CITY ROAD EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT
CHAPEL HILL BOULEVARD EXTENSION
The Grantors, William Fawn Rupp and Rosa M. Rupp, husband and wife for and in
consideration of mutual benefit and other valuable consideration, conveys and grants unto the
CITY OF PASCO, a municipal corporation, and its assigns, Grantee, a permanent and exclusive
gross Easement for the purpose of a public Right-of-Way to include but not be limited to
construction, operation, use, and maintenance of a public road, public and private utility facilities
to the extent they serve the general public, frontage improvements, street lights, and other related
improvements to benefit the general public and/or adjacent properties.
Said Easement being situated on lands in Franklin County, State of Washington, and
described as follows:
The existing fifty (50) foot wide Public Access Easement located on each
side of centerline on Chapel Hill Boulevard as shown on Amendment Pasco 16
Segregation Survey (AFN 1847849), over and across portions of Lot 2 of Binding
Site Plan 2007-01, Vol 1, Pg. 101BSP, Franklin Co., WA.
This Easement shall convert to a permanent Right-of-Way dedication, through the platting

process or another approved method.
In addition to the Right-of-Way Easement provided for above, Gran.tor hereby
grants to Grantee a fifty (50) foot temporary construction easement to begin at the point where the
above Right-of-Way Easement ends, and to be located between fifty (50) feet and one hundred
(100) feet from centerline of Chapel Hill Blvd over and across portions of Lot 2 of Binding Site
Plan 2007-01, Vol 1, Pg. lOIBSP, Franklin Co., WA., and to be granted on the date this document
is executed and to last for a period of 18 months or until construction is completed, for the purpose
of any and all activities related to the construction of the roadway, frontage improvements, street
lights, and utilities as described above.
Grantee shall be responsible for any and all costs, damages or expenses arising from
the above-described construction, and agrees to defend, indemnify and hold the Gran.tor harmless
from and against any costs, claims, losses, damages, expenses, judgments, and causes of action the
Gran.tor may incur arising out of, or in connection with the Grantee's construction activities upon
the premises.
In the event any claim or dispute arises as a result of this Agreement, the parties
shall meet in a good faith attempt to resolve such dispute or claim, and in the event such dispute
or claim cannot be resolved by agreement of the parties, such dispute shall be resolved by binding
arbitration pursuant to RCW 7 .04A, as amended, with the venue for such arbitration being Franklin
County, Washington, and the prevailing party awarded its reasonable attorney fees as a cost of the
arbitration.
