HomeMy WebLinkAbout4419 Ordinance ORDINANCE NO. 4/ (71/ AN ORDINANCE of the City of Pasco, Washington, Amending PMC Section 9.15.070 "Reckless Endangerment" WHEREAS,the City of Pasco has defined reckless endangerment in the second degree in Section 9.15.070; and WHEREAS,the Washington State Legislature,through revisions to Chapter 9A.36 of the Revised Code of Washington, changed the definition of reckless endangerment in the second degree to be referred to as reckless endangerment, and has revised the definition of reckless endangerment in the first degree to be referred to as "Drive-by shooting"; and WHEREAS, the City Council of the City of Pasco desires to amend Section 9.15.070 of the Pasco Municipal Code to accord with the State law regarding reckless endangerment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That Section 9.15.070 of the Pasco Municipal Code entitled "Reckless Endangerment in the Second Degree" shall be and hereby is amended and shall read: 9.15.070 RECKLESS ENDANGERMENT IN THE SECOND DEGREE. A person is guilty of reckless endangerment in the second degree when he or she recklessly engages endangers, in conduct not amounting to - - - .. --- -- •- -- • -- conduct as defined by RCW 9A.36.045—Drive-by shooting;but which that creates a substantial risk of death or serious physical injury to another person. Reckless endangerment is a gross misdemeanor. (Ord. 3484 Sec. 2, 2001.) Section 2. This Ordinance shall take full force and effect five (5) days after its approval, passage and publication as required by law.
