HomeMy WebLinkAboutMiddleton Six Sons FW-1091 Addendum No. 1ADDENDUM NO. 1 CITY OF PASCO Agricultural Lease No. FW -1091 THIS ADDENDUM is entered into this day ofa�K�2017, by and between the City of Pasco, Washington, a Municipal Corporation, heUinafter referred to as "Lessor", and Middleton Six Sons Farms, hereinafter referred to as "Lessee." WHEREAS, the parties have previously entered into that certain Agricultural Lease No. FW -1091, dated April 5, 2017. NOW, THEREFORE, in consideration of the mutual covenants provided herein, the parties agree as follows: 1. That Section 4 entitled "Rent", subsection (b), shall be amended and shall read as follows: "(b) Total rent includes Washington State Leasehold Tax in the amount of 12.84% which Lessor shall deduct from total rent payment and remit to State. [Total rent of $89,600 = actual rent of $79,404.47 + 12.84% tax of $10,195.531 2. All remaining terms of the Agricultural Lease No. FW -1091 to the extent that they are not in conflict with any of the provisions of this Addendum No. 1, shall remain in full force and effect and be fully enforceable by either party.
