HomeMy WebLinkAbout1991.09.03 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING SEPTEMBER 3, 1991 CALL TO ORDER The meeting was called to order at 8 00 P M by Joe Jackson, Mayor ROLL CALL By Deputy City Clerk Council members present were Joyce DeFelice, Michael Garrison, Joe Jackson, Chris Jensen, Charles Kilbury, E A Snider, and Dan Lathim Also present were Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Dennis Wright, Assistant City Engineer, Dave McDonald, Community Development Director, and Kurt Luhrs, Administrative Assistant PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance CONSENT AGENDA Mr Garrison moved to approve the Consent Agenda Seconded by Mr Snider Motion earned Consent items are as follows A) Approval of Minutes To approve minutes of regular meeting held August 19, 1991 B) Bills and Communications • To approve General Claims in the amount of $197,644 38 consisting of Claim Warrants numbered 71399 through 71567 Bad Debt Write-offs To approve bad debt wnte-offs for utility billing, ambulance, and Municipal court non-criminal accounts receivable in the total amount of $7,752 11 and, of that amount authorize $5,953 38 be turned over for collection C) Agreement with YMCA at Martin Luther King Community Center To authorize the Mayor to sign an Agreement between the City of Pasco and the YMCA of the Lower Columbia Basin to provide recreational activities at the Martin Luther King Jr Community Center D) Resolution No 1970 To approve Resolution No 1970, establishing a policy of the Pasco City Council on the use and appropriation of City hotel/motel tax receipts E) Resolution No 1971 To approve Resolution No 1971, accepting the work performed by Power City Electric, Inc under contract No 91-4-01 for the construction of a traffic signal at 20th Avenue and Henry Street F) Special Permit - Off-Site Parking Lot in R-1 Zone (MF #91-17-SP) To approve the special permit for an off-site parking lot at 827 West Brown Street, as recommended by the Planning Commission G) Urban Growth Boundaries To direct the Planning Commission to conduct a public hearing to develop and recommend an appropriate urban growth boundary for the City by September 23, 1991 H) Appointment to Air Pollution Control Board To concur in the Mayor's appointment of Harry Elzie to the Board of Directors of MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 3, 1991 the Benton-Franklin-Walla Walla Counties Air Pollution Control Authority PROCLAMATION AND ACKNOWLEDGMENTS "Yard of the Month" Awards The following Pasco residents were presented Certificates of Appreciation from City Council. Lynn and Bertha Dale, 412 North Owen Street (Son accepted award for parents) George and Garnette Blake, 2724 Fleming Lane Hubert and Amy Schleicher, 1531 West Clark Street. Frank and Leona Stinson, 219 Riviera Trailer Park (Unable to attend) Andy and Rosa Anthony, 1748 North 6th Avenue Spencer and Whitney Osborn, 3802 View Court VISITORS Lyons Annual Conference for 1992. Mr W H Ketchersid, of Wallula, Wa , addressed Council to request use of city property at the Golf Course for the purpose of R V parking during May 20-24, 1992 The Lyons Multi-District #19 plan to convene their annual conference at the Red Lion This matter has been discussed with the City Manager and Golf Course officials seeking their approval Mr Red Bingham, of Edmonds, Wa , addressed Council also asking for use of city property for R V parking The R V 's will be parked in stalls 20' wide and 40' long with no sewer or water hook-up (known as dry parking) Mr Garnson moved to endorse letting the Lyons use the Golf Course for R V dry parking Need for Recreation Facilities Mr Juan Bayona, of 2200 W Shoshone St, addressed Council about the immediate need of recreation facilities for teenagers He has been meeting with these teenagers for the last several months The group has been going from park to park, and from school to school trying to find a field to play soccer on without interfering with events already scheduled These teenagers had tried out for high school soccer programs, but out of 90 children only 34 were picked for teams Mr Bayona has volunteered to coach the remainder not picked for teams and for the last several months they have been trying to find a place to practice and play soccer Mr Snider asked if the group would qualify for some assistance through the Parks & Recreation Department9 Mr Crutchfield suggested that the Parks Director be approached to see if there's someway to fold these children into some other soccer association or league so that there would be other teams to play and a place to practice and play Mr Crutchfield pointed out to Council that the enure Tn-Cities, not just Pasco, is very short of soccer fields "There simply aren't enough to go around" Mrs DeFelice asked Mr Bayona if he had attended any of the public meetings of the Parks & Recreation Advisory Board where the Comprehensive Parks & Recreation Plan was discussed Mr Bayona stated that he had been attending the meetings 2- MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 3, 1991 Mrs DeFelice remarked that hopefully, in the long term, this issue could be resolved Mr Garnson pointed out that there was a Committee working towards an Ag Arena/Sports Complex Unfortunately, this complex is a couple years away and needs money and time REPORTS FROM commn lEES AND/OR OFFICERS B F Substance Abuse Coalition Trustees Meeting Mr Jensen was unable to attend the meeting Good Roads Association Meeting Mr Snider was unable to attend the meeting B F Regional Council Mr Kilbury reported that the Council agreed to a 3% a year traffic volume increase Public funding of Columbia Basin Dive and Rescue was discussed Visitor & Convention Bureau Board Meeting Mrs DeFelice reported that the meeting was brief and there was nothing to report PUBLIC HEARINGS MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE REMOVAL OF PARKING ON A PORTION OF 20TH AVENUE Mr Wright addressed Council and explained that the removal of parking on 20th Avenue between Court and Ruby Streets is necessitated by the Council's desire to improve the channelization on four legs of that approach to that intersection Mr Wright noted that the Hearing had been duly publicized and there are only three different property owners that own property adjacent to this particular leg of the intersection These property owners were sent letters explaining what was proposed and inviting them to attend the hearing At recent meetings, staff has presented a proposal for installing raised channelization on the four approaches to the intersection of 20th Avenue and Court Street As a part of that proposal, staff proposed to modify the traffic island on the north approach to the intersection which will require the removal of parking Staff requested that at the conclusion of the public hearing, Council adopt an ordinance banning parking on this portion of 20th Avenue Following three (3) calls from Mayor Jackson for further comments from the floor, either for or against, the public hearing was declared closed ORDINANCE NO 2832 AN ORDINANCE RELATING TO PARKING ON A PORTION OF 20TH AVENUE BETWEEN COURT AND RUBY STREETS AND AMENDING SECTION 10.56 080 OF THE PASCO MUNICIPAL CODE Ordinance No 2832 was read by title only Mr Garrison moved to adopt Ordinance No 2832 prohibiting parking on both sides of 20th Avenue between Ruby Street and Court Street Mr Jensen seconded the motion Motion earned -3 MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 3, 1991 MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE VACATION OF CERTAIN PORTIONS OF 24TH AVENUE AND YAKIMA STREET RIGHTS-OF-WAY Mr McDonald addressed Council and stated that the Heanng had been duly publicized notifying the public of the hearing Also notified were affected utilities The city did receive comments back from the P U D and Public Works Department The P U D requested that an easement be retained on the portion of 24th Avenue that would be vacated and the Public Works Department is requesting an easement on Yakima Street The city has received no other correspondence Mr Snider asked Mr McDonald if this action would restrict the only ingress and egress to Yakima Street on the east end 9 Mr McDonald stated that this was correct Mr Snider wanted to know if staff thought this was a good idea? Mr McDonald explained that it was not the best idea The problem is obtaining the right-of-way to continue Yakima Street to the west The property owners had no desire for a western access at this time Mr Snider stated that as it exists now the street being vacated doesn't exist Mr McDonald concurred with this statement and explained that there's just half of a nght-of-way. Mr Snider wanted to know if staff was sure that the City really wanted to do this because after the vactation is approved the city would be unable to get it back'? Mr. Wnght informed Council that staff has been talking to the property owners within Keltch's Mobile Home subdivision and they've been against having the road go through The owner of the apartments, who actually initiated the L I D on 24th Avenue, also requested that this street be closed because they don't like the kind of traffic travelling through that area Mr Wright stated that he had taken a look at it and felt most of the adjacent property owners would be glad to see that road permanently closed, including those within the mobile home subdivision Mr. Bud Williams, of 2017 W Yakima Street, addressed Council wanting to know what the feeling is of closing this street') He stated that there was a lot of traffic coming out of the apartments and mobile home park onto 20th Street Mr Williams felt that opening that street up would relieve some of the traffic going into 20th Street Mr Crutchfield asked Mr Wnght if there was any urgency to action on this issue 9 Mr Wnght stated that there is some urgency as Council will be asked in two weeks to consider a final assessment roll on L I D 122, which does assume that this vacation of Yakima Street has occurred If it does not then staff will ask Council to amend the assessment roll Mr Kilbury moved to return this issue to staff and continue the Public Hearing at the next regular meeting of Council Mr Snider seconded the motion Motion earned. 4 - son, Mayor MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 3, 1991 ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS Ordinance No 2833 AN ORDINANCE CONCERNING THE REGULATION OF BUSINESS LICENSES AND AMENDING CHAPTER 504 OF THE PASCO MUNICIPAL CODE Ordinance No. 2833 was read by title only. Mr Garrison moved to adopt Ordinance No 2833, concerning the regulation of business licenses and amending Chapter 5 04 of the Pasco Municipal Code Mr Jensen seconded the motion Motion carried Ordinance No 2834 AN ORDINANCE RELATING TO ZONING AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM R-3 (MEDIUM DENSITY RESIDENTIAL) TO "0" (OFFICE). Ordinance No 2834 was read by title only Mr Snider moved to adopt Ordinance No 2834, granting the rezone from R-3 to "0" Mr Jensen seconded the motion Motion carried UNFINISHED BUSINESS None NEW BUSINESS None MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mayor Jackson informed Council that upon the conclusion of the regular meeting he would call an Executive Session to discuss property acquisition No action will be taken during Executive Session ADJOURNMENT No further business, the meeting was adjourned at 9 15 P M ATTEST Catherine D Seaman Deputy City Clerk PASSED and APPROVED this /6' day of , 1991 -5
