To approve bad debt write-off for Utility Billing, Ambulance, Cemetery, General Accounts, Miscellaneous Accounts, and Municipal Court (non- criminal, criminal, and parking) accounts receivable in the total amount of $284,616.13 and, of that amount, authorize $156,776.17 to be turned over for collection. VISITORS - OTHER THAN AGENDA ITEMS: Page 1 of 3 Page 5 of 22 REGULAR MEETING MINUTES PASCO CITY COUNCIL MAY 6, 2019 • Jeffrey Robinson provided accolades of councilmembers professionalism. • Gabriel Portugal thanked the City of Pasco for their efforts to make the Cinco de Mayo Festival a success. • Dr. Paul Pigulski addressed Council on snow removal; he provided a letter dated March 13, 2019 for staff to review. • Victor Scott addressed Council on the topics of integrity, honesty, and the police department. • Brent J. Brant addressed Council about a group for police oversight. REPORTS FROM COMMITTEES AND/OR OFFICERS: Verbal Reports from Councilmembers • Ms. Barajas attend Day of the Children and provided overview of Cinco de Mayo Festival events. • Mr. Maloney attended the Chef's Table at the Pasco Specialty Kitchen as well as Cinco de Mayo Festival. • Mr. Martinez attended the HAPO Center Advisory Board and Hanford Communities meetings. • Mr. Milne attended the Chef's Table at the Pasco Specialty Kitchen and thanked City staff for work at Cinco de Mayo Festival. • Mr. Alvarado attended a half day board retreat for Accountable Communities of Health. General Fund Monthly Report - March 2019 ORDINANCES AND RESOLUTIONS NOT RELATING TO HEARINGS: Homeless Temporary Shelters Mr. White confirmed only religious organizations fall under ordinance and cold weather shelters would not be impacted. MOTION: Mr. Maloney moved to adopt Ordinance No. 4434, creating Chapter 25.205 "Homeless Temporary Shelters." Mr. Martinez seconded. Motion carried unanimously. Rezone from RS-20 to RS-12 (Black Belle Estates) (MF# Z2019-003) MOTION: Mr. Maloney moved to adopt Ordinance No. 4435, rezoning three parcels between Road 52 and Road 54 south of West Court Street from RS-20 to RS-12 and further, authorize publication by summary only. Mr. Milne seconded. Motion carried unanimously. Rezone from RT to R-1 (Salas) (MF# Z2019-001) MOTION: Mr. Maloney moved to adopt Ordinance No. 4436, rezoning five parcels east of Heritage Boulevard from RT to R-1 and further, authorize publication by summary only. Mr. Alvarado seconded. Motion carried unanimously. Rezone from RT to C-1 (AHLB, Inc) (MF #Z2019-002) MOTION: Mr. Maloney moved to adopt Ordinance 4437, rezoning the Northeast 6.1 acres at the intersection of Sandifur Parkway and Road 68, from RT (Residential Transition) to C-1 (Retail Business), and further, authorize publication by summary only. Chapel Hill Blvd DNR Inter Local Agreement & Road Easement MOTION: Mr. Maloney moved to approve Resolution No. 3904, authorizing the City Manager to negotiate, make minor changes to, and sign the Interlocal Cooperative Agreement and City Road Easement with Washington State Department of Natural Resources for Chapel Hill Boulevard. Ms. Barajas seconded. Motion carried unanimously. NEW BUSINESS: Interlocal Agreement Addendum for School Resource Officer Services MOTION: Mr. Maloney moved to approve the Interlocal Agreement Addendum for School Resource Officer Services with the Pasco School district for the 2018-2019 and 2019-2020 school year and, further, authorize the City Manager to sign the addendum. Mr. Martinez seconded. Motion carried unanimously. Addendum to Collective Bargaining Agreement (CBA) with International Union of Operating Engineers (IUOE), Local 280 MOTION: Mr. Maloney moved to approve the Addendum to the CBA with the IUOE, Local #280, for years 2020 - 2021 and, further, authorize the City Manager to execute the agreement. Mr. Alvarado seconded. Motion carried unanimously. MISCELLANEOUS DISCUSSION: • Mr. Zabell stated the Pasco Police Department received National Accreditation through CALEA. The effort took over a year to complete and the Department was required to comply with nearly 400 standards. • Mr. Zabell provided an update on the City Hall remodel project stating the Council Chambers received new carpet and the new one-stop permit center was underway. EXECUTIVE SESSION: Council adjourned to Executive Session at 8:02 PM for approximately 13 minutes to consider acquisition of real estate attended by the City Manager, City Attorney, and Deputy City Manager. Councilmember Martinez excused himself from the session for personal business. Mayor Watkins called the meeting back to order at 8:15 PM. ADJOURNMENT. DISCUSSION: Page 11 of 22 Proclamation “Older Americans Month” May 2019 WHEREAS, the City includes a community of older Americans who enrich our community through their diverse life experiences; and WHEREAS, the City is committed to strengthening our community by connecting with and supporting older adults, their families, and caregivers and acknowledging their many valuable contributions to society; and WHEREAS, the City recognizes the importance of bringing together all generations and engaging in activities that promote physical, mental and emotional well-being for the benefit of all; and WHEREAS, the City can enhance the lives of older Americans in our community by: • Promoting home and community-based services that support independent living; • Involving older adults in community planning, events, and other activities; and • Providing opportunities for older adults to share their experiences. REFERENCE(S): Proclamation II. ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: Council to present Proclamation to Joe Robles, Public Works Construction Inspector. III. FISCAL IMPACT: IV. HISTORY AND FACTS BRIEF: Public Works Week started in 1960 as an annual way to energize and educate the public on the importance of public works to their daily lives: planning, building, managing and operating at the heart of local communities to improve everyday quality of life. “It Starts Here” is the theme for the 2019 National Public Works Week. This theme represents the many facets of modern civilization that grow out of the efforts put forth by the public works professionals. What starts here? Infrastructure starts with public works. Growth and innovation starts with public works. Mobility starts with public works. Security starts with public works. Healthy communities start with public works. The bottom line is that citizens' quality of life starts with public works. Here at Pasco City hall, there will be an exhibit for citizens to see the public works equipment that is used daily, along with information on what Public Works does for the City. We also take this opportunity to appreciate and encourage our Public Works employees for all of the hard work they do for the citizens, businesses and visitors of Pasco. V. DISCUSSION: Page 13 of 22 cÜÉvÄtÅtà|ÉÇ “Public Works Week” May 20-26, 2019 WHEREAS, public works services provided in our community are an integral part of our citizens’ everyday lives; and WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation of public works systems and programs such as water, sewer, streets and highways, public buildings, and solid waste collection; and WHEREAS, the health, safety, and comfort of this community greatly depends on these facilities and services; and WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design, construction and continued maintenance is vitally dependent upon the efforts and skill of public works employees; and WHEREAS, the efficiency of the qualified and dedicated personnel who staff public works departments is materially influenced by the people’s attitude and understanding of the importance of the work they perform; NOW, THEREFORE, I, Matt Watkins, Mayor of the City of Pasco, Washington, do hereby proclaim May 20-26, 2019 as “Public Works Week” in the City of Pasco, and call upon all citizens and civic organizations to acquaint themselves with the challenges and diversity of public works projects and operations, and to recognize the contributions which public works employees make every day to our health, safety, comfort, and quality of life. REFERENCE(S): Map Ordinance II. ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: MOTION: I move to adopt Ordinance No. _____________ Requiring Construction of Utility Facilities as a Prerequisite to Development of Property. III. FISCAL IMPACT: None IV. HISTORY AND FACTS BRIEF: On August 31st 2018, the City received an Application for Developer Reimbursement Agreement (Latecomers Agreement) by Mr. Robert & Michelle Kiddy for a water main line extension to be constructed along parcel #119-101-170. RCW 35.91.020 permits a contract for such reimbursement of utility improvements for development property upon an owner’s request, only in a location where a municipality’s ordinances require the facilities to be improved or constructed as a prerequisite to further property development. In satisfaction of this requirement of RCW 35.91.020, this Ordinance specifically states such requirement. The Public Works Department considers the above mentioned Application to be complete to process in establishing the benefiting property being parcel #119-092-036 for repayment in accordance with RCW 35.91.020 and Pasco Municipal Code 14.12.030. The reimbursement is based on acreage. V. DISCUSSION: Page 15 of 22 Pursuant to the requirements established in RCW 35.91.020, we recommend that the City adopt an Ordinance requiring the water main line extension be constructed as a prerequisite to further property development. This item was discussed at the May 13, 2019 Council Workshop. Page 16 of 22 Page 17 of 22 ORDINANCE NO.__________ AN ORDINANCE of the City of Pasco, Washington Requiring Construction of Utility Facilities as a Prerequisite to Development of Property WHEREAS, developers have made application for the development of certain real property known as Parcel Number 119101170, located within the municipal boundaries of the City of Pasco (“Property”); and WHEREAS, the City of Pasco has identified that there is a necessity for municipal water facilities at a location adjacent to the Property that must be constructed prior to the development of the Property; and WHEREAS, the City has identified potential development of other real property that may benefit from the water facilities described herein; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City of Pasco requires the following municipal water facilities to be constructed as a pre-requisite to development of the property described above: Installation of 180 linear feet of 8” Class 52 Ductile Iron Pipe beginning at the intersection of Road 48 and Walker Way extending north and terminating at the northern property line of parcel #119101170, along with appurtenances to include two 8” gate valves, one 6” gate valve, and one fire hydrant assembly. Section 2. This Ordinance shall take full force and effect five (5) days after its approval, passage, and publication as required by law. HISTORY AND FACTS BRIEF: Currently, Section 10.65.070 of the Pasco Municipal Code prohibits parking of motor vehicles between the hours of 11:00pm and 5:00am on city-owned parking areas, specifically two parking lots associated with the former City Hall. With risks presented by unattended vehicles overnight or camping under the Farmer’s Market roof structures, redevelopment of the Market structures and Park, as well as an increase in the number of formal events occurring at Peanuts Park, staff requests that section 10.65.070 of the Pasco Municipal Code be amended to include the parking area at Peanuts Park. Page 20 of 22 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, AMENDING SECTION 10.65.070 OF THE PASCO MUNICIPAL CODE, PROHIBITING OVERNIGHT PARKING IN SPECIALLY IDENTIFIED LOTS. WHEREAS, public parking lots within the City of Pasco serve the need for parking of vehicles during daytime hours WHEREAS, future redevelopment plans for certain sites within the Pasco Central Business District will require clear and secure access to property. WHEREAS, in the interest of public safety, sanitary conditions, and overall appearance; THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That Section 10.65.070 of the Pasco Municipal Code entitled “Overnight Parking Prohibited – City Lots” shall be hereby amended and read as follows: 10.65.070 OVERNIGHT PARKING PROHIBITED – CITY LOTS Parking in the following City parking lots shall be limited to two hours in duration between the hours of 11:00 p.m. and 5:00 a.m.: The City parking lot located south of the alley between Bonneville and Clark Streets and north of Clark Street and lying approximately mid-block of Fourth Avenue and west of Third Avenue. The City parking lot located south of Clark Street and north of the alley between Lewis and Clark Streets and lying approximately mid-block east of Fourth Avenue and west of Third Avenue. [Ord. 3105 § 3, 1995; Code 1970 § 10.52.070.] The City parking lots located at the northeast corner of the intersection of South 4th Avenue and West Columbia Street, also commonly known as the Pasco Farmers’ Market and/or Peanuts Park. Section 2. This ordinance shall take full force and effect five (5) days after it approval, passage, and publication as required by law.
