PASCO CITY COUNCIL
REGULAR MEETING NOVEMBER 1, 1993
CALL TO ORDER
The meeting was called to order at 8 00 P M by Joyce DeFehce,
Mayor
ROLL CALL
By Deputy City Clerk Council members present Joyce DeFehce,
Michael Garrison, Edgar Hargrow, Chris Jensen, Charles Kilbury, Dan
Lathan, and Carl Strode Also present Gary Crutchfield, City Manager,
Greg Rubstello, City Attorney; and Kurt Luhrs, Administrative
Assistant
PLEDGE OF ALLEGIANCE.
The meeting was opened with the Pledge of Allegiance.
CONSENT AGENDA
MOTION Mr Garrison moved to approve the Consent Agenda
Seconded by Mr. Jensen.
MOTION. Mr. Kilbury moved to amend the Consent Agenda and
replace Item 3(e) - Go-Cart Track (MF #93-58-SP) with the Farrell
Annexation (MF #93-43-A1) Mr Garrison seconded the motion
Motion earned unanimously
Onginal motion as amended earned unanimously Consent items are
as follows
A) Approval of Minutes To approve minutes of Regular Meeting held
October 18, 1993
B) Bills and Communications To approve General Claims in the
amount of $325,736 81 ($7,694 12 being in the form of Wire
Transfer Nos 2826, and $318,042 69 consisting of Claim
Warrants numbered 83619 through 83788)
Payroll Claims To approve Payroll Claims in the amount of
$645,856 18, Payroll voucher Nos 32777 through 32962, and
32963 through 33339
Bad Debt Write-Offs To approve bad debt write-offs for utility
billing, ambulance, cemetery, miscellaneous, and Municipal Court
non-criminal and criminal accounts receivable in the total amount
of $107,718 44 and, of that amount, authorize $106,542 87 be
turned over for collection
C) Special Permit Off-Premise Directional Sign at Ainsworth Street
and Fourth Avenue (MF #93-46-SP) To approve the Special
Permit for the Waterworld Marina's off-premise directional sign at
Ainsworth Street and Fourth Avenue, as recommended by the
Planning Commission
D) Special Day Care at 1512 East Columbia Avenue (MF #93-52-SP)
To approve the Special Permit for the Apostolic Bethel Temple
Day Care Center at 1512 East Columbia Street, as recommended
by the Planning Commission
E) Farrell Annexation (MF #93-43-A1) To set 8 00 p m, Monday,
November 15, 1993, as the time and date for a public hearing to
consider the Farrell Annexation Petition

PROCLAMATION AND ACKNOWLEDGMENTS.
Certificate of Appreciation to William (Bill) Leahy Mayor DeFelice
presented a Certificate of Appreciation to Mr Leahy for the
development of the Tn-Cities International Cross Country Race Course
and expressed the gratitude of the Council for his efforts in making a
good idea a reality.
Mr Leahy expressed his gratitude to those who helped him complete
this project
AAA Pedestnan Safety Award Mr Jim Ajax, Public Works Director,
presented a plaque to the Mayor and City Council from the American
Automobile Association (Pedestnan Protection Program) for a fatality-
free pedestrian safety record He also expressed his appreciation of
the Engineering and Public Works staff for their efforts in keeping
Pasco's streets clean and safe
VISITORS
None.
REPORTS FROM COMMITTEES AND/OR OFFICERS
Mayor's Activity Report Mayor DeFelice reported that on October 23,
participated in ribbon cutting ceremony for Little Chapala, located at
508 N. 4th Avenue.
On October 22, gave welcoming remarks to the District #9
Toastmasters.
On October 24, gave welcoming remarks to the new pastor of the
Greater Faith Baptist Church
On October 29, participated as a judge for a pumpkin carving contest
for the Franklin County Historical Society
Pasco Downtown Development Association Annual Meeting - October
19 1993 Mr Kilbury reported that there was discussion on the need
for new carpet at the Village Market Place, membership lists were
passed out, Mark Mornsette received a plaque as retiring president,
comments from the floor suggested that the City purchase the Shields
building and use the front for an office
Good Roads Association Meeting - October 20. 1993 Mr. Lathim
reported that he attended the PNWA meeting before the Good Roads
Association meeting and would give a report on that
He reported that Washington D C had rescinded their offer to allow
lowering the levees by the Moore Mansion This decision was based
on the events of the Flood of 1993 along the Mississippi River The
Division offices stated that we were given the okay to go ahead in May,
1992, and they plan to carry through with that decision
Visitor and Convention Bureau Board Meeting - October 28. 1993 Mr
Strode was unable to attend the meeting
B F Health Board Meeting - October 28. 1993 Mr Strode reported
that the Board was presented with the state of the Health Department
report from Dr. Williams, Health Officer He presented a video that
served as a broad overview of what a health department does and the
kind of services provided He pointed out that due to growth, the
programs that are mandated by the State, and changing regulatory
environments he believes that a review of existing procedures and

policies, and the structural organization of the B F Health District
needs to be made to help avoid being strangled by regulation
B F Regional Council Board Meeting - October 29, 1993 Mr Kilbury
reported that proposals for Franklin County Emergency Management
in the amount of $214,329, and for Water District #1 of Franklin
County for funds to construct a water distribution system were
endorsed A presentation was made by the Kennewick Irrigation
District of a satellite management agency and the operation of small
water systems The 240 Study, the recommendation of the functional
classification of Burden and Broadmoore Roads in Pasco, the extension
of the draft National Highway System Enrichment (Stevens Drive from
Spangler to the "Y" barricade), and the rules and regulations criteria
for the Surface Transportation Program were approved
PUBLIC HEARINGS
Street Vacation - Rose Street/Clifton Street (MF #93-39-V) Mr
McDonald, Director of Community Development, addressed Council
and noted for the record that notice of the public hearing was
published as required by law
Mr McDonald explained that this item was postponed from the last
regular meeting to allow staff an opportunity to further discuss the
proposed street and alley vacation with adjoining property owners In
discussing this matter with adjoining property owners, they both
indicated that they had some reservations with the proposed vacations
because of uncertainty of development patterns in the area at the
present time Due to these concerns staff recommends that Council
vacate Clifton Street and leave the other two rights-of-ways in their
present state
MAYOR DEFELICE RECONVENED THE PUBLIC HEARING TO
CONSIDER THE VACATION OF ROSE STREET/CLIFTON STREET
Following three (3) calls from Mayor DeFelice for comments from the
floor, either for or against, and there being none, the public hearing
was declared closed
ORDINANCE NO. 2968
AN ORDINANCE VACATING CLIFTON STREET
MOTION Ordinance No 2968, was read by title only Mr Lathim
moved to adopt Ordinance No 2968, vacating Clifton Street Mr
Hargrow seconded the motion Motion carried unanimously
Removal of Parking on East "A" Street Mr Wright, City Engineer,
addressed Council and noted for the record that notice of the public
hearing was published as required by law
Mr Wright explained the City has received ISTEA Funding to rebuild
East "A" Street and as a part of the funding package the City is
obligated to construct bicycle lanes on both sides of the roadway To
ensure that the bicycle lanes do not become parking strips, staff
recommends the banning of parking on both sides of the street
MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO
CONSIDER THE REMOVAL OF PARKING ON EAST "A" STREET FROM
ELM AVENUE TO SR 12
Following three (3) calls from Mayor DeFelice for comments from the
floor, either for or against, and there being none, the public hearing

ORDINANCE NO. 2969
AN ORDINANCE RELATING TO PARKING ON "A" STREET AND
AMENDING SECTION 10.56 080 OF THE PASCO MUNICIPAL
CODE
MOTION Ordinance No 2969, was read by title only Mr Garrison
moved to adopt Ordinance No 2969, banning parking on both sides of
"A" Street from Elm Avenue to SR 12 Mr Lathim seconded the
motion Motion carried unanimously
ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS
ORDINANCE NO. 2970
AN ORDINANCE RELATING TO LAND USE AMENDING TITLE
22 BY ENACTING NEW PROVISIONS IN CHAPTER 22 37
DEALING WITH MANUFACTURED HOMES
Mr McDonald explained that at the last regular meeting of the
Planning Commission there was a public hearing to entertain possible
amendments to the RMH-1 zoning district Requests were received
from Mr Tom Dellinger to be able to put site-built homes with
modular and mobile homes in the Highland Park area The Planning
Commission reviewed the request, along with some other changes
recommended by staff to clean up the language in the RMH-1 zoning
district to make it fall in line with the other residential zoning
districts within the community Currently the only type of dwelling
units that are permitted in this zoning district are mobile homes The
proposal would allow mobile, site-built, and modular homes within all
RMH-1 zoning districts
Mr Strode asked if there was any difference in the requirements for
square footage, lot sizes, set-backs, outward appearances, garages and
carports, etc , that would necessitate any specific distinction between
a site-built home and a manufactured home?
Mr McDonald explained that all of the set-back and height
requirements would be the same for each unit The square footage
requirements for the size of the home would stay the same
Mr Strode asked if there would be any reason to believe that there
would be any visual disturbance in the area with the mingling of these
two types of homes as far as the code is concerned? Mr McDonald
said there should be no difference
Mr Hargrow asked if there were any promises given to the people
who purchased homes in this area that there would be no homes of
this type built in this area? Mr McDonald stated that he didn't know
if that were true or not
MOTION Mr Strode moved to table Ordinance No 2970, until the
Regular Meeting of November 15, 1993 Mr Garrison seconded the
motion Motion carried unanimously
Mr Marvin Nelson, Jr, of P 0 Box 983, Pasco, addressed Council to
state that to his knowledge there are no protective covenants
concerning site-built homes in that area
Mr Tom Dellinger, no address given, addressed Council to say that
Mr Nelson is misinformed as far as covenants are concerned There
are very restrictive covenants on his section of Highland Park
development

Mr Dellinger presented his sample site-built home to Council and
explained how they are put together
Mayor DeFelice requested that staff look into any covenants that may
pertain to this area

MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL
Prison Site Mr Hargrow asked Mr. Crutchfield to discuss the
memorandum concerning the possibility of a prison site in Pasco
Mr Crutchfield explained that the State Department of Corrections
has announced a solicitation of interest from communities around the
State that might be interested in hosting the development of a new
pnson A map of the community has been provided showing several
areas that could meet State requirements for the location of a pnson
complex It was the concensus of Council that this subject be placed
on the next workshop agenda
Budget Preparation After a general discussion by Council it was
determined that November 15, 1993, at 5 30 p m would be set aside
for discussion of the preliminary 1994 budget
TRAC Project Mayor DeFelice informed Council that the Franklin
County Commissioners have agreed to sign a lease agreement and the
interlocal agreement concurrently
Executive Session Mayor DeFelice recessed to an executive session to
discuss labor negotiations, land acquisition, and personnel at 9 05 p m
Mayor DeFelice reconvened the regular meeting at 10 40 p m
ADJOURNMENT
No further business, the meeting was adjourned at 10 40 p m
