HomeMy WebLinkAbout1994.10.03 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 3, 1994 CALL TO ORDER The meeting was called to order at 7 30 P M by Joyce DeFelice, Mayor ROLL CALL By Deputy City Clerk Councilmembers present Joyce DeFelice, Edgar Hargrow, Chris Jensen, Charles Kilbury, Dan Lathim, and Carl Strode Councilmembers absent Michael Garrison Also present Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, David McDonald, City Planner, Dennis Wright, City Engineer, and Richard Erickson, Parks & Recreation Director PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION Mr Lathim moved to approve the Consent Agenda Seconded by Mr Hargrow Motion earned unanimously Consent items are as follows A) Approval of Minutes To approve minutes of Regular Meeting held September 19, 1994 To approve minutes of the Special Meeting of September 26, 1994 B) Bills and Communications To approve General Claims in the amount of $1,662,742 52 ($14,759 68 being in the form of Wire Transfer No 2933, and $1,647,982 84 consisting of Claim Warrants numbered 88146 through 88551 Payroll Claims To approve Payroll Claims in the amount of $776,837 08, Payroll Voucher Nos 38162 through 38393, and 38419 through 38639, and 38654 through 38858 Bad Debt Write-offs To approve bad debt write-offs for utility billing, ambulance, cemetery, miscellaneous, and Municipal Court non-criminal and criminal accounts receivable in the total amount of $81,790 94 and, of that amount, authorize $75,925 13 be turned over for collection C) Special Permit Location of a Day Care Center at 1215 West Court (MF #94-61-SP) To approve the special permit for the Day Care Center at 1215 West Court Street, as recommended by the Plannmg Commission D) Rezone C-1 to C-3, 3408 West Court Street (Killarney's Old Heidi Haus) (MF #94-57-Z) To fix 7 30 p m, Monday, October 17, 1994, as the time and date to consider the Simpsons Appeal E) Resolution No 2153 To approve Resolution No 2153, fixing 7 30 p m, November 7, 1994, as the time and date for a public hearing to consider the proposed vacation MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1994 PROCLAMATION AND ACKNOWLEDGMENTS Proclamation for "Breast Cancer Awareness Month", October 1994, and "Mammography Day", October 19, 1994 Mr Robert Marple, Jr, Board President of the Benton-Franklin Unit of the American Cancer Society "Yard of the Month" Awards (NO WRITTEN MATERIAL ON AGENDA) The following Pasco residents received Certificates of Appreciation from Mayor Joyce DeFelice for "Yard of the Month", August 1994 Dan and Patty Miner, 627 N Sycamore Street (unable to attend) Harry and Margaret Tracy, 2722 W Hopkins (unable to attend) Harold and Mildred Jacob, 1727 W Bonneville Glen and Agnes Hansey, 700 Road 32, Lot 87 (unable to attend) Armen and Dixie Weishaar, 216 Willow Court (unable to attend) Chuck and Carrie Chambers, 3908 Meadow Beauty Drive (unable to attend) VISITORS Mr Paul Lawson, of 319 S 26 Avenue, addressed Council regarding the proposed reconstruction of the intersection at 10th Ave and Sylvester St , which he was told would result in the loss of approximately 5 parking spaces for his building located on that corner Mr Lawson felt this would be a burden to current renters in his building and would also affect his ability to get renters in the future He requested that Council instruct staff to include him in the planning process to hopefully reduce the impact on his building Mayor DeFelice felt this was a reasonable request and with the concurrence of Council requested that staff meet with Mr Lawson about this issue REPORTS FROM COMMITTEES AND/OR OFFICERS Mayor's Activity Report Due to an equipment malfunction information on this report was not available B F Good Roads Meeting, September 21, 1994 Due to an equipment malfunction information on this report was not available Tn-Cities Visitor and Convention Bureau Board Meeting, September 22, 1994 Due to an equipment malfunction information on this report was not available Liberty Theater Meetings, September 22 and 29, 1994 Mr Hargrow reported that he didn't attend the meeting on the 22nd and the meeting of the 29th was canceled B F Health Board Meeting, September 22, 1994 Due to an equipment malfunction information on this report was not available B F Regional Council Board Meeting, September 23, 1994 Due to an equipment malfunction information on this report was not available PUBLIC HEARINGS Processing Center L I D Additions Mr Dennis Wright, City Engineer, addressed Council and noted for the record that notice of the public hearing was published and mailed to affected property owners as required by law - 2 - MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1994 Mr Wright reported that after the adoption of the original ordinance for LID 128 the State requested that the Port of Pasco take some action to mitigate the traffic related problems caused by the development in that area That will include widening Foster Wells Road and on Highway 395 to create deceleration and turn lanes MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE BOUNDARIES AND SCOPE OF WORK FOR L I D NO 128 AT THE PORT PROCESSING CENTER Mr Mack Funk, of 3912 W Park St (representing the Port of Pasco), spoke on behalf of the amendment to LID 128 Mr Funk explained that the amendment and the original LID were vital to the Port of Pasco for the development of the Simplot processing plant Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3048 AN ORDINANCE RELATING TO LOCAL IMPROVEMENT DISTRICT NO 128, AMENDING ORDINANCE NO 3032 BY ENLARGING THE BOUNDARIES OF THAT DISTRICT AND PROVIDING FOR AND ORDERING ADDITIONAL IMPROVEMENTS MOTION Ordinance No 3048 was read by title only Mr Jensen moved to adopt Ordinance No 3048, amending the L I D boundaries and scope of work for L I D No 128 at the Port Processing Center Mr Strode seconded the motion Motion carried unanimously Modifications to the Broadmoor Parkway L I D Mr Dennis Wnght, City Engineer, addressed Council and noted for the record that notice of the public hearing was published and mailed to affected property owners as required by law Mr Wright explained that after LID 126 was created for street improvements to Broadmoor Parkway, Metropolitan Mortgage requested that the City also include some improvements on Road 100 to the LID Those improvements include the widening of Road 100 just north of the 1-182 Interchange, which was adjacent to one of Metropolitan's properties The additional area added to the LID was the property south of the interchange adjacent to Metropolitan's business park MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER MODIFYING THE BOUNDARIES AND SCOPE OF WORK FOR L I D NO 126 Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3049 AN ORDINANCE RELATING TO LOCAL IMPROVEMENT DISTRICT NO 126, AMENDING ORDINANCE NO 3010 BY ENLARGING THE BOUNDARIES OF THAT DISTRICT AND PROVIDING FOR AND ORDERING ADDITIONAL IMPROVEMENTS -3-. MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1994 MOTION Ordinance No 3049 was read by title only Mr Jensen moved to adopt Ordinance No 3049, modifying the boundaries and scope of work for L I D No 126 and, further, authorizing staff to negotiate a change order with the contractor to make the improvements Mr Strode seconded the motion Motion carried unanimously Street Vacation - North/South Alleys in Block 137, Pasco Land Company's First Addition (MF #94-44-V) Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public hearing was published and posted as required by law Mr McDonald explained that at the last public hearing on this issue the owners of Fasteners expressed their concern that if the entire alley was vacated they wouldn't be able to access the loading dock at the rear of their building After the last public hearing staff met with the owners of Fasteners and Mr Bob Gilbert about the possibility of vacating just the southern portion of the alley All parties were in agreement to do this MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF THE NORTH/SOUTH ALLEY IN BLOCK 137, PASCO LAND COMPANY'S FIRST ADDITION Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3050 AN ORDINANCE VACATING A PORTION OF THE NORTH/SOUTH ALLEY IN BLOCK 137, PASCO LAND COMPANY'S FIRST ADDITION MOTION Mr Jensen moved to adopt Ordinance No 3050, vacating a portion of the north/south alley abutting Lots 9-16, Block 137, Pasco Land Company's First Addition Mr Strode seconded the motion Mr Strode wanted to congratulate staff for their diligence in this particular matter and for helping the parties involved to reach a mutually satisfactory solution to the problem Mayor DeFelice also felt staff had done a good job of helping all parties involved reach a solution Mr Kilbury reiterated his long standing position on the issue of vacations and felt that the entire area needed to be examined Motion camed (No - Kilbury) Street Vacation - Hayes Street and Main Avenue, Pasco Land Company's First Addition (MF #94-55-V) Mr David McDonald, City Planner, addressed Council and noted for the record that notice of the public heanng was published and mailed to affected property owners as required by law A request for easement was received from the Franklin County PUD, Cascade Natural Gas, and the City Engineering Department Mr McDonald reported that the right-of-way to be vacated is improved with street, curb, and gutter It's located just north of the Oxarc building and south of Northwest Pipeline The property owners -4- MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1994 surrounding these rights-of-way have requested that the rights-of-way be vacated for security purposes and to allow the expansion of their busmesses Mr McDonald explained that staff was concerned about vacating the right-of-way without changing the configuration of the curb and gutter to provide a distinction between what's public and private to let individuals know when they were leaving the public street and entering private property The owners of Oxarc have provided staff with a letter and assurances that they will undertake the necessary improvements to make that distinction MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF HAYES STREET FROM THE EAST RIGHT-OF-WAY LINE OF OREGON AVENUE TO THE EAST RIGHT-OF- WAY LINE OF MAIN AVENUE AND MAIN AVENUE FROM THE NORTH RIGHT-OF-WAY LINE OF "A" STREET TO THE NORTH RIGHT-OF- WAY LINE OF HAYES STREET Following three (3) calls from Mayor DeFelice for comments from the floor, either for or against, and there being none, the public hearing was declared closed ORDINANCE NO. 3051 AN ORDINANCE VACATING HAYES STREET AND MAIN AVENUE NORTH OF "A" STREET AND WEST OF OREGON AVENUE MOTION Mr Hargrow moved to adopt Ordinance No 3051, vacating portion of Hayes Street and Main Avenue located in Pasco Land Company's first Addition Mr Lathim seconded the motion Mr Strode moved to amend the motion to read as follows Based upon assurances by the proponents to complete necessary curb and gutter modifications, Mr Strode moved to adopt Ordinance No 3051, vacating portions of Hayes Street and Main Avenue located in Pasco Land Company's First Addition Mr Jensen seconded the motion The amendment to the motion earned unanimously The original motion as amended camed (No - Kilbury) ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO. 3052 AN ORDINANCE CONCERNING THE PUBLIC USE OF CITY PARKS, THEIR CLOSURE AND PENALTIES FOR VIOLATIONS, AND AMENDING CHAPTER 948 OF THE PASCO MUNICIPAL CODE MOTION Ordinance No 3052, was read by title only Mr Strode moved to adopt Ordinance No 3052, concerning public use of city parks, their closure and penalties for violations, and amending Chapter 9 48 of the Pasco Municipal Code Mr Jensen seconded the motion Motion carried unanimously UNFINISHED BUSINESS None 5 I I MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1994 NEW BUSINESS Industrial Wastewater Treatment System - Project No 94-1-05 MOTION Mr Jensen moved to award the contract for the Industrial Wastewater Treatment System, Project No 94-1-05, to the low bidder, Robison Construction, Inc , in the amount of $4,304,090 44 and, further, to authorize the Mayor to sign the contract documents Mr Hargrow seconded the motion Motion camed by unanimous roll call vote Acquisition of the Wells at West Pasco Water MOTION Mr Jensen moved to authorize staff to exercise the city's option to acquire the wells supplying water to the West Pasco Water System Mr Strode seconded the motion Motion carried unanimously Award of Contract for Foster Wells/Ramier Avenue Waterline Projects MOTION Mr Jensen moved to award the contract for the Foster Wells/Rainier Avenue Waterline project to the low bidder, Ray Poland and Sons, in the amount of $83,909 91 and, further, to authorize the Mayor to sign the contract documents Mr Strode seconded the motion Motion carried unanimously Execution of a Contract for Value Engmeenng Study with CH2M Hill MOTION Mr Hargrow moved to authorize the Mayor to execute a contract with CH2M Hill to perform a Value Engineering Study for the design on the wastewater treatment plant design performed by HDR Engineers Mr Lathim seconded the motion Mr Strode felt this was a good way to show the citizens of Pasco that the proposed plans are sound and that the City's consultant is providing a good product Motion earned unanimously MISCELLANEOUS -
