HomeMy WebLinkAbout1996.09.03 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING SEPTEMBER 3, 1996 CALL TO ORDER The meeting was called to order at 7 30 P M by Charles D Kilbury, Mayor ROLL CALL By Deputy City Clerk Councilmembers present Joe Jackson, Chris Jensen, Charles Kilbury, Dan Lathim, Rebecca Francik, and Carl Strode Councilmembers absent Michael Garrison Also present Gregg Haney, Acting City Attorney, Dan Underwood, Finance Director, Dave McDonald, City Planner, Denis Austin, Police Chief, and Liesl Smith, Management Assistant PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION Mr Jensen moved to approve the Consent Agenda Seconded by Mr Jackson Motion carried unanimously Consent items are as follows A) Approval of Minutes To approve minutes of Regular Meeting held August 19, 1996 B) Bills and Communications To approve General Claims in the amount of $1,128,544 65 ($40,855 30 being in the form of Wire Transfer Nos 3100 and 3101, and $1,087,689 35 consisting of Claim Warrants numbered 98285 through 98478) Payroll Claims To approve Payroll Claims in the amount of $939,221 76, Payroll Voucher Nos 50517 through 50794, 50822 through 51090, and 51111 through 51375 Bad Debt Write-offs To approve bad debt write-offs for utility billing, ambulance, miscellaneous, and Municipal Court non-criminal, criminal and parking accounts receivable in the total amount of $49,283 22 and, of that amount, authorize $49,024 68 be turned over for collection C) Special Permit Location of an off-premise directional sign at 4th Avenue and Ainsworth Avenue (MF #96-70-SP) To approve the location of an off-premise directional sign for the Marinas located in the Pasco Boat Basin, as recommended by the Planning Commission PROCLAMATIONS AND ACKNOWLEDGMENTS Yard of the Month Award Mayor Kilbury presented Yard of the Month Awards for August, 1996 to the following Pasco residents Paul 86 Carol Mitchell, 440 N Waldemar Avenue Bob 86 Vivian Eby, 2728 Fleming Lane (unable to attend) Thomas 86 Doreen Michel, 404 N 7th Avenue (unable to attend) Orville 86 Barbara Olson, 1715 W Henry Street (unable to attend) Leonard 86 Marion VanDinter, 1916 W Agate Street Dan &Johanna Davis, 4700 W Hilltop Drive (unable to attend) Gene 86 Beverly Bailie, 412 Road 38 (unable to attend) VISITORS Mr Peter LeMieux, of 3408 West Pearl Street, explained to Council that his property was recently annexed into the City of Pasco and he was attending MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 3, 1996 Council Meeting to petition for a variance or an amendment of PMC 22 68 085 - Factory Assembled Home Standards for Infill Development that would allow him to place his manufactured home on his property currently zoned RS-12 The City's current code requires that his property be designated as a sub-division Mr Jensen also suggested that Mr LeMieux attend the next Workshop Meeting when this problem will be discussed Ms Karen Hammerberg addressed Council for her sister, Ms Jo Ann Farris, regarding her sisters property located at 808 S 5th Avenue Ms Hammerberg explained that her sister recently discovered that she has been paying for sewer on her City utility bill when she is not connected to the sewer system She was concerned to learn that according the City code she will only be reimbursed for one and a half years worth of payments Mr Strode recommended that Ms Farris contact the City Manager's office regarding this matter REPORTS FROM COMMITTEES AND/OR OFFICERS Arts Council Meeting, September 3, 1996 Ms Francik reported that the Arts Council is trying to relocate their facility The Council is looking for high, walk-in gallery space, and space for an office PUBLIC HEARINGS Street Vacation - East 10 feet and the west 10 feet of 18th Avenue between Bonneville Street and Lewis Street (MF #96-65-V) Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published and posted as required by law Mr McDonald reported that Mr Dallas Dorsett requested the proposed vacation to aid in the placement of a new factory assembled home under the City's infill requirements The Franklin County P U D has requested an easement be retained on portions of the rights-of-way proposed for vacation MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE PROPOSED VACATION Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3167 AN ORDINANCE VACATING THE EAST 10 FEET AND THE WEST 10 FEET OF 18TH AVENUE BETWEEN BONNEVILLE STREET AND LEWIS STREET MOTION Ordinance No 3167, was read by title only Mr Jackson moved to adopt Ordinance No 3167, vacating the east 10 feet and the west 10 feet of 18th Avenue between Bonneville Street and Lewis Street Mr Lathim seconded the motion Motion carried unanimously ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS RESOLUTION NO. 2266 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN THE RIVERVIEW AREA AND TO CREATE A LOCAL IMPROVEMENT DISTRICT TO ASSESS A PART OF THE COST AND EXPENSE OF CARRYING OUT THOSE IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITED -2- MINUTES REGULAR MEETING PASCO,CITY COUNCIL SEPTEMBER 3, 1996 THEREBY, AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A HEARING BEFORE THE CITY COUNCIL TO BE HELD ON OCTOBER 7, 1996 MOTION Resolution No 2266, was read by title only Mr Francik moved to approve Resolution No 2266, declaring Council's intention to create an LID for sanitary sewers in Riverview, east of Road 40 and south of Sylvester Street and, further, to set Monday, October 7, 1996, at 7 30 p m at the Pasco City Council Chambers as the time and the place for a public hearing on this matter Mr Strode seconded the motion Motion carried unanimously ORDINANCE NO. 3168 AN ORDINANCE RELATING TO ZONING AND CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM C-1 (RETAIL BUSINESS) TO R-3 (MEDIUM DENSITY RESIDENTIAL) MOTION Ordinance No 3168, was read by title only Mr Jensen moved to adopt Ordinance No 3168, granting a rezone from C-1 to R-3, as recommended by the Planning Commission Mr Jackson seconded the motion Motion carried unanimously ORDINANCE NO. 3169 AN ORDINANCE RELATING TO ZONING AND CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM C-1 (RETAIL BUSINESS) TO R-4 (HIGH DENSITY RESIDENTIAL) MOTION Ordinance No 3169, was read by title only Mr Jensen moved to adopt Ordinance No 3169, granting a rezone from C-1 to R-4, as recommended by the Planning Commission Mr Strode seconded the motion Motion carried unanimously ORDINANCE NO. 3170 AN ORDINANCE RELATING TO ZONING AND CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM C-1 (RETAIL BUSINESS) TO R-5 (HIGH DENSITY RESIDENTIAL) MOTION Ordinance No 3170, was read by title only Mr Jensen moved to adopt Ordinance No 3170, granting a rezone from C-1 to R-5, as recommended by the Planning Commission Mr Francik seconded the motion Motion carried unanimously ORDINANCE NO. 3171 AN ORDINANCE OF THE CITY OF PASCO, AMENDING AND UPDATING CERTAIN SECTIONS OF TITLE 10 OF THE PASCO MUNICIPAL CODE TO PROMOTE CONTINUITY WITH THE WASHINGTON MODEL TRAFFIC ORDINANCE (MTO) BY REPEALING CONFLICTING AND REDUNDANT PROVISIONS AND TO UPDATE CERTAIN PENALTY PROVISIONS OF TITLE 10 OF THE PASCO MUNICIPAL CODE TOGETHER WITH SELECTED PROVISIONS OF THE WASHINGTON MODEL TRAFFIC ORDINANCE -3- N further busines , the meeting was adjourned at 8 09 P M Charles D Kilbury, May MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 3, 1996 MOTION Ordinance No 3171, was read by title only Mr Jensen moved to adopt Ordinance No 3171, amending certain parking laws and penalty provisions and repealing Ordinance No 3165 Mr Strode seconded the motion Motion carried unanimously UNFINISHED BUSINESS None NEW BUSINESS 20th Avenue and Sun Willows Signahzation Project MOTION Mr Strode moved to award the contract for the construction of a traffic signal on Sun Willows Boulevard, Project No 96-4-01, to the low bidder, Power City Electric, Inc, in the amount of $79,560 and, further, to authonze the Mayor to sign the contract documents Mr Jackson seconded the motion Motion carried by unanimous roll call vote MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mr James Forman, of 4220 W Sylvester Street, requested information regarding any proposed annexation for his area Specifically, he was concerned about the cost for an LID to provide City utilities to his area Mayor Kilbury referred Mr Forman to Mr McDonald for answers to his questions ADJOURNMENT ATTEST _c7 _/. q,14-/_,a-i ,--- Catherine D Seaman Deputy City Clerk PASSED and APPROVED this 16_ day of September , 1996 -4-
