HomeMy WebLinkAbout1995.12.18 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING DECEMBER 18, 1995 CALL TO ORDER The meeting was called to order at 7 30 P M by Joyce DeFelice, Mayor ROLL CALL By Deputy City Clerk Councilmembers present Joyce DeFelice, Michael Garrison, Chns Jensen, Charles Kilbury, Dan Lathim, and Carl Strode Councilmembers absent Edgar Hargrow Also present Gary Crutchfield, City Manager, Leland B Kerr, Interim City Attorney, Dan Underwood, Fmance Director, Bob Alberts, Public Works Director, Dave McDonald, City Planner, Dennis Wnght, City Engmeer, Richard Smith, Community & Economic Dev Director, and Kurt Luhrs, Administrative Assistant PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION Mr Garrison moved to approve the Consent Agenda Seconded by Mr Strode Motion earned unanimously Consent items are as follows A) Approval of Minutes To approve mmutes of Regular Meeting held December 4, 1995 B) Bills and Communications To approve General Claims m the amount of $479,836 87 (840,347 07 bemg in the form of Wire Transfer Nos 3033 and 3039, and S439,489 80 consisting of Claim Warrants numbered 94577 through 94778) PROCLAMATION AND ACKNOWLEDGMENTS None VISITORS None REPORTS FROM COMMITTEES AND/OR OFFICERS Tn-MATS RTPO Policy Advisory Council Meeting, December 14, 1995 Mr Kilbury reported that Members recounted transportation projects in their areas It was recommended to reduce the speed limit on SR-395 from Oregon Avenue Interchange to one thousand feet (1,000') north of Foster Wells Road For all other Interstate roads it was approved to increase the speed limit to 70 mph B F Transit Board Meeting, December 14, 1995 Mr Garrison reported that pay mcreases were approved for the non-represented employees A resolution was adopted on the 1996 Operating and Capital Budgets for the Transit Authority A resolution was passed requesting authorization to go to bid on sixteen (16) para-transit vehicles The remainder of the meeting was routine B F Regional Council Board Meetmg, December 15, 1995 Mr Kilbury reported that Mr Charlie Howard, of the Department of Transportation, gave a dissertation on the new Highway System Act The plan certification of the Regional Revolving Loan Fund was adopted, and two annual appointments were made to the Advisory Committee The Board MINUTES REGULAR MEETING PASCO CITY COUNCIL DECEMBER 18, 1995 adopted support for the revision of speed limits throughout the RTPO, but lowermg the speed limit on SR-395 from Oregon Avenue Interchange to East Foster Wells Road PUBLIC HEARINGS Final Assessment Roll for LID No 128 Mr Dennis Wright, City Engineer, addressed Council and noted for the record that notice of the public heanng was published and notices mailed as required by law Mr Wnght explained that LID 128 was created at the request of the Port of Pasco and consisted of the construction of sanitary sewer, mdustnal wastewater sewers, water lines, streets, curbs and gutters, illumination and a sanitary sewer lift station for the development of the first phase of -r the Port of Pasco Industnal Park, located south of Foster Wells Road just west of SR-395 The LID was amended to mclude additional improvements for widenmg SR-395 at Foster Wells Road to accommodate a request of the Department of Transportation At the start of the LID there were three (3) parcels owned by the Port of Pasco After the LID was created three (3) parcels were transferred to J R Simplot Co , Amencold, and the Franklin County PUD Franklin County PUD filed a letter of protest on the LID stating they didn't feel it was fair that they should be assessed for some of the improvements The work performed on this project is now complete and the fmal costs are known Staff notes that the final assessments are approximately 33 percent under the preliminary assessment roll amounts Staff feels that the assessment roll is fair and just and requests Council adopt the ordinance confirmmg the assessment roll MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE FINAL ASSESSMENT ROLL FOR LID NO 128 The Clerk read a letter into the record addressed to Mr Dennis Wnght from Kenneth Sugden, manager of the Franklin County PUD regarding their objection to Assessment Roll for LID #128 - Pasco Processing Center The letter stated that Franklin PUD built an electrical substation on the subject property to provide services to the Pasco Processing Center The electncal substation does not use the services or facilities provided by the LID Mr Wnght explained that the Mr Sugden is not totally correct in his assertion that the PUD does not use the services or facilities provided by the LID Approximately $40,000 of the money spent under the LID was to place the conduits that will be owned, and exclusively used, by the Franklin County PUD to extend services to their customers as the area is developed Therefore, they will expenence some direct use and they will also use some water at their site Staff feels that the Franklin County PUD does receive benefit from the LID Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none other than the letter read into the record, the public hearmg was declared closed Mr Strode asked what direction was received from the Franklm County PUD in sizing and locating the conduits'? Mr Wright explained that the sizes of the conduits were as directed by the consultant for the Franklin County PUD The Port of Pasco, not only gave up acreage for the substation, but was also required to donate to the PUD an easement of twenty feet (20') in width on private property -2- MINUTES REGULAR MEETING PASCO CITY COUNCIL DECEMBER 18, 1995 Mr Strode asked if the installation of these conduits, at a later time, would cost significantly more than the $40,000 quoted'? Mr Wright concurred with Mr, Strode and explamed that if the roadway were torn up to install these conduit lines at a later time it would be much more expensive Mr Strode asked if it would be correct to assume if all the conduits, that were sized and located due to in-put from the Franklin County PUD, were installed at a later date it would cost more to the PUD and the property owners they would serve in the future'? Mr Wright concurred with Mr Strode's statement ORDINANCE NO. 3126 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO 128 FOR THE IMPROVEMENT OF PROPERTIES IN THE PASCO PROCESSING CENTER, AS PROVIDED BY ORDINANCE NO 3032, AS AMENDED BY ORDINANCE NO 3048, AND LEVYING AND ASSESSING THE COST AND EXPENSE THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY AS SHOWN ON THE ASSESSMENT ROLL MOTION Ordinance No 3126, was read by title only Mr Garrison moved to adopt Ordinance No 3126, confirming the Final Assessment Roll for LID No 128 Mr Strode seconded the motion Motion carried unanimously Recovery of Abatement Costs at 120 West Sylvester Street Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published and posted on the property as required by law Mr McDonald explamed that due to a lack of maintenance, the building located at 120 West Sylvester Street, was determined to be substandard and dangerous The property owner failed to make needed repairs As a result the City, through application of the Uniform Housing Code, hired a contractor to raze the structure The City incurred a cost of $6,074 57 for the abatement of this structure Staff recommends that abatement expenses be assessed against the property as a lien MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE RECOVERY OF ABATEMENT COSTS AT 120 WEST SYLVESTER STREET Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public hearing 'was declared closed MOTION: Mr Jensen moved to assess abatement expenses for Lot 14, Block 26, N P Plat, in the amount of $6,074 57 against said property as a special assessment and lien upon the property Mr Strode seconded the motion Motion earned unanimously Recovery of Abatement Costs at 209 North 7th Avenue Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published as required by law -3- MINUTES rREGULAR MEETING PASCO CITY COUNCIL DECEMBER 18, 1995 Mr McDonald explained that due to a lack of maintenance, the building located at 209 North 7th Avenue, was determined to be substandard and dangerous The property owner failed to make needed repairs As a result the City, through application of the Uniform Housing Code, hired a contractor to raze the structure The City incurred a cost of $7,574 75 for the abatement of this structure MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE RECOVERY OF ABATEMENT COSTS AT 209 NORTH 7TH AVENUE Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public heanng was declared closed MOTION: Mr Jensen moved to assess abatement expenses for the north 56 feet of Lots 9 and 10 and the west 12 feet of Lot 11, except the south 84 feet thereof, Pettit's Addition, in the amount of $7,574 75 against said property as a special assessment and hen upon the property Mr Strode seconded the motion Motion carried unanimously ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS Ordinance No. 3122 An Ordinance amending the 1995 Annual Budget of the City of Pasco by providing a supplemental thereto, by appropriating and reappropnatmg revenue, by providing transfer and expenditure authority, by adjusting the expenditure program of vanous funds and the budget within funds, and declaring an emergency MOTION Mr Gamson moved to adopt Ordinance No 3122, authonzmg the 1995 Operatmg Supplemental Budget in the amount $4,596,890 Mr Lathim seconded the motion Motion carried by unanimous roll call vote Ordinance No. 3123 An Ordinance relatmg to Supplemental Capital Improvements budget for the year 1995 MOTION Mr Garrison moved to adopt Ordinance No 3123, authorizing the 1995 Capital Improvements Budget Supplement in the amount of $786,900 Mr Lathim seconded the motion Motion carried by unanimous roll call vote Ordinance No. 3124 An Ordinance adopting the City of Pasco Operating Budget for the Year 1996 MOTION Mr Gamson moved to adopt Ordinance 3124, authorizing the 1996 Annual Operating Budget Mr Lathim seconded the motion Motion carried by unanimous roll call vote Ordinance No. 3125 An Ordinance adopting the City of Pasco Capital Projects Budget for the Year 1996 MOTION Mr Garrison moved to adopt Ordinance No 3125, authorizing the 1996 Capital Projects Budget Mr Lathim seconded the motion Motion earned by unanimous roll call vote -4-
