HomeMy WebLinkAbout1993.02.01 Council Minutest 'MINUTES PASCO CITY COUNCIL REGULAR MEETING FEBRUARY 1, 1993 CALL TO ORDER The meeting was called to order at 8 00 P M by Joyce DeFelice, Mayor. ROLL CALL: By Deputy City Clerk. Council Members present were. Joyce DeFelice, Michael Garnson, Edgar Hargrow, Chns Jensen (arnved late), Charles Kilbury, and Dan Lathim (Strode, absent/excused) Also present were Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Dave McDonald, Community Development Director, and Dennis Wright, Engineer PLEDGE OF ALLEGIANCE The meetmg was opened with the Pledge of Allegiance. CONSENT AGENDA MOTION Mr Garrison moved to approve the Consent Agenda as amended (Item 3-E moved to Item 10-B) Seconded by Mr Lath= Motion carried Consent items are as follows. A) Approval of Minutes. To approve minutes of Special Meeting held January 25, 1993. B) Bills and Communications To approve General Claims in the amount of $153,264 05, consisting of Claim Warrants numbered 79742 through 79880. (1992 Expenditures) To approve General Claims in the amount of $117,005 33 ($28,034 97 being in the form of Wire Transfer Nos 2789 and 2790, and $88,970 36 consisting of Claim Warrants numbered 79881 through 80019) (1993 Expenditures) To approve Payroll Claims in the amount of $429,076 71, Payroll Voucher Nos 28934 through 29117, and 29118 through 29301 C) Agreement between City of Pasco and Franklin County Fire District #3 providing for Ambulance Service To approve the proposed Agreement between the City and Franklin County Fire District #3 for Ambulance Service and, further, authorize the Mayor to sign the Agreement D) Resolution No 2058 To approve Resolution No 2058, authorizing Ben Franklin Transit to relocate an existing transit stop at 1st and Lewis Street to 320 W Lewis Street, as shown on Exhibit A attached to the Resolution PROCLAMATION AND ACKNOWLEDGMENTS None VISITORS None REPORTS FROM COMMITTEES AND/OR OFFICERS Mayor's Activity Reports Mayor DeFelice reported that she was invited to be on KONA Radio dunng the "Community Profile" segment, which MINUTES REGULAR MEETING PASCO CITY COUNCIL FEBRUARY 1, 1993 provided an opportunity to talk about the City's accomplishments in 1992 and outline the City's goals for 1993. B F Distnct Health Board Meeting - January 28. 1993* Mr Strode was absent. Emergency Management Services Council Meeting - February 1. 1993* Mr Strode was absent PUBLIC HEARINGS* Creation of the L I D for the Ruby Street Alley Mr Denrus Wright - addressed Council and reported for the record that staff did cause notice to be published in the Tn-City Herald and each of the property owners involved were notified by certified mail of the hearing. Mr Wnght explained that this issue was discussed last year and it was decided that the alley should be repaved to eliminate severe dust problems on the north side of the street and a drainage problem within the alley Mr Wright pointed out that a number of responses were received through the mail Five of the nine residential property owners on the north side of the alley stated that they were in favor of this action and the commercial property owners on the south side of the alley, with the exception of one property owner, are in favor also One (1) protest was received from Mr Damalson, account #15 MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN CONCERNING THE INTENTION OF THE PASCO CITY COUNCIL TO CREATE A LOCAL IMPROVEMENT DISTRICT FOR THE IMPROVEMENT OF THE ALLEY LYING NORTHERLY OF COURT STREET AND SOUTHERLY OF RUBY STREET, BETWEEN 19TH AVENUE AND 20TH AVENUE Ms Dorothy Shaffer, of 1932 West Ruby Street, addressed Council and stated that she was in favor of the L I D, however, she wanted to know if anything could be done with the traffic problem by making the alley a one-way street? Mayor DeFelice called for a show of hands of those living on Ruby Street who were in favor of the L I D , of which there were seven (7) Following three (3) calls from Mayor DeFelice for further comments from the floor, either for or against, the public hearing was declared closed Mr Wright informed the Council that making the alley a one-way street could help the traffic problems, however, it could also make them worse A study would have to be done Mr Gary Sailor, of 1936 West Ruby Street, addressed Council and also expressed his concerns on the traffic problem Ordinance No. 2921 AN ORDINANCE ORDERING THE IMPROVEMENT OF THE ALLEY LYING NORTHERLY OF COURT STREET AND SOUTHERLY OF RUBY STREET BETWEEN 19TH AVENUE AND 20TH AVENUE, IN THE CITY OF PASCO, ALL IN ACCORDANCE WITH RESOLUTION NO 2055 OF THE PASCO CITY COUNCIL, ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO 123 AND ORDERING THE CARRYING OUT OF THE PROPOSED IMPROVEMENT, PROVIDING THAT PAYMENT FOR THE ' ,4 S1,11%!1 gvy, MINUTES REGULAR MEETING PASCO CITY COUNCIL FEBRUARY 1, 1993 IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON THE PROPERTY IN THE DISTRICT, PAYABLE BY THE MODE OF "PAYMENT BY BONDS"; AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL IMPROVEMENT DISTRIST WARRANTS REDEEMABLE IN CASH OR OTHER SHORT-TERM FINANCING AND LOCAL IMPROVEMENT DISTRICT BONDS MOTION. Ordinance No 2921, was read by title only Mr Garrison moved to adopt Ordinance No 2921, creating L I D No 123 for the improvement to the alley south of Ruby Street and north of Court Street between 19th Avenue and 20th Avenue Mr Hargrow seconded the motion Motion earned. ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS Mr Jensen arrived at 8 15 p m Ordinance No. 2922 AN ORDINANCE RELATING TO THE REVOCATION AND REINSTATEMENT OF A BUSINESS LICENSE, AND AMENDING SECTION 504 110 OF THE PASCO MUNICIPAL CODE, AND ADDING NEW SECTION 504 115 TO THE PASCO MUNICIPAL CODE MOTION. Mr Garrison moved to adopt Ordinance No 2922, an ordinance amending Chapter 5 04 PMC and establishing procedures and standards for the review of an application for the reinstatement of the business licensing privilege Mr Lathim seconded the motion Mr Garrison stated for the record that he felt the probationary period should be five (5) years for a felony conviction involving the business Motion carried (Garrison - No) Resolution No. 2059 A RESOLUTION DECLARING THE PASCO CITY COUNCIL'S SUPPORT OF INTEREST-FREE LOANS BY THE UNITED STATES TREASURY TO TAX-SUPPORTED BODIES FOR THE PURPOSE OF FUNDING CAPITAL PROJECTS AND FOR PAYING OFF EXISTING DEBTS MOTION Mr Lathim moved to adopt Resolution No 2059, supporting the concept of interest-free loans from the U.S Treasury for public facilities Mr Jensen seconded the motion Mr Garrison stated he was against the resolution because at some point someone has to pay interest no matter whether it's the city or individually as citizens and taxpayers and, therefore, he couldn't support the resolution Motion earned by the following roll call vote Yes - DeFelice, Hargrow, Jensen, Kilbury, No - Garrison, Lath= Resolution No. 2060 A RESOLUTION SUPPORTING THE ADDITION OF STATE ROUTE 12 AND INTERSTATE 82 TO THE SCENIC AND RECREATIONAL HIGHWAY SYSTEM MINUTES REGULAR MEETING PASCO CITY COUNCIL FEBRUARY 1, 1993 MOTION Resolution No. 2060, was read by title only Mr Lathim moved to adopt Resolution No 2060, supporting the addition of State Route 12 and Interstate 82 to the Scenic and Recreational Highway System Mr Garrison seconded the motion Motion carned UNFINISHED BUSINESS None NEW BUSINESS. Humane Society Animal Control Contract MOTION Mr. Garnson moved to approve the Agreement with Benton Franklm Humane Society for the provision of Animal Control Services for calendar year 1993 for a contract amount of $63,205 and, further, authonze the Mayor to sign the Agreement Mr Lathan seconded the motion Motion carned Agncultural Use Within 1,000 ft of Residence (MF #92-59-SP) MOTION Mr Lathim moved to deny the special permit to allow agricultural uses within 1,000 ft of a residence located in the southwest quarter of Section 16, Township 9 North, Range 29 East W M, lying south of the Franklin County Irrigation ditch, as recommended by the Planning Commission Mr. Jensen seconded the motion Mr Wayne Wilson, of 3291 Dent Road, addressed Council and expressed his concern that the City was sending the wrong message to the farming community by having an ordinance that would ban farming within 1,000 ft of a residential area unless by special permit Mayor DeFelice responded to his concerns by explaining that the City Council adopted an ordinance 2 years ago that states that if a person wishes to farm within 1,000 ft of a residential area within the City they would have to go through a special permit process, the ordinance does not ban farming Mr Tom Kay, of 6724 West Court Street, addressed Council and expressed his concern over the ordinance requiring a special permit He feels the City should remember that agriculture is a very important part of the economy of this area and to restrict it would be to do damage to our local community's economy Ms (unclear) Burnes, of 4161 Dent Road, addressed Council and expressed her concern with the ordinance and wanted to know what would happen to the farm that she and her husband have had for the last 60 years if the City were to annex the area she currently lives m9 Mr Jensen explained that in the event her area was annexed into the City her farm would be grandfathered in also Mr Crutchfield addressed Council to explain that the newspaper has macurately represented this issue He went on to explain that an existing farm would not be affected by the City's regulation, whether that farm was in the City at the time that the regulation was adopted or would be annexed in the future The only time that this requirement is applied is in the case of ground that has not been actively farmed and is proposed to be farmed within a distance of 1,000 ft of an established residential area, each such request is handled on a case-by-case basis 4 _ ice, Mayor Joy MINUTES REGULAR MEETING PASCO CITY COUNCIL FEBRUARY 1, 1993 Mayor DeFelice wanted to explain that it was not the City's intention to send a message to the farming community that the City is banning farming There is a process with the ordinance that was adopted several years ago and each request will be looked at on a case-by-case basis The City recognizes that much of the community's prospenty is attributed to ties to agriculture Motion carried (Kilbury - No).
