PASCO CITY COUNCIL
REGULAR MEETING APRIL 19, 1993
CALL TO ORDER
The meeting was called to order at 8 00 P M by Joyce DeFelice,
Mayor
ROLL CALL:
By Deputy City Clerk. Council Members present were Joyce DeFelice,
Michael Garrison, Edgar Hargrow, Chris Jensen, Charles Kilbury, Dan
Lathim, and Carl Strode Also present were Gary Crutchfield, City
Manager, Greg Rubstello, City Attorney, Dan Underwood, Finance
Director, James Ajax, Public Works Director, Dennis Wright, Engineer,
Dick Erickson, Parks & Recreation Director, Don Francis, Police
Chief, David McDonald, Community Development Director, and Kurt
Luhrs, Administrative Assistant
PLEDGE OF ALLEGIANCE
The meeting was opened with the Pledge of Allegiance
CONSENT AGENDA
MOTION Mr Garrison moved to approve the Consent Agenda
Seconded by Mr Hargrow
MOTION Mr Lathim moved to amend the consent agenda to include
items 3(d) - Ivy Glades, and item 3(e) - Rejection of Bids for Senior
Center
Motion carried unanimously Consent items are as follows
A) Approval of Minutes To approve minutes of Regular Meeting held
April 5, 1993
B) Bills and Communications To approve General Claims in the
amount of $292,084 48 consisting of Claim Warrants numbered
80904 through 81103
Bad Debt Write-offs To approve bad debt write-offs for
ambulance, cemetery, and miscellaneous accounts receivable, in
the total amount of $57,386 90 and, of that amount, authorize
$32,341 95 be turned over for collection
C) Wastewater Treatment Plant Upgrade/Expansion. To set Monday,
May 17, 1993, at 8 00 p m, as the date and time to conduct a
hearing on the City of Pasco Proposed Wastewater Facility Plan
D) Ivy Glades To approve the concept of permitting the Ivy Glades
Development Project to connect to the City sewer system by the
way of pressure lines and pump station at the cost of the
developer and subject to approval of formal written agreement
E) Rejection of Senior Center Bids To reject the bids received on
April 14, 1993, for Senior Citizen Center expansion
PROCLAMATION AND ACKNOWLEDGMENTS
Mayor DeFehce presented a Proclamation for "Mathematics Awareness
Week", April 25 - May 1, 1993 to Miso Mitkovski of Columbia Basin
College Math Club

Chief Francis presented the "Reserve Police Officer of the Year" Award
to Sgt Jack Miller for volunteer service to the City of Pasco as a
reserve police officer Sgt Miller has logged over 2500 hours as a
reserve officer since 1988 when he joined the Police Department
VISITORS.
None
REPORTS FROM COMMr1ThES AND/OR OFFICERS.
Mayor's Activity Report. Mayor DeFelice reported that on April 12 she
attended a meeting at Our Lady of Lourdes Health Center for the
purpose of conveying concern on the part of OLOL for the funding of La
Chnica as well as their concern on La Chnica's ability or inability to
retain and recruit physicians
On April 14 attended the Volunteer Reception.
Pasco Downtown Development Association Board Meeting - April 6.
1993. Mr. Kilbury reported that the only item of business concerned
the State's putting social programs, i e , work release, into Pasco
without the benefit of public heanngs prior to implementation It was
felt that these programs should be spread among the several cities
B F Transit Board Meeting - April 8, 1993. Mr Garrison reported
that he was unable to attend the meeting
Senior Citizens Advisory Committee Meeting - April 12. 1993 Mayor
DeFelice reported that the Committee was anxiously awaiting the bids
for the remodel, which unfortunately, were $150,000 over the
$800,000 budgeted and would have to be rebid or modified
Tr-Cities Rivershore Enhancement Association Meeting - April 14.
1993 Mr Jensen stated that there was no meeting -
TRIDEC Board Meeting - April 15. 1993. Mayor DeFelice reported
that since the City is no longer a voting member she is no longer
attending these meetings on a regular basis unless there is a specific
item that concerns Pasco
PUBLIC HEARINGS.
Schoviller Rezone. Mr. McDonald, Director of Community
Development, addressed Council and noted for the record that notice
of the public hearing was published as required by law. There were
also two letters read into the record by the Clerk from Dale G Van
Scholack and Raymond T Michener, both being against the proposed
rezone
Mr McDonald explained that the area is currenly zoned I-1 - Light
Industnal and is traversed with a BPA power line When lookmg at the
area south of "A" Street it has somewhat of a look of a heavy industrial
area with a meat packing plant and a large salvage yard to the west of
the site To the north there is the Bonneville Power Substation, which
is an intense use and could be classified a heavy industrial use, and in
the south there are tank farms and Big Pasco facility All of this gives
the area a look and feel of a heavy industrial setting
The power lines and their easement runs across the property, which
makes it very difficult for it to be used for a number of things No
building is allowed under the power lines, while a salvage yard Would
be one of the uses that could utilize all of the property without

concern or detnment to the power line easement For these reasons
staff recommends the rezone be approved.
The Planning Commission disagreed with staff due to the following
reasons The proposed site is near one of the mam entrances to the
City, the community needs to build up the city and eliminate eye
sores, the proposed rezone would have a negative impact upon the
development potential of surrounding properties, East Pasco is
looking to improve and the proposed uses are not an improvement,
and 1-2 uses need to be concentrated next to each other Based upon
these issues and testimony provided by adjacent property owners, the
Planning Commission concluded it was not appropriate to rezone the
property in question from I-1 to 1-2 and recommended the City
Council deny the rezone.
MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO
CONSIDER THE SCHO'VILLER REZONE I-1 (LIGHT INDUSTRIAL) TO
1-2 (HEAVY INDUSTRIAL) (MF #93-08-Z/SP)
Mr Joseph Schoviller, of 1613 Road 32, addressed Council to speak in
favor of the proposed rezone and explained that the plan is to put up
the required 8' fence, paint and landscape it, and also plant trees in
front with shrubs along the side
Mr Jake Roth, no address given, spoke on behalf of property owners
in the area He explained that several pieces of property in that area
have been listed with him for three to six years and in that time has
received approximately five phone calls concerning it It was his wish
that Council would consider the zone change in a favorable way to
enhance said property's resale value.
Mr Doug Ensor, of 4211 West 17th Court, addressed Council to
explain that the group of people he invested with in the property with
have spent a great deal of time and energy improving it and would be
opposed to the proposed rezone He also felt the a rezone of this
property would conflict with the type of development envisioned for
the property.
Mr Dale VanSchmack, 2141 South Lyle Street, addressed Council and
expressed his continued opposition to the proposed rezone
Ms Carol Moser, 2862 Eastwood Avenue, addressed Council and spoke
against the proposed rezone as a concerned property owner She also
felt that even with the required fencing the proposed salvage yard
would be an eye sore.
Pastor Eugene Lewis, of 1715 West Octave Street, also spoke in
opposition to the proposed rezone as it would add to the beautification
problems already being experienced in East Pasco and hamper efforts
bemg made to improve the image of that section of town
Following three (3) calls from Mayor DeFelice for further comments
from the floor, either for or against, the public hearing was declared
closed
Ordinance No. 2928
AN ORDINANCE RELATING TO ZONING AND CHANGING THE
CLASSIFICATION OF CERTAIN PROPERTY WITHIN THE CITY
OF PASCO FROM 1-1 (LIGHT INDUSTRIAL) TO 1-2 (HEAVY
INDUSTRIAL)

MOTION Ordinance No 2928, was read by title only Mr Lath=
moved to adopt Ordinance No 2928, rezoning said property from I-1
to 1-2.
Motion failed to gain the floor for lack of a second
MOTION Mr Strode moved to deny the adoption of Ordinance No
2928 rezoning said property from I-1 to 1-2 Mr Garrison seconded
the motion Motion earned (Lathim - No)
Abatement Cost Recovery - 811 South Myrtle Avenue Mr Rubstello,
City Attorney, addressed Council and noted for the record that notice
of the public hearing was published as required by law
Mr Rubstello explained that this property was partially damaged in a
fire To remove or abate what remained cost the City $7,904 19,
which is in excess of property's assessed valuation Thus, placing a
lien and foreclosing on this property would not recover the amount
paid by the City for clean-up, however, there are two owners of the
property that the City could proceed against and this was staffs
recommendation
MAYOR DEFELICE DECLARED THE PUBLIC HEARING OPEN TO
CONSIDER THE METHOD OF RECOVERING CITY COSTS FOR
ABATEMENT ACTIVITIES AT 811 SOUTH MYRTLE AVENUE
Following three (3) calls from Mayor DeFelice for further comments
from the floor, either for or against, and there being none, the public
hearing was declared closed
MOTION. Mr. Strode moved to declare abatement expenses for 811
South Myrtle Avenue in the amount of $7,904 19 to be a personal
obligation of the property owners and direct the City Attorney to
collect same by use of all appropriate legal remedies Mr Jensen
seconded the motion Motion earned unanimously
ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS
Ordinance No. 2929
AN ORDINANCE CONCERNING THE CORRECTION OR
ADJUSTMENT OF VOLUNTARY PAYMENTS TO THE CITY, AND
CREATING NEW CHAPTER 117 TO THE PASCO MUNICIPAL
CODE
MOTION. Ordinance No 2929, was read by title only Mr Garrison
moved to adopt Ordinance No 2929, establishing a limit of one year
prior to notice of error for the collection or refund of water/sewer
charges Mr Hargrow seconded the motion Motion carried
unanimously.
Ordinance No. 2930
AN ORDINANCE RELATING TO PARKING ON JAY STREET AND
ROAD 22, AND AMENDING SECTION 10 56 080 OF THE PASCO
MUNICIPAL CODE
MOTION: Mr. Garrison moved to adopt Ordinance No 2930, banning
parking on a portion of Jay Street and on a portion of Road 22 Mr
Lathim seconded the motion
Mr Wright explained that approximately 3 to 4 cars would be
eliminated from parking by banning parking on that curve This action
was being taken due to a request from the apartment management and

after field research was done to determine the radius around the curve
in question It was found that vehicles, especially B F Transit buses,
trying to make that curve would have difficulty if vehicles were parked
there
Ms Ruby Smith, of 2119 West Jay Street #B, spoke in opposition to
the proposed ordinance. She felt that parking should be allowed
because when tenants of the apartment complex have visitors that's
the only place they can park.
Motion carried unanimously.
Ordinance No. 2931
AN ORDINANCE INCREASING THE MONTHLY COMPENSATION
PAID THE MAYOR AND CITY COUNCILMEMBERS: AND
AMENDING SECTION 2 16 010 OF THE PASCO MUNICIPAL
CODE
MOTION. Mr. Lath= moved to adopt Ordinance No. 2931, fixing the
monthly compensation for the Mayor at $650 00 and Councilmembers
at $450 00 Mr Jensen seconded the motion
Mr. Strode expressed his opposition to the proposed ordinance due to
the recent increase in water/sewer rates He felt that if the Council
could demonstrate that the proposed increase in salary will upgrade
and improve the performance of this Council he would support it,
however, he didn't believe that to be the case and would urge the
Council not to adopt the proposed ordinance
Mr. Garrison felt that people know going in what the salary is and if
they got elected to make money they are in the wrong place to run for
office He, therefore, was opposed to the proposed increase
Mr. Hargrow spoke in favor of the increase due to the expenses
incurred in the course of performing the duties of Councilmember
Mr Dennis Smythwaite, of 925 North Elm Avenue, addressed Council
in opposition of the proposed ordinance due to the timing of it
Pastor Eugene Lewis expressed his opposition to the proposed
ordinance and felt that there was no justification for an increase at this
time
Motion carried by the following roll call vote Yes - DeFelice, Lathim,
Hargrow, Jensen, No - Gamson, Kilbury, Strode

NEW BUSINESS.
Demolition Clean-up - 113 North Oregon Avenue Mr McDonald
explained to Council that in December, 1992, staff caused said
structure to be vacated because of substandard conditions The
building was posted and the property owner was required to repair or
demolish the building The owner failed to do either
MOTION Mr Garrison moved to award a contract for the demolition
and clean-up of 113 North Oregon Avenue to l3J's Cleaning Service in
the amount of $5,236 10 Mr Hargrow seconded the motion Motion
earned unanimously
