HomeMy WebLinkAbout1995.07.17 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING JULY 17, 1995 CALL TO ORDER The meeting was called to order at 7 30 P M by Joyce DeFelice, Mayor ROLL CALL By City Clerk Councilmembers present Joyce DeFelice, Michael Gamson, Edgar Hargrow, Chns Jensen, Charles Kilbury, Dan Lathim, and Carl Strode Also present Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Dan Underwood, Fmance Director, Bob Alberts, Pubhc Works Director, Greg Garcia, Fire Chief, Dick Erickson, Parks & Recreation Director, Dave McDonald, City Planner, Webster Jackson, Personnel/Purchasing, Richard Smith, Community & Economic Dev Director, and Denis Austin, Police Chief PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION Mr Garrison moved to approve the Consent Agenda Seconded by Mr Lathim Motion carried unanimously Consent items are as follows A) Approval of Minutes To approve minutes of Regular Meeting held June 19, 1995 Minutes of the Special Meeting of the Pasco City Council, dated June 26, 1995 B) Bills and Communications To approve General Claims in the amount of 8430,073 60 ($31,729 21 being in the form of Wire Transfer Nos 2998 through 2999, and $398,344 39 consisting of Claim Warrants numbered 92221 through 92456) To approve General Claims in the amount of $1,060,833 98 (13,522 21 being in the form of Wire Transfer No 2303, and $1,047,311 77 consisting of Claim Warrants numbered 92457 through 92703) Payroll Claims To approve Payroll Claims in the amount of $555,927 70, Payroll Voucher Nos 42794 through 43010, and 43037 through 43294 Bad Debt Write-offs To approve bad debt write-offs for utility billing, ambulance, cemetery, and Municipal Court non-criminal and criminal accounts receivable, in the total amount of $65,422 36 and, of that amount, authorize $61,215 42 be turned over for collection C) Easement for the Franklin County PUD adiacent to St Andrews Loop To authorize the Mayor to sign an easement granting the Franklin County PUD the right to install, operate and maintain PUD lines adjacent to St Andrews Loop D) Resolution No 2194 To approve Resolution No 2194, fixing 730 p m, August 7, 1995, as the time and date for a public hearmg to consider the proposed vacation MINUTES REGULAR MEETING PASCO CITY COUNCIL JULY 17, 1995 E) Resolution No 2195 To approve Resolution No 2195, fixing 730 p m, August 7, 1995, as the time and date for a public hearing to consider the proposed vacation F) Special Permit Construction of the Work Force Training Center on the Columbia Basin Community College Campus (MF #95-38-SP) To approve the special permit for the construction of the Work Force Training Center, as recommended by the Planning Commission G) Amendment to Bi-PIN Agreement To approve the Amendment to the Bi-County Police Information Network (Bi-PIN) Interlocal Agreement, dated November 19, 1991 H) Resolution No 2196: To approve Resolution No 2196, accepting the work by D Fortune Company to furnish and install an imgation system and landscaping at Pasco City Hall PROCLAMATION AND ACKNOWLEDGMENTS "Yard of the Month" Awards: The following Pasco residents were present at the Council Meeting to receive Certificates of Appreciation from Mayor Joyce DeFelice for "Yard of the Month", June, 1995 Blas and Sylvia Ohvera, 231 West Bonneville Street Donald Fontaine, 403 South 25th Avenue (unable to attend) Gene and Opal White, 1119 West Irving Street Enk and Mary Ann Sorensen, 811 West Margaret Street (unable to attend) Jon and Claudette Fnedenchs, 1927 North 19th Avenue (unable to attend) Craig and Sandi Richter, 4302 Riverhill (unable to attend) VISITORS Zoning Vanence Request Mr Dustin Hammerberg, of 1603 West Yakima Street, addressed Council concerning his property at 414 North 23rd Avenue He explained that he came before Council on June 5, 1995, to ask for a variance to allow him to place a mobile home, that was under the 1,000 square feet minimum, on the property This request was denied Since that time he has applied for, and received, a placement permit and building permit for the mobile home He is buildmg an addition to the mobile home to bring it up to code requirements for the minimum square footage, however, he feels he is being harassed and singled out by a certain staff member He asked why he was bemg denied the right to occupancy while the addition is bemg built Mayor DeFelice suggested to Mr Hammerberg that he meet with the City Manager and several Councilmembers to attempt to reach a resolution to this problem Pasco Housing Authority - Harassment/Discrimination Claims Ms Mary Waters, of 311 West Octave Street and a resident of the Pasco Housing Authority Senior Units, addressed Council to discuss conditions at the Housing Authority and asking for the removal of four of the commissioners and administrative staff That request did not mclude clerical or maintenance personnel It was her understandmg that the City has contacted the Housing Authority and requested that they talk with the residents about their complamts, however, residents have tried for over two years to get listened to and to have changes made There has been no apparent response from the Housing Authority She asked what could be done to correct to problems of residents because there is discriminatory practices being used at the Housing Authority -2- MINUTES REGULAR MEETING PASCO CITY COUNCIL JULY 17, 1995 • 4 ‘,1 Mr Crutchfield explamed that the Housing Authority is a separate municipal corporation It is not an advisory board of the City where the members can be removed at will, and as such the Board members are appointed to five year terms on a staggered basis They can be removed only for neglect of duty or misconduct in office The City has not been presented with any evidence which would constitute a violation of either of those standards If there is sufficient evidence presented to the City or County Commissioners, which would need to be in the form of a finding by another party, that someone has violated the law this information would be considered when deciding whether or not to consider removal of the person found in violation State law specifies that any removal process requires a notice of hearing be provided to the board member so accused It's not a simple matter of violating ones perceived standard of conduct, it has to violate a legal standard of conduct Ms Waters asked if the residents could prove harassment and/or discrimination charges through a third party this could be brought to the Council for consideration? Mr Crutchfield stated that was correct The third party could be the Human Rights Commission, the HUD (which oversees the housing program) Either of these agencies could investigate complaints or to find that one or more board members violated some law This information could be considered by the Council in deciding whether or not to initiate removal consideration Ms Alice Doncaster, of 4122 West Mane Street, explained that she had provided Mr Crutchfield and the Housing Authority with a list of concerns and was anxiously awaiting a response from both parties Her list of concerns included allegations of conducting illegal meetings, violating their code of misconduct, questions of conflict of interest, the potential violation of civil rights, and distributing confidential information as public record Mr Crutchfield pointed out that the Council would be receiving additional information provided by Ms Doncaster and a report from staff advising Council of what the legal standards are The report would also explain whether or not the complaints that have been filed and reviewed constitute sufficient grounds to consider any action He emphasized that the City is not an investigative body for any claim of violation that might be lodged against the Housing Authority or any other body Mr Kilbury felt it was important to emphasize the fact that the Council is not an investigative body and the requirements for the Council to take action against members of the Housing Authority are clearly defined by ordmance REPORTS FROM COMMITTEES AND/OR OFFICERS Pasco Downtown Development Association Board Meeting, June 20, 1994 Mr Kilbury was unable to attend the meeting Tn-Cities Visitor & Convention Bureau Board Meeting, June 22, 1995 Mr Lathim reported that phone and letter inquiries have increased, convention leads have increased due to TRAC and some other things, the renewal of all cities for the five year funding plan has given the Bureau the go ahead to plan for the future, and the Bureau has also taken a strong stance on nvershore enhancement B F Health Board Meeting, June 22, 1995 Mr Strode explained that the meeting was rescheduled and he had no report -3- MINUTES REGULAR MEETING PASCO CITY COUNCIL JULY 17, 1995 Benton-Franklm Regional Council Board Meeting, June 23, 1995 Mr Lathim attended the meeting for Mr Kilbury, but failed to bring the report with him Association of Washington Cities Annual Convention, June 27 - June 30, 1995 Mr Lathim reported that he attended numerous seminars and net-worked with representatives from other communities that were attending the convention He learned that next year the Annual Convention will be held in Pasco Senior Citizens Advisory Committee Meeting, July 10, 1995 Mayor DeFelice was unable to attend the meeting Parks & Recreation Advisory Council Meeting, July 13, 1995 Mayor DeFelice was unable to attend the meeting B F Transit Board Meeting, July 13, 1995 Mr Garrison reported that a resolution was approved to purchase land for future expansion, the new General Manager, Tim Frederickson, was welcomed PUBLIC HEARINGS Street Vacation - FR-3 Line State Access Road (MF #95-42-V) Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published as required by law Mr McDonald explained that the property owner representing 100% of the abutting privately held ownership of the area in question and has requested said right-of-way be vacated The property owner is requesting the vacation to enable development of a grocery store complex Originally the right-of-way was only created to provide access to the northern property, however, since the northern and southern parcels are held under the same ownership the access road is no longer needed Part of this process requires the developer to provide a deed or easement which would extend 26th Avenue on the east side of the property This is required because part of the FR-3 Line was purchased with federal money when the highway was constructed Staff proposes to trade for additional property for the extension of 26th Avenue, however, the developer has not yet provided the signed easement The City Attorney advises that Council hold the hearing and at a later date, when the easement is ready, present it for Council acceptance and for adoption of an ordinance that would vacate the FR-3 Line MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER VACATION OF THE FR-3 LINE RIGHT-OF-WAY Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public hearmg was declared closed ORDINANCE NO. 3094 AN ORDINANCE VACATING THE FR-3 LINE LOCATED NORTHEAST OF COURT STREET AND HIGHWAY 395 MOTION Ordinance No 3094, was read by title only Mr Strode moved to table Ordinance No 3094, until further action on obtaining the easement for Road 26 Mr Kilbury seconded the motion Motion earned unanimously -4- MINUTES REGULAR MEETING PASCO CITY COUNCIL JULY 17, 1995 ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO. 3095 AN ORDINANCE ESTABLISHING THE SPEED LIMIT ON CERTAIN STREETS AND AMENDING PMC 10 24 040 MOTION Ordinance No 3095, was read by title only Mr Strode moved to adopt Ordmance No 3095, establishing a 35 m p h speed limit on Commercial Avenue between St Helens Street and the Kahlotus Highway, and on Broadmoor Parkway between Road 100 and Road 68 and, further, to establish a 30 m p h on Burden Boulevard between Road 68 and Road 60 Mr Garrison seconded the motion Motion earned unanimously ORDINANCE NO. 3096 AN ORDINANCE RELATING TO ZONING AND AMENDING PMC TITLE 22 MOTION Ordinance No 3096, was read by title only Mr Gamson moved to adopt Ordinance No 3096, amending PMC Title 22 by eliminating references to "modular" and "manufactured homes", creating a definition and standards for "factory assembled homes" and authonze publication by summary Mr Jensen seconded the motion Motion earned unanimously ORDINANCE NO. 3097 AN ORDINANCE CONCERNING RESTRICTED PARKING AND AMENDING §1056 110 OF THE PASCO MUNICIPAL CODE MOTION Ordinance No 3097, was read by title only Mr Hargrow moved to adopt Ordinance No 3097, revising the Pasco Municipal Code to create two-hour parking adjacent to the Histoncal Society Mr Garrison seconded the motion Motion earned unanimously UNFINISHED BUSINESS None NEW BUSINESS Demolition Contracts MOTION Mr Jensen moved to award the demolition contracts to the low bidders, as follows 1 Mahaffey Enterpnses for 120 West Sylvester, in the amount of $5,433 12 2 Andnst Enterpnses for 322 North Second, in the amount of $5,659 50 Mr Kilbury seconded the motion Motion earned by unanimous roll call vote Conciliation Agreement between HUD, City of Pasco, Housing Authonty of Pasco and Franklin County and Office of Rural and Farmworker Housing Mr Crutchfield explained that a year ago there was discussion between the City and the Housing Authonty regarding a proposed housing farmworker housing project to be located on 26th Avenue and Henry Street The Housing Authority, in conjunction with the Office of Rural and Farmworker Housing, filed discnmmation charges with the -5- MINUTES REGULAR MEETING PASCO CITY COUNCIL JULY 17, 1995 Department of Housing and Urban Development These charges constituted a legal action against the City After a mediation session the misunderstanding was resolved in the form of the settlement agreement It is understood that the City will treat the proposed housing project at 26th and Henry Street like it would any other apartment project In exchange for this the Housing Authority will acknowledge and pursue the City's objective that all future housing projects, to the extent practicable, disburse those units in smaller increments throughout the community MOTION Mr Jensen moved to approve the Conciliation Agreement for settlement of the complaints filed against the City and City officials with the Department of Housing and Urban Development by the Housing Authority of the City of Pasco and Franklin County and by the office of Rural and Farmworker Housing, and authorize the Mayor to sign same Mr Lathim seconded the motion Motion earned unanimously Sale of Sul plus Vehicle MOTION Mr Garrison moved to declare one 1966 Ford water-tank truck surplus to city need and authorize staff to advertise and sell, as is and where is, by the sealed competitive bid process, subject to a minimum price of not less than $1,800 Mr Kilbury seconded the motion Motion carried unanimously Additional Court Services Specialist MOTION Mr Garrison moved to authorize the City Manager to employ a second Court Services Specialist and include the estimated $15,000 expense in the 1995 General Fund Supplemental Budget Mr Lathim seconded the motion Motion earned by unanimous roll call vote MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Image Campaign Program Report Ms Liz Johnson, of Ultimedia, Inc , reported to Council that presentation folders have been developed for distribution during realtor tours of the different school district facilities The packets can be used when staff or Councilmembers are speaking at the Rotary Club, the Visitor & Convention Bureau, etc The packets can be used by the School District, the Port of Pasco, Franklin County P U D, etc These packets contain multiple pieces of information that can be used to target specific audiences As part of the public image campaign some public access programing has been developed There were also supporting advertonals in the Tn-City Herald Ms Johnson gave a presentation of the television commercials recorded by Ultimedia, Inc , that included interviews with citizens in the community Citizens were asked to talk about what Pasco means to them These mterviews were edited together into the commercials There is a version of the commercials for non-english speaking persons to be run on Umvision Ms Johnson presented Mayor DeFelice, and the Council, with a 1995 Chinook Advertising Award for a public service announcement put together for Univision on services available -6- .0.,7_, Felice, Mayor Jo MINUTES
