HomeMy WebLinkAbout1994.06.27 Council MinutesMINUTES PASCO CITY COUNCIL SPECIAL MEETING JUNE 27, 1994 CALL TO ORDER The meeting was called to order at 8 00 P M by Joyce DeFelice, Mayor ROLL CALL By City Manager Councilmembers present Joyce DeFelice, Michael Garrison, Edgar Hargrow, Chris Jensen, Charles Kilbury, and Carl Strode Councilmembers absent Dan Lathim Also present Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, and Kurt Luhrs, Administrative Assistant AGENDA ITEMS Awarding a Contract for Road 100 to Road 36 Sanitary Sewer MOTION Mr Jensen moved to award the contract for Road 100 to Road 36 Sanitary Sewer Construction to the low bidder, John M Keltch, Inc , in the amount of $1,539,125 32 and, further, to authorize the Mayor to sign the contract documents Mr Kilbury seconded the motion Motion earned by unanimous roll call vote Resolution No 2140 MOTION Mr Garrison moved to approve Resolution No 2140, approving the preliminary plat for Sunny Meadows Mr Hargrow seconded the motion Mr Joseph Pizzarella, of 4213 Brown Place, asked that a letter from his attorney be added as an addendum to the Resolution This letter requests that access will be provided prior to plat approval and before the abandonment of Overton Road He asked that on the Road 60 alignment a gravel road be provided in conjunction with Phase I of the development and that this access would travel up, and tie into, Burden Road to Overton Road This road should be constructed to City standards and be maintained by the City This would resolve the issue of the easement for those property owners above the proposed development Mr McDonald explained that it was his understanding that the property owners (before they relinquish Overton Road), would like to have Burden Road put in all the way to Road 68, and a small portion of the Road 60 alignment paved with the rest being graveled After this is accomplished the property owners would relinquish their interest in Overton Road Mr McDonald stated that the resolution requires that Burden Road be installed to the end of the quarter section and then, as phasing dictates, move up Road 60 with permanent improvements In the meantime Overton Road would still remain in place until Phases 5-7, at which time Road 60 would have to be completed and there would no longer by any need for Overton Road Mr Rubstello explained that it's not the City's place to dictate to the developer what will have to be done to satisfy the property owners above the proposed development and get them to agree to vacation of the access easement It is not the City's role in the subdivision approval process to ensure that the property owners above the subdivision have the kind of access that they want to their property MINUTES SPECIAL MEETING PASCO CITY COUNCIL JUNE 27, 1994 Mr Ron Dick, 101 (unclear) Lane, stated that he would like to have the Road 60 alignment done before any work is done on the subdivision Ms Ruth Overton, of 211 Overton Road, was opposed to relinquishment of Overton Road Mr Jim Overton, of 175 South Lake Road in Burbank, his father was the first property owner to get rights-of-way for Overton Road and he paid for those rights He wanted assurance in writing that before the current right-of-way is destroyed proof of another right-of-way is provided Mr Crutchfield explained that the proposed subdivision will not eliminate Overton Road The resolution requires the developer to build Burden Road along the south line of the section and Road 60 up the east line in conjunction the the development phases The Overton Road easement will remain untouched until Road 60 is built to the north end Motion failed by the following roll call vote Yes - Jensen, DeFelice, Strode, No - Kilbury, Gamson, Hargrow ADJOURNMENT No further business, the meeting was adjourned CA-- Joy Felice, Mayor I ATTEST I Catherine D Seaman Deputy City Clerk PASSED and APPROVED this .5--- day o 1994 1994 -2- 2-
