Description: Retaining wall, excavation or other structures partially destroyed PMC 9.90.040(11) Violation: Any unsightly building,billboard,fence,excavation,or other structure,or any abandoned or partially destroyed building,fence,excavation or structure,or any building, fence,excavation or structure commenced and left unfinished. ' CODE ENFORECEMENT BOARD MEETING y Hall-Council Chambers a: 525 North Third Avenue Pasco, Washington THURSDAY, December 5,2019 7:00 PM CALL TO ORDER Board Chair Daniel Gottschalk called the regular meeting of the Code Enforcement Board to order in the Council Chambers of City of Pasco, 525 North Third Street in Pasco,Washington at 7:00 p.m. ROLL CALL MEMBERS PRESENT MEMBERS ABSENT Daniel Gottschalk Thomas Granbois Mary Gutierrez James Rawlinson APPROVAL OF MINUTES Board Member Mary Gutierrez moved to approve the November 7, 2019 Code Enforcement Board Meeting minutes. Board Member James Rawlinson seconded and the motion carried. HEARINGS A. Administration of Oaths B. Hearings Scheduled ➢ There were no objections to any Board Member hearing cases being presented. CEB2019-1293—4020 W OPAL St-JOSE L TOVAR,owner NICHOLAS POTVIN, Code Enforcement Officer Description: White boxer off premises from owners, roaming free. Tri-Cities Animal Control attempted to capture dog, but were unsuccessful. PMC 6.05.040(1) Violation: Permitting a dog, licensed or not, to roam or stray or be off its owner's premises unless it is at all times under the control of a person. Corrective Action:Ensure that all dogs are kept on the property and are not permitted to stray from the property unless on a leash while being accompanied by a person. I, ❖ Board Member Granbois moved to confirm violations did occur. Board member Gutierrez seconded and the motion carried. Code Enforcement Board November 7,2019 Meeting Minutes Page 1 of 3 City staff recommended imposing a repeat penalty of$400 ❖ Board Member Rawlinson moved to impose a repeat penalty of$400. Board Member Granbois seconded and the motion carried. CEB2019-1354—200 S 20TH AVE—G C & ELIZABETH MILLER,owner NICHOLAS POTVIN, Code Enforcement Officer Description: Damaged, wrecked inoperable vehicles, vehicle parts (bumpers,fenders, doors etc.) and tires stored in front of this business in public view(I-1). (Repeat)PMC 25.165.200(3) Violation: Inoperable vehicles, vehicle parts, tires and accessories that are not readily moveable and for immediate sale are not being stored or parked behind approved screening or within the building. Corrective Action: Remove all inoperable vehicles, vehicle parts, tires and accessories into the building, behind an approved screening or completely to an approved location. Description: Parking area used to store wrecked, inoperable, disassembled autos, and auto parts. (REPEAT) PMC 9.90.040(12) Violation: All places used or maintained as junkyards, or dumping grounds, or for the wrecking or disassembling of automobiles,trucks,tractors,or machinery of any kind, or for the storing or leaving of worn- out, wrecked or abandoned automobiles, trucks, tractors, or machinery of any kind, or of any of the parts thereof,or for the storing or leaving of any machinery or equipment used by contractors or builders or by other persons. Corrective Action: Discontinue wrecking or disassembling automobiles, trucks, etc. Remove and lawfully dispose of all wrecked or abandoned vehicles, machinery, etc, along with any parts thereof. Discontinue the storage of heavy machinery or equipment (i.e. front end loaders, dump trucks,backhoes, etc.)at this property. Description: Pallets and plywood stored in parking area and next to sidewalk which pose a fire hazard. (REPEAT)PMC 9.90.040(6) Violation: Any parcel within the City which is filthy, littered or trash-covered to placing,dropping,disposing, throwing away, or otherwise discarding litter, garbage, refuse, cans, bottles, paper or paper material, metal organic or inorganic material on areas of the property other than approved garbage containers. Corrective Action: Remove and lawfully dispose of all litter,garbage,junk or vegetative waste on the property. Description: Vehicle parts stored in the parking area (tires, bumpers,fenders, doors, auto bodies). (REPEAT) PMC 9.90.040(9) Violation: Scrap metal, ashes, bric-a-brac, broken stone or cement, broken crockery, broken glass, broken plaster, automobile bodies and/or parts, and all such trash or abandoned material that are not kept in approved containers. Corrective Action: Remove all vehicle parts, scrap metal, machinery, disassembled vehicles, etc. from the property or store these items in an enclosed container or building. Board Member Gutierrez seconded and the motion carried. City staff recommended the Board give the Respondent an additional ten (10) days to abate the violations or pay a daily penalty of one hundred dollars ($100)per day for 10 days. ❖ Board Member Rawlinson moved to allow sixty (60) days to abate the violations and if abatement does not occur,impose a penalty of$100 per day for ten (10)days with$200 repeat held in abeyance for one year. Board Member Gutierrez seconded and the motion carried. C. Amendments There were no amendments added to the Resolution/Agenda. D.
