The meeting was called to order at 8:00 P.M. by Ed
'-'idler, Mayor.

PASCO CITY COUNCIL
REGULAR MEETING AUGUST 21, 1989
EXECUTIVE SESSION: There was an Executive Session of the City Council
at 7:30 P.M. to discuss Personnel. No action was taken.
CALL TO ORDER:
By City Clerk. Councilmen present were: Michael Garrison,
Joyce DeFelice, Ed Hendler, Lee Kraft, Joe Jackson, Luisa
Torres and E.A Snider. Also present: Gary Crutchfield, City
Manager.
CONSENT AGENDA:
Mr. Snider moved to approve Consent Agenda as amended. Seconded
by Mr. Garrison. Motion carried. Consent items are as follows:
a) Approval of Minutes. To approve minutes of regular
meeting, held August 7, 1989.
b) Bills. To approve General Claims in the amount of
$220,226.24 ($16,908.14 being in the form of Wire Transfer No.
2311 and 2317; and $203,318.10 consisting of Claim Warrant Nos.
62593 through 62741).
C) Resolution No. 1884. A Resolution providing for a
method of City Property Tax distributions by the County
Treasurer.
d) Proposed Contract for Soils Testing for Road 68 Water Tank.
To approve the Agreement between Chen-Northern, Inc. and the City
of Pasco for Geotechnical Engineering Services for Road 68
Elevated Storage Tank Project.
PROCLAMATIONS:
There were no Proclamations acknowledged at this time.
VISITORS:
Boy Scout Troop No. 159 was recognized by Mayor Hendler. They
represent area adjacent to Knights of Columbus Hall and are
working on their Communications Merit Badges.
REPORTS FROM COMMITTEES AND/OR OFFICERS:
Tr-MATS Policy Advisory Committee. Mrs. Torres reported the
Airport Plan had been approved and she had encouraged the Transit
Authority to work with the Cities in applying for Transportation
Improvement Authority Grants.
Ben-Franklin Transit Board Meeting. Mr. Garrison stated it was
a most constructive meeting. Mr. John Williamson questioned
bidding process used in purchase of buses. Further, the Capitol
Facilities Committee had approved participation in the
Lewis/Sylvester Interchange Project (Pasco's only
Transportation Improvement Authority Project) in the amount of
$40,000 for four bus turnouts. Mr. Cos Edwards had resigned as
Marketing Director to accept employment with Westinghouse, and
service to the Finley area had been extended to November.

Senior Citizens Advisory Committee. Mrs. DeFelice reported
that a Nutrition Report had been given by Mrs. Susan Moore. Art
Finke, Senior Services Coordinator, gave financial report as well
as goals and projections for coming year.
ORDINANCES/RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS:
ORDINANCE NO. 2736.
AN ORDINANCE CONCERNING SEPTIC TANK WASTE DISPOSAL;
AND AMENDING CHAPTER 13.54 OF THE PASCO MUNICIPAL
CODE.
Ordinance No. 2736 was read by title only. Mr. Kraft moved to
adopt Ordinance No. 2736, revising the sewer treatment rates for
septic tank pumpings. Seconded by Mr. Garrison. Motion carried.
UNFINISHED BUSINESS:
None.
NEW BUSINESS:
Low-Income Neighborhood Bituminous Surface Treatment Project.
Mr. Snider moved to award the Contract for Low-Income
Neighborhood Bituminous Surface Treatment Project No. 89-3-04, to
low bidder, Transtate Paving, Inc., in the amount of $94,565.00
and, further, authorize the Mayor to sign the Contract Documents.
Seconded by Mrs. Torres. Motion carried. (Councilman Joe
Jackson abstained from voting due to having an interest in the
area).
Letter to Congressman Sid Morrison re: Garza Investigation.
The City Manager read letter to be sent to Congressman Sid
Morrison as follows:
"The Pasco Police Department recently investigated a complaint by
one Jose Cruz Garza which alleged that he was struck by a Police
vehicle in the process of being arrested in Pasco. The internal
investigation has been characterized by Mr. Garza and his
spokesmen as a "whitewash" or "cover up" of alleged Police
brutality and as being representative of the way the Pasco Police
Department deals with Hispanic residents. The City wishes to
clear the air surrounding the investigation and feels it can do
so only through the use of a qualified and impartial third party.
To that end, we respectfully request you urge the U.S. Department
of Justice to assign appropriate personnel to perform an
independent audit of the Garza complaint investigation.
Specifically, the investigation should:
Review the complaint, all related police reports, recorded
tapes and transcripts of witness interviews, physical
evidence gathereed and medical reports. Review
investigative methodology utilized by the City. Interview
City staff members who participated in the investigation.
Determine whether or not the investigative steps taken by
City Staff were deficientt in any manner. If so, identify
what steps not taken should have been taken.
Determine whether the witness interviews were thorough and
professional. Determine whether the interviews of
complaintant (Garza) reflect a search for the truth or an

attempt to "cover up" or "whitewash" the investigation.
Determine whether the findings released by the City are
supported by the evidence.
In view of the community tension associated with this matter, it
is imperative that an independent audit be completed as soon as
possible. In that regard, we urge that you (and perhaps Senator
Gorton) impress upon the Department of Justice our sense of
urgency. We will certainly appreciate your earliest response and
stand ready to accommodate the independent audit as soon as
possible."

Mr. Kraft moved that the Pasco City Council endorses this letter
as official action of their body. Seconded by Mr. Jackson.
Motion carried.
Mr. Pete Chacon commended the Council for their action and felt
it was a positive way to clear the air.

No further business, the meetin adjourned at 8:15 P.M.
