Adjournment: January 7, 2020 PPFD Minutes Page - 1 PASCO PUBLIC FACILITIES DISTRICT BOARD JANUARY 7, 2020 SPECIAL MEETING MINUTES Call to Order: Pasco Public Facilities District (PPFD) Board President Morrissette called the meeting to order at 4:04 PM the in the Conference No. 2 at Pasco City Hall. The motion carried unanimously. Amending the Agenda: Mr. Ratkai requested that the New Business, Item A, Review Proposed Resolution No. 2020-01, be removed from this agenda. The Pasco Public Facilities District Board (PPFD) members agreed. Mr. Ratkai also announced that there is a need to hold an Executive Session at the end of the meeting. Old Business:  Response to Questions Posed at December 17, 2019 Meeting Mr. Ferguson explained while he and his staff were researching the questions posed at the last PPFD Board meeting, more questions resulted and legal review would continue until the answers were fully vetted. However, Mr. Ferguson stated following: DRAFT January 7, 2020 PPFD Minutes Page - 2 • The Pasco Public Facilities District (PPFD) Secretary/Treasurer position is a PPFD Board position and is clearly defined within the PPFD Charter. • It appears that the PPFD sales and use taxes should be operating under the Revised Code of Washington (RCW) Section 82.14.048 (4)(e). • It also appears that the two-tenths of one percent tax is an evergreen tax, more research is needed to confirm this statement. • The proposed project should be referred to as a recreation facility and not an aquatic center. • Legal is still reviewing the process (key actions) needed to be followed for the ballot issue. Discussion continued among the PPFD Board members and Pasco staff regarding which RCWs the PPFD will operate under for creating a recreational facility, possible amendments to the PPFD Charter and a reminder to focus on the long-term needs of the recreational facility so that it will remain viable a growing population.  Draft Ballot Language Update Mr. Ratkai distributed a revised draft ballot for the board to review and discuss it at the next meeting. Miscellaneous Discussion: Mr. Morrissette asked about Ballot Measure the timeline distributed at the December 17, 2020. Mr. Ratkai will sent out an updated timeline to the Board within the next few days. Mr. Dietrich stated that he would be back in Pasco, WA from February 20-24, 2020 and February 26 for a few more days. The next PPFD meeting is scheduled for Tuesday, January 28, 2020 and will include a presentation from Ballard*King and Associates. Executive Session: Mr. Morrissette called an Executive Session at 4:40 PM to potential litigation with legal counsel RCW 42.30.110(1)(i) for approximately ten (10) minutes. Mr. Morrissette called the meeting back to order at 4:55 PM.
