CALL TO ORDER Chairperson Gottschalk called the regular meeting of the Code Enforcement Board to order at 7:00 p.m. B. ROLL CALL a. Board Members MEMBERS PRESENT Daniel Gottschalk James Rawlinson Thomas Granbois MEMBERS ABSENT Mary Gutierrez Dwayne Speer C. ADOPTION OF MINUTES: Board Member Granbois moved, seconded by Board Member Rawlinson, that the minutes of the March 1, 2018 meeting be approved. The motion carried unanimously. D. DETERMINATION HEARINGS: Chairperson Gottschalk explained the procedure and purpose for the meeting, noting that the City of Pasco was the Petitioner and property owners and their authorized representatives who had appeared to discuss the alleged violations of the Pasco Municipal Code were the Respondents. a. Hearings i. City of Pasco vs. Benedettie, Judy (for the owner), case number CEB2018-0128, for the Property located at 5527 Robert Wayne Dr. Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer, Nicholas Potvin, to read the case facts into the record. Mr. Potvin indicated that the cited violations on this property were IFC 605.5 — Extension cords supplying permanent power to the motor home, PMC 25.69.040(1) Repeat — Motor home in alley being occupied on a nightly basis, PMC 9.60.030(l 0) Repeat — Accumulation of miscellaneous materials in the alley near the fence and PMC 9.60.030(9) — Appliances and other items that have served their intended original purpose are not kept in approved containers. The property was inspected on February 5, 2018 and violations of the Pasco Municipal Code were observed and determined to be repeat violations. Previous notice was sent on October 3, 2016 for case number CEB2016-2707. A repeat notice of civil violation was issued on February 6, 2018 via certified mail. The property owner was legally notified on February 8, 2018. Based on a final inspection of the property completed on March 12, 2018 the property is in compliance at this time. Judy Benedettie, 5527 Robert Wayne Drive, spoke on behalf of this case The City of Pasco recommended imposing a repeat penalty of $200. CODE BOARD DECISION: Board Member Rawlinson moved, seconded by Board Member Granbois, that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Rawlinson moved, seconded by Board Member Granbois, to impose a repeat penalty of $200 to be held in abeyance for 12 months and dropped if no further violations occur in that 12 month time. The motion carried unanimously. 04052018 CEB Minutes Page 1 of 2 ii. City of Pasco vs. Serrano. Miguel & Maria case number CEB2018-0276. for the property located at 817 S. Maitland Ave. Troy Hendren, Inspection Services Manager, asked Code Enforcement Officer, Martin Barajas, to read the case facts into the record. Mr. Barajas indicated that the cited violations on this property were PMC 25.78.020 — Inoperable vehicle and vehicle under repair stored on a vacant lot and PMC 9.60.030(12) — Vehicles in disrepair stored outside of the approved enclosure. The property was inspected on February 23, 2018 and violations of the Pasco Municipal Code were observed and determined to be repeat violations. Previous notice was sent on January 17, 2017. A repeat notice of civil violation was issued on March 8, 2018 and delivered via certified mail. The property owner was legally notified on March 14, 2018. Based on a final inspection of the property completed on April 4, 2018 the property is in compliance at this time. Nicolas Serrano, 817 S. Maitland Avenue, spoke on behalf of this case. The City of Pasco recommended imposing a repeat penalty of $200. CODE BOARD DECISION: Board Member Rawlinson moved, seconded by Board Member Granbois, that the actions taken by the City were appropriate and timely. The motion carried unanimously. Board Member Rawlinson moved, seconded by Board Member Granbois, to impose a repeat penalty of $400 to be held in abeyance for 24 months and dropped if no further violations occur in that 24 month time. The motion carried unanimously. b. Amendments c. Dismissals d. Motion Board Member Speer made a motion to approving Resolution No. 2018-003, Board Member Gutierrez seconded. The motion carried unanimously. E. STAFF REPORT AND OTHER BUSINESS: F.
