REGULAR MEETING NOVEMBER 4, 1996
CALL TO ORDER
The meeting was called to order at 7 30 P M by Charles D Kilbury, Mayor
ROLL CALL
By Deputy City Clerk Councilmembers present Michael Garrison, Joe
Jackson, Chris Jensen, Charles Kilbury, Dan Lathim, Rebecca Francik, and
Carl Strode Also present Gary Crutchfield, City Manager, Leland B Kerr,
City Attorney, Bob Alberts, Public Works Director, Dave McDonald, City
Planner, and Richard Smith, Community & Economic Dev Director
PLEDGE OF ALLEGIANCE
The meeting was opened with the Pledge of Allegiance
CONSENT AGENDA
MOTION Mr Garrison moved to approve the Consent Agenda Seconded
by Mr Lath= Motion carried unanimously Consent items are as follows
A) Approval of Minutes To approve minutes of Regular Meeting held
October 21, 1996
B) Bills and Communications To approve General Claims in the amount
of $400,579 49 ($11,709 51 being in the form of Wire Transfer Nos
3115 and 3116, and $388,869 98 consisting of Claim Warrants
numbered 99130 through 99346)
Payroll Claims To approve Payroll Claims in the amount of
$619,471 34, Payroll Voucher Nos 51932 through 52160, and 52187
through 52405
Bad Debt Write-offs To approve bad debt write-offs for utility billing,
ambulance, miscellaneous, Municipal Court non-criminal, criminal and
parking accounts receivable, in the total amount of $124,535 81 and, of
that amount, authorize $124,488 23 be turned over for collection
C) Resolution No 2274 To approve Resolution No 2274, accepting the
work performed by Levernier Construction, Inc for the construction of
the Pasco Civic Center
D) Special Permit - Location of a Church and a Daycare facility at 316
North 4th Avenue (MF #96-68-CA) To approve the special permit for
the Apostolica Mission Church and Daycare Center at 316 North 4th
Avenue, as recommended by the Planning Commission
E) Rezone (Appeal) - Rezone from RS-12 (Residential Suburban) to C-3
(General Business) with development conditions (MF #96-79-Z) To set
78 30 p m, November 18, 1996, as the time and date for a Closed
Record Hearing to consider the Concinnity Inc appeal
F) Resolution No 2275 To approve Resolution No 2275, fixing 7 30
p m, December 2, 1996, as the time and date for a public hearing to
consider the proposed vacation of the north/south alley in Block 3, Plat
of Highland Park Homes Additions and portions of Owen Avenue and
Beech Avenue

G) Appointment to Housing Authority Board To concur in the Franklin
County Commission's appointment of Donna Broums to Position No 1
on the Franklin County/City of Pasco Housing Authority Board, to a
term which will expire on January 28, 1997 (filling the unexpired term
of Cynthia Hayes)

PUBLIC HEARINGS
Street Vacation - North 15 feet of Court Street Abutting Mr Quik's at 2519
West Court Street (MF #96-83-V) Mr David McDonald, City Planner,
addressed Council and noted for the record that notice of the public hearing
was published as required by law
Mr McDonald explained that John H Kim, the property owner of Lot 1,
Short Plat 86-06, requested the proposed vacation Mr Kim's request
involves that portion of Court Street right-of-way lying north of the existing
sidewalk The right-of-way in question was acquired from the State of
Washington through a right-of-way turn back agreement in conjunction with
the Court Street interchange State law requires that compensation be
obtained in conjunction with vacation of this right-of-way
Staff obtained a "Brokers Opinion of Value" from Rusty Morse, Director of
Commercial Real Estate for Coldwell Banker/Adams Realty in the amount of
$4,650 00 Mr Kim has paid that amount, plus the cost of the Broker's
Opinion
MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO CONSIDER
VACATION OF THE NORTH 15 FEET OF COURT STREET ABUTTING LOT
1, SHORT PLAT 86-06
Following three (3) calls from Mayor Kilbury for comments from the floor,
either for or against, and there being none, the public hearing was declared
closed
ORDINANCE NO. 3182
AN ORDINANCE VACATING THE NORTH 15 FEET OF COURT
STREET ABUTTING LOT 1, SHORT PLAT 86-06
MOTION Ordinance No 3182, was read by title only Mr Jensen moved to
adopt Ordinance No 3182, vacating the north 15 feet of Court Street
abutting Lot 1, Short Plat 86-06 Mr Strode seconded the motion Motion
carried unanimously

ORDINANCE NO. 3183
AN ORDINANCE PROVIDING FOR AN INCREASE FOR
LICENSE, IMPOUND AND BOARDING FEES, AND AMENDING
PASCO MUNICIPAL CODE 804 - ANIMAL CONTROL

MOTION Ordinance No 3183, was read by title only Mr Garrison moved
to adopt Ordinance No 3183, providing for an increase for license, impound
and boarding fees, and amending Pasco Municipal Code Chapter 8 04 -
Animal Control Mr Lathim seconded the motion Motion carried
unanimou sly
RESOLUTION NO. 2276
A RESOLUTION CONCERNING THE NEED TO REDUCE THE
SPEED LIMIT ON A PORTION OF 1-182 EAST OF MILE POST

MOTION Resolution No 2276, was read by title only Mr Jensen moved to
approve Resolution No 2276, recommending to the Washington State
Department of Transportation to lower the speed limit on 1-182 between Mile
Post 12 5 to Mile Post 14 0 from 70 m p h to 55 m p h Mr Strode
seconded the motion Motion carried unanimously
ORDINANCE NO. 3184
AN ORDINANCE DEALING WITH LAND DEVELOPMENT FEES
AND AMENDING THE PASCO MUNICIPAL CODE
MOTION Mr Jackson moved to adopt Ordinance No 3184, amending the
Pasco Municipal Code and adopting revised fees for special permits,
variances, short plats, preliminary plats, comprehensive plan amendments,
shoreline permits, street vacations and rezonings Mr Jensen seconded the
motion Motion carried by the following roll call vote Yes - Garrison,
Lathim, Jackson, Kilbury, No - Francik, Jensen, Strode
ORDINANCE NO. 3185
AN ORDINANCE ELECTING TO MAKE THE RETIREMENT
PROVISIONS OF CHAPTER 41 24 RCW AVAILABLE TO
RESERVE POLICE OFFICERS, AND ADDING SECTION
2 52 060 TO THE PASCO MUNICIPAL CODE
MOTION Ordinance No 3185, was read by title only Mr Garrison moved
to adopt Ordinance No 3185, electing to make the retirement provisions of
Chapter 41 24 RCW available to reserve police officers, and adding Section
2 52 060 to the Pasco Municipal Code Mr Lathim seconded the motion
Motion carried unanimously

CRO Memo of Understanding
MOTION Mr Lathim moved to authorize the Mayor to sign a revised
TRIDEC CRO Memorandum of Understanding consistent with the revisions
requested by TRIDEC Ms Francik seconded the motion Motion carried
unanimously
MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL
Council agreed to meet at 6 00 p m, November 13, 1996, in lieu of the
regularly scheduled November 11th meeting date, in honor of Veteran's Day
on November 11th, the agenda will include the 1997 Budget workshop
