The motion carried unanimous ly. 0. DETERMINATION HEARINGS : Chairperson Gottsch alk exp lained the procedure and purpose for the meeting, noting that th e Ci ty of Pa sco was the Petitioner and property owners and their authorized representatives w ho had appeared to di scuss th e a ll eged v iolations of the Pasco Municipa l Code were the Respondents . a. H earings i. City of Pasco vs. Ramirez, Refugio cas e number CEB2018-l 715, for the prop e rt v located at 1715 East B C ircl e Troy Hendren, In s p ect ion Se r vices Manager, asked Code Enfo rcement Officer, Rosanna Johnson , to read the case fact s into the record. Ms. Johnson indicated that the ci ted v iolations on thi s property were IRC R 109 .1.6 -Failure to obtain a fin a l pa ssi ng in s pection for constru c ti on of the galvanized fe nce on sit e, PMC 25.54.020 -Junk ya rd and scrap ya rd without an acti ve permi t and recre a t ional vehicle s have been occupied o n si te, PMC 25.54.020(2)(a) -Scrap metal a nd junk vehicles a re not stored behind an 8 foot sight-o b scuring fence and/or fence is not a so li d sin g le n eu t ra l c o lor, PM C 25.54.020(2)(b) -A utomobi le parts, junk or salvage materia ls or part s thereof a re v isible from the right of way and not stored b ehind the requ ired sight obscuri ng fence , PMC 25 .54.0 20(2)(c) -Fire lanes a re not ma intained as required by th e IFC, PMC 25 .54.020(2)(d) -No insurance b ond has been provided for use of thi s property as a scra p or junk yard , PMC 25.69.040( l ) -Recr eational ve hi c le within t he enclosed fen ce area appears to be occupied on an overnight bas is, PMC 9.60 .030( 16 ) -W ee d s a nd debri s throu ghout which poses a s a fire haza rd , e ncroaches o n s idewal ks or ne ighboring properties, is d amaging publ ic improvement s, impa irs the v ision of traffic signs or s ignal s and/o r has reached a h e igh t of 12 inches and PMC 9.60.030(6) -Tras h , litt er and de bri s is discarded on the property, no t disposed of in approved cont a iners or contained in a way that prevents it from b low in g to adjacent properties or the pub lic right of way. Ms. Johnson di scussed the notification process fo r v iolations observed, previous notice s sent and v iol a ti ons o n th is property. Ba sed on a fin a l ins pection of the prope rt y completed o n D ecember 6 , 2018, the property wa s still in v iolati o n of th e Pa sco Munic ipal Cod e according to staff. 12 06 20 18 CEB Mi nutes Page 1 of 2 The City of Pasco recommended giving the respondent 10 days to correct any remaining violations on the property or pay a penalty of $200 per day for 10 days. CODE BOARD DECISION: Board Member Speer moved, seconded by Board Member Gutierrez, that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Speer moved, seconded by Board Member Gutierrez, to require monthly inspections determining minimum level of compliance of the cleanup with the Building Inspector determining the compliance with a final compliance date of April 1, 2019 or the re spondent shall pay a daily penalty of $400 per day for 10 days . The motion carried unanimously. b. Amendments c. Di smissals d. Motion Board Member Speer made a motion to approving Resolution No. 2018-011 , Board Member Granbois seconded. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: F.
