This Agreement made and entered into on this 20111 day of August 2019, by and between
the Washington State Department of Transportation, hereinafter referred to as
"WSDOT", and the event coordinator Brent Kubalek, hereinafter referred to as the
"EVENT COORDINATOR", representing The City of Pasco, for the purpose of staging
an event on state highway(s) rights of way.
Event Description
The 2019 Lampson Cable Bridge Run, hereinafter referred to as the "EVENT", will stage
on North Gum Street (Hwy 397), cross the Columbia River using the cable bridge onto
South 10th Street, proceeding east along East Ainsworth Street.
Whereas, WSDOT and the Washington State Patrol, hereinafter referred to as "WSP"
have determined that the EVENT may impact normal traffic operations on state
highway(s) to the extent that special traffic controls or other safety considerations are
required.
Whereas, WSDOT with the advice of WSP conditionally approves EVENT operations on
Hwy 397 at or near milepost 17.92 to 18.79, on the date of Saturday December 21 ST 2019
beginning at 8:00 a.m. to 11 :00 a.m., subject to the terms and conditions in this
Agreement and any attached Exhibit(s).
Administration and Procedures
1. WSDOT enters into this written agreement with you for the purpose of defining
responsibilities and requirements for EVENT operations on state highways. This
Agreement is not effective unless or until signed by WSDOT and countersigned by
you prior to the commencement of the EVENT. WSDOT assumes no obligation for
any EVENT, pursuant to an agreement form that is unsigned, or altered by the
EVENT COO RD INA TOR without WSDOT concurrence. WSDOT reserves the right
to postpone or deny an EVENT operation when approval is requested without
sufficient advance notice, as determined by WSP or WSDOT.
2. You are encouraged to use county roads or city streets if at all possible. You are
responsible for securing approval from local agencies or communities in
unincorporated areas that may be impacted by the EVENT. If the EVENT takes place
on city streets without access control that are part of state highways, you shall furnish
WSDOT with copies of any traffic control, insurance, and applicable agreements
made with local agencies.
3. You are responsible for cleaning up immediately after EVENT operations and
returning any and all state highway facilities to the state or condition that
existed prior to the EVENT.
4. The WSDOT and WSP will not provide resources for this event. If resources are
required to return the roadway to the condition is was prior to the EVENT, to conduct
traffic control for the EVENT, or to provide additional enforcement for the EVENT;
you will be responsible for paying the full cost to provide these resources.
5. Any base of operations, or storage or staging area for the EVENT shall be located
outside the state 's right of way. Prior authorization from WSDOT shall be required
for any base of operations, storage or staging areas to be located within the right of
way.
6. For events having participant registration forms , you are encouraged to include
WSDOT and WSP in a statement of waiver or release of damages against the state of
Washington, for signature by event participants or parents or guardians of participant
minors. A sample release for such forms is as follows:
I, ( name o f participant ). do hereby release, discharge , and hold
harmless the Washington State Transportation Commission, the
Washington State Department of Transportation, the Washington State
Patrol, and their officers, agents, and employees from all claims, demands,
and causes of actions of every kind whatsoever for any damage, loss, or
injuries which may result from my participation in the ( 2019 Lampson
Cable Bridge Run ), involving state highways, known or unknown,
foreseen or unforeseen.
7. Information in attached EXHIBIT(S) may identify existing regulatory prohibitions of
specific types of traffic on limited access highways, such as the pedestrian prohibition
on full access controlled highways.
Liability
1. EVENT COORDINATOR, at solely his or her expense, shall obtain and keep in force
during the term of the EVENT, general liability insurance coverage in an amount no
less that $1 million per occurrence (combined single limit of liability) and $2 million
in the aggregate providing bodily injury, property damage, and personal injury
coverage for the state of Washington for any liabilities, including all costs of defense,
arising out of the use of state highways for the EVENT. Said general liability
coverage shall be written on an "occurrence" basis, not a "claims made" basis, and
shall provide coverage no less than the coverage provided by a Commercial General
Liability Coverage Form (CG 00 01 07 98 ISO or later). Said policy shall not be
subject to any self-insured retained limit of liability, or endorsements that would limit
the coverage provided by the original policy form, except to the extent that coverage
is limited to claims arising from the EVENT. EVENT COORDINATOR, at his or her
expense, shall obtain and keep in force during the term of the EVENT commercial
automobile liability coverage in an amount no less than $1 million per occurrence
(combined single limit of liability) providing bodily injury and property damage
coverage for the State of Washington as an additional insured under said policy. Said
liability coverage shall provide coverage no less than the coverage provided by a
Commercial Automobile Liability Form (CA 00 010797 ISO or later). Said policy
shall not be subject to any self-insured retained limit of liability, or any endorsement
that would limit the coverage provided by the original policy form, except to the
extent that coverage is limited to claims arising from the EVENT. An affidavit
verifying proof of insurance reflecting the required coverage is required and must be
in the possession of WSDOT and WSP prior to commencement of the event. (See
EXHIBIT B -to determine if insurance will be required for parades on city streets
that are also state highways.)
2. EVENT COORDINATOR shall indemnify and hold the state of Washington
harmless against any and all claims or actions of any type of nature by third parties
for injuries or property damage, including all costs of defense, caused by or arising
out of the EVENT.
Venue
1. In the event that any party deems it necessary to institute legal action or proceedings
to enforce any right or obligation under this Agreement, the parties hereto agree that
any such action or proceeding shall be brought in a court of competent jurisdiction
situated in Thurston County, Washington, and EVENT COORDINATOR herein
submits to jurisdiction thereunder.
Traffic Control
1. WSDOT has determined that a traffic control plan is necessary for this EVENT.
Operational details specific to the EVENT are contained in EXHIBIT ( J l, attached
hereto. All components of the traffic control plan shall conform to the standards of
the Manual on Uniform Traffic Control Devices (MUTCD).
Such plans must be approved by the WSDOT Regional Traffic Engineer and are
coordinated by the State Traffic Engineer for inter-regional events. In addition, traffic
control plans shall meet the following requirements and restrictions:
• EVENT COORDINATOR is responsible for acquiring all traffic control
devices, and shall have all traffic control devices installed per approved plan
prior to commencement of the EVENT.
• Traffic control operations shall be performed by certified flaggers, or off duty
law enforcement officers.
• Any rolling traffic break (intentional slowing of traffic through a moving
roadblock, provided by WSP) shall operate at a speed greater than 35 mph on
full access control, freeway type highways. In no event shall any vehicle
exceed the regulatory speed limits.
• Traffic control plans may include proposals to close shoulders, lanes, or entire
sections of state highways. Information about the proposed closures including
dimensions such as overall distance, lane or shoulder widths, times and dates,
and detour plans shall be included in the approved traffic control plans.
Closures on interstate and other access controlled, freeway type highways will
not be allowed.
• Road closures will be considered only where no other traffic control strategies
appear satisfactory, and where an adequate detour route is available. The
EVENT COORDINATOR is required to provide notification of the closure, at
least 72 hours in advance, to all fire and law enforcement departments,
ambulance companies, and transit agencies that would be affected by the
closure. The EVENT COODINATOR is required to comply with RCW
47.48.020, a copy of which is hereto attached. (The copy ofRCW 47.48.020
has been provided as a courtesy. It may or may not have current amendments.
EVENT COORDINATOR is responsible for reading and complying with any
subsequent amendments to the statute that are not attached). Notice of closure
signs posted under purview of this statute shall read, at a minimum, 'HWY 397
WILL BE CLOSED 12-21 8:00 AM TO 11 :00 AM AT location (s ).' The signs
shall have 2-inch minimum size capital black letters on a white background
with a black border and shall be fabricated so the sign will not be affected by
weather conditions, or a Portable Changeable Message Sign may be used.
2. If elements of the traffic control plan such as road or lane closures, or rolling traffic
breaks impact normal traffic operations, a pre-event meeting, scheduled by the
EVENT COODINATOR may be required. The EVENT COODINATOR, WSDOT,
WSP should attend this meeting, along with a representative of any local agency
impacted by the EVENT.
The purpose of the meeting is to ensure that the traffic control plan and related
operational procedures are finalized and participants understand their roles and
responsibilities prior to commencement of the EVENT. Minor events (as determined
by WSDOT or WSP) may not require this operational meeting.
3. EVENT COORDINATOR and WSDOT do agree that operational decisions and/or
emergency situations may require road/lane closures to be opened immediately.
WSP is responsible for traffic enforcement, and has final authority regarding the
location and specific time of day that any road/lane closures, or any other part of the
traffic control plan may be implemented. Neither WSDOT nor WSP shall be liable
for any damages, or loss arising from the decision to reopen lanes during an event
closure.
Please indicate your concurrence by signing and returning the enclosed copy of this
Agreement to the South Central Region Traffic Office. Once received, SCR Traffic
will sign and return to you a copy of the Agreement for your records. Failure to do so,
or any alteration of this document, will render this Agreement invalid. If you have

PEDESTRIAN EVENT AGREEMENT

This Exhibit in combination with the Agreement comprises a complete understanding
between the Washington State Department of Transportation (WSDOT), the Washington
State Patrol (WSP), and the parade Event Coordinator.
Unless specifically required to participate in the development or deployment of any
traffic control plan, WSDOT and WSP will have only incidental involvement with the
event.
I. For cities and towns having a population in excess of22,500, only a traffic control
plan is required prior to conducting a parade on a city street that is also a state
highway. There are no other terms or conditions.
2. The event sponsor agrees to hold the State of Washington harmless from any and all
claims of any type or nature arising from the EVENT that is the subject of this
agreement.
3. Events sponsored by cities or towns, and covered by existing insurance policies do
not need to comply with the liability insurance article contained in the Letter of
Agreement.
4. Any base of operations, or storage or staging area for the EVENT shall be located
outside the state's right of way. Prior authorization from WSDOT shall be required
for any base of operations, storage or staging areas to be located within the right of
way.
5. The attached traffic control/detour plans shown as Exhibit J will be made a part of
this Agreement .
6 . Signs shall be black on orange 48" x 48" diamond shape signs or 48" x 18" detour
signs, supplied by the EVENT COORDINATOR.
7. Signs as shown in the traffic control/detour plans shall be set up , maintained in place
and then taken down by the EVENT COORDIANTOR.

Notice of closure or restriction -Emergency closure.
Before any state highway, county road, or city street is closed to, or the maximum speed
limit thereon reduced for, all vehicles or any class of vehicles, a notice thereof including
the effective date shall be published in one issue of a newspaper of general circulation in
the county or city or town in which such state highway, county road, or city street or any
portion thereof to be closed is located; and a like notice shall be posted on or prior to the
date of publication of such notice in a conspicuous place at each end of the state highway,
county road, or city street or portion thereof to be closed or restricted: PROVIDED, That
no such state highway, county road, or city street or portion thereof may be closed sooner
than three days after the publication and the posting of the notice herein provided for:
PROVIDED, HOWEVER, That in cases of emergency or conditions in which the
maximum time the closure will be in effect is twelve hours or less the proper officers
may, without publication or delay, close state highways, county roads, and city streets
temporarily by posting notices at each end of the closed portion thereof and at all
intersecting state highways if the closing be of a portion of a state highway, at all
intersecting state highways and county roads if the closing be a portion of a county road,
and at all intersecting city streets if the closing be of a city street. In all emergency cases
or conditions in which the maximum time the closure will be in effect is twelve hours or
less, as herein provided, the orders of the proper authorities shall be immediately
effective.

BICYCLING/PEDESTRIAN RULES OF THE ROAD
Revised Code of Washington Statutes Pertaining to Bicyclists
RCW 46.04.071 Definition of "Bicycle"
"Bicycle" means every device propelled solely by human power upon which a
person or persons may ride, having two tandem wheels either of which is sixteen inches
or more in diameter, or three wheels any of which is more than twenty inches in diameter.
RCW 46.04.200 Definition of "Hours of Darkness"
"Hours of Darkness" means the hours from one-half hour after sunset to one-
halfhour before sunrise, and any other time when persons or objects may not be clearly
discernible at a distance of five hundred feet.
RCW 46.04.431 Definition of "Highway"
"Highway" means the entire width between the boundary lines of every way
publicly maintained when any part thereof is open to the use of the public for purposes of
vehicular travel.
RCW 46.04.500 Definition of "Roadway"
"Roadway" means that portion of a highway improved, designed or ordinarily
used for vehicular travel, exclusive of the sidewalk or shoulder even though such
sidewalk or shoulder is used by persons riding bicycles. In the event a highway includes
two or more separated roadways, the term "roadway" shall refer to any such roadway
separately but shall not refer to all such roadways collectively.
RCW 46.04.670 Definition of "Vehicle".
"Vehicle" includes every device capable of being moved upon a public highway
and in, upon, or by which any persons or property is or may be transported or drawn upon
a public highway, excepting devices moved by human or animal power or used
exclusively upon stationary rails or tracks, except that mopeds shall be considered
vehicles or motor vehicles for the purposes of chapter 46.12 RCW, but not for the
purposes of chapter 46.70 RCW.
RCW 46.61.160 Restrictions on use of limited access highway use by bicyclists.
The department of transportation may by order, and local authorities may by
ordinance or resolution, with respect to any limited access highway under their respective
jurisdictions prohibit the use of any such highway by funeral processions, or parades,
pedestrians, bicycles or other non-motorized traffic, or by any person operating a motor-
driven cycle. Bicyclists may use the right shoulder of limited access highways except
where prohibited. The department of transportation may by order, and local authorities
may by ordinance or resolution, with respect to any limited-access highway under their
respective jurisdictions prohibit the use of the shoulders of any such highways by bicycles
within urban areas or upon other sections of the highways where such use is deemed to be
unsafe.
The department of transportation or the local authority adopting any such prohibitory
regulation shall erect and maintain official traffic control devices on the limited-access
roadway on which such regulations are applicable, and when so erected no person may
disobey the restrictions stated on such devices.
RCW 46.61.502 Driving while under influence of intoxicating liquor or drug-
What constitutes
A person is guilty of driving while under the influence of intoxicating liquor or
any drug ifhe drives a vehicle within this state while: (1) He has 0.10 percent or more by
weight of alcohol in his blood as shown by chemical analysis of his breath, blood or other
bodily substance made under RCW 46.61.506 as now or hereafter amended, or (2) He is
under the influence of or affected by intoxicating liquor or any drug, (3) He is under the
combined influence of or affected by intoxicating liquor and any drug.
The fact that any person charged with a violation of this section is or has been
entitled to use such drug under the laws of this state shall not constitute a defense against
any charge of violating this section.
RCW 46.61. 700 Parent or guardian shall not authorize or permit violation by a
child or ward.
The parent of any child, and the guardian of any ward shall not authorize
or knowingly permit any such child or ward to violate any of the provisions of this
chapter.
RCW 46.61.750 Effect of regulations-Penalty
(1) It is a traffic infraction for any person to do any act forbidden or fail to
perform any act required in RCW 46.61.750 through 46.61.780.
(2) These regulations applicable to bicycles apply whenever a bicycle is operated
upon a highway or upon a bicycle path, subject to those exceptions stated herein.
RCW 46.61.755 Traffic laws apply to persons riding bicycles.
Every person riding a bicycle upon a roadway shall be granted all of the rights and
shall be subject to all of the duties applicable to the driver of a vehicle by this chapter,
except as to special regulations in RCW 46.61.750 through 46.61.780 and except as to
those provisions of this chapter which by their nature can have no application.
RCW 46.61.758 Hand Signals.
All hand signals required of persons operating bicycles shall be given in the
following manner:
(1) Left turn. Left hand and arm extended horizontally beyond the side of the
bicycle;
(2) Right turn. Left hand and arm extended upward beyond the side of the bicycle,
or right hand and arm extended horizontally to the right side of the bicycle;
(3) Stop or decrease speed. Left hand and arm extended downward beyond the
side of the bicycle. The hand signals required by this section shall be given before
initiation of a tum. [ ed note: hand signals should only be used when it is safe to remove a
hand from the bicycle handlebars.]
RCW 46.61.760 Riding on bicycles.
(1) A person propelling a bicycle shall not ride other than upon or astride a
permanent and regular seat attached thereto.
(2) No bicycle shall be used to carry more persons at one time than the number for
which it is designed and equipped.
RCW 46.61.765 Clinging to vehicles.
No person riding upon any bicycle, coaster, roller skates, sled or toy vehicle shall
attach the same or himself to any vehicle upon a roadway.
RCW 46.61. 770 Riding on roadways and bicycle paths.
(1) Every person operating a bicycle upon a roadway at a rate of speed less than
the normal flow of traffic at the particular time and place shall ride as near to the right
side of the right through lane as is safe except as may be appropriate while preparing to
make or while making turning movements, or while overtaking and passing another
bicycle or vehicle proceeding in the same direction. A person operating a bicycle upon a
roadway or highway other than a limited-access highway, which roadway or highway
carries traffic in one direction only and has two or more marked traffic lanes, may ride as
near to the left side of the left through lane as is safe. A person operating a bicycle upon a
roadway may use the shoulder of the roadway or any specially designated bicycle lane if
such exists.
(2) Persons riding bicycles upon a roadway shall not ride more than two abreast
except on paths or part of the roadway set aside for the exclusive use of bicycles.
RCW 46.61.775 Carrying articles.
No person operating a bicycle shall carry any package, bundle or article which
prevents the driver from keeping at least one hand upon the handlebars.
RCW 46.61.780 Lamps and other equipment on bicycles.
(1) Every bicycle when used during the hours of darkness as defined in RCW
46.37.020 shall be equipped with a lamp on the front which shall emit a white light
visible from a distance of at least five hundred feet to the front and with a red reflector on
the rear of a type approved by the state commission on equipment which shall be visible
from all distances from one hundred feet to six hundred feet to the rear when directly in
front of lawful lower beams of head lamps on a motor vehicle. A lamp emitting a red
light visible from a distance of five hundred feet to the rear may be used in addition to the
red reflector. (2) Every bicycle shall be equipped with a brake which will enable the
operator to make the braked wheel skid on dry, level, clean pavement.

BICYCLING/PEDESTRIAN EVENT
ROAD MARKING
The Washington State Department of Transportation discourages marking or painting the
roadway surface. If it is determined that marking the pavement is the best way to inform
participants of the correct course, then pavement marks called "Dan Henry's" can be
placed within the shoulder area or as close to the edge of pavement a practical.
WSDOT approves only water-based chalk marking paint, such as that manufactured
by Aervoe-Pacific Company. This paint is designed to mark most paved surfaces, soil,
and grass. Adhesion is provided by non-resin binders and low pigment solids in a slurry
that will hold the chalks together as the mark dries. This paint is removable by heavy
water, traffic, and natural self destruction. Duration normally is 2-3 weeks.
The chalk based paint should be applied only for "Dan Henry" type logos, and such
marks should be no larger than a maximum of 12" wide and 18" long. The "Dan Henrys"
should be used only at key directional or decision making points along the route of travel.

Pavement markings must adhere to the following guidelines:
• Use only chalk-based or other "fade-away" paint. Pennanent paint is prohibited as it does
not wear off. The organizer is responsible for any paint-related clean-up costs incurred by WSDOT .
• Route pavement markings alert event participants to a change of direction in the event route.
They may be used just before, at, and just after directional decision-making points. Excess markings
are not permitted. Route confirmation markings may be permitted at major mtersections .
• The route directional pavement markings (sometimes known as "Dan Henry's") should be
no larger than 12 inches x 18 inches.
• For bicycle events, place the markings to the right of the right edge line if cyclists will be
on a rideable shoulder. Otherwise, place the markings within the ordinary line ofreasonable riding .
• For running or walking events, place the markings on the left shoulder where pedestrians
face on-coming traffic. Place markings on the right shoulder only where traffic control directs the
event route there.
• Word messages may be permitted. They must be short, simple, and small in size, readable to
event participants but not distracting to motorists .
• Do not place pavement markings at or near traffic control devices, survey monuments, or
construction markings .
• For the best visibility, the preferred colors are yellow or white.

Signs and Pavement Markings
Bicycle, Pedestrian, Running, or Auto Tour Events,
Guidelines for Special Event Coordinators
Signs and pavement markings are the most immediate and effective way to communicate with
special event participants. The Washington State Department of Transportation (WSDOT) allows
placing signs and pavement markings on its right of way to adequately mark a special event route
and to give direction to stops for rest or food.
Signs must adhere to the following guidelines:
• Small signs to give direction to event participants, may be permitted at points where the
route changes or to event food, water, or rest stops. The signs may be placed just before, at, and
just after directional decision-making points. Excess signs are not permitted, although occasional
route confinnation signs are allowed.
• Signs may be no larger than 2 feet x 2 feel, except that car tour signs may be no larger than
4 feet x 4 feet. Sandwich board signs are allowed.
• Sign messages are simple and short. They may include the event name, simple message
(e.g., FOOD or WATER AHEAD) and an arrow. Messages may not contain advertising, nor
emulate a regulatory traffic control sign.
• Signs must be of lightweight crashworthy materials such as corrugated plastic.
• Place signs either off the shoulder or as far to the right on the shoulder as possible. Signs
may not block driveways, alleys. or intersections, or bicycle or pedestrian access to the shoulder.
• Signs must be placed on a crashworthy base, such as wood lath or lightweight aluminum
stakes. If signs are weighted, the weight must be a sand bag weighing less than 40 lbs. and
placed with the bottom of the bag no more than l foot above the ground.
• Signs may not be attached to utility poles or signal poles. or to luminaires (RCW 70.54.090
and WAC 480-62-999).
• Sign colors are al the event sponsor's option.

The above captioned entity is a member of the Washington Cities Insurance Authority 0,NCIA),
which is a self-insured pool of over 155 public entities in the State of Washington.
WCIA has at least $4 million per occurrence limit of liability coverage in its self-insured layer that
may be applicable in the event an incident occurs that is deemed to be attributed to the
negligence of the member. Liability coverage includes general liability, automobile liability, stop-
gap coverage, errors or omissions liability, employee benefits liability and employment practices
liability coverage.
