GRANTOR, DAHAVA FINANCIAL LTD PARTNERSHIP, for good and valuable
consideration, the receipt of which is hereby acknowledged, hereby grants to the GRANTEE, City of
Pasco, Franklin County, Washington, a Municipal Corporation, and to its successors or assigns, the right
to enter upon and occupy the lands of the Grantors situated in the County of Franklin, State of
Washington, and more particularly described as follows:
AN EASEMENT FOR SIDEWALK AND TRAFFIC SIGNAL PURPOSES LOCATED IN THAT
PORTION OF THE NORTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 30,
TOWNSHIP 9 NORTH, RANGE 30 EAST, PASCO, FRANKLIN COUNTY, WASHINGTON,
DESCRIBED AS FOLLOWS:
BEGINNING AT THE POINT OF INTERSECTION OF WEST COURT STREET AND NORTH 20TH
AVENUE RIGHT OF WAY CENTERLINES, BEING THE NORTHWEST CORNER OF SAID
SECTION; THENCE S89°01'01"E A DISTANCE OF 40.00 FEET ALONG THE CENTERLINE OF
SAID WEST COURT STREET; THENCE S00°24'10"W A DISTANCE OF 40.00 FEET TO THE
INTERSECTION OF THE SOUTH RIGHT OF WAY LINE OF WEST COURT STREET AND THE
EAST RIGHT OF WAY LINE OF NORTH 20T" AVENUE AND THE TRUE POINT OF BEGINNING;
THENCE CONTINUING S00°24' 10"W ALONG THE EAST RIGHT OF WAY LINE OF NORTH 20TH
AVENUE A DISTANCE OF 41.40 FEET TO A POINT ON SAID LINE AND THE BEGINNING OF A
CURVE TO THE RIGHT HAVING A RADIUS POINT BEARING S82001'02"E AND A DISTANCE
OF 47.60 FEET; THENCE ALONG A CURVE TO THE RIGHT HAVING A DELTA OF 75°35'06", A
RADIUS OF 47.60 FEET AND A LENGTH OF 62.79 FEET TO A POINT ON THE SOUTH RIGHT
OF WAY LINE OF WEST COURT STREET; THENCE N89°01'01"W A DISTANCE OF 41.52 FEET
ALONG THE SOUTH RIGHT OF WAY LINE OF SAID WEST COURT STREET TO THE TRUE
POINT OF BEGINNING.
SAID EASEMENT CONTAINING 462.0± SQUARE FEET.
SUBJECT TO RESERVATIONS, RESTRICTIONS, RIGHTS-OF-WAY AND EASEMENTS OF
RECORD.
and to install a traffic signal pole with luminarie and to construct curbs, gutters and sidewalks, and to
exercise such other rights as necessary to carry out these purposes.

The Grantor agrees that all facilities installed upon the above-described land shall remain the
property of the Grantee, and that the Grantee shall have the right of reasonable ingress and egress over
the adjacent lands of the Grantors for the purpose of exercising all rights hereby granted.
This Agreement is exclusive to the Grantee, touching and connecting the above-described real
property and shall run with the land.
In the event of any claim or dispute arising out of this Agreement, venue shall be placed in
Franklin County Superior Court, and an award of reasonable attorney fees hall L C ma to
