations and
a comparison of Tyson and Lamb Weston was addressed.
• Mayor Martinez summarized the call as productive and he was able to
express some of the concerns the has heard from Council and the public
with Governor Inslee and that other communities shared similar
concerns.
Mayor Pro Tem Barajas stated that Council and the City continue to follow the
Governor's directives and the public will be informed as soon as any changes to

those directives are made through the City's website and social media sites.

IV. HISTORY AND FACTS BRIEF:
Attached is a monthly financial update to Council on the General Fund, the City's
major fund. The administration provides quarterly reports to Council for other non-
major funds.
V. DISCUSSION:
No major variance(s) to the approved budget anticipated at this date beyond those
identified in the report. It is however noteworthy that while expenditures are within
appropriations, most expenditures associated with the pandemic response were not
anticipated, and because of the lag in reporting at the State level, the anticipated
adverse impact to sales tax and other revenues are yet to be seen.
Going forward, staff expects the effect of the COVID-19 pandemic and measures taken
across the nation, state and locally to safeguard public health will adversely imp act the
City's finances. Fiscal impacts will include; reduced revenue from various taxes such as
sales, public safety, criminal justice, utility, REET, lodging and gambling.
Furthermore, COVID-19 specific federal and state mandates will serve to increase

costs and reduced productivity. Full reimbursements from federal or state sources are
unknown at this point; however, to the extent they materialize we anticipate the will
cover a fraction of the true cost. Beyond new federally mandated benefits, addition
expenses relating to personal protective equipment, unplanned technology costs to
provide for increased connectivity, separation of the workforce by providing
workspace alternatives, increased housekeeping efforts to maintain a safe workplace
for employees required to be on the job to perform their duties will impact overall
expenditures.
City has been informed that it will receive up to $2.3 million in pass-through funding
from the recently authorized federal CARES Act. These funds will be available for
reimbursement through the Washington State Department of Commerce and are
intended to reimburse the City for costs relating to the management of COVID-19;
however, do not allow for provisions to mitigate revenue shortfalls attributable to the
pandemic and the Stay Home Stay Healthy limitations on commerce. At this point, it
is too early to know or project with confidence the full impact of the pandemic on the
City's finances, particularly the General Fund.
As mentioned last month, previous focus and work to build up and maintain healthy
reserves has positioned the City well to maintain service levels and avoid the need to
incur debt within the budget period, even in the midst of an economic downturn this
dramatic. As per the un-audited 2019 financial reports, General Fund reserves on the
order of $20 million are available that can may used to temporarily supplement the
reduction in revenue. Staff is not anticipating cash flow issues at this point in time.
Contracts over $100,000 and under $300,000 executed administratively in the month of
March and donations to the City will be included in this report.

MOTION: I move to continue the public hearing set in accordance with Resolution
No. 3945, to May 18, 2020, at 7:00 PM, concerning the vacation of the east/west alley
in the plat of Sunny Acres.

IV. HISTORY AND FACTS BRIEF:
The applicant, Eric Tidrick of Render Holdings, LLC, submitted a vacation petition for
the east to west alley within Block 1 of the plat of Sunny Acres. The applicant has
already combined the individual parcels abutting the alley into one singular tax parcel
to with property the develop to facilitate he vacation; proposed the a intends
commercial/office-use strip shopping center. The proposed development site plan has
been included; however, the design is not final and is subject to change.
Council set May 4, 2020 as the date to consider the proposed vacation in a public

hearing.
V. DISCUSSION:
Per PMC Chapter 12.40, the Council may require compensation for vacated rights-of-
way. The compensation involves obtaining a title report and appraisal of value.
However, the compensation and the requirements attached thereto may be waived if
one or more of the following conditions apply:
1. The vacation is initiated by the City Council by Resolution;
2. The vacation is at the request of the City;
3. The right-of-way to be vacated was previously determined by the City Council
not to be essential to public traffic circulation and available for vacation;
4. The grant of substitute right-of-way which has a value as a right-of-way at least
equal to that right-of-way to be vacated; or
5. The resulting benefit to the community of the project requiring the vacation
outweighs the appraised value of the right-of-way to be vacated.
The portion of right-of-way to be vacated is approximately 10,642 square feet (0.24
acres) and assessed at approximately $79,838.41. The site plan of the proposed
development has been included, but please note that the plan has not been officially
reviewed for conformance to the Pasco Municipal Code and may be altered. Staff has
concluded that the most likely scenario for any right-of-way dedication may be at the
northeast corner of the property to allow for a larger turning radius at the intersection.
Any right-of-way dedications necessary for the development will be addressed and
conditioned at the time of building permit submittal.
Because of extenuating circumstances involving COVID-19, the public hearing for this
item should be continued to the May 18, 2020 regular Council meeting.

Motion: I move to continue the public meeting to May 18, 2020 to consider the Notice
of Intent to annex property located near the corner of West Court Street and Harris
Road due to the COVID-19 restrictions mandated by Governor Inslee's Proclamation
No. 20-28.

IV. HISTORY AND FACTS BRIEF:
The City received a Notice of Intent to Commence Annexation from owners of
property located near the corner of West Court Street and Harris Road.
The Notice of Intent contains sufficient signatures to initiate the annexation process.
Notices of Intent are required to contain the signatures of property owners representing
at least ten (10) percent of the assessed value of an area proposed for annexation.

In this case, the Notice of Intent contains the signatures of owners representing 100
percent of the assessed value within the proposed annexation area, as described and
depicted in Exhibit No. 3.
The petition also represents approximately 50 percent of the total assessed valuation of
the County island in this vicinity, as depicted in Exhibit No. 4.
V. DISCUSSION:
The petition method of annexation is a two-step process requiring the submittal of a
Notice of Intent to Commence Annexation Proceedings, followed at a later date by an
actual Annexation Petition.
Upon receipt of a Notice of Intent to Commence Annexation the Council is required by
law to set a date to hold a public meeting to consider:
1. Whether the city will accept, reject, or geographically modify the proposed
annexation;
2. Whether it will require the simultaneous adoption of a proposed zoning
regulation; and
3. Whether it will require the assumption of all or any portion of existing city
indebtedness by the area to be annexed.
If, after conduct of the continued public meeting on May 18, 2020, Council chooses to
move forward with the annexation process, staff recommends:
• The annexation area be geographically modified to include the entire County
area between Harris Road to the north, the I-182 freeway to the east and the
north-south segment of West Court Street to the west, as described in Exhibit
No. 1 and depicted in Exhibit No. 2;
• That the territory to be annexed will not require simultaneous adoption of
zoning regulations (following policy - zoning will be recommended by the
Planning Commission after conduct of a public meeting); and
• That the annexation area assume a proportionate share of the City's past bonded
indebtedness (per Resolution No. 3872).
If the annexation is accepted, the applicant will need to accomplish a Development
Agreement for extension of City utilities and approval of the scale and scope of the
intended development. The future Development Agreement will be processed through
the Planning Commission and return to Council for consideration near the completion
of the Comprehensive Plan update process late summer of this year.

Staff has analyzed the timelines pertinent to both delaying the annexation until the
Comprehensive Plan cycle is complete and accepting the annexation with zoning
predicated on approval of the preferred Comprehensive Plan Land Use Element. There
is no appreciable difference in timing in either scenario.
The Public Meeting to consider the Notice of intent to annex was original set for May
4, 2020 through Resolution No. 3954. However, continuation of this item to the May
18, 2020 recommended meeting date will ensure compliance with the Governor's
Proclamation No. 20-28 (Open Public Meetings Act) during the COVID-19 health
crisis.

MOTION: I move to award the bid for construction of the 9th & Washington and
South Maitland Lift Stations Improvements to C & E Trenching, LLC, in the amount
of $637,872.96, including Washington State Sales Tax, and further authorize the City
Manager to execute the contract documents.
III. FISCAL IMPACT:
$637,872.96 funded by the 2017 Sewer Bond.
IV. HISTORY AND FACTS BRIEF:
Consistent with the 2020-2025 Capital Improvement Plan (CIP) and the adopted 2019-
2020 Biennial Budget, the design was completed for improvements to the 9th &
Washington sewer lift station and the South Maitland sewer lift station. Plans and
specifications were developed and bids were then solicited for the construction of these
improvements.
As previously discussed with Council, the 9th & Washington Lift Station was
constructed in 1964, and is located at the intersection of South 9th Avenue and West
Washington Street. This regional lift station was designed to convey flows from the
western portions of Pasco to the City's Wastewater Treatment Plant (WWTP).
Improvements for this facility include replacing several pieces of mechanical and
electrical equipment that have well exceeded their useful life, and are no longer capable
of reliably meeting current or future needs. Other improvements include structural
upgrades to access points, as well as the construction of new security fencing to control

entry and access to the facility.
Additionally, the South Maitland Lift Station was constructed in 1998, and is located
north of East Ainsworth Avenue, near the Pasco Fire Department Administration &
Franklin County Emergency Management office. This regional lift station was
designed to convey flows from Pasco's eastern industrial development area to the City's
WWTP. The existing facility houses three high capacity pumps that operate during
peak hours. Improvements for this facility include the installation of a fourth pump and
its ancillary controls needed to accommodate lower flows, which occur during off-peak
hours.
For both facilities, the aforementioned improvements will significantly improve the
efficiency and reliability of sewer service to the surrounding areas, as well as improve
safety conditions and ease of maintenance for staff operating the lift stations.
V. DISCUSSION:
As part of a competitive formal bidding process, bids for the project were received up
until the hour of 2:00 PM, and opened at the scheduled time of 2:30 PM on April 23,
2020 at Pasco City Hall. Although access to City Hall is temporarily closed to the
public, the bid opening was administered in Council Chambers by City staff and
streamed live for the public via GoToMeeting.
A total of three (3) sealed bids were received. A roll call was initially taken during the
live-stream bid opening, and each bidder was verified as present. Each individual bid
included two (2) proposal forms (see attached Bid Tabulation): "Schedule A" for the
9th and Washington Lift Station, and "Schedule B" for the South Maitland Lift Station.
The low bid thereof represents the lowest combined amount of "Schedule A" and
"Schedule B" proposed and submitted by an individual bidder. The lowest responsive
bidder was C & E Trenching, LLC in the amount of $637,872.96.
Staff reviewed the lowest bidder's submittal and find no exceptions or irregularities.
The low bid is within the budget appropriation. Accordingly, staff recommends award
of the contract to C & E Trenching, LLC of Pasco, Washington in the amount of
$637,872.96, including Washington State Sales Tax.
