CALL By Acting Clerk Councilmembers present Michael Gamson, Joe Jackson, Chns Jensen, Charles Kilbury, Dan Lathim, Rebecca Francik, and Carl Strode Also present Gary Crutchfield, City Manager, Leland B Kerr, City Attorney, Dan Underwood, Fmance Director, Bob Alberts, Pubhc Works Director, Dave McDonald, City Planner, Dennis Wright, City Engineer, Greg Garcia, Fire Chief, Richard Smith, Community & Economic Dev Director, Kurt Luhrs, Personnel/Risk Manager, and Liesl Smith, Management Assistant PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION Mr Gamson moved to approve the Consent Agenda Seconded by Mr Jensen Motion carried unanimously Consent items are as follows A) Approval of Minutes To approve minutes of Regular Meeting held May 20, 1996 To approve minutes of Special Meeting held May 28, 1996 B) Bills and Communications To approve General Claims in the amount of $353,675 26 ($46,824 62 bemg in the form of Wire Transfer Nos 3077 and 3079, and $306,850 64 consisting of Claim Warrants numbered 96970 through 97140) Payroll Claims To approve Payroll Claims in the amount of $570,142 54, Payroll Voucher Nos 48865 through 49089, and 49115 through 49340 Bad Debt Write-offs To approve bad debt write-offs for utility billing, ambulance, miscellaneous, and Municipal Court non- criminal and criminal and parking accounts receivable in the total amount of $50,477 11 and, of that amount, authorize S47,547 94 be turned over for collection C) Reciprocating Agreement for Overhead Charges with WSDOT To approve the reciprocating agreement eliminating billing for overhead charges between the City of Pasco and the Washington State Department of Transportation and, further, to authorize the Mayor to sign the agreement D) SR-12 - East Lewis Street Interchange Turnback Agreement To authorize the Mayor to execute the SR-12 - East Lewis Street Interchange Turnback Agreement with Washington State Department of Transportation E) Special Permit Location of a rental car lot at 620 North 20th Avenue (MF #96-36-SP) To approve the location of an Enterprise Rent-A-Car lot at 620 North 20th Avenue, as recommended by the Planning Commission MINUTES REGULAR MEETING PASCO CITY COUNCIL JUNE 3, 1996 PROCLAMATION AND ACKNOWLEDGMENTS Yard of the Month Award Mayor Kilbury presented Yard of the Month Awards for May, 1996 to the following Pasco residents Ralph and Eva Thomas, 604 North Owen Avenue Ralph and Carol Bemasch, 312 South 26th Avenue (unable to attend) Richard and Sharon Long, 1939 West Irving Street (unable to attend) Jess and Evelyn Tiffany, 1104 North 16th Avenue Ron and Shirley Vannostrand, 724 West Jay Street Rodo and Julie Lingle, 4306 Riverhill Drive (unable to attend) Ivan and Elodia Mendez, 3621 West Ella Street VISITORS None REPORTS FROM COMMITTEES AND/OR OFFICERS None PUBLIC HEARINGS Creation of LID No 125 - Frontage Road and Road 24 Mr Dennis Wright, City Engineer, addressed Council and noted for the record that notice of the pubhc hearing was published as required by law and notices were sent to the affected property owners of record Mr Wright explained to Council that on May 6,1996, Council approved Resolution No 2246 declaring its intention to create an LID and set this date for a public heanng This process follows an earlier public meetmg conducted by the Engineering staff to determine the feasibility of repeating the process completed in 1993, whereby the original attempt for this LID was made This LID has been slightly scaled back from the earlier version by elimmatmg work on Lewis Street and on 20th Avenue Staff believes this LID has a reasonable chance of succeeding and requests Council adopt the ordinance at the conclusion of the Public Hearing The Clerk read a letter of protest received from Mr Earl Wattenburger wherein he states that he doesn't feel MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO CONSIDER CREATION OF LID NO 125 - FRONTAGE ROAD AND ROAD 24 Mr Jim Christianson, of Delta Star Electric Motor Service at 2424 West Lewis Street, protested the LID because he didn't want an access road put in He felt it would place children going to and from school at risk Mr Lester Smith, of Columbia Memorial Gardens at 224 South 24th Avenue, spoke in favor of the LID He felt the access road was very necessary because people have difficulty finding the funeral home Mr Carter Miller, of Cascade Bearing, Inc at 200 South 20th Avenue, protested the LID because he didn't feel an access road to Lewis Street would be appropriate and would cause additional problems Ms Elaine Rassmussen, of 402 South 23rd Avenue, protested her assessment amount and felt it was a lot to pay for only three (3) feet of sidewalk -2- , MINUTES REGULAR MEETING PASCO CITY COUNCIL JUNE 3, 1996 Mr Wnght explained that Ms Rassmussen was not bemg assessed anything for curb, gutter and sidewalk Mr Wright pointed out that the properties located on 22nd and 23rd Avenues are being assessed only for the amount of street that is the projection of their lots on Frontage Road Ms Sylvia Dukelow, of 304 South 25th Avenue, protested her assessment amount because she is on fixed income and can't afford it Mr Crutchfield explained that citizens who are assessed for an LID, and who qualify under the low income guidelmes of the Block Grant Program, can have their assessment paid out of this fund The assessment must be on property that is zoned residential and the property owners must live on the property to qualify for this assistance Mr Mike Vincent, of 2205 West Frontage Road, spoke in favor of the LID and in particular the access road onto Lewis Street that would result from the LID Mr Underwood read a letter from Mr Earl Wattenburger into the record Mr Wattenburger protested the LID because it was too costly Mr Wright explamed to those present the correct protest procedures that would need to be followed to make an official formal protest of the LID Specifically, protests would need to be in writing and would need to be presented within the next 30 days to the City Clerk Ms Rassmussen was concerned about the number of trucks that use the roads in the area and their impact on the roads Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, the public hearing was declared closed ORDINANCE NO. 3155 AN ORDINANCE ORDERING THE IMPROVEMENT OF FRONTAGE ROAD FROM HOPKINS STREET TO 20TH AVENUE AND ROAD 24 FROM HOPKINS STREET TO LEWIS STREET, ALL IN ACCORDANCE WITH RESOLUTION NO 2246 OF THE CITY COUNCIL, ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO 125 AND ORDERING THE CARRYING OUT OF THE PROPOSED IMPROVEMENT, PROVIDING THAT PAYMENT FOR THE IMPROVEMENT BE MADE IN PART BY SPECIAL ASSESSMENTS UPON THE PROPERTY IN THE DISTRICT, PAYABLE BY MODE OF "PAYMENT BY BONDS", AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH OR OTHER SHORT- TERM FINANCING AND LOCAL IMPROVEMENT DISTRICT BONDS AND MAKING OF INTERFUND LOANS MOTION Ordinance No 3155, was read by title only Mr Garrison moved to adopt Ordinance No 3155, creating LID No 125 ordering the improvement of Frontage Road between Hopkins Street and 20th Avenue and the improvement of Road 24 between Hopkins Street and Lewis Street Mr Strode seconded the motion Motion earned by unanimous roll call vote Recovery of Abatement Cost at 508 South Beech Avenue Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published as required by law Mr McDonald explained that as a result of a lack of maintenance, the building located at 508 South Beech Avenue was determined to be -3- MINUTES REGULAR MEETING PASCO CITY COUNCIL JUNE 3, 1996 substandard and dangerous The owner of the property failed to make necessary repairs to address the substandard conditions on his property As a result the City, through application of the Uniform Housing Code, hired a contractor to raze the structure The City incurred a cost of $3,841 83 for the abatement of this structure MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO CONSIDER RECOVERY OF ABATEMENT COSTS AT 508 SOUTH BEECH AVENUE Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, and there being none, the public hearmg was declared closed MOTION Mr Gamson moved to assess abatement expenses for Lots 309 and 310, Block 12, Terrace Heights Addition, in the amount of $3,841 83 agamst the property as a special assessment and lien upon the property Mr Strode seconded the motion Motion carried unanimously ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO. 3156 AN ORDINANCE RELATING TO ZONING AND CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-2 (MEDIUM DENSITY RESIDENTIAL) TO RMH-1 (FACTORY ASSEMBLED HOME) MOTION Ordinance No 3156, was read by title only Mr Strode moved to adopt Ordinance No 3156, granting a rezone from R-2 to RMH-1, as recommended by the Planning Commission Mr Jensen seconded the motion Motion camed unanimously RESOLUTION NO. 2254 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR VINN ADDITION MOTION Resolution No 2254, was read by title only Mr Strode moved to approve Resolution No 2254, approving the preliminary plat for the Vmn Addition Mr Jensen seconded the motion Motion carried unanimously RESOLUTION NO. 2255 A RESOLUTION URGING CREATION OF A FRANKLIN COUNTY PUBLIC FACILITIES DISTRICT MOTION Resolution No 2255, was read by title only Mr Jensen moved to approve Resolution No 2255, urging Franklin County to create a public facilities district Mr Lathim seconded the motion Motion earned unanimously UNFINISHED BUSINESS None NEW BUSINESS Award of Contract for the Pearl Street Sewer, Proiect No 96-1-03 MOTION Mr Garnson moved to award the contract for the construction of the Pearl Street Sewer to the low bidder, John M Keltch, -4- MINUTES REGULAR MEETING PASCO CITY COUNCIL JUNE 3, 1996 Inc , in the amount of $73,839 60, including sales tax and, further, authorize the Mayor to sign the contract documents and to include $37,000 in the 1996 Water/Sewer Fund Supplemental Budget Mr Lathim seconded the motion Motion carned by unanimous roll call vote Award of Contract for Road 44 Sewer Interceptor, Project No 95-1-06 MOTION Mr Gamson moved the award the contract for the construction of Road 44 Sewer Interceptor to the low bidder, Tnco, Inc , in the amount of $1,675,249 56, including sales tax and, further, authorize the Mayor to sign the contract documents Ms Franck seconded the motion Motion earned by unanimous roll call vote 1996 Overlays MOTION Mr Garrison moved to award the contract for the construction of the 1996 Overlays to the low bidder, Transtate Paving, Inc , in the amount of $137,780 and, further, to authorize the Mayor to sign the contract documents Mr Jensen seconded the motion Motion earned by unanimous roll call vote HDR Agreement - Amend Engineering Report for Industrial Wastewater Facility MOTION Mr Gamson moved to approve the agreement with HDR Engineering, Inc , to amend the engineering report for the Industrial Wastewater Facility and, further, to authorize the Mayor to sign the agreement Mr Lathim seconded the motion Motion carried by unanimous roll call vote Amendment No 4 to HDR Engineering Professional Services Agreement for the Wastewater Treatment Plant MOTION Mr Gamson moved the authorize the Mayor to execute Amendment No 4 to the HDR Engineering, Inc Professional Services Agreement Mr Strode seconded the motion Motion earned unanimously Special Permit Sunderland Family Treatment Services - Location of a group care home at 1520 West Irving Street (MF #96-25-SP) MOTION Mr Strode moved to set a public hearing for June 17, 1996, at 7 30 p m , to consider a special permit for the Sunderland Family Group Home Mr Garrison seconded the motion Motion carried unanimously MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mr Garrison requested that staff provide a report at the next workshop meeting regarding the current status of accidents and problems being experienced on 20th Avenue and Court Street MOTION Ms Francik moved to have Council continue discussion of mobile home minimum standards at the next Council meeting Mr Garnson seconded the motion MOTION Mr Jensen moved to amend the motion to have Council continue discussion of mobile home minimum standards at the next workshop meeting and not refer the matter to the Planning Commission as previously directed Mr Strode seconded the motion Motion earned unanimously -5- MINUTES REGULAR MEETING PASCO CITY COUNCIL JUNE 3, 1996 Mr George Goulet, of 4812 West Sylvester Street, requested that Council reconsider this issue and realize that single-wide mobile homes are what is affordable for some low income and fixed income households ADJOURNMENT a No further business,
