HomeMy WebLinkAbout04-24-1995 MinutesMINUTES PASCO CITY COUNCIL SPECIAL MEETING APRIL 24, 1995 CALL TO ORDER The meeting was called to order at 7 30 P M by Charles Kilbury, Mayor Pro-tern ROLL CALL By City Clerk Councilmembers present Charles Kilbury, Mike Gamson, Dan Lathim, Carl Strode, Chns Jensen Councilmember(s) absent Joyce DeFelice, Edgar Hargrow Also present Greg Rubstello, City Attorney, Dan Underwood, Fmance Director, Bob Alberts, Public Works Director, Dick Enckson, Parks & Recreation Director, Greg Garcia, Fire Chief, Richard Smith, Community & Economic Dev Director, and Kurt Luhrs, Administrative Assistant NEW BUSINESS Settlement of Courthouse Lease Dispute Mr Crutchfield explained that the Special Meeting was arranged as a result of a two (2) day mediation session held last week The County and the City representatives worked to negotiate a settlement of the outstanding lease dispute This dispute has been outstanding for the better part of three (3) years The Special Meeting was set in anticipation of taking formal action, however, after a discussion with Mayor DeFelice today, it was concluded that perhaps it would be best if the Council reviewed the tentative agreement in executive session After the executive session Council can indicate whether or not the matter will be scheduled for formal action at the next regular meeting This will give the public a week to review the proposed settlement and offer public comment He recommended that Council retire to a bnef executive session to review the proposed settlement and then reconvene the meeting and advise whether or not Council wants the issue put on the agenda for the next regular meeting for formal action MOTION Mr Garrison moved that Council recess to an executive session Mr Strode seconded the motion Motion earned unanimously Mayor Pro-tem Kilbury recessed the special meetmg to an executive session to discuss the proposed settlement at 7 35 p m Mayor Pro-tern Kilbury reconvened the special meeting at 7 50 p m and asked Mr Crutchfield to explain the proposed settlement Mr Crutchfield explained that retired Franklin County Supenor Court Judge Richard Patrick acted as mediator durmg the mediation sessions The foundation of the agreement reached through mediation mvolved the County building a new Supenor Court on the top floor of the Public Safety Building It was felt that this would be a better expense of tax monies for the long run, because currently there is a need for a new Supenor Courtroom This courtroom would fill long term cnmmal justice needs for Franklin County better than a small municipal courtroom built by the City The City has agreed to this concept, therefore, the agreement calls for the County to construct, within the next two (2) years, a new Supenor Courtroom Once this is accomplished it will free up a small courtroom on the second floor The Municipal and District Courts can equally share that courtroom and the main floor courtroom The result will be two (2) full time courtrooms available for the two (2) lower courts In the meantime, the small courtroom that the County has remodeled to handle some of the District Court needs, will be made available to the Char es yor Pro-t MINUTES SPECIAL MEETING PASCO CITY COUNCIL APRIL 24, 1995 Municipal Court This will enable both courts to effectively function on a full-time basis until the new courtroom is constructed The Municipal Court offices will be located in the section of the Public Safety Building formerly occupied by the Police Department The City will be responsible for all costs associated with remodeling that space to house the clerk's functions, judge's chambers, and the probation/work crew supervisor offices The balance of the office space on the main floor, that was previously used by the City as well as all of the space downstairs, would be immediately relinquished to the County for their use The negotiated value of the space which the City would relinquish to the County under the pre-paid lease was set at $90,000 This will represent a financial credit for the City and will be applied against the City's annual share of operation and maintenance costs of the Court House This is a drop from 12% of the building's square footage to 6%, thus representing 4 to 6 years of 0/M credit It was agreed that term associated with the original 40 year lease would not change, expinng in 2012 It was also agreed that the City would meet with the County before May 18, 1995, to formally approve a lease amendment document to reflect the revised terms and conditions Mayor Pro-tem Kilbury opened the floor for comment After calling three (3) times for public comment he brought the matter to the table for consideration RESOLUTION NO. 2183 A RESOLUTION APPROVING THE SETTLEMENT REACHED IN MEDIATION BETWEEN REPRESENTATIVES OF THE CITY OF PASCO AND THE FRANKLIN COUNTY BOARD OF COMMISSIONERS CONCERNING THE PUBLIC SAFETY BUILDING LEASE MOTION Resolution No 2183, was read by title only Mr Jensen moved to approve Resolution No 2183, approving the mediation settlement concerning the Public Safety Building Lease Mr Strode seconded the motion Motion carried by
