CALL By Acting Deputy City Clerk Councilmembers present Michael Garrison, Joe Jackson, Chris Jensen, Charles Kilbury, Dan Lathim, Rebecca Francik, and Carl Strode Also present Gary Crutchfield, City Manager, Leland B Kerr, City Attorney, Dan Underwood, Finance Director, Dennis Wright, City Engineer, Dave McDonald, City Planner, Denis Austin, Police Chief, Greg Garcia, Fire Chief, Richard Smith, Community 86 Economic Dev Director, and Tim Arntzen, Management Assistant PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION Mr Garrison moved to approve the Consent Agenda Seconded by Mr Lathim Motion carried unanimously Consent items are as follows A) Approval of Minutes To approve minutes of Regular Meeting held December 2, 1996 B) Bills and Communications To approve General Claims in the amount of $980,891 38 ($83,062 27 being in the form of Wire Transfer Nos 3125 through 3127, and $897,829 11 consisting of Claim Warrants numbered 99716 through 99972) C) Resolution No 2285 To approve Resolution No 2285, exercising the Reserve Police Officers Retirement Election D) Resolution No 2286 To approve Resolution No 2286, authorizing interfund loan from the General Fund to the TRAC Development and Operating Fund and to the Medical/Dental Insurance Fund PROCLAMATIONS AND ACKNOWLEDGMENTS None VISITORS None REPORTS FROM COMMITTEES AND/OR OFFICERS B F Transit Authority Board Meeting Mr Garrison reported that at the last meeting various personnel items were discussed A health insurance plan was adopted for 1997 and established the pay rates for non-represented employees A number of routine contracts were extended and the 1997 Capital Budget was adopted PUBLIC HEARINGS Thomas Annexation (MF #96-88-A) MOTION Mr Garrison moved to postpone the Thomas Annexation hearing to 7 30 p m on January 6, 1997 Mr Jackson seconded the motion Motion carried unanimously MINUTES REGULAR MEETING PASCO CITY COUNCIL DECEMBER 16, 1996 Alley Vacation - The north/south alley in Block 15, Gantenbein's Addition (MF #96-77-V) Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published as required by law The City Engineer has no objection to the proposed vacation The Franklin County P U D and Cascade Natural Gas have requested that an easement be retained for the area Mr McDonald explained that this alley has been fenced off for many years and has been utilized by property owners in pursuit of their business activities MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF THE NORTH/SOUTH ALLEY IN BLOCK 15, GANTENBEIN'S ADDITION Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3201 AN ORDINANCE VACATING THE NORTH/SOUTH ALLEY IN BLOCK 15, GANTENBEIN'S ADDITION MOTION Ordinance No 3201, was read by title only Mr Garrison moved to adopt Ordinance No 3201, vacating the north/south alley in Block 15, Gantenbein's Addition Mr Lath= seconded the motion Motion carried unanimously Adult Business Moratorium (MF #1004) Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published as required by law Mr McDonald explained that on November 18, 1996, the Council adopted Ordinance No 3191 imposing a moratorium, for up to one year, on the licensing and permitting of adult entertainment businesses in Pasco RCW 36 70A 390 requires that Council hold a public hearing within 60 days of the effective date of the ordinance Immediately after the hearing, the Council must adopt findings of fact on the subject of the moratorium, and either justify its continued imposition or cancel the moratorium One of the compelling reasons for extending the moratorium is to provide the necessary time to properly study the issue Staff has developed a work program and schedule identifying major tasks and target dates for accomplishing those tasks With the need to review both the zoning regulations and the Comprehensive Plan considerable time will be involved Staff would therefore recommend that the moratorium be continued for a year MAYOR KILBURY DECLARED THE PUBLIC HEARING OPEN TO CONSIDER CONTINUATION OF A MORATORIUM ON LICENSING OF ADULT ENTERTAINMENT USES AND BUSINESSES PENDING POTENTIAL AMENDMENT OF APPLICABLE CITY REGULATIONS Mr Ken Reithmayr, 516 W Clark St (Kurt's Discount Flooring), spoke in favor of the moratorium and requested that Council consider a comprehensive over-haul of the current law He requested that Council consider a model ordinance written by the Assistant Prosecuting Attorney for Pierce County, the Assistant City Attorney for the City of Spokane, and the organization known as "Washington Together Against Pornography" Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, the public hearing was declared closed -2- MINUTES REGULAR MEETING PASCO CITY COUNCIL DECEMBER 16, 1996 ORDINANCE NO. 3202 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, ADOPTING FINDINGS OF FACT TO JUSTIFY THE CONTINUED IMPOSITION OF A ONE-YEAR MORATORIUM ON THE ACCEPTANCE OF APPLICATIONS FOR USE PERMITS, BUILDING PERMITS AND LICENSES FOR ADULT ENTERTAINMENT USES AND BUSINESSES, AS REQUIRED BY RCW 36 70A 390 MOTION Ordinance No 3202, was read by title only Mr Garrison moved to adopt Ordinance No 3202, continuing the imposition of the adult entertainment business moratorium established by Ordinance No 3191, approving the Findings and Conclusions set forth therein, and authorizing publication by summary only Mr Lathim seconded the motion Motion carried unanimously 1996 Supplemental Budget Mr Underwood, Finance Director, addressed Council and noted for the record that notice of the public hearing was published as required by law Mr Underwood explained that staff is recommending a budget supplement to the 1996 Operating Budget in the amount of $1,423,806 and the 1996 Capital Improvements Budget in the amount of $183,000 This supplement is required to meet unanticipated or indeterminable expenditure requirements at the time the 1996 Budget was adopted MAYOR KILBURY OPENED THE PUBLIC HEARING TO CONSIDER THE 1996 BUDGET SUPPLEMENTS Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3203 AN ORDINANCE AMENDING THE 1996 ANNUAL BUDGET OF THE CITY OF PASCO BY PROVIDING A SUPPLEMENTAL THERETO, BY APPROPRIATING AND REAPPROPRIATING REVENUE, BY PROVIDING TRANSFER AND EXPENDITURE AUTHORITY, BY ADJUSTING THE EXPENDITURE PROGRAM OF VARIOUS FUNDS AND THE BUDGET WITHIN FUNDS, AND DECLARING AN EMERGENCY MOTION Ordinance No 3203, was read by title only Mr Garrison moved to adopt Ordinance No 3203, authorizing the 1996 Operating Supplemental budget in the amount of $1,423,806 Mr Lathim seconded the motion Motion carried unanimously Following three (3) calls from Mayor Kilbury for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3204 AN ORDINANCE RELATING TO SUPPLEMENTAL CAPITAL IMPROVEMENTS BUDGET FOR THE YEAR 1996 MOTION Ordinance No 3204, was read by title only Mr Garrison moved to adopt Ordinance No 3204, authorizing the 1996 Capital Improvements Budget Supplement in the amount of $183,000 Mr Lathim seconded the motion Motion carried unanimously -3- MINUTES REGULAR MEETING PASCO CITY COUNCIL DECEMBER 16, 1996 , ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO. 3205 AN ORDINANCE RELATING TO LOCAL IMPROVEMENT DISTRICTS, ESTABLISHING CONSOLIDATED LOCAL IMPROVEMENT DISTRICT NO 126 ET AL AND CONSOLIDATED LOCAL IMPROVEMENT FUND, DISTRICT NO 126 ET AL, FIXING THE AMOUNT, FORM, DATE, INTEREST RATES, MATURITY AND DENOMINATIONS OF THE CONSOLIDATED LOCAL IMPROVEMENT DISTRICT NO 126 ET AL BONDS, PROVIDING FOR THE SALE AND DELIVERY THEREOF TO SEATTLE-NORTHWEST SECURITIES CORPORATION OF SEATTLE, WASHINGTON, AND FIXING THE INTEREST RATE ON LOCAL IMPROVEMENT DISTRICT ASSESSMENT INSTALLMENTS MOTION Ordinance No 3205, was read by title only Mr Garrison moved to adopt Ordinance No 3205, establishing Consolidated Local Improvement District No 126 et al and authorizing the sale of Consolidated Local Improvement No 126 et al Bonds Mr Lathim seconded the motion Mr Dick Kennedy, of Seattle-Northwest Securities Corporation, addressed Council and presented a bond purchase contract for consideration that would consolidate LID's 126, 127, and 128 into a consolidated LID Bond Issue The contract identifies Seattle-Northwest Securities Corporation as the purchaser and the City of Pasco as the seller and sets forth the interest rates on the bonds as well as the fees for handling the transactions Motion carried unanimously ORDINANCE NO. 3193 AN ORDINANCE ADOPTING THE CITY OF PASCO OPERATING BUDGET FOR THE YEAR 1997 MOTION Ordinance No 3193, was read by title only Mr Garrison moved to adopt Ordinance No 3193, authorizing the 1997 Annual Operating Budget Mr Lathim seconded the motion Motion carried unanimously ORDINANCE NO. 3194 AN ORDINANCE ADOPTING THE CITY OF PASCO CAPITAL PROJECTS BUDGET FOR THE YEAR 1997 MOTION Ordinance No 3194, was read by title only Mr Garrison moved to adopt Ordinance No 3194, authorizing the 1997 Capital Projects Budget Mr Lathim seconded the motion Motion carried unanimously RESOLUTION NO. 2287 A RESOLUTION DESIGNATING CERTAIN AREAS OF THE CITY WHERE SHOTGUN HUNTING IS AUTHORIZED DURING THE APPROPRIATE HUNTING SEASON Mr McDonald explained that Ms Fran Thomas and Courtney Calloway, of Calloway Farms, are requesting permission to shotgun hunt as a method to protect their fields from crop damage as a result of thousands of geese feeding there MOTION Mr Strode moved to approve Resolution No 2287, establishing areas within the 1-182 Corridor where shotgun hunting is permitted during official hunting seasons Mr Lathim seconded the motion -4- MINUTES REGULAR MEETING PASCO CITY COUNCIL DECEMBER 16, 1996 Ms Fran Thomas explained to Council that she would be posting notices on her property to inform the public that her property is not open to the public for hunting purposes Motion carried unanimously RESOLUTION NO. 2288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PASCO, WASHINGTON, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN THE RIVERVIEW AREA AND TO CREATE A LOCAL IMPROVEMENT DISTRICT TO ASSESS A PART OF THE COST AND EXPENSE OF CARRYING OUT THOSE IMPROVEMENTS AGAINST THE PROPERTIES SPECIALLY BENEFITED THEREBY, AND NOTIFYING ALL PERSONS WHO DESIRE TO OBJECT TO THE IMPROVEMENTS TO APPEAR AND PRESENT THEIR OBJECTIONS AT A HEARING BEFORE THE CITY COUNCIL TO BE HELD ON JANUARY 20, 1997 Mr Wright explained that staff is requesting a two week delay of the public hearing to allow additional time to contact several of the property owners who are affected by the project but cannot be served The proposed resolution includes a list of streets within which the sanitary sewers will be constructed as requested by the City's Bond Council This resolution will replace the resolution approved December 2, 1996 MOTION Mr Garrison moved to approve Resolution No 2288, fixing a date and time for a public hearing to consider creating a sanitary sewer LID generally south of Court Street and east of Road 44 Mr Jensen seconded the motion Motion carried unanimously UNFINISHED BUSINESS None NEW BUSINESS Award of Public Works Shop Remodel MOTION Mr Garrison moved to award the contract for the Public Works shop Remodel, Project No 96-2-02, to the low bidder, Booth Brothers Construction, in the amount of $182,058 84 including sales tax and, further, authorize the Mayor to sign the contract documents Mr Strode seconded the motion Motion carried by unanimous roll call vote MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mr Crutchfield introduced Mr Tim Arntzen as the new Management Assistant Mayor Kilbury recessed to an executive session at 8 14 p m to discuss legal issues and reconvened the regular meeting at 8 34 p m Mr Lathim requested that Council discuss TRAC operations more thoroughly and have Mr Crutchfield make recommendations on a method of getting together with the Franklin County Commissioners Mr Crutchfield suggested Council meet with the Commission to explore the idea of an operating agreement that would allow the City to operate TRAC on behalf of the County -5- No further business, the meeting was adjourned at 8 40 P M Charles D Kilbury, ayor / MINUTES REGULAR MEETING PASCO CITY COUNCIL
