ROLL CALL Board Members Present C. ADOPTION OF MINUTES D. HEARINGS Administration of Oaths Hearings Scheduled CEB2019-0530 2021 ROAD 64 - KELTON C & CLORISSA C ORCHARD, owner NICHOLAS POTVIN, Code Enforcement Officer Description: Dust blowing off this property into neighboring properties while recreational vehicles are being driven in the rear yard. (Repeat) PMC 9.125.030 Violation: Allowing blowing (fugitive) dust to leave the property. Corrective Action: Treat all exposed and/or disturbed soils with an approved dust control treatment (i.e. hydro seed, mulch, landscaping, sprinkler, etc.) to prevent blowing dust from leaving the property. Description: Off road vehicles operating on your property are exceeding allowable decibel levels. PMC 9.130.030 (3) (1) Violation: Construction noise being made between the hours of 10 p.m. and 7 a.m. Corrective Action: Discontinue all construction activities that cause noise which can be heard by any neighboring resident between the hours of 10 p.m. and 7 a.m. Description: Off road vehicles operating on your property are creating noise which is intruding upon seperate neighboring residences in excess of allowable decibel limits. (Repeat) PMC 9.130.040 (1) (A) Violation: Causing or permitting noise to intrude into the property of another person which noise exceeds the maximum permissible noise levels. Corrective Action: Reduce the volume of sound producing equipment (television, radio, speakers etc.) to less than 55 dBA between the hours of 7 am - 10 pm and below 45 dBA between the hours of 10 pm - 7 am. Note: The City of Pasco would be pleased to assist you in regulating your devices to appropriate noise levels. CEB2019-0620 820 S 5TH AVE - MARGARITA MARTINEZ, owner Rosanna Johnson, Code Enforcement Officer Description: Failure to obtain L&I electrical permits and City of Pasco building permits to convert or demolish the improvements within the rear yard shed, replace the roof on the rear yard shed, demolish or repair & permit CEB Agenda Page I of 2 the garage structure, add a bathroom to the main house, remodel the main house, and add a fence to the rear of the property. (REPEAT) PMC 16.05.010 Violation: Failure to secure a City of Pasco building permit where a permit is required (IBC 105.1 and IRC 105.1). Corrective Action: Discontinue all construction activities and submit an application for a building permit from the City of Pasco (call (509) 543-5721 for information on permit requirements). If no permit can be obtained, unpermitted construction must be removed. Description: Failure to obtain a City of Pasco rental license for this residential property. PMC 5.60.010 Violation: A City of Pasco rental license is required for all rental dwelling unit(s). Corrective Action: Obtain a City of Pasco rental license. Call (509) 545-3402 for more information or visit http://www,pasco-wa.gov/192/Business-Licenses for more information. Description: Failure to obtain or submit an approved passing habitability inspection of this residential dwelling unit prior to renting to the public. PMC 5.60.030 Violation: A certificate of inspection is required to be submitted to the City for all rental dwelling unit(s). Corrective Action: Submit a certificate of inspection for the rental dwelling unit(s) (call (509) 543-5743 to schedule a habitability inspection or submit an approved HUD inspection report). Description: Dilapidated garage/shop. Exterior materials are not approved, not weatherproof and are deteriorating. (REPEAT) PMC 9.90.040 (11) Violation: Any unsightly building, billboard, fence, excavation, or other structure, or any abandoned or partially destroyed building, fence, excavation or structure, or any building, fence, excavation or structure commenced and left unfinished. Corrective Action: Make necessary repairs to building(s), billboard(s), fence(s) and/or other dilapidated structures, complete structure or excavation or demolish and lawfully remove structure(s) from the property. Description: Failure to abate all nuisances on this property as outlined in notices to you when you previously owned it and to the last owner of record. (Copies enclosed) PMC 9.90.070 Violation: Failure of the successive owner of this property to abate a continuing nuisance upon or in the use of such property caused by a former owner. Corrective Action: Abate all nuisances created by the former owner(s) of this property. Each successive owner of the property is liable in the same manner as the owner who created it.
