ROLL CALL: By City Manager. Councilmembers present were: Joyce DeFelice, Michael Garrison, Ed Hendler, Joe Jackson, Chris Jensen, Charles Kilbury and E.A. Snider. Also present were: Gary Crutchfield, City Manager; Greg Rubstello, City Attorney; and David McDonald, Director of Community Development. ORDER OF BUSINESS: Amendment No. 2 to Golf Course Development Agreement. The City Manager reported that the agreement between the City and MSL Group calls for the City to install the infrastructure for the sub-division. It has always been the understanding of staff that the improvements required as part of the sub-division included the security entry gate, as well as improvement of the common areas (landscaping, irrigation). That understanding is confirmed by the appraised values which include the increment of value associated with the security entry gate. The estimated cost for the entry gate system, landscape the common areas and fencing of the rear lot line of the interior lots, ranges from $60,000 to $80,000. At the request of staff, the MSL Group has agreed in principle to make those improvements as part of the real estate transaction. Hence, staff proposes the attached amendment to the Real Estate Agreement. The general design and content of the improvements will be subject to City approval prior to installation. Staff anticipates that such approval would be given at the administrative level, unless staff sees a reason to bring an issue to the Council for a decision. Mr. Snider moved to approve Amendment No. 2 to Real Estate Purchase and Sale Agreement with the MSL Group and, further, authorize the Mayor to sign the Agreement. Seconded by Mr. Garrison. Motion carried by roll call vote of six (6). Mr. Hendler voting no. ADJOURNMENT:
