HomeMy WebLinkAbout1993.10.18 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 18, 1993 CALL TO ORDER The meeting was called to order at 8 00 P M by Joyce DeFelice, Mayor ROLL CALL. By Deputy City Clerk Councilmembers present Joyce DeFelice, Michael Garnson, Edgar Hargrow, Chris Jensen, Charles Kilbury, Dan Lathim, and Carl Strode Also present Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, and David McDonald, Community Development Director. PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA MOTION • Mr Jensen moved to approve the Consent Agenda Seconded by Mr Garrison Motion carried unanimously. Consent items are as follows. A) Approval of Minutes To approve minutes of Special Meeting held October 11, 1993 B) Bills and Communications To approve General Claims in the amount of $488,637 31 ($79,099 28 being in the form of Wire Transfer Nos 2824 and 2825, and $409,538 03 consisting of Claim Warrants numbered 83414 through 83618) C) AFIS Interlocal Agreement' To approve the AFIS Interlocal Agreement and authonze the Mayor to sign same D) Agreement for Indigent Defense Services To approve the Agreement with Linda Waite and Phil Rodriguez for Municipal Court Indigent Defense Services for calendar year 1994 and, further, authonze the Mayor to sign the Agreement E) Public Hearing for the Removal of Parking on East "A" Street To set Monday, November 1, 1993, at 8 00 p m, in the Council Chambers as the time and place for a public hearing to discuss the removal of parking on "A" Street from Elm Avenue to SR 12 PROCLAMATION AND ACKNOWLEDGMENTS None VISITORS None REPORTS FROM commn hES AND/OR OFFICERS Mayor's Activity Report Mayor DeFelice reported that on October 6, she attended a proclamation signing ceremony, along with the Mayors of the other cities, to declare the week of October 10th as the "National Auto Safety Week" On October 7 & 12, attended a meeting at City Hall to go over the annexation video MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 18, 1993 Pasco Task Force For A Safe Community Meeting - October 5. 1993 Mr Jensen reported that he was unable to attend the meeting Mr Lathim noted that he attended the meeting and could give a report Mr Lath= reported that applications for the position of Executive Director were examined by the Committee There were approximately 20 applicants for the position, six of which were chosen to continue through the process and would be given interviews in November Pasco Downtown Development Association Board Meeting - October 5. 1993 Mr Kilbury reported that Larry Lee is the new President of the Board of Directors for the Chamber of Commerce There will be another "Barn Burner" sponsored by the Chambers this year There was discussion on the beautification of the entrances to the City Weeds need to be removed. Parks and Recreation Advisory Council Meeting - October 7. 1993 Mayor DeFelice reported that November 6, 1993, will be the Annual High School Cross Country Meet. This event is the largest and best organized of it's kind in the State. Air Pollution Control Board Meeting - October 7. 1993 Mr Hargrow reported that the Board decided that Walla Walla should go through the proper procedures, as outlined in the Interlocal Agreement, for pulling out of the organization The Board passed a resolution to formally commit to the air operating program. Senior Citizens Advisory Committee Meeting - October 11. 1993 Mayor DeFelice reported that she was unable to attend the meeting due to a conflict BFRC Tn-MATS Policy Advisory Committee Meeting - October 14. 1993 Mr Kilbury reported that the City's request to amend the functional classification system to include Burden and Broadmoor Roads as collector roads was approved A recommendation to add Stevens Drive from Horn Rapids Road to the Hanford barncade to the National Highway System was approved and a recommendation to accept a draft policy statement saying that transportation utilities were the primary function of the Committee with the environment being second B F Transit Board Meeting - October 14. 1993 Mr Garrison reported that the main topic of discussion was the possibility of extended service from 7 00 to 11 00 p m, Monday through Saturday The remainder of the meeting was routine PUBLIC HEARINGS Street Vacation (MF #93-39-V) Mr McDonald, Director of Community Development, addressed Council and noted for the record that notice of the public heanng was published as required by law MAYOR DEFELICE DECLARE THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF CLIFTON'S STREET NORTH OF THE NORTH RIGHT-OF-WAY LINE OF JAMES STREET AND ROSE STREET NORTH OF THE NORTH RIGHT-OF-WAY LINE OF JAMES STREET AND THE NORTH/SOUTH ALLEY ABUTTING LOTS 1-8, BLOCK 2, ALL IN THE BOSTON'S ADDITION Mr McDonald explained that late last week dunng the preparations for the public hearing it was discovered that there were several reciprocal easement agreements across some of the nghts-of-way that need to be cleared up for the proposed vacation Staff requests time to get with all of the property owners involved -2- MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 18, 1993 MOTION . Mr. Lathim moved to continue the Boston's Addition vacation hearing to the Regular Meeting of November 1, 1993 Mr Garnson seconded the motion Motion carried unanimously R-3 (Medium Density Residential) to C-1 (Retail Business) IMF #93- 45-Z) Mr McDonald, Director of Community Development, addressed Council and noted for the record that notice of the public hearmg was published as required by law. Mr McDonald explained that this was a consideration of an appeal filed by approximately 20% of the property owners within 300 feet of the property located at the southeast corner of 15th Avenue and Court Street The Planning Commission recommended at their last regular meeting that this piece of property be rezoned to C-1 The surrounding properties are zoned commercial When looking at this issue the Planning Commission considered the surrounding land uses and also considerd the Comprehensive Plan, which suggests that arterials be developed commercially in a nodal fashion This piece of property would fit within the nodal concept, however, property owners in the area were concerned with additional traffic, parking, access, noise, garbage, and the safety of children going to and from school The owner of the property wants to put a screen shop on his property, which already has a duplex on it, to consolidate his businesses to one location Mr Strode wanted to point out that Council was considering a rezone and needS to consider the possible uses that are permitted in the C-1 zone and how they fit into the community MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE HOLT/MADSON APPEAL, A REZONE FROM R-3 (MEDIUM DENSITY RESIDENTIAL) TO C-1 (RETAIL BUSINESS) FOR A SITE LOCATED AT THE SOUTHEAST CORNER OF COURT STREET AD 15TH AVENUE Ms Marilyn Holt, of 1327 N 15th Avenue, addressed Council to voice her objections to the proposed rezone She felt that the additional traffic, noise, garbage, etc, would be detrimental to her neighborhood and was asking the Council to deny the rezone. Mr R W Pischel, of 4100 Riverhaven, addressed Council to ask that Council grant the request for a rezone to enable him to build a structure on the property where his duplexes are located He wants to have all his business interests in one location Mr Bruce Whitemarsh, of 1327 N 16th Avenue, addressed Council and objected to the proposed rezone for the same reasons as Ms Holt He felt that allowing commercial development to expand along the corridor would create more problems for the residential areas Mr Collin Madson, of 1323 N 15th Avenue, addressed Council in support of comments already made by those objecting to the proposed rezone Mr. John Shaw, of 1311 N 15th Avenue, addressed Council to object to the proposed rezone He felt it would effect the quality of his neighborhood The Clerk read letters objecting to the proposed rezone from John and Andea Evans, of 1307 N 15th Avenue, and also from Menem and Rosa Fnas, of 1408 N 15th Avenue - 3 - • MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 18, 1993 Following three (3) calls from Mayor DeFelice for further comments from the floor, either for or against, the public hearing was declared closed Mr Jensen asked Mr Pischel what type of structure he would require m order to operate a screen business and was told the structure would be approximately the size of a two-car garage Mr Garnson asked what the dimensions of the property were for the proposed rezone and was told that it was 75 feet. Mr Strode asked Mr McDonald to explain what type of businesses would be permitted should the rezone be approved Mr McDonald stated that the types of businesses that would be excluded would be outdoor type activities, i e , auto and boat sales, contractor storage facilities, and warehouse trucking facility The types of activities allowed would be indoor retail and office functions ORDINANCE NO. 2966 AN ORDINANCE RELATING TO ZONING AND CHANGING THE CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE CITY OF PASCO FROM R-3 (MEDIUM DENSITY RESIDENTIAL) TO C- 1 (RETAIL BUSINESS) MOTION Ordinance No 2966, was read by title only Mr Lathim moved to adopt Ordinance No 2966, granting a rezone from R-3 to C- 1 Mr Strode seconded the motion. Mayor DeFelice expressed her gratitude to the citizens who attended the meeting and provided their input on the issue She stated that it was a tough decision because the rezone makessense when considering the City's Comprehensive Plan, however, she understands the concerns of the citizens in that area Motion carried by the following roll call vote Yes - Strode, Kilbury, Jensen, Lathim, Garnson, DeFelice, No - Hargrow ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS ORDINANCE NO. 2967 AN ORDINANCE CONCERNING DOMESTIC VIOLENCE AND ANTI-HARASSMENT ORDERS ISSUED BY FRANKLIN COUNTY COURTS. MOTION Ordinance No 2967, was read by title only Mr Jensen moved to adopt Ordinance No 2967, concerning domestic violence and anti-harassment orders issued by Franklin County Courts Mr Garrison seconded the motion Motion carried (DeFelice abstained from the vote). UNFINISHED BUSINESS None NEW BUSINESS Regulation of Cable Television Rates MOTION Mr Garrison moved to authorize the City Manager to apply to the Federal Communications Commission for city authonty to -4- DeFelice, Mayor MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 18, 1993 regulate basic cable service rates Mr Jensen seconded the motion Motion carried unanimously MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL. There was a general discussion by Council concerning the TRAC Project It was the concurrence of Council to direct staff to contact the Franklin County Commissioners and attempt to set up a joint meeting to attempt to resolve this issue and get the project moving ADJOURNMENT.
