HomeMy WebLinkAbout1991.09.16 Council MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING SEPTEMBER 16, 1991 CALL TO ORDER The meeting was called to order at 8.00 P M by Joe Jackson, Mayor ROLL CALL By Deputy City Clerk Council members present were Joyce DeFelice, Michael Garrison, Joe Jackson, Chris Jensen, Charles Kilbury, E A Snider, and Dan Lathim Also present were Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Dan Underwood, Finance Director, Dennis Wright, Assistant City Engineer, Dick Enckson, Parks and Recreation Director, David McDonald, Director of Community Development, and Jim Ajax, Public Works Director PLEDGE OF ALLEGIANCE The meeting was opened with the Pledge of Allegiance. CONSENT AGENDA MOTION Mr Garrison moved to approve the Consent Agenda Seconded by Mr Jensen Motion carried Consent items are as follows A) Approval of Minutes To approve minutes of regular meeting held September 3, 1991 To approve minutes of special meeting held September 9, 1991. B) Bills and Communications. To approve General Claims in the amount of $379,882 66 ($8,498 72 being in the form of Wire Transfer Nos 2684 and 2685, and $371,383 94 consisting of Claim Warrants numbered 71568 through 71747) C) Benton-Franklin Governmental Conference - Contract Amendment No 1 on "Road Rater" Program To approve Amendment No 1 to the Inter-governmental Service Agreement between the City of Pasco and the Benton-Franklin Governmental Conference relating to the "Road Rater" and, further, authorize the Mayor to sign the Amendment D) Setting a Public Heanng date for the Final Assessment Roll for LID #122 (Ruby/Agate Sewer) To set Monday, October 21, 1991, at 8 00 p m in the City Council Chambers, as the time and the place for a public hearing on the final assessment roll for LID #122 E) Resolution No 1972 To approve Resolution No 1972, authorizing the relocation of the existing bus stop at U S Bank on North 10th Avenue F) Public Works Trust Fund Loan Agreement - Road 68 Tank - Proposed Amendments to Agreement To approve the proposed amendment Nos 1 and 2 to the Agreement No PW-5-89-962-036 between the State and the City of Pasco and, further, authorize the Mayor to sign the Amendment PROCLAMATION AND ACKNOWLEDGMENTS None. 7 MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 16, 1991 VISITORS Ms Donna Raines, of Rt 14 Box 2283, Kennewick, Washington, addressed Council to request funds for a North West Youth Summit on Fitness and Sports Ms Raines explained to Council that youth from all over the State of Washington would be coming to the Tn-Cities for the Summit and would Council be willing to donate $2,000 00 in support of this activity? MOTION After a general discussion Mr. Kilbury moved to approve donating $2,000 00 from the Hotel/Motel Tax Fund Mr Snider seconded the motion Motion carried (DeFelice and Kilbury - no) MOTION Mr Jensen moved to amend the motion and approve donating $2,000 00 from the General Fund should it prove to be ineligible to come out of the Hotel/Motel Tax Fund Mr Snider seconded the motion Motion carried (DeFelice and Kilbury - no) REPORTS FROM COMMIllhES AND/OR OFFICERS Park & Recreation Advisory Council Meeting. Mrs DeFelice reported that she was unable to attend the meeting Senior Citizens Advisory Committee Meeting. Mrs DeFelice reported Mr Finke gave statistical reports on the Senior Center and a report was given by the nutritionist Tn-MATS RTPO Policy Advisory Committee Meeting Mr Kilbury reported that the contract for the Eltopia to Mesa section of 395 will be (unclear) in April, 1992, including blasting the hill immediately north of Eltopia. At the State Transportation Commission meeting in Walla Walla Dick Larson will attempt to get money for the engineering of the Sylvester/Lewis Street interchange. B F Transit Board Meeting Mr Garrison reported that the meeting was routine The only item of note was the Washington State Bus Rodeo Championship On the large bus and the "Dial-a-Ride" vehicle Ben-Franklin Transit drivers placed 1st in both categories, which is a first for the State and unheard of in the past PUBLIC HEARINGS MAYOR JACKSON DECLARED THE PUBLIC HEARING RECONVENED TO CONSIDER THE VACATION OF CERTAIN PORTIONS OF 24TH AVENUE AND YAKIMA STREET RIGHTS-OF-WAY Mr McDonald addressed Council and explained that as a result of the last hearing on this issue staff was asked to provide additional information This has been provided in the form of background information Mr McDonald explained that approximately 14 years ago the portion of street that is in question was utilized by traffic going into and out of the Keltch Addition The residents of that Addition had concerns about traffic and submitted a petition to Council to request that this portion of the street be closed As directed by Council, a barricade was erected across f -ie full width of Yakima Street as the west side of the Keltch Addition and is still there today Yakima Street has not been used as a street for 14 years -2- MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 16, 1991 Mr McDonald informed Council that the Public Works Department has pointed out that the way the Keltch Addition is configured there are 4 90 degree turns, which doesn't adequately accommodate through traffic. Following three (3) calls from Mayor Jackson for further comments from the floor, either for or against, the public hearmg was declared closed Ordinance No. 2835 AN ORDINANCE VACATING CERTAIN PORTIONS OF 24TH AVENUE AND YAKIMA STREET RIGHTS-OF-WAY MOTION Ordinance No 2835 was ready by title only Mr Jensen moved to adopt Ordinance No 2835, vacating certain portions of 24th Avenue and Yakima Street Mr Garrison seconded the motion Motion carried MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN TO CONSIDER THE FINAL ASSESSMENT FOR LID #121 Mr Rubstello addressed Council and outlined the duties and functions of Council as pertains to the Public Hearing to consider the final assessment for L I D #121 Mr Rubstello further explained that the Council acts as a Board of Equalization for the proposed final assessment, that it's Council's function to determine that the final assessment is fair and equitable: and at the close of the public hearing to adopt or amend the final assessments Clerk read a letter into the record from Richard and Pernie Ryder, 10724 West Court Street, Pasco, Washington stating their objection to the final assessment roll of L I D No 121 dated September 10, 1991 Mr. Ajax addressed and informed Council that notice of the hearing was properly published as required by law and, further, each of the affected properties within the L I D boundanes were mailed notice of this heanng Mr Ajax stated that it is the view of staff that each of the properties within the assessment district was benefited and the proposed assessment amounts were fairly and equitably distributed. Mr Wright addressed Council and explained that a new street was created between Sylvester and Lewis Streets by installing curbs, gutters, sidewalks, grating, paving, storm drainage, and illumination. On Lewis Street the project included placing curbs, gutters, sidewalks, and landEcaping on the north side of Lewis Street Also, as part of the construction contract and not included in the L I D , was placing a curb and gutter on the south side of Lewis Street as well as widening the Street A water line was also installed, connecting an existing water line across Lewis Street This was not included in the L I D and does not appear in the assessment amounts Mr. Wright explained to Council the method used to determine the amount of assessment for each parcel of land in the district. Mr. Greg Markel, of 8627 Gage Blvd, Kennewick, Washington, certified appraiser for Washington Securities and Investment Co, Inc, addressed Council and explained that his review of the assessed properties did find that there was benefit to the properties Mr Markel stated that the entire strip of properties benefited to the extent of "special benefit", as well as general benefit to people adjacent to Sylvester and Lewis Streets 3 MINUTES REGULAR MEETING PASCO CITY COUNCIL SEPTEMBER 16, 1991 Mr Wayne Campbell, of 1100 Jadwin Avenue, #260, Richland, Washington, addressed Council as representation for Mr & Mrs Ryder, who own parcel #3 Mr Campbell stated that the L.I D. does not confer a special benefit to the Ryder property and that the benefits are negligible, that the city did not comply with its ordinance when it enacted L I D No 121, the assessments, viz, L I D No 121 violates the 5th and 14th Amendments to the U S Constitution and Article 1, section 3 and 16 of the Washington State Constitution Mr Ryder informed Council that half of his property is already developed with a cyclone fence topped with barbed-wire surrounding it Mr Ryder stated that he didn't believe the remaining undeveloped footage is worth the amount of the proposed assessment Following three (3) calls from Mayor Jackson for further comments from the floor, either for or against, the public hearing was declared closed (A complete transcript of the Public Hearing on Final Assessment Roll for L I D No 121 is filed in the City Clerk's vault) Ordinance No. 2836 AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO 121 FOR THE IMPROVEMENT OF A PORTION OF BOTH LEWIS STREET AND ROAD 24, AS PROVIDED BY ORDINANCE NO 2815, AND LEVYING AND ASSESSING A PART OF THE COST AND EXPENSE THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY AS SHOWN ON THE ASSESSMENT ROLL, AND PROVIDING FOR AN INTERFUND LOAN FOR LONG-TERM FINANCING UNTIL ASSESSMENTS ARE PAID MOTION Ordinance No 2836 was read by title only Mr Garnson moved to adopt Ordinance No 2836, confirming the assessments and assessment roll for Local Improvement District No 121 Mr Jensen seconded the motion Motion carried by the following roll call vote Yes DeFehce, Garnson, Lathim, Jackson, Jensen, Kilbury, Snider (7- 0) ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS None UNFINISHED BUSINESS None. NEW BUSINESS Memorial Park and Library Irngation System Bid Results MOTION Mr Snider moved to award the bid for the Memonal Park and Library irrigation systems to Loftus, Inc in the total amount of $49,078 10, sales tax included Mr Garrison seconded the motion Motion carried (7-0) -4 .Ariantei, elirrenr-.
