REGULAR MEETING MARCH 4, 1996
CALL TO ORDER
The meetmg was called to order at 7 30 P M by Charles D Kilbury,
Mayor
ROLL CALL
By Deputy City Clerk Councilmembers present Michael Garrison, Joe
Jackson, Chris Jensen, Charles Kilbury, Dan Lathim, and Carl Strode
Also present Gary Crutchfield, City Manager, Leland B Kerr, City
Attorney, Dan Underwood, Finance Director, Dave McDonald, City
Planner, Dennis Wright, City Engineer, and Greg Garcia, Fire Chief
PLEDGE OF ALLEGIANCE
The meetmg was opened with the Pledge of Allegiance
CONSENT AGENDA
MOTION Mr Gamson moved to approve the Consent Agenda with the
amendment that Item 3(c) - Resolution No 2241 is removed Seconded
by Mr Lathim Motion carried unanimously Consent items are as
follows
A) Approval of Minutes To approve minutes of Regular Meetmg held
February 20, 1996
B) Bills and Communications To approve General Claims in the
amount of $280,282 85 ($27,946 03 bemg in the form of Wire
Transfer Nos 3055 and 3056, and $252,336 82 consistmg of Claim
Warrants numbered 95594 through 95803)
Payroll Claims To approve Payroll Claims in the amount of
$567,813 75, Payroll Voucher Nos 47175 through 47387, and
47417 through 47634
PROCLAMATION AND ACKNOWLEDGMENTS
None
VISITORS
Ms Regema Goulet, of 4812 West Sylvester Street, addressed Council to
express her concerns regardmg sections of the PMC that affect property
she owns inside the city limits She was concerned about zoning
changes to Title 22 of the PMC that restricts the minimum lot size to
7,200 square feet, the minimum floor size of the mobile unit to 1,000
square feet, and an age restriction that prevents units older than 5 years
from being issued a placement permit in a mobile home subdivision Ms
Goulet was also concerned about the requirement for pit-setting of
mobile homes and the financial burden this would place on those
wanting to place a mobile home on a lot It was her desire that Council
reconsider these changes and that Council grant a waiver to allow her
renters to use the property
Mayor Kilbury explained that a waiver could not be granted by Council
The Council does not have the legal authority to waive the existing rules
It must be done by formal process, which includes a public hearing
MOTION Mr Gamson moved to have Council direct staff to initiate a
public hearing to be held by the Planning Commission to consider a
possible new zone or reconsider the age restriction and/or the size

restriction applicable to factory assembled units Mr Lathim seconded
the motion
Mr Strode felt that the requirement for pit-setting should be
reconsidered, however, he felt that the other changes were appropriate for
the prevention of degradation by changing the square footage size
requirements
The motion carried unanimously
REPORTS FROM COMMITTEES AND/OR OFFICERS
B F Regional Council Board Meeting, February 23, 1996 Mayor Kilbury
reported that several loans were approved The meeting was routine
PUBLIC HEARINGS
Street Vacation - Indiana Street Between 18th Avenue and Lewis Street
(MF #96-04-V) Mr David McDonald, City Planner, addressed Council
and noted for the record that notice of the public hearing was published
and posted as required by law
Mr McDonald explained that the property owners representing 100% of
the abutting ownership of the area in question have requested said right-
of-way be vacated
MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO
CONSIDER VACATING INDIANA STREET EAST OF 18TH AVENUE AND
WEST OF LEWIS STREET
Following three (3) calls from Mayor Kilbury for comments from the floor,
either for or against, and there being none, the public hearing was
declared closed
ORDINANCE NO. 3150
AN ORDINANCE VACATING INDIANA STREET EAST OF
18TH AVENUE AND WEST OF LEWIS STREET
MOTION Ordinance No 3150, was read by title only Mr Gamson
moved to adopt Ordinance No 3150, vacatmg Indiana Street between
18th Avenue and Lewis Street located in Helm's 2nd Addition Mr
Strode seconded the motion Motion carried unanimously
ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS
RESOLUTION NO. 2241
A RESOLUTION APPROVING A SEPTIC TANK AND
DRAINFIELD SEWER SYSTEM FOR PROPERTY LOCATED
AT 3945 WEST COURT STREET OWNED BY COLUMBIA
ORGANIZERS, L L P
MOTION Resolution No 2241, was read by title only Mr Garrison
moved to approve Resolution No 2241, permittmg a septic tank and
dramfield sewer system for property located at 3945 West Court Street
owned by Columbia Organizers, L L P Mr Strode seconded the motion
Motion carried unanimously

MOTION Mr Gamson moved to adopt Ordinance No 3151,
establishing guidelines for development and permit review in Pasco Mr
Lathim seconded the motion
Mr McDonald explained that last year the State Legislature adopted
several new rules and standards relating to permits and development
review as an outgrowth of problems that have been experienced on the
west side of the State The Legislature set up guidelines on time-frames
to ensure timely and consistent processing of land use and permit
applications This was an attempt to fix problems on the west side of
the State, however, the regulations apply to cities on the eastern side of
the State These regulations are required to be adopted by March 31,
1996
The process used by the City of Pasco for approving rezones, preliminary
plats, and the divisions of land require a hearing by the Planning
Commission Presently, if an adjoining property owner or the applicant
disagreed with the recommendation of the Planning Commission they
could file a written appeal to the City Council Under the new State laws
that would no longer be allowed The Planning Commission will make
it's recommendation and if someone appeals that recommendation the
Council will have to base their decision on the record that was provided
by the Planning Commission
Motion carried unanimously

NEW BUSINESS
Franklin County Imgation District License
MOTION Mr Jensen moved to approve the license agreement with
Franklin County Imgation District providing for the discharge of waters
pumped from the City of Pasco wellfields and, further, authorize the
Mayor to sign the license agreement Mr Strode seconded the motion
Motion carried unanimously
MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL
Mayor Kilbury recessed to an executive session for the purpose of
discussing the sale of land
