HEARINGS Administration of Oaths Hearings Scheduled CEB2018-1715 NKA EAST B CIRCLE - REFUGIO M RAMIREZ (ETUX), owner Rosanna Johnson, Code Enforcement Officer Description: Failure to obtain a final passing inspection for construction of the galvanized fence on site. Abandoned Permit #B13-0072. IRC R109.1.6 Violation: A passing final inspection has not been completed for this building project. Corrective Action: Stop all construction on this project until a City of Pasco building permit has been secured. Contact the building department at (509)543-5726. Description: The property is being used as a junk yard and scrapyard without an active permit. Recreational vehicles have been occupied on site. PMC 25.54.020 Violation: The property is being used for residential habitation or in a way that is prohibited by law. Corrective Action: Immediately discontinue all illegal or residential use of this property in the (1-2) Medium Industrial District. Description: Scrap metal and junk vehicles are not stored behind an 8 foot sight -obscuring fence and/or fence is not a solid single neutral color. PMC 25.54.020 (2) (a) Violation: Goods and materials or not stored behind an 8 foot sight -obscuring fence and/or fence is not a solid single neutral color. Corrective Action: All goods and materials must be stored behind an 8 foot sight -obscuring fence of a solid single neutral color. Building permits are required prior to commencing construction. Contact the Building Department at (509) 543-5721 for further information. Description: Automobile parts, junk or salvage materials or parts thereof are visible from the right-of-way and not stored behind the required sight -obscuring fence. PMC 25.54.020 (2) (b) Violation: Automobile parts, junk or salvage materials or parts thereof are visible from the right-of-way and not stored behind the required sight -obscuring fence. Corrective Action: Automobile parts, junk or salvage materials or parts must not be visible from the right-of-way and must be stored within the required fenced area. Description: Fire lanes are not maintained as required by the IFC. PMC 25.54.020 (2) (c) CEB Agenda Page 1 of 9 Violation: Fire lanes are not maintained as required by the IFC. Corrective Action: Provide fire lanes as required by the (IFC) International Fire Code. Building permits are required prior to commencing construction. Contact the Building Department at (509) 543-5721 for further information. Description: No insurance bond has been provided for use of this property as a scrap or junk yard. PMC 25.54.020 (2) (d) Violation: Failure to obtain, provide proof of, and/or maintain a performance bond. Corrective Action: Obtain and provide proof of a $1,000 performance bond to be in force as long as the use exists. Description: Recreational vehicle within the enclosedfence area appears to be occupied on an overnight basis. PMC 25.69.040 (1) Violation: Occupying recreational vehicle(s) overnight while not in a recreational vehicle park. Residential occupation of any kind is prohibited in the I-2 zoning district. Corrective Action: Discontinue occupancy of all recreational vehicles on the property & properly secure them from entry or remove all from the property. Description: Weeds and debris throughout which poses afire hazard due to the condition of the property. PMC 9.60.030 (16) Violation: Weeds, noxious weeds, grass, and other vegetation which constitutes a fire hazard, encroaches on sidewalks or neighboring properties, is damaging public improvements, impairs the vision of traffic signs or signals, and/or has reached a height of twelve inches (12"). Corrective Action: Eradicate weeds by chemicals, cutting or other acceptable means so that they do not exceed twelve inches (12"), encroach on neighboring properties, constitute afire hazard, etc. Weeds that are cut or removed by the rootmust be removed from the property and lawfully disposed of. Description: Trash, litter and debris is discarded on the property, not disposed of in approved containers or contained in a way that prevents itfrom blowing to adjacent properties or the public right of way. PMC 9.60.030 (6) Violation: Any parcel within the City which is filthy, littered or trash -covered due to placing, dropping, disposing, throwing away, or otherwise discarding litter, garbage, refuse, cans, bottles, paper or paper material, metal, organic or inorganic material on areas of the property other than approved garbage containers. Corrective Action: Remove and lawfully dispose of all litter, garbage, junk or vegetative waste on the property. CEB2019-0167 3101 W RUBY ST - FELIX BUENO, owner NICHOLAS POTVIN, Code Enforcement Officer Description: No business license for 'DIAMOND EMPIRE TRUCKING LLC" at this property. Applicant has failed to respond to requests for additional information. PMC 5.05.020 Violation: Engaging in business within the City of Pasco without a required City of Pasco business license. Corrective Action: Apply for a City of Pasco business license for each business and each individual business location. Discontinue ALL business activities until such time as a business license can be obtained. CEB Agenda Page 2 of 9 CEB2019-0282 3224 W YAKIMA ST - DANIEL AGUIRRE, owner NICHOLAS POTVIN, Code Enforcement Officer Description: Rebuilding vehicles, including vehicle repair and rebuilding motors with the intent to sell. PMC 25.150.020 Violation: Operating a prohibited and unlicensed home occupation. Corrective Action: IMMEDIATELY discontinue all prohibited home occupation activities. Prohibited home occupations include: vehicle repair and/or maintenance, rebuilding motors; painting vehicles; welding; sheet metal shops; upholstering; firewood cutting, any group H Occupancy as defined in the International Building and Fire Code adopted by the City and any other uses that are similar in nature. Description: Noise and vibrations are being generated by the work being done on the vehicles and the delivery of the vehicles by semi -trucks or tow trucks. PMC 25.150.040 (13) Violation: The home occupation is generating light, glare, vibration, fumes, odors, etc. and/or is permitting other conditions which create a public nuisance. Corrective Action: Discontinue all home occupation activities which generate any of the conditions described above. Description: Multiple inoperable vehicles are stored or kept on the property. PMC 25.165.200 (2) (A -D) Violation: Only one (1) inoperable vehicle may be stored outside of a fully enclosed building on the property in any residential zone. The vehicle shall not be stored upon a public right-of-way or in the front or side yard areas of the property. The vehicle must be locked and secured at all times it is unattended and must be stored on an approved hard surface (i.e. gravel, asphalt or concrete) behind a completely enclosed six (6) foot fence, which is fully sight obscuring. All vehicle parts not properly installed upon a vehicle shall be stored inside a fully enclosed building or within the vehicle itself. Corrective Action: Store all inoperable vehicles within an enclosed building (such as a garage or shed). One vehicle may be stored outside an enclosed building in compliance with the provisions above. All other vehicles must be removed from the property or made operable. Unlicensed vehicles are considered inoperable. Any vehicle that cannot legally drive on the road is inoperable Store all vehicle parts in an enclosed building, within the vehicle or remove the parts from the property. CEB2019-0302 5906 W SYLVESTER ST - RAYMOND KRUEGER, owner NICHOLAS POTVIN, Code Enforcement Officer Description: No building permit for the patio cover. PMC 16.05.010 Violation: Failure to secure a City of Pasco building permit where a permit is required (IBC 105.1 and IRC 105.1). Corrective Action: Discontinue all construction activities and submit an application for a building permit from the City of Pasco (call (509) 543-5721 for information on permit requirements). If no permit can be obtained, unpermitted construction must be removed. CEB2019-03171121 W BONNEVILLE ST - JAIME REBOLLEDO, owner Martin Barajas, Code Enforcement Officer Description: Renting basement rooms that have no emergency egress available, in a basement that is not habitable. Hazardous conditions including a kitchen in the basement. Insanitary dwelling including cockroach infestation. Occupancy has never been approved for the basement. IPMC 108.1.3 Violation: Allowing a structure that is in disrepair, lacks maintenance, is insanitary, vermin or rat infested, lacks ventilation or heat, or other essential equipment or is determined to be a hazard for any other reason by the code official to be CEB Agenda Page 3 of 9 occupied. Corrective Action: Vacate the basement, remove the kitchen in the basement, and allow inspection of the entire property for a habitability inspection. Description: Unpermitted improvements including a kitchen and bathroom in the basement. PMC 16.05.010 Violation: Failure to secure a City of Pasco building permit where a permit is required (IBC 105.1 and IRC 105.1). Corrective Action: All unpermitted construction must be removed, including basement kitchen and bathroom. Allow inspection of entire property to confirm compliance. Description: Renting rooms andpart of the property without a City of Pasco rental dwelling license. Non -rental certification is no longer valid after finding of deceased tenant in the basement. PMC 5.60.010 Violation: A City of Pasco rental license is required for all rental dwelling unit(s). Corrective Action: Obtain a City of Pasco rental license. Call (509) 545-3402 for more information or visit http://www.pasco-wa.gov/192Business-Licenses for more information. Description: No Certificate of Habitability Inspection on file for the residential rental dwelling. PMC 5.60.030 Violation: A certificate of inspection is required to be submitted to the City for all rental dwelling unit(s). Corrective Action: Call the undersigned inspector (509) 543-5743 to schedule a habitability inspection of the entire property. Allow inspection of all areas of the property to confirm no other areas are being used for rental habitability purposes. Description: Tenants who might be displaced based on the City's determination that the dwelling or anypart thereof is not habitable, shall be provided with relocation assistance, in accordance with RCW 59.18.085. RCW 59.18.085 (3) (A) The tenant(s) of the unlawful or condemned dwelling(s) are hereby notified that they may be entitled to relocation assistance under this section. CEB2019-0335 1800 1825 & 1905 W LEWIS ST - SOHAL DEVELOPMENT LLC, owner Rosanna Johnson, Code Enforcement Officer Description: Accumulation of mattresses, old furniture and building materials throughout the vacantportion of this building poses afire hazard. IFC 304.2 Violation: Storing flammable or combustible materials and/or rubbish in a way that produces conditions that create a nuisance or hazard to the public health, safety or welfare. Corrective Action: Remove all combustible and/or flammable materials from the property. Description: Broken windows throughout rear of buildingfacing W Bonneville St. Windows are at ground level and accessible by guests of the property and the general public. Window in Room #153 has been broken since December 2018. IPMC 304.13.1 Violation: Windows have cracks, holes or are completely broken out. Corrective Action: Repair or replace all damaged or destroyed windows. CEB Agenda Page 4 of 9 Description: Roof is leaking throughout East end of building. Trees along South side ofbuilding have grown against and damaged the fascia boards and roof trim. IPMC 304.7 Violation: Failure to maintain roof and flashing in sound condition, free of defects which admit rain, adequate roof drainage, roof drains, gutters and downspouts in good repair and free from obstruction and/or roof water drainage is creating a public nuisance. Corrective Action: Repair the roof and flashing so that they are in good sound, tight and do not have defects that admit rain, provide adequate roof drainage to prevent dampness or deterioration in the walls or interior of the structure, maintain roof drains, gutters and downspouts in good repair free of obstructions, route roof water so that it does not discharge in a manner which creates a public nuisance. Trim or remove all trees and vegetation which is causing damage to the structure. Description: Furniture is insanitary and damaged, missing cabinet doors in kitchens and bathrooms, wall installed air conditioners are not sealed or weathertight, wall molding and trim is damaged, damaged ceiling due to water leaks, damaged window handles, and flooring is damaged or missing. IPMC 305.3 Violation: Interior surfaces (i.e. windows, doors, floors, ceilings, etc.) are unsanitary or damaged. Corrective Action: Clean and sanitize all interior surfaces and/or repair peeling, chipping, flaking or abraded paint. Cracked or loose plaster, decayed wood and other defective surface conditions need to be repaired. Surfaces which cannot be repaired must be replaced. Violation: Interior surfaces (i.e. windows, doors, floors, ceilings, etc.) are unsanitary or damaged. Corrective Action: Clean and sanitize all interior surfaces and/or repair peeling, chipping, flaking or abraded paint. Description: Roach infestation throughout the building. (REPEAT) IPMC 309.1 Violation: Failure to exterminate and maintain the structure free from insect and rodent infestation. Corrective Action: Promptly exterminate insect and/or rodent infestation by approved processes that will not be injurious to human health. Maintain structure free of infestation and take proper precautions to prevent re -infestation. The owner is required to submit a written pest control plan prepared by a pest control company, carrying an active City of Pasco business license, and copies of the service ticket. Of units inspected the following showed signs of infestation: 151, 153, 158, 163, 253, 259, 261, 263, 278 CEB Agenda Page 5 of 9 Description: Kitchen ventilation fan is inoperable. IPMC 403.4 Violation: No or inoperable local exhaust ventilation system in the kitchen. Corrective Action: Properly install or repeair local exhaust ventilation system. Air shall be exhausted to the exterior and not be recirculated to any space. Description: Light fixtures are missing covers and/or are unsecured. IPMC 605.1 Violation: Failure to maintain electrical equipment, wiring and appliances in a safe and approved manner. Corrective Action: Repair or replace any defective electrical equipment, wiring and/or appliances which are not maintained in a safe and approved manner. Violation: Failure to maintain electrical equipment, wiring and appliances in a safe and approved manner. Corrective Action: Repair or replace any defective electrical equipment, wiring and/or appliances which are not maintained in a safe and approved manner. Description: Smoke detector is not mounted and/or missing backup battery and not connected to the building alarm system. IPMC 704.2 Violation: Failure to provide smoke detector in all required habitable areas. Corrective Action: Install smoke detector in all habitable spaces as required: outside of each separate sleeping area in the immediate vicinity of bedrooms, in each bedroom and in each story within the dwelling unit including basement. Description: Failure to have all fire extinguishers inspected on an annual basis - extinguishers expired May 2018. (REPEAT) NFPA 10: 7.3.2.1 Violation: Failure to have all fire extinguishers inspected on an annual basis. Corrective Action: Cause an inspection of each fire extinguisher to occur annually. Description: Unpermitted use of this property as a long term rental dwelling building (30+ days continuous occupation of the premises). PMC 25.100.020 Violation: Operating or allowing an unpermitted use in a C-3 Zoning District. Corrective Action: Discontinue all unpermitted uses of this property. The following have been identified as units occupied on a long term basis (30+days): 152, 156, 162, 169, 173, 176, 250, 252, 254,258,262,264,273,274,280,289,261 Description: Weeds, tumbleweeds, accumulations ofpine needles & leaves throughout landscaping areas on this property. PMC 25.180.110 (1) Violation: Failing to maintain landscaping and/or screening free of weeds and trash and not providing, protecting, and permanently maintaining all landscaping material, areas and plants in a healthy, growing condition, replacing it when necessary. Corrective Action: CEB Agenda Page 6 of 9 Remove and lawfully dispose of all weeds and trash and replace any dead/dying plants and other vegetation. Maintain landscaped areas in compliance with the provisions described above. Description: This property is not licensed to offer longterm rental dwelling units. PMC 5.60.010 Violation: A City of Pasco rental license is required for all rental dwelling unit(s). Corrective Action: Thi property is zoned C-3. A special permit has not been obtained to allow long term rental housing. Vacate all units per the Washington State Landlord Tenant Laws until such time as a special permit, rental license and passing habitability inspection have been obtained or use the property for the current intended, licensed purpose (motel). Description: Allowing hazardous conditions, as noted in these violations to remain on the property which pose a hazard to the occupants and guests of the property. (REPEAT) PMC 9.90.030 (4) Violation: Rendering other persons, in any way, insecure in life or the use of property. Corrective Action: Discontinue all actions which are causing others to be insecure in the use of their property. CEB2019-0340 808 S 5TH AVE - JOANN FARRIS, RAYMOND FARRIS, owner Rosanna Johnson, Code Enforcement Officer Description: Exterior siding is damaged, missing, and rotten. Door has been removed and structure is not maintained weatherproof. IPMC 302.7 Violation: Accessory structures (shed, detached garage, fence, walls) are dilapidated. Corrective Action: Make repairs to structure(s) as necessary and maintain structurally sound and in good condition or demolish. Obtain required building permits prior to construction or demolition. Description: Modifications made to the main house breaker panel without proper permits from Labor & Industries (added flex wire directly to breaker panel). IPMC 605.1 Violation: Failure to maintain electrical equipment, wiring and appliances in a safe and approved manner. Corrective Action: Repair or replace any defective electrical equipment, wiring and/or appliances which are not maintained in a safe and approved manner. Description: Oil throughout public right of way (street and planting strip) must be properly cleaned. (REPEAT) PMC 10.65.020 (1) Violation: Causing or allowing to be dropped from any vehicle or the machinery thereof, any oil, grease or similar substance upon the streets or alleyways of the City. Corrective Action: Discontinue allowing any vehicular liquid discharge onto City streets or alleyways. Description: Unlicensed vehicles being stored on the public street. PMC 10. 65.020 (3) Violation: Parking of unlicensed vehicles on the City streets. Corrective Action: Properly register and license all vehicles, affixing required stickers and plates or remove all unlicensed vehicles from the City streets within 24 hours from the date of notification. Description: Storage of a recreational trailer on the street in front of this propertyfor more than 72 hours and CEB Agenda Page 7 of 9 not for the purpose of loading or unloading. PMC 10. 65.020 (4) Violation: Storing or maintaining any boat, motor home, camp trailer, trailer, fifth wheel, pickup camper, snowmobile, or utility trailer, etc. as defined in Title 25 on any public street, right-of-way, or other public areas. Corrective Action: Discontinue storage on the street of any of the types of vehicles except such items may be parked in public right-of-way in front of an owners property for a period of seventy-two hours in any given two-week period for loading and unloading purposes. Description: Planting strip which is being used to store junk, debris, and park vehicles has been covered with gravel. Planting strip must be covered with 100% live vegetation. PMC 12.12.040 Violation: Failure of the owner, occupant or person having control of any real property is to maintain all vegetation in a healthy and live condition on the planting strip or the drainage swale abutting the property. Corrective Action: Restore/replace all vegetation in planting strip/swale to alive and healthy condition. Maintain planting strip and Swale in this manner at all times. Description: Using the planting strip to park and store vehicles. PMC 12.12.070 (3) Violation: Parking or placing of motor vehicles, recreational equipment or vehicles, building materials, dead vegetation or any other items with the exception of grass, shrubs or trees (as permitted) in the planting strip or drainage swale. Corrective Action: Remove all items such as those listed above from the planting strip/drainage swale and discontinue parking vehicles in these areas. Maintain area free from debris, unpermitted items and vehicles at all times. Description: Unpermitted home occupation (recycling and metal salvage). (REPEAT) PMC 25.150.020 Violation: Operating a prohibited and unlicensed home occupation. Corrective Action: IMMEDIATELY discontinue all prohibited home occupation activities. Description: Using this R-2 zoned propertyfor an unpermitted use (junk yard, vehicle scrapping, etc). PMC 25.60.020 Violation: Unpermitted use of a property in a R-2 Zone. CEB Agenda Page 8 of 9 Corrective Action: The following uses are permitted: single-family dwellings, new factory assembled homes, two-family dwellings and multiple dwellings. Discontinue ALL unpermitted uses on this property. Description: Plywood throughout rear yard is not neatly stacked. PMC 9.90.040 (10) Violation: Trash, litter, rags, accumulations of empty barrels, boxes, crates, packing cases, mattresses, bedding, excelsior, packing hay, straw, or other packing material; lumber or scrap metal not neatly piled or anything which may be a fire danger. Corrective Action: Remove and lawfully dispose of all trash, litter, and other debris which is not neatly piled and/or which is a fire danger. Description: Property is being used as a junk yard to store inoperable vehicles, junk vehicles, debris and auto parts. (REPEAT) Damaged, dilapidated chainlink fence and gate along rear ofproperty adjacent to the alley. Hot tub is damaged and no longer in use, must be removed from the property. PMC 9.90.040 (12) Violation: All places used or maintained as junkyards, or dumping grounds, or for the wrecking or disassembling of automobiles, trucks, tractors, or machinery of any kind, or for the storing or leaving of worn-out, wrecked or abandoned automobiles, trucks, tractors, or machinery of any kind, or of any of the parts thereof, or for the storing or leaving of any machinery or equipment used by contractors or builders or by other persons. Corrective Action: Discontinue wrecking or disassembling automobiles, trucks, etc. Remove and lawfully dispose of all wrecked or abandoned vehicles, machinery, etc. along with any parts thereof. Discontinue the storage of heavy machinery or equipment (i.e. front end loaders, dump trucks, backhoes, etc.) at this property. Amendments Dismissals Motion E. STAFF REPORT AND OTHER BUSINESS F.
