Some questions require consideration by Council over time and after a deliberative process with input from a number of different sources; some questions are best directed to staff members who have access to specific information. Citizen comments will normally be limited to three minutes each by the Mayor. EXECUTIVE SESSION: Council adjourned to Executive Session at 7:38 p.m. for approximately 20 minutes to consider acquisition of Real Estate, establish sales price or lease amount of Real Estate and discuss collective bargaining strategy and proposals with the City Manager, Deputy City Manager and City Attorney. Mayor Watkins returned to Council Chambers and noted the Executive Session would continue for an additional 10 minutes. REFERENCE(S): Proposed Interlocal Agreement II. ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: 7/6/2018: Discussion 7/16/2018: MOTION; I move to approve the Interagency Agreement with the Pasco School District for police resource officers services for the 2018-19 and 2019-20 school years and, further, authorize the City Manager to sign the agreement. III. FISCAL IMPACT: 2018-2019 City Funds: $450,504.00 2019-2020 City Funds: $457,848.00 Per the terms of the proposed agreement, the Pasco School District will reimburse these costs. IV. HISTORY AND FACTS BRIEF: School Resource Officers (SRO) are full-time uniformed police officers primarily dedicated to providing law enforcement resource services to assigned schools and surrounding neighborhoods. SRO are assi gned to work at their assigned school for eight hours each scheduled school day. SRO are assigned to work normal patrol duties when school is not in session. The City and Pasco School District (PSD) have enjoyed a long-time partnership on many issues impacting the community, including the housing of SRO at some of the public schools through an Interlocal Agreement (ILA). The previous ILA pertaining to SRO expired at the end of the most recent academic Page 12 of 123 year. V. DISCUSSION: The Police department and PSD continue to see value in the program and desire to continue the program. The proposed ILA provides five SROs, one each at McLoughlin Middle School, Ochoa Middle School, Stevens Middle School, Pasco High School and Chiawana High School. The proposed ILA is a two-year agreement effective August 2018 through June 2020. Similar to the terms of the previous ILA, the PSD would reimburse the City for the salary and fringe benefits costs for five (5) officers at the top salary level for police officer for 180 school days per year (8 hours per school day). The City would fund the balance of salary and benefits of the officers for the remainder of the year, and all other costs associated with their employment, including; overtime, equipment, training, administrative and overhead costs. Page 1 of 9 WHEN RECORDED RETURN TO: City of Pasco, Washington 525 North 3rd Pasco WA 99301 INTERLOCAL AGREEMENT for SCHOOL RESOURCE OFFICER Between PASCO DISTRICT NO. 1 and CITY OF PASCO, WASHINGTON THIS INTERLOCAL AGREEMENT is made and entered into this ______ day of August, 2018, by and between the Pasco School District No. 1, hereinafter referred to as "District", and the City of Pasco, Washington, a Municipal Corporation, hereinafter referred to as "City. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the Parties agree as follows: 1. Purpose. It is the purpose of this Agreement to: A. Enhance the safety and security of students, teachers, staff, and visitors and provide patrol of the various campuses of the District located within the City of Pasco, Washington. B. Provide for the presence of armed and uniformed City Police Officers both inside and outside the school buildings on selected campuses of the District during certain school hours in support of such safety and security and the maintenance of a secure and peaceful learning atmosphere. C. Provide for prevention, intervention, and prompt effective enforcement by the City's Police Department in situations involving, but not limited to: 1) Maintenance of order; 2) Use, possession, or sale of illegal drugs and alcohol on school premises; 3) Crimes against persons; 4) Crimes against property; and Page 14 of 123 Interlocal Agreement between Pasco School District No. 1 and the City of Pasco. Page 2 of 9 5) Any other situations or activities which require the intervention of law enforcement officers. D. Provide for participation by police officers in the educational activities and role modeling to foster and enhance knowledge of and respect for law enforcement and law enforcement officers by students and the community. E. Provide positive and supportive interface between law enforcement representatives and the District's substance abuse, harassment and bullying prevention efforts including, but not limited to Natural Helpers, Student Assistance Teams, and other intervention and prevention efforts by the District. 2. Statement of Work. The City shall furnish the necessary personnel and services and otherwise do all things necessary for and incidental to the performance of the work stated herein. The City shall: A. Station a full-time uniformed police officer (“School Resource Officer” or “SRO”) at each of the following schools during the 180 days when school is in session during the months of August through June: 1) Pasco High School (8 hours/day). 2) Chiawana High School (8 hours/day). 3) Stevens Middle School (8 hours/day). 4) Ochoa Middle School (8 hours/day). 5) McLoughlin Middle School (8 hours/day) Office space shall be provided as available at each school for the use of the SRO. Such office shall be equipped with one office desk and chair, and one locking cabinet. The City shall provide a lockable cabinet capable of securing police department equipment when not in use by the officer. The SRO will remain an employee of the City. B. The SRO services are provided as in independent contractor and nothing contained herein shall be deemed to make the SRO an employee of the District, nor to empower the SRO to bind or obligate the District in any way. The City is solely responsible for paying all of the SRO's wages and benefits, as well as directs the manner or performances of such service under this Agreement. C. Cooperate with the District to provide training and education to each assigned officer to insure effective communication and interrelation with the school community and its students. Cooperate with the District to monitor and evaluate the effectiveness of the assigned officers and the program. E. Meet as needed during the academic year with the District's representative (as designated by the District) to evaluate the effectiveness of the program; F. Cooperate with the District's representative to investigate and report on any complaints regarding the conduct of an assigned officer, share fully, as permitted by law, with the District's representative all results of such investigations for the purpose of responding to each complaint and cooperate to resolve each complaint. Provided, that it shall be the responsibility of the District to respond to any complaint the District received from a student, parent or patron of the District and communicate the results of any investigation to such person or persons. 3. Terms and Conditions. All rights and obligations of the parties to this A greement shall be subject to and governed by the terms and conditions contained in the text of this agreement. 4. Period of Performance. Subject to its other provisions, the period of performance of this Agreement shall commence on August 1, 2018, and shall expire on the 30th day of June, 2020, unless terminated sooner as provided herein. The District's representative shall provide the Chief of Police with a school-year calendar annually. The principal of each building shall be responsible for notifying the Chief of the City’s Police Department of the school site calendar, schedule of events and activities, and any changes in the same. The principal shall determine the specific hours when an officer shall be present within the limits set forth in Section 2.A of this Agreement. 5. Selection and Transfer of School Resource Officers. A. The Chief of Police or designee shall conduct an internal selection process and provide the school principal of the school to which the officer will be assigned the names of suitable qualified candidates. The principal and/or District representative shall interview and select the SRO considering the following criteria: 1) Ability to deal effectively with students. 2) Ability to present a positive image and symbol of the entire police agency and to foster a positive image of police officers among young people. 3) Sincere desire to work with the staff and students at a particular school to which he/she is assigned. 4) Ability to provide quality educational services and/or resources in Page 16 of 123 Interlocal Agreement between Pasco School District No. 1 and the City of Pasco. Page 4 of 9 the area of law enforcement. The education, background, experience level, and communication skills of the SRO must be of high caliber so he/she can effectively provide resource teaching services when requested. 5) Ability and desire to work cooperatively with the principal and school staff. B. To transfer a SRO from his/her position at an assigned school, the following procedures will apply: 1) The principal will recommend to the Superintendent or designee that the SRO be removed from the program at the school, stating the reasons for the recommendation in writing. Within a reasonable period of time after receiving the written recommendation, the Superintendent or designee will meet with the Chief of Police or designee to mediate or resolve any problem that may exist between the SRO and the staff at the assigned school. With the agreement of the Superintendent and Chief of Police or their designees, the SRO and specified school staff may be required to be present at the resolution meeting. If, within a reasonable period of time after the resolution meeting, the problem is not resolved, in the opinion of both the Superintendent and the Chief of Police or their designees, then the SRO will be removed from the program at the school and a replacement will be selected as provided in this Agreement. 2) When the City elects to reassign an SRO to other duties for reasons such as, but not limited to, transfer or promotional opportunities, discipline, resignation/retirement, etc., adequate notice will be provided to the District and a replacement will be selected as provided in this agreement. 3) The City and the District will schedule regular meetings with their representatives to review the SRO program and address any issues or concerns. 6. Payment. A. The District shall reimburse the City for its actual costs of employment of the SRO, and shall be that amount determined by negotiated wage agreements between the City and the Police Officer's Collective Bargaining Unit. Included in the reimbursement amounts listed below are the 3.5% non-LEOFF employer billings for DRS in compliance with RCW 41.26.450. 1) For the period of August 1, 2018, through June 30, 2019, the District shall reimburse the City for the salary and benefit expenses to employ the five assigned officers for 180 days, or 7,200 hours for an estimated amount of $450,504.00; and Page 17 of 123 Interlocal Agreement between Pasco School District No. 1 and the City of Pasco. Page 5 of 9 2) For the period commencing on August 1, 2019, through June 30, 2020, the District shall reimburse the City for the salary and benefit expenses to employing the five officers for 180 days, or 7,200 hours for an estimated amount of $457,848.00. B. Actual amounts are to be determined by the parties based upon any negotiated wage increase between the City and the police officer's collective bargaining unit and the officers assigned. The City and the District will share equally the cost of any training received by the officer that is specific to school resource officer services. C. Due to early release days and other regularly scheduled non-school days when an officer's presence is not required for a full eight (8) hours, in consideration for compensation as stated in section 4 above, the City agrees to provide officers during the school year for activities outside of the regularly scheduled school assignment. Requests for an officer's presence at school activities outside of the officer's regularly scheduled school assignment during the school year will be compensated separately at the estimated rate of $65.49 per hour for 2018, $66.80 per hour for 2019, and $68.13 per hour for 2020. 7. Billing Procedure. The City shall submit a monthly invoice or billing statement to the District. Payment shall be made to the City according to the regular procedures of the District. 8. Non-discrimination. In the performance of this agreement, the District and the City shall comply with the provisions of Title VI of the Civil Rights Act of 1964 (42 USC 200d), Section 504 of the Rehabilitation Act of 1973 (29 USC 7904) and Chapter 49.60 RCW, as now and hereafter amended. Both shall not, except as they may be specifically allowed by laws to do so, discriminate on the basis of race, color, national origin, sex, sexual orientation, religion, marital status, age, creed, Vietnam-Era and Disabled Veterans status, or the presence of any sensor, mental, or physical handicap. In the event of non-compliance by either party or refusal to comply with the above provisions this agreement may be rescinded, canceled, or terminated in whole or in part. The non-complying party shall, however, be given a reasonable time in which to cure this non- compliance. Any dispute may be resolved in accordance with the "Disputes" procedure set forth herein. 9. Records Maintenance. The City shall maintain books, records, documents and other evidence that sufficiently and effectively reflect all direct and indirect costs expended in the performance of the services described herein for which they will seek reimbursement from the District. These records shall be subject to inspection , review or audit by the personnel of both parties, other personnel authorized by either party, the Office of the State Auditor and federal officers, if any, so authorized by law. The City and District shall retain all books, records, documents, and other materials relevant to this agreement for five (5) years after expiration. Page 6 of 9 parties shall have full access and the right to examine any of these materials during this five-year period. 10. Responsibilities and Authority of School Administrator. The principal or other administrator designated by the District is responsible for the supervision and daily operations of the school shall, subject to the lawful exercise of the officer's law enforcement responsibilities, schedule, assign and direct the officer's duties under this agreement. The principal is responsible for the investigation of non-criminal incidents that occur at or are related to the school. If the principal finds that he or she or any individual is in physical danger, the principal may request the law enforcement officer to assist him or her. In the case of a search of student property for the violation of District rules or other administrative reasons, the school principal or designated administrator or District employee will conduct the search. Once the principal has reason to believe that a crime has been or may be committed, the principal or other designated administrator shall request the law enforcement officer to assume responsibility. To the extent such action does not preclude the officer from executing his/her legal obligations or jeopardize an ongoing criminal investigation, the building administrator shall have the responsibility to contact and report to parents and patrons regarding activities and findings of the law enforcement officer, where appropriate. 11. Indemnification. Each party shall defend, protect and hold harmless the other party from and against all claims, suits and/or actions arising from any negligent or intentional act or omission of that party's employees or agents while performing under this Agreement. 12. Agreement Alterations and Amendments. The District and the City may mutually amend this agreement. Such amendments shall not be binding unless they are in writing and signed by the personnel authorized to bind the District and the City. 13. Termination. Except as otherwise provided for in this agreement, either party may terminate this agreement by providing sixty (60) days advance written notification to the other party of their intent to terminate the agreement. If this agreement is so terminated, the terminating party shall be liable only for performance, in accordance with the terms of this agreement for performance rendered prior to the effective date of termination. In the event of an unforeseen and dramatic change of conditions which causes the District to exhaust its budgeted funds, PSD can immediately terminate this agreement. 14. Interlocal Agreement Provision. This Agreement is entered into pursuant to RCW 39.34. No special budget or funds are anticipated, nor shall be created. It is not intended that a Page 19 of 123 Interlocal Agreement between Pasco School District No. 1 and the City of Pasco. Page 7 of 9 separate legal entity be established to conduct this cooperative undertaking, nor is the acquiring, holding, or disposing of real or personal property other than as specifically provided within the terms of this Agreement, anticipated. The Chief of Police of the City of Pasco, Washington, shall be designated as the Administrator of this lnterlocal Agreement. This Agreement shall be filed with the Franklin County Auditor, or alternatively listed by subject on either parties' website or other electronically retrievable public source. 15. Savings. Should any portion of this agreement be declared illegal, the balance of the agreement shall remain in full force and effect to carry out the purposes of this agreement. 16. Disputes. In the event that a dispute arises under this agreement, it shall be resolved in the following manner: The Director of Educational Services of the District shall appoint a member to the Dispute Board. The Pasco Chief of Police shall appoint a member to the Dispute Board. The Director of Educational Services and the Pasco Chief of Police shall jointly appoint a third member to the Dispute Board. That person shall act as chairperson, convene the Dispute Board and cause a determination of the dispute, arrived at by a majority of the Board, to be rendered in a timely manner. In the event the parties are unable to agree on a third member of the Dispute Board, that member shall be selected pursuant to RCW 7.04A by a Franklin County Superior Court Judge. The determination of the Dispute Board shall be final and binding on the District and the City. 17. Notices. III. FISCAL IMPACT: 3-year total impact: Federal Grant - $500,000 City Cost Share (General Fund) - $781,192 As indicated, the fiscal impact would be over a period of three years, the length of the grant. After which the positions, if continued, would be funded entirely from the City's General Fund budget at an approximate cost of $450,000 annually in 2018 dollars. The impact to the current year budget, 2018, will be minimal due to the length of the testing, selection process and availability of space in the Basic Law Enforcement Academy. IV. HISTORY AND FACTS BRIEF: At the January 8, 2018 workshop meeting, staff announced that a COPS Hiring Grant had been awarded to the City for the partial funding of four Police Officers. While Council recognized the need for the additional officers and in dicated its overall support for the grant, based on the City Manager's recommendation, Council decided to review this issue more closely at mid-year when the City would have more complete data on current year revenues and in a better position to project trends. Page 23 of 123 V. DISCUSSION: With the continued growth of the city, the correspondingly increased demands for police services, and enhanced police-community relations efforts comes the need for additional staffing in the police department. While current staffing levels have performed well in meeting Council goals and fulfilling its mission, officers are being stretched thin against increasing demands. The addition of four police officers would provide additional depth within the department, improve sustainability of current efforts and allow capacity for potential enhancements to service, all of which are consistent with the recently adopted City Council goal of Community Safety, specifically "Enhancing proactive community policing efforts.” This particular grant also fits into the Council goal of “Continued efforts to improve police/community relations.” As Council will recall, the grant was awarded specifically to work pro-actively in the area of the homeless population. If approved, these positions would be integrated into the patrol work force and assist those officers with this population. This will enhance our community policing by working in the areas, particularly downtown, where the concentration of the homeless population is the highest. These officers would work in conjunction with our Area Resource Officers and Hot Spotters program. The addition of these officers would allow other patrol officers more time to respond to other calls for service and traffic concerns around the city. As to impact, given the length of time it takes for an officer to complete the academy training and subsequent departmental training, an entry level officer hired today would not be fully trained and ready to handle police duties solo until December 2019. As a side note, the next available slots for the Basic Law Enforcement Academy come up in January 2019. If a lateral officer is hired, that officer would be available within a couple of months after completing the equivalency academy and successfully completing the departmental Patrol Training Officer program. If hired today, a lateral officer would be released for full duty in approximately December 2018. As alluded to in the Fiscal Impact section and illustrated immediately above, if authorized it would be months before any of the four positions requested would be in service. The 2018 Fiscal Impact, if any, would be minimal. Council has been previously provided revenue and expenditure reports for the General and other funds. While the fiscal impacts of this proposal will be quite limited in 2018 and most prevalent in the budget years 2019-2021, current revenues and expenditures provide insight as to sustainability of these positions. Year to date General Fund revenues through May continue on an upward trend over previous years reflecting a robust local and national economy. General Fund expenditures are overall tracking on budget, with Police Department overtime up for the year. It is worth noting that the additional officers requested would have the benefit of lessening overtime from what would otherwise be the case. An analysis of the revenues and expenditures indicates sustainability of the positions at least through the life of the grant. If revenues lessen Page 24 of 123 below projections expenditures can be controlled through the budget process. Staff is requesting authorization by Council to accept the grant award for the four additional officers and enter into an COPS Grant agreement with the Federal Department of Justice. The applicant has filed a written appeal of the Planning Commission's recommendation due to dissatisfaction with the approval conditions and citing process defiencies. The earliest date available for a Closed Record Hearing (which provides the necessary notification period and allows for transcript preparation) is August 20, 2018. V. DISCUSSION: Only the appeal letter has been attached to the Council Report. References to policies, reports and State Law which are voluminous and attached to the appeal letter will be provided with the record of the hearing. The Council will receive a copy of the Planning Commission hearing record about a week before the closed record hearing. Staff is reviewing the appellant's claims regarding process with the City Attorney and will be prepared to address those claims at the hearing. A closed record hearing allows Council to consider the evidence contained in the record and receive clarification on that record. The parties involved in the issue will be able to present to Council particular points or perspectives from the assembled reco rd but will not be able to introduce new evidence. Removing parking in this area will improve visibility for drivers and pedestrians reducing the potential for pedestrian/vehicle conflicts due to the mid-block crossing and multiple driveways. Currently, parking on Manzanita Lane is restricted on the west side from 'A' Street 150 feet to the north and on the east side 220 feet to the north . The proposed Ordinance, if adopted, amends Section 10.56.080 (Schedule III, Parking Prohibited at All Times on Certain Streets) of the Pasco Municipal Code to revise the list of prohibited parking streets as follows: Amend: Manzanita Lane - west side from "A" Street to 400 feet north Amend: Manzanita Lane - east side from "A" Street to 300 feet north Staff recommends the parking modifications this area to promote greater visibility for the recently constructed mid-block crossing and multiple driveways. Currently, PMC 10.56.080 prohibits parking on the west side of Manzanita Lane from ‘A’ Street to 150 feet north and on the east side from ‘A’ Street to 220 feet north. EXISTING CONDITIONS City staff conducted a review of existing conditions. Manzanita Lane’s cross section allows for parking on both sides. Parking is heavily used on both sides where allowed. Several vehicles appear not to have been moved for quite some time. Ben Franklin Transit recently began service to the area and placed a bus stop on the east side of the road, approximately 230 feet to the north of ‘A’ Street. This service is planned to continue. Recent development installed a mid-block crossing approximately 240 feet to the north of ‘A’ Street, and two driveways on the west side, while there is an existing drive on the east side. POSSIBLE MODIFICATIONS In order to provide visibility for the crosswalk, parking could be removed to 400 feet north of ‘A’ Street on the west and 300 feet north on the east. This modification will remove approximately 13 parking spaces, but the recently constructed apartments have double the amount of parking by current City requirements. We should also consider the possibility that vehicles will merely change parking locations, moving into the residential area to the north. While removing the ability to park in this location will increase visibility for the crosswalk, it may also cause an increase in average vehicle speeds, which may be mitigated by striping 11’ travel lanes and/or adding bike lanes in the future. RECOMMENDATION Staff recommends amending the PMC to prohibit parking on the west side to 400 feet north of ‘A’ Street. This will promote visibility for the crosswalk and multiple driveways. On the east side, staff recommends prohibiting parking to 300’ north of ‘A’ Street. This will allows for crosswalk and driveway visibility, as well as a bus stop area. ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: MOTION: I move to approve the Collective Baragining Agreement with the IAFF Local #1433, for the years 2018 - 2020 and, further, authorize the City Manager to execute the agreement. III. FISCAL IMPACT: Increases cost of department operations (base wages and benefits) by approximately $143,000 in 2018 and $215,000 in 2019 and 215,000* for 2020, with 50% covered by the ambulance utility and 50% from the general fund (fire). * Assumes worst case scenario, see schedule below. IV. HISTORY AND FACTS BRIEF: IAFF Local #1433 represents the City's professional firefighters and para-medics through the rank of Battalion Chief. The previous labor agreement terminated December 31, 2017. V. DISCUSSION: Negotiations commenced in the fall of 2017 with this 73-member bargaining unit with the parties reaching a tentative agreement on May 9, 2018. Local 1433 notified the City on 07/13/2018 that the members had voted to ratify the tentative agreement. Numerous contract language modifications were negotiated which provide greater Page 41 of 123 clarity for management and the bargaining unit members. Additionally, to address the Council’s interest that employees have an increased cost sharing for the Health Plan (as well as attempting to maintain internal equity between employee groups as much as possible) the City sought an increase in the cap that employees pay for medical insurance. The IAFF agreed to a raise in the employee portion of the premium from 2.5% to 3.00% of the pay rate of a top step firefighter (to $185.56 up from $167.26). It is important to note that having a settled contact with this interest arbitration eligible unit is advantageous in that it limits potential arbitration costs and prevents an outside party from imposing financial mandates upon the City. It is important for the City to maintain reasonable parity, over a range of benefits which can be priced out as "total compensation," in order not to find itself in a position of vulnerability if arbitration is invoked and to reduce turn-over and maintain an attractive posture to prospective candidates druring recruitment. The proposed settlement is part of a multi-contract effort over the past three years and a half years to bring total compensation to a point where it is competitive with comparable departments. The COLA based economic concessions indicates the Union's recognition that they consider this goal largely met. Following are the key economic changes reflected in the new agreement: Increases the cap on employee medical premium from 2.5% to 3.0% of monthly wage (this equates to an approximate 12% share of the premium). Section 3.2 Payroll Deductions.The City will deduct membership dues and any assessments from all employees of the department covered under this Agreement,upon the receipt by the City of a certi?ed total payroll deduction form from the treasurer of the Local.The membership dues and assessments shall be equal for all of said employees and the City shall pay the same monthly dues or assessments withheld to the Secretary/Treasurer of said Local No.1433.Further,the City will submit a monthly accounting of said deductions,giving the amount deducted opposite the employee’s name.The City will also deduct the monthly sum for disability insurance premiums Such deduction shall be remitted by the City to the Secretary/Treasurer of Local No.1433 with the dues deduction.The disability insurance deduction is a ?xed monthly amount for each employee for whom the deduction is taken,not a percentage of their pay. I I Zlj?11'-lj -I-I —-“w —IrI Section 15.2 Employees.Upon initial employment,employees shall be credited four hundred and twenty-three (423)hours of sick leave and no additional sick leave shall accrue through the forty- seventh (47th)pay period of the employee’s service with the City.Thereafter,commencing With the forty-eight (48th)pay period,such employee shall accrue sick leave at the rate of nine (9)hours per pay period.Should an employee terminate with a sick leave de?cit (more hours used than would have been earned during the period of service),the City shall be reimbursed out of other employee earnings.In addition,no sick leave buy-back shall apply unless the net hours would have accrued during the period of service. Section 15.3 Benefit Changes.In the event the bene?ts are increased or decreased by the legislature,the City and Union retain the right to open negotiations regarding the provisions of this Article. Section 15.4 Illness of Family Members. 1.In the event of a serious illness/injury in the immediate family of the employee,the employee,at his request,shall be granted time off utilizing earned sick leave time. Immediate family shall be de?ned as the spouse of the employee and his or her mother and father. 2.Accumulated sick leave may be used to care for a child of the employee under the age of eighteen (18)years of age with a health condition that requires treatment or supervision. “Health condition that requires treatment or supervision”means: (a)Any medical condition that requires medication that the child carmot self-medicate. (b)Any medical or mental health condition that would endanger the child’s safety or recovery without the presence of a parent or guardian;or (c)Any condition warranting preventative health care,such as physical,dental,optical or immunization services,when a parent must be present to authorize treatment and when sick leave may otherwise be used for the employee’s preventative health care. ((1)Sub-sections (b)and (c)above are not intended to include medical or mental health conditions which could adequately be supervised by a child’s regular daycare provider. (c)When both the employee and their spouse are employed and eligible for the family sick leave bene?ts under Chapter 49.12 RCW,the employee shall use reasonable efforts to annually equalize the use of the family sick leave bene?t between the employee and the employee’s spouse.The employer may deny the use of this family sick leave bene?t who does not exercise such reasonable efforts. (b)Cash-out of time shall occur on either or both (to the extent of holiday hours actually earned or accrued prior to such date)the ?rst paycheck in April or on the ?rst paycheck in December at the employee’s adjusted hourly rate of pay.In order for holiday time to be paid in April,the employee must submit a written request to the Chief at least two (2) weeks prior to the ?rst payday in April.The December payment shall be made automatically by the employer.The cut-off date for scheduling of holiday time usage shall be the ?rst day of the pay period for the ?rst payday in December.Holiday hours not schedule or paid in April for the year by that day shall be cashed out by the City at the employee’s adjusted hourly rate of pay the ?rst payday in December.For rules regarding the scheduling of Holiday time off see Section 14.2 ARTICLE 18 —BEREAVEMENT In the event of a death in the immediate family of an employee,the employee shall be granted up to forty-eight (48)hours of leave from scheduled work with pay.Additional leave for such purpose may be taken and charged to other eamed leave upon authorization of the Fire Chief. Documentation for need of such leave shall be provided when required by the City. Section 19.2 Employee Prescription Coverage.The City will provide prescription insurance coverage for employees who will be covered by a plan providing for no deductible,one hundred percent (100%)coverage of eligible expenses.The employee will not be required to pay for any prescription costs at time of prescription pickup.Employee pays zero percent (0%),one hundred percent (100%)coverage. Section 19.3 Employee Dental Coverage.The City will provide dental insurance coverage for employees who will be covered by a plan providing one hundred percent (100%)coverage of Class 1 expenses (i.e.,covered diagnostic and preventive care),eighty percent (80%)coverage of Class 2 expenses and ?fty percent (50%)coverage for Class 3 expenses.The maximum annual bene?t for dental expenses is one thousand ?ve hundred dollars ($1,500)per employee.The dental coverage shall be subject to a maximum twenty-?ve dollar ($25.00)deductible per person per calendar year to a maximum of seventy-?ve dollars ($75.00)per family;provided the dental deductibles shall not apply to covered Class 1 expenses and shall apply to the medical deductible limitation established in sections 19.5 and 19.6. Section 19.4 Employee Vision Coverage.The City will provide vision insurance coverage for employees who will be covered by a plan providing for a twenty-?ve dollar ($25.00)co-pay every plan year.Employee coverage will include a wellness exam every plan year;prescription lenses every plan year,frames every other plan year,(or)contact lens care every plan year.In addition employees will receive extra discounts and savings on glasses,sunglasses,contacts,laser vision correction.(See attached VSP bene?t summary) Section 19.5 Dependent Medical Wellness/Preventive Coverage.The City will provide medical insurance coverage for dependents of employees who will be covered by a plan providing for a two hundred dollars ($200.00)deductible per person per calendar year,to a maximum of six hundred dollars ($600.00)deductible per covered family per calendar year.Dependent coverage will be an eighty/twenty percent (80%/20%)co-insurance which applies to all covered expenses incurred.In accordance with the Health Plan,Wellness/Preventive care bene?ts may not be subject to the eighty/twenty percent (80%/20%)co-insurance or deductible. Section 19.6 Dependent Prescription Coverage.The City will provide prescription insurance coverage for dependents of employees.Dependent coverage will be an eighty/twenty percent (80%/20%)co-insurance for brand name prescriptions and generic prescriptions will be covered at one hundred percent (100%)which applies to all covered expenses incurred. The following shall apply to Employer Initiated Training; a. b. Education/Training must be approved by the Fire Chief or his designee. Actual costs of books,fees,tuition,registration,or any other costs shall be covered by the City. Employee(s)shall receive overtime compensation as per Article 24 for all actual hours in class/training and travel time outside their regular scheduled shift/hours. If the training duration is of multiple days and over ??y (50)miles away from the Tri-Cities metropolitan area,the employee(s)attending training shall be back?lled to cover their regular scheduled shift as needed to meet staffing levels. Employee(s)shall receive per diem for mileage,meals,and lodging based on the Standard Federal Rate,for the speci?c travel destination. If the training is less than f1?y(50)miles away from the Tri-Cities metropolitan area employee(s)attending training shall be back?lled to cover their regular scheduled hours for training and travel time as needed to meet staf?ng levels. Employee(s)shall receive per diem for mileage and meals based on the Standard Federal Rate,for the speci?c travel destination.Normally the employee(s)will be expected to return to work a?er their education/training for the day has concluded. The Fire Chief or his designee may deem it unsafe to travel back from training for any reason including but not limited to weather and road conditions,time of day travel is to take place,etc.In cases where the Fire Chief or his designee deems it unsafe to travel,the employee(s)attending training shall be back?lled to cover their regular scheduled shi?/hours as needed to meet staf?ng levels. Employee(s)shall receive per diem for lodging based on the Standard Federal Rate,for the speci?c travel destination in addition to per diem mentioned in paragraph (c)above. Employee Initiated Training in one (1)or more ways as provided for Employer Initiated Training.The determination of any support will be subject to seniority,?nancial resources,and department staf?ng needs. Section 21.3 —Fire Science and Advanced Life Support.Employees shall be eligible for reimbursement for the actual cost of books,fees,and tuition and the payment of per diem for courses in ?re science or advanced life support.A grade of “C”or better must be obtained if it is a graded course,or a certi?cate of completion be issued to an employee in a non-graded course. a.Employees intending to take classes in ?re science shall submit a letter of intent to do so by June 15‘,prior to the year seeking reimbursement. b.Paramedics shall be eligible for overtime pay for actual hours in attendance at no more than one (1)meeting per month called by the physician advisor,subject to approval of the Fire Chief;however,no call out pay shall be required. c.Paramedics shall be eligible for off duty overtime for attendance at courses that are required by the regional Medical Program Director (MPD)and approved by the Fire Chief.Such training will be allowed “on duty”if response status and/or manpower allows.No call back pay shall be required. ARTICLE 22 —UNIFORM/PROTECTIVE CLOTHING ARTICLES Section 22.1 Provisions and Maintenance.All uniforms,protective clothing,or protective devices required for employees in the performance of their duties shall be furnished to the employees by the City.The cleaning of safety clothing shall be accomplished on duty or by the City through commercial facilities.The cleaning of daily duty uniforms shall be the responsibility of the employer. Section 22.2 Quantity Provided to Each Employee.In the ?rst year of employment,?ve (5) sets of daily uniforms will be furnished to each employee.Thereafter,one (1)uniform per year will be purchased as needed to maintain uniform appearance.Winter coats and cold weather gear will be purchased and replaced by the City as conditions warrant.The employer will maintain on hand “throw-away”coveralls for the use of employees as conditions warrant. Section 22.3 Replacement.Equipment and/or clothing lost,stolen,destroyed,or damaged in the line of duty,and without negligence on the part of the employee,will be replaced by the City without cost or charge to the employee.Clothing and equipment provided by the City shall be purchased and maintained with regard to employee’s health and safety. I III‘In uIIJ:—:uu'—I"——I —'u 'I-1-I'—uuuu'Iu '-In‘.‘_- ARTICLE 24 —OVERTIME PAY The City shall administer overtime according to the following provisions: Section 24.1 Pre-Scheduled Overtime.Any pre-scheduled overtime must be approved by the Fire Chief.Any emergency overtime may be approved by the Duty Of?cer,but only in accordance with departmental regulations. Section 24.2 Time Paid.Time worked to the nearest greater one-half hour beyond an employee’s regularly scheduled shift shall be paid at one and one-half times the employee’s adjusted hourly rate of pay.The time and one-half shall be paid for all hours worked rounded to the greater half hour. Section 24.3 Call Back Pay.Except as otherwise stated herein below,an employee who is called back to duty from off the station site after his normal shift has ended,but before the scheduled start of his next shift,shall receive the sum of sixty Dollars ($60.00)plus one hour minimum of overtime oav. Section 24.4 Off-Duty Events.Any employee attending a meeting,public function,schooling or training outside his regular shift shall not be eligible for call back pay per subsection 24.3,except when the employee’s attendance is required by the administration and the employee has not been given at least seventy-two (72)hours’notice of said function,in which case the employee shall be paid callback pay per subsection 24.3. Section 24.5 Overtime Rates.When it is necessary to hold an employee beyond his regular or exchange shift,he shall be paid at the time and one-half rate and no call-back pay shall apply.In the event coverage is required due to the absence of another employee,as soon as practical either a twelve (12)or twenty-four (24)hour shift shall be offered to employees in inverse order of accumulated overtime (those with least amount ?rst).However,if an employee is willing to work the full twenty-four (24)hours they shall bump the employee/employees wanting to split the shift. Call—backpay shall not apply when employees work the f11lltwenty-four (24)hours or Voluntarily split the twenty-four (24)hour shift. Exceptions: 0 Stand-by for emergency medical services at Pasco high schools’athletic events may take place during emergency stand-by time. 0 Transports as outlined in Article 36 —Inter-Facility Patient Transports may take place during emergency stand-by time. ARTICLE 29-SHIFT REASSIGNMENT The City will cooperate to the extent reasonably possible with the affected employees to minimize or eliminate any loss of hours or bene?ts due to a shift reassignment initiated by the City,through the use of advance notice,voluntary shift exchanges,working additional hours,or other available means not increasing the wages or bene?ts that would be paid by the City to the employees had the shift reassignment not occurred.However,any plarmed shift reassignment for an upcoming year shall normally take place early in the calendar year to facilitate the scheduling and taking of vacations,holiday leave or other long—rangetime-off bene?ts. ARTICLE 30 —SHIFT EXCHANGE Employees shall be permitted to change shifts or portions thereof when the change does not interfere with the best interest of the Fire Department and with the approval of the Fire Chief or his designee.Approval of the Fire Chief is contingent upon the employees meeting the following conditions: 1.The exchange is voluntary and upon the written request of the two involved employees. Bidding will not occur due to vacancies. Notwithstanding the above,the Fire Chief,at his discretion and for reasonable cause,may make changes in the shift or station assignments to meet the operational needs of the department, including,but not limited,to staf?ng of shift of?cers and ?re?ghter/pararnedics.Except in emergencies,thirty (30)days advanced notice will be given any employee who will be transferred and the Fire Chief shall provide a statement in writing to the affected employee(s)giving the reasons for the transfer. ARTICLE 33 PROBATIONARY EMPLOYEES The City and Local 1433 have established a joint Labor/Management Pasco Fire Department Apprenticeship Program.The Program is outlined in the Rules and Regulations.All new hire Fire?ghter/Fire?ghter Paramedic employees,regardless of previous experience,shall enter the apprenticeship program,and at conclusion,shall be awarded a Pasco Fire Department Joumey level certi?cate. Advancement through pay grades is dependent upon success?llly completing the apprenticeship task book assigned for the year in which they are entering. Probationary employees shall meet the requirements of the ?rst year task book and successfully complete the probationary review period with their assigned of?cer to maintain employment with the Pasco Fire Department. New hire employees on probation shall not be allowed shi?trades during their ?rst year of employment and shall not be entitled to take vacation or holiday leave unless authorized by the Fire Chief.The employee will earn vacation credit and holiday hours in accordance with Article 14 and Article 17.Sick leave shall be earned and utilized in accordance with Article 15.However, the employee must provide documentation (a written explanation from health care provider or employee)to the Fire Chief or his designee for all sick leave used.New employees who do not pass their probation for any reason shall not receive any accumulated leave bene?ts under this agreement,except any holiday hours they have accrued. Probationary employees shall not be permitted to accept operational overtime during their review period,except as authorized and agreed upon by the Chief or designee and the Local.Probationary employees;however,shall be allowed to accept non—operationalovertime for training,public events,and non-emergent standby’s. ARTICLE 34 -PARAMEDIC PERSONNEL Section 34.1 As a local paramedic training program is available,the City may offer employees in the Fire?ghter classi?cation the opportunity to participate in the local paramedic training program by reimbursement to the employee of their tuition,cost of their books and other training materials and coverage for their on duty time and to attend training.Any off duty training time will not be reimbursable by the City.Employees requesting employer assistance in paramedic training as set forth herein shall be screened by a committee whose membership shall include Union representatives.The committee shall rar1kand make recommendation to the Fire Chief of a list of the applicants showing the greatest potential to complete the training program and commitment to long-term paramedic service for the City.The Chief’s determination as to the employee(s)selected for the City-assisted paramedic training program shall be ?nal. Section 34.2 Employees selected for the paramedic training program by the Fire Chief,once enrolled,shall utilize their best efforts to success?illy complete the program.Any request by trainees to drop out of the program must be made in writing to the Fire Chief.Approval to discontinue training shall be given only by the Fire Chief. Section 34.3 Paramedic/Fire?ghter personnel may,after eight (8)years in the classi?cation of Paramedic/Fire?ghter,make written request to the Fire Chief to be allowed to return to the Emergency Medical Technician (EMT)classi?cation.The request shall be granted provided there are vacant Fire?ghter position(s)available in the Fire Department due to resignation,dismissal, promotion or expansion.In the event two or more Paramedic/Fire?ghters request reclassi?cation to the Fire?ghter classi?cation and there are insuf?cient available positions,the most senior Paramedic/Fire?ghter shall have ?rst preference.Seniority for purposes of this Article shall be determined by time served as a Paramedic/Fire?ghter with the City. Section 34.4 Persons previously certi?ed as Paramedics or persons desiring advanced skills may certify as Intermediate Life Support (ILS).The City will support the training of these positions the same as Paramedic training list in section 35.]. ARTICLE 35 —INTER-FACILITY TRANSPORTS Section 35.1 The parties agree that inter-facility transports for Lourdes Medical Center and other care facilities for the aged and in?rm in Pasco that are currently taking place at the time of the rati?cation of this collective bargaining agreement are within the scope of public services to be provided by the Fire Department. Section 35.3 Negotiations.The parties agree to open bargaining on the impacts and effects of the transports described in Section 36.1 and Section 36.2 if the volume of transports exceeds one (1) transport per twenty-four (24)hour shift over a period of ninety (90)consecutive days,otherwise, the employer’s obligation to participate in impacts and effects bargaining for making changes to the current practice described in Section 36.2 shall be consistent with requirements of Chapter 41.56 RCW. ARTICLE 36 —STAFF MEETINGS Section 36.1 Regular Meeting.A staff meeting comprised of the Fire Chief,Battalion Chiefs, and day shift personnel shall be called as often as determined by the Fire Chief,but not less than quarterly.The length of such meetings shall be determined by the Chief. Section 36.2 Decisions Regarding Department Operations.The Chief shall take into consideration the discussion and input he receives at the meetings in his decision-making concerning department operations.Nothing herein,however,shall be interpreted to prevent the Chief from making a change in department operations that he otherwise has the discretion to make. Section 36.3 Off-Duty Employees Required to Attend.Off-duty employees required to attend any staff meetings shall be paid at the overtime rate of pay.No call-back premium or minimum hours of pay requirement is applicable. ARTICLE 37 —RULES AND REGULATIONS The Union agrees that its members shall comply in full with Fire Department rules and regulations, as currently in effect or hereafter amended,including those relating to conduct and work perfonnances.The Employer agrees that departmental rules and regulations which affect working conditions and performance shall be subject to the Grievance procedure.In addition,the employer agrees that any changes in rules and regulations which affect working conditions,other than for emergency matters,will be posted thirty (30)days in advance of their effective date,unless said posting period is waived by the Union. Inter-of?ce memos that amend working conditions shall be incorporated in departmental rules and regulations within forty-?ve (45)days of the date issued. Section 42.3 Place.While both parties work toward the goal,physical ?tness activities may take place in the assigned stations or at a ?tness facility approved by the Fire Chief. Section 42.4 Rules and Regulations/Safety Precautions.Employees shall follow all rules and regulations regarding the use of exercise equipment and wear proper clothing and safety devices when recommended for the physical activity they are performing. ARTICLE 43 PERSONNEL REDUCTION Section 43.1 Reductions Re-Employment.In the case of a personnel reduction within any classi?cation,the employee with the least seniority shall be laid off ?rst.When two or more employees of the same classi?cation being reduced have the same date of employment,they shall be laid off by inverse ranking off the Civil Service list from which they were hired.An employee being laid off may choose to transfer to a lower classi?cation for which he is quali?ed and may do so provided he has more seniority than other employees occupying that classi?cation.Any employee who has been laid off shall be ?rst offered re-employment in a position within the bargaining unit which becomes Vacant subsequent to the individual being laid off,provided the individual meets the minimum quali?cations for the position and was laid off within the immediately preceding three (3)years.Any employee turning down the re-employment offer shall forfeit his right to future re-employment offers.Any employee(s)holding an of?cer position that was eliminated due to personnel reductions and who transferred to a lower classi?cation shall be ?rst offered the opportunity to return to his prior rank when a position becomes available. Section 43.2 Seniority De?ned.Seniority shall be de?ned as the date of hiring to a regular full- time position.Rank shall be de?ned as Battalion Chief,Captain,Lieutenant,Paramedic- Fire?ghter and Fire?ghter.The rank of Paramedic-Fire?ghter and Fire?ghter shall be considered the same with respect to the choosing of Kelly Days,Vacation,and Holiday time off. Section 43.3 Seniority Listing.A seniority list shall be maintained by the Department,veri?ed by the local and updated as new employees are hired and existing employees leave city service. ARTICLE 44 —DISCIPLINE Section 44.1 Just Cause.The City shall not take disciplinary action against any employee without just cause.The City retains the right to discharge new employees at will during or at the end of the probationary period and the discharge shall not be made the subject of a grievance either by the employee or the Union. Formal discipline of non-probationary employees in circumstances not warranting termination will normally follow a progressive disciplinary pattern with the objective of correcting the problem. When deciding the degree of discipline,the City will take into consideration the circumstances surrounding the incident(s),the severity of the offense,and the past work record and past conduct of the employee.When meeting with a management supervisor or at any hearing where discipline is being considered,the employee shall be entitled to union representation.The term progressive discipline,as used herein,refers to a discipline process normally including the following steps: (a)A verbal warning will be documented in writing and placed in the of?cial personnel ?le. (b)A written reprimand (warning);discussion between the disciplined employee and administrative of?cers.The written reprimand shall be placed in the employee personnel ?le. Section 46.2 Work Related.Employees who have a temporary disability that restricts their ability to perform the essential functions of their position may agree to work modi?ed duty assignments. The employee shall present the Fire Chief with a release form from their medical provider that contains the current limitations and/or restrictions and if possible,the anticipated release to ?ill duty.The determination as to whether modi?ed duty work exists rests solely with the Fire Chief. Hours worked shall not exceed the employee’s assigned average work week and the medical providers information.The actual number of hours worked will be agreed upon by the employee, and the Fire Chief. If an employee is offered modi?ed duty for a work-related injury and does not accept,they will forfeit the bene?t provided by Labor and Industries and/or Disability Leave Supplement.However, this does not restrict the employee ?om using other accrued leave bene?ts for time off during modi?ed duty. Section 46.3 Offering of Modified Duty.If more than one employee is eligible,as determined by their medical provider,and agrees to a modi?ed duty assignment,the Fire Chief shall split available work as evenly as possible among the eligible employees.The splitting of available modi?ed duty applies to both work and non-worked related medical conditions. ARTICLE 47 WSCFF MEDICAL EXPENSE REIMBURSEMENT PLAN (MERP) The City shall contribute $75.00 per month on a pre—taxbasis for all bargaining unit members to the Washington State Council of Fire Fighters (WSCFF)MERP.These contributions shall be included as salary for the purpose of calculating retirement bene?ts. ARTICLE 48 ELECTRONIC EMERGENCY CALLBACK PAGING Up to four (4)employees may sign-up for Electronic Emergency Callback Paging for call—ins.The Fire Chief may allow an increase in the number of employees that may sign-up for Electronic Emergency Callback Paging at any time.Employees lowest on the overtime list shall have first choice for signing up for Electronic Emergency Callback Paging until 0800 hours.After 0800 hours,employees shall be allowed to sign-up for Electronic Emergency Callback Paging on a ?rst come basis. In compensation for signing up to be available for Electronic Emergency Callback Paging,the employee will be paid thirty ($30.00)dollars for each uninterrupted twenty-four (24)hour shift. When an employee is paged,they shall receive sixty ($60.00)callback pay plus one-hour minimum of overtime pay.When the employee is paged,goes out of service,or fails to respond during the twenty-four (24)hour period,they shall not receive the thirty ($30.00)dollars. Any employee electing to sign-up for Electronic Emergency Callback Paging shall remain within a twenty (20)minute average response time to the City limits of Pasco,with their portable radio in their in their possession. When an employee is paged,s/he shall obey all traf?c laws while responding to a ?re station. Electronic Emergency Call Paging shall be activated whenever the on duty Battalion Chief has reason to believe that the Pasco Fire Department may be committed to providing and/or receiving Mutual Aid/Automatic Aid that may extend beyond thirty (30)minutes. The on-duty Battalion Chief shall activate Electronic Emergency Callback Paging whenever the Pasco Fire Department resources are being depleted with multiple and/or extended calls. Recognizing this reality,although the City of Pasco encourages voluntary drug and alcohol abuse treatment,the City will take strong action against employees who do not seek treatment on their own.This strong action is designed to break through the denial barrier and convince substance abusing employees of the need for treatment. Assistance in Overcoming alcohol or Drug Abuse for Employees who Voluntarily Seek Help. Early recognition and treatment of alcohol or drug abuse is important for successful rehabilitation and for reduced personnel,family,and social disruption.The City of Pasco encourages the earliest possible diagnosis and treatment for alcohol or drug abuse.The City of Pasco supports sound treatment efforts.Whenever feasible,the City of Pasco will assist employees in overcoming drug or alcohol abuse.However,the decision to seek diagnosis and accept treatment for alcohol or drug abuse is primarily the individual employee’s responsibility. The City has contracted with Lourdes Business Health Services for an employee assistance program,which program includes con?dential referral to drug and alcohol treatment. The City’s self-insurance program provides benefits to help pay for treatment for chemical dependency,up to a maximum of $1,000 per calendar year.The City of Pasco also offers a variety of leave options for employees who need time off work for treatment of substance abuse problems.To insure that these bene?ts are available,however,employees must voluntarily seek help. Employees with personal,alcohol or drug abuse problems may seek help without the approval or even knowledge of their supervisor.Employees who voluntarily request the City’s assistance in dealing with an alcohol or drug abuse problem may do so without jeopardizing their continued employment with the City. The City will not discriminate against or discipline an employee on the basis of illegal use of drugs,provided the employee in not engaging in a current illegal use of drugs and who (a)has successfully completed a supervised drug rehabilitation program or who has otherwise been rehabilitated successfully,or (b)is participating in a supervised rehabilitation program. Voluntary requests for assistance from the City for appropriate counseling and treatment services will not prevent disciplinary action for violation of the prohibitions set forth in Article VIII,however.The City will not use a voluntary confession of a violation of a prohibition of Article VIII as a basis for discipline,absent other corroborative evidence. Employees who undergo voluntary counseling or treatment and who continue to work must meet all established standards of conduct in job performance. If you are an employee who is subject to call by assignment of a pager,beeper or special response status during off-duty hours for emergency response,being in an un?t condition to respond and effectively perform assigned duties when called to report due to the consumption of alcohol.It is not a violation hereof for an employee who carries a beeper more frequently than on a rotation or sporadic basis to occasionally engage in social drinking of alcoholic beverages when off-duty or that such an employee,on occasion,be in a condition unable to respond to an anticipated off-duty call to return to duty,due to the consumption of alcohol. Possession,use,manufacture,distribution,dispensation or sale of an illegal drug off City premises or off duty that adversely affects the employee’s work performance or his own or another’s safety during working hours. Refusing to submit to an inspection authorized by Article IX when requested by management. Refusing to submit to a breath or blood testing authorized by Article IX to determine blood/alcohol level when requested by management. Failing to adhere to the requirements of any drug or alcohol treatment,or counseling program in which the employee is to be a participant as a condition of continued employment or required by written agreement between the employer and employee, resulting from a violation of this policy. Failure to report to the employee’s supervisor the use of a prescribed drug or over-the- counter medication which the employee has reason to believe may alter the employee’s behavior or physical or mental abilities. HISTORY AND FACTS BRIEF: The PPOA Non-uniformed bargaining unit represent is comprised of seven members serving in the areas of records, evidence and crime analysis. The previous contract terminated on December 31, 2016. V. DISCUSSION: The non-uniformed PPOA unit most recently recieved a 1% cost of living increase in January of 2016. During the course of negotiations the unit changed representation which delayed the process. Ultimately the bargaining teams agreed to mediation through the Washington State Public Employee Relations Commission (PERC). PERC mediators typically require considerable lead time, which delayed negotiations further. Agreement was eventually reached as described below. The 4% first year adjustment is in recognition of the unit's economic relationship with comparable positions within the organization. The proposed schedule will bring these employees into closer alignment with comparable internal positions. Neither the Association,its of?cers,or agents,nor any of the employees covered by the Agreement will engage in,encourage,sanction,support or suggest any strikes,slowdowns,blu ?u,speed-ups, mass resignations,mass absenteeism,the willful absence from one’s positions,the stoppage of work or the abstinence in whole or in part of the full,faithful and proper performance of the duties of employment.In the event that any employee violates this Article,the Association shall,upon written request from the City to any elected representative of the Association,immediately notify any such employees in writing to cease and desist from such action and shall instruct them to immediately return to their normal duties.Any and all employees who violate any of the provisions of this Article may be discharged or otherwise disciplined. ARTICLE 5 -Grievance Procedures. If parties fail to agree upon and/or obtain a Fact Finder within seven (7)working days of service of the request,then either party may request a Federal Mediation and Conciliation Service (FMCS) to supply the names of ?ve (5)disinterested individuals who are quali?ed and willing to perform as an impartial Fact Finder in the dispute.Upon receipt of said names,the parties shall meet within seven (7)working days to make a selection.Selection shall be achieved by alternate striking of names with the party striking ?rst being determined by a coin toss. The Fact Finder shall convene a hearing in the City of Pasco within thirty (30)days of selection by the parties.At said heating the parties may present evidence and sworn testimony as well as cross-examine one another’s witnesses.Each of the parties agrees to produce any records or materials that the Fact Finder may require relative to the dispute. Upon closure of the hearing,the Fact Finder shall promptly issue written ?ndings and recommended action(s).In formulating his position,the Fact Finder shall designate the losing party.The opinion shall not attempt to destroy,change,delete from,add to or alter the terms of this Agreement. Within ten (10)Working days of the City Manager’s receipt of the Fact Finder’s written opinion, the City Manager shall either af?rm,disaf?rm,or amend said opinion and provide the reasons therefore.The result of the City Manager’s review shall be ?nal and binding on the parties and there shall be no further appeal. Section 2.Accrual and Use.All employees shall accrue and receive sick leave bene?ts as follows: a.Accrual of Sick Leave.Sick leave shall accrue at the rate of eight (8)hours for each month of active service for each regular employee to a maximum accumulated sick leave of 960 hours;however,the severance bene?t provided hereafter shall be based on the product of twenty- ?ve percent times the accrued number of sick leave hours up to a total of 720 hours. b.New or Probationary Employees Accrual and Use of Sick Leave.A temporary, provisional or probationary employee shall eam sick leave credit in accordance with Section 2a, which shall be credited to the probationary employee after ninety (90)days of employment.New employees beginning work for the City prior to midnight of the 15”‘of the month shall earn sick leave credits ?om the ?rst of the month.All employees beginning work for the City after 12:01 A.M.on the 16thof the month shall not earn sick leave credits until the 15‘of the succeeding month. c.Sick Leave with Pay.Employees shall earn and may be granted time off with pay covering periods of illness or involuntary physical incapacity except time off caused by accident connected with other gain?ll employment not previously approved by the City to the extent that sick leave has accrued.In order to be granted sick leave with pay,an employee must meet the following conditions: (1)Report to the Chief,immediate supervisor or designated representative the reason for the absence.Unless the employee’s condition otherwise prohibits,sick report must be made as soon as possible on the ?rst day of the absence and every day thereafter (unless waived by the Chief or his designee)as far in advance of the scheduled work as possible. Normally,this report shall be made no later than one-half hour before the start of the shift. (2)Keep the Chief,immediate supervisor or designated representative informed of their condition if the absence is of more than three working days duration. (3)If absence extends beyond three working days duration,the employee will be required,at the option of the Chief,to submit a medical certi?cate signed by a physician stating the kind or nature of sickness or injury,that the employee has been un?t for work for the period of absence or quarantine or required to receive out-patient care and is again physically able to perform his duties.The cost of obtaining such medical certi?cate shall be at the City’s expense.The medical certi?cate shall be submitted to the Chief of Police or his designee and the contents of the certi?cation shall be disseminated to other City employees only on a “need to know”basis. (2)The employee has given at least fourteen (14)days written notice to his supervisor unless said notice is waived. (3)The supervisor has approved the day. (4)The day is taken during the calendar year.Entitlement to the day will lapse except where the day has been requested and that day and an alternate have been denied.In the event of denial,the employee shall be paid for the day the last pay period of December at the holiday rate of pay unless the employee’s request for a personal holiday is made on or alter December 1,in which case the employee shall receive their regular hourly rate of pay. b.Additional Holidays.Any addition holidays declared by the city Council shall apply to the members of the bargaining unit. Section 2.Holiday Compensation Rate.In addition to being paid for the holidays designated above,if an employee is required by the City to work on a paid holiday the employee shall receive one and one-half times their regular rate of pay for the hours actually Worked in addition to Holiday pay at straight time rates. Section 3.Weekend Holidays.Whenever any holiday speci?ed above falls on a Saturday,the Friday immediately preceding such holiday shall be observed as the holiday.When any of the above holidays falls on a Sunday,the Monday immediately following shall be observed as the holiday. Section 4.Holiday During Vacation Leave.In the event a holiday honored under this Agreement falls during an employee’s armual vacation,vacation leave for that day will not be charged. ARTICLE 10 —Bereavement. Section 1.Death in Family.In the event of a death in the immediate family of an employee, the employee shall be granted up to 32 hours off with pay.Additional leave for such purpose may be taken and charged to other earned leave upon authorization of the Police Chief or his designee. The City may require documentation of the need for such leave. ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: MOTION: I move to award the Road 84 Safe Walking Route Connection project to Moreno & Nelson Construction Corp. in the amount of $141,910.00 and, further, authorize the City Manager to execute the contract documents. III. FISCAL IMPACT: 2017 Safe Routes to School (SRTS) State Funds $ 214,970 City of Pasco Fund 125 [I-182 Traffic Impact Fees] $ 27,500 Total Project Cost $ 242,470 This project was included in the 2018 budget; however, the budget appropriation was $215,000. If approved, a budget adjustment to account for the additional $27,500 expenditure will be made as part of a larger budget supplement later this year. IV. HISTORY AND FACTS BRIEF: This project will construct the missing link of sidewalk along the east side of Road 84, between Argent Road and Massey Drive. Recent development has resulted in the complete construction of sidewalk from Massey Dr. north to Chapel Hill Dr. To enhance pedestrian safety and accessibility, the project includes Rectangular Rapid Flashing Beacons, and a marked school crossing with Americans with Disabilities Act Page 114 of 123 (ADA) compliant curb ramps. Completion of this project is consistent with the Council goal of an improved pedestrian, multi-modal transportation network. V. DISCUSSION: On June 28, 2018, the City received two (2) bids for construction of the project. The low bid was from Moreno & Nelson Construction, Corp. in the amount of $141,910.00. The Engineer's construction estimate was $160,493.00. The total project estimate is $242,470, which includes design, constructions costs, project management and inspection. Staff has reviewed the bid submittal and found no exceptions or irregularities and, therefore, recommends award of the contract to Moreno & Nelson Construction, Corp. of Walla Walla, Washington. This Item was discussed at the July 9, 2018 Council Workshop. ACTION REQUESTED OF COUNCIL / STAFF RECOMMENDATIONS: MOTION: I move to award the Rowena Chess School Crossing project to Allstar Construction Group in the amount of $61,019.85 and, further, authorize the City Manager to execute the contract documents. III. FISCAL IMPACT: 2017 Safe Routes to School (SRTS) State Funds $ 88,140 City of Pasco Fund 125 [I-182 Traffic Impact Fees] $ 20,000 Total Project Cost $108,140 This project was included in the 2018 budget; however, the budget appropriation was $88,140. If approved, a budget adjustment to account for the additional $20,000 expenditure will be made as part of a larger budget supplement later this year. IV. HISTORY AND FACTS BRIEF: This project will provide a designated marked crossing with Rectangular Rapid Flashing Beacons for the students of Rowena Chess Elementary School to safely cross 22nd Avenue. Adding this crossing would also allow students the ability to enter the school grounds directly via the gate opening currently used near the proposed crossing location. Page 119 of 123 Completion of this project is consistent with the Council goal of an improved pedestrian, multi-modal transportation network. V. DISCUSSION: On June 28, 2018, the City received two (2) bids for construction of the project. The low bid was from Allstar Construction Group, Inc. in the amount of $61,019.85. The Engineer's construction estimate was $66,104.00. The total project estimate is $108,140, which includes the design, constructions costs, project management and inspection. Staff reviewed the bid submittal and found no exceptions or irregularities and, therefore, recommends award of the contract to Allstar Construction Group, Inc of Richland, Washington. This Item was discussed at the July 9, 2018 Council Workshop.
