AMENDMENT NO.2 TO
SUPPLEMENTAL EMPLOYMENT AGREEMENT
(Retirement Deferral)
BY THIS AMENDMENT NO. 2, entered into this 1N day146. of 9RA
2019, between the City of Pasco, Washington, hereinafter referred to as "City"; andnefBert
Gear, hereinafter referred to as "Chief."
WHEREAS, the City is presently engaged in the construction of two fire stations, as well
as the organization and relocation of the Fire Department administrative offices which, due to the
experience, training and familiarity with these projects, the Chief provides a significant value to
the City; and
WHEREAS, the Pasco Fire Department is in various stages of engagement on numerous
Progressive efforts in which the Chief possesses specialized knowledge, skill and familiarity not
easily replaced or replicated in a timely manner, and
WHEREAS, the Chief may be eligible for retirement from the service during the term of
this Agreement and prior to the completion of these essential projects; and
WHEREAS, it is determined in the best interest of the City that the City, based upon
adequate consideration, seek the deferral of the Chief s eligibility for retirement until significant
completion of the pending projects has occurred. NOW, THEREFORE,
IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN,
the Parties agree that the Supplemental Employment Agreement shall be amended as follows:
Section 1. That Section 2, `Term of Agreement", shall be and hereby is amended and
shall read as follows:
2. Term of Agreement This Agreement shall be effective on the 1st day of
January, 2019, and terminate on the 31st day of March, 2021, unless earlier
terminated as provided below.
Section 2. That Section 3, "Compensation", shall be and hereby is amended and shall
read as follows:
3. Co enation. As additional compensation, the City shall pay to the Chief the
following:
3.1 Moneta1y Com enation. Compensation shall be at the monthly rate of $13,327
commencing on the first day of the first pay period of 2019, increasing to a monthly
rate of $13,995 beginning the first day of the first pay period of 2020, and increasing
by an amount equivalent to the Council approved cost of living for management
employees as applied in January of 2021.
3.2 Participation in the Annual Merit Pgy Pro [am. Effective January 1, 2019 through
the term of this agreement, the Chief will not be eligible for consideration of merit
pay as provided for in City of Pasco Administrative Order 205.
3.3 Benefits. Chief shall be entitled to the following additional benefits:
3.3.1 Uniforms and uniform maintenance on a basis consistent with
current practice.
3.3.2 Educational leave consistent with current practice.
3.3.3 Eligibility for overtime when working in a position compensated by
state or federal reimbursement.
3.3.4 Participation in incident management assignments and training.
Section 3. That a new Section 3A, entitled "Vehicle Allowance", shall be created and
hereby is included as part of the Supplemental Employment Agreement and shall read as follows:
3A. Vehicle Allowance. The City shall make available to the Chief a City -owned
motor vehicle solely for the Chief s official use.
Section 4. That Section 4, "Additional Duties", shall be and hereby is amended and
shall read as follows:
4. Additional Duties. Chief shall provide oversight and management over the
following ongoing projects during the term of this Agreement:
4.1 Assist in negotiations per IAFF Labor Agreement (leading the language discussion
pertaining to working conditions).
4.2 Implementation of GEMT program.
4.3 Coordinating and collaborating -with the Finance Department and consultant in the
development of ambulance utility billing rates reflective of the demand on utility.
4.4 Evaluation and possible expansion of the public education and community Risk
Reduction program to provide community paramedic services with a goal of
managing emergent responses.
4.5 Develop and implement a five (5) year plan to maintain the City's WSRB Class 3
community rating.
4.6 Oversee design, bidding process, and construction of Station 83 relocation and
Station 84 replacement.
4.7 Represent the City in collaboration with community partners in addressing the
impacts of homelessness and mental illness in the community.
4.8 Collaborate with Community and Economic Development Department in
evaluating how the Building Permits & Inspection Services Division and the Fire
Department can improve effectiveness and community safety.
4.9 Continue development of the burn training site and inclusion of Franklin County
Fire District #3 in the operations and maintenance expense of the site.
4.10 Modernize the living areas and provide station alerting in stations 81 and 82.
4.11 Examine opportunities to improve ambulance billing in North Franklin Hospital
District, Franklin County Fire District #3 and Walla Walla County Fire District #5.
4.12 Improve capability to respond to Oil and Hazardous Materials incidents, in
particular those that may occur on the Snake and Columbia Rivers.
4.13 Oversee the development of a City Emergency Response and Continuity of
Operations plan.
4.14 Complete onboarding of the current Deputy Chief and assist with hiring of a new
Fire Chief.
Section 5. That Section 5, "Early Termination", shall be and hereby is amended and
shall read as follows:
5. Early Termination. Other than upon the death, disability, or determination of
ineligibility, this Agreement may only be terminated at the election of either party with
ninety (90) days advance notice to the other Party.
Section 6. That Section 6, "Remaining Terms", shall be and hereby is amended and
shall read as follows:
6. Remainin, , Terms. Except as modified herein, all remaining terms contained in
the Letter Agreement of Employment dated November 13, 2008; and such additional
addendums and applicable employment conditions imposed by Ordinance, law, or
regulation, not inconsistent with the provisions of this Agreement, shall remain in full force
and effect to the extent that they remain applicable.
In the event that any prior terms of the Parties are in conflict with or are inconsistent with
any addendums, supplements, or amendments to the terms contained in the Letter
Agreement of November 13, 2008, including the terms of this Amendment No. 2 to the
Supplemental Employment Agreement, the terms of the last -modified revisions to the
terms shall prevail.
Section 7. All remaining terms and conditions not inconsistent herewith shall remain
in full force and effect.
