SPECIAL MEETING OCTOBER 24, 1994
CALL TO ORDER
The meeting was called to order at 7 30 P M by Joyce DeFelice,
Mayor
Mayor DeFelice recessed the meeting to an executive session to
discuss potential litigation
ROLL CALL
By City Manager Councilmembers present Joyce DeFehce, Michael
Garrison, Edgar Hargrow, Chris Jensen, Charles Kilbury, Dan Lathim,
and Carl Strode Also present Gary Crutchfield, City Manager, Greg
Rubstello, City Attorney, and Kurt Luhrs, Administrative Assistant
NEW BUSINESS
TRAC Financing Agreement Mr Crutchfield explained that he had the
opportunity to meet with County staff representatives on the TRAC
project and the project architect The site work elements of the
project were discussed and it was concluded that the City could help
on the sewer and water improvements, and possibly the second of two
pieces of the electrical system extension Therefore, it was staffs
recommendation that Council commit to the County to finance the
sewer and waterline improvements related to TRAC, not to exceed
$120,000 This will allow the County to get this work done, in
conjunction with the installation of Rodeo Drive The City can nearly
recover these costs through development of the adjacent property
Mr Strode was uncomfortable with agreeing to the financing
agreement when it isn't formally written because of difficulties
experienced in the past with having agreements executed He wanted
to know if there were any assurances that the County would sign the
agreement when it is presented to them9
Mr Crutchfield stated that there isn't anything for the County to
present to the Council and he felt there wasn't anything to get into a
tug-of-war over
Mr Strode felt that since the proposed agreement is entirely in the
favor of the County he wanted them to draft the agreement for
Council's review before committing the funds for the improvements
Mr Crutchfield explained that the reason that he put this item on the
agenda is because the County has the contract in place with the
contractor for the site work and they need to let the contractor know
by the end of this month what pieces of that contract work need to be
deleted
Mr Strode was reluctant to commit funds in advance of seeing a
written agreement due to the situation that developed with the
baseball stadium project
Mr Gamson agreed with Mr Strode that the City shouldn't make any
commitment of funds until there is something in writing from the
County
Mr Kilbury preferred that the City should draft the contracts
Mr Lathim felt that the County has some tough issues in front of them
with agriculture issues and water spreading issues He wanted to

excuse the County from some of the situations mentioned He felt the
County was working with the City in good faith and he would support
this item
MOTION Mr Jensen moved to authorize the Mayor to formally
commit the City to pay up to $120,000 for municipal sewer and water
improvements related to the TRAC project, in addition to the
commitment established in the TRAC Interlocal Agreement Mr
Kilbury seconded the motion Motion carried by the following roll call
vote Yes - Hargrow, Lathim, Jensen, Kilbury, DeFelice, No - Garrison,
Strode

No further business, the meeting was adjourned
