HomeMy WebLinkAbout10-03-1988 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING OCTOBER 3, 1988 EXECUTIVE SESSION: An Executive Session was called at 7:30 P.M. to discuss pending litigation. It adjourned at 8:00 P.M. with no action taken. CALL TO ORDER: The meeting was called to order at 8:00 P.M. by Ed Hendler, Mayor. ROLL CALL: By City Clerk. Councilmen present were: Michael Garrison, Beverly Green, Ed Hendler, Joe Jackson and Emerson Morgan. Councilmen Lee Kraft and E.A. Snider were absent (excused). Also present were: Gary Crutchfield, City Manager; Greg Rubstello, City Attorney; Dennis Wright, City Engineer; David McDonald, Director of Community Development; and Webster Jackson, Personnel/Purchasing Officer. CONSENT AGENDA: Mrs. Green moved to approve Consent Agenda. Seconded by Mr. Morgan. Motion carried. Consent items are as follows: a) Approval of Minutes. To approve minutes of regular and special meetings, held September 19 and 22, 1988 respectively. b) Bills. To approve general claims in the amount of $175,222.72 ($6,104.58 being in the form of Wire Transfer No. 2017; and $169,118.14 consisting of Claim Warrant Nos. 59375 through 59489). To approve Payroll Claims in the amount of $306,777.07; Payroll Voucher Nos. 8560 through 8750; and 8751 through 8924. To approve bad debt write-offs for utility billing, ambulance, and Municipal Court non-criminal accounts receivable in the total amount of $13,182.46 and, of that amount, authorize $12,373.50 be turned over for collection. c) Regional Revolving Loan Fund. To approve the Letter of Understanding with the State of Washington as to the receipt and distribution of $50,000 for recapitalization of the Regional Revolving Loan Fund. d) Cable Bridge - Cable Rewrap Project. To authorize the Mayor to sign the Municipal Agreement relating to funding of the Cable Bridge Rewrap Project. e) Resolution No. 1850. A Resolution accepting work by Contractor's Equipment Maintenance, Inc. under Contract No. CD 88-300 for the demolition of the Roberts Hotel. f) Traffic Signal Improvements at 7th Avenue & Lewis Street. To authorize staff to call for bids for the modernization of the traffic signals at 7th Avenue and Lewis Street. g) 20th Avenue at "A" Street Improvements. To authorize staff to seek formal quotations for improvements to the intersection at 20th Avenue and "A" Street. -1- MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1988 h) 1988 Patching Contract. To authorize staff to seek informal quotes to perform the 1988 patching contract. VISITORS: 1 There were no visitors wishing to address the council at this time. PUBLIC HEARINGS AND COUNCIL ACTION ON ORDINANCES RELATING THERETO: MAYOR HENDLER DECLARED THE PUBLIC HEARING OPEN TO CONSIDER FINAL ASSESSMENT ROLL FOR LID NO. 120: Mr. Dennis Wright, City Engineer, stated the Hearing had been publicized according to State Law and all affected property owners notified. There were no written communications. LID No. 120 is construction of Road 34 between Henry and Court Street and is nearly complete. While minor construction items remain, the final costs of the project have been determined, and the final assessments have been mailed to the property owners. The final assessment roll amount was $79,778.72, which was approximately 10.8% under the preliminary assessment roll of $89,496.00. A portion of the underrun was due to the fact that one property owner placed curb, gutter, and sidewalk prior to construction of the LID. Most property owners, therefore, saw a real savings of approximately 9.6% from their preliminary assessed amount. The exception to this would be at the Heidi Haus, where the property owner requested an additional driveway be added after the start of construction, and also requested that one of his driveways be modified. That assessment actually increased approximately $800 over the preliminary assessment. Following three (3) calls from Mayor Hendler for further comments from the floor, either for or against, the public hearing was declared closed. ORDINANCE NO. 2701: AN ORDINANCE OF THE CITY OF PASCO, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 120 FOR THE IMPROVEMENT OF A PORTION OF ROAD 34, AS PROVIDED BY ORDINANCE NO. 2683, AND LEVYING AND ASSESSING A PART OF THE COST AND EXPENSE THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS OF LAND AND OTHER PROPERTY AS SHOWN ON THE ASSESSMENT ROLL; AND AMENDING ORDINANCE NO. 2683 IN PART. Ordinance No. 2701 was read by title only. Mr. Jackson moved to adopt Ordinance No. 2701, confirming the Assessment Roll for the construction of LID 120. Seconded by Mr. Garrison. Motion Carried. ORDINANCES AND RESOLUTIONS NOT RELATED TO PUBLIC HEARINGS: ORDINANCE NO. 2702: AN ORDINANCE RELATED TO ZONING, AMENDING PMC TITLE 22, BY ENACTING A NEW SUB-SECTION 22.40.020(5) AND REPEALING SUB-SECTION 22.48.030(3). Ordinance No. 2702 was read by title only. Mrs. Green moved to -2- MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1988 adopt Ordinance No. 2702, allowing funeral homes as a permitted use in the Office District. Seconded by Mr. Garrison. Motion Carried. ORDINANCE NO. 2703: AN ORDINANCE RELATING TO PUBLIC SAFETY AND MORALS, PROHIBITING LOITERING WITH THE INTENT TO COMMIT AN ACT OR ACTS IN VIOLATION OF THIS TITLE, ENUMERATING CIRCUMSTANCES WHICH MAY BE CONSIDERED AS MANIFESTING SUCH INTENT; AND AMENDING THE PASCO MUNICIPAL CODE CHAPTER 9.36; AND DECLARING AN EMERGENCY TO MAKE NECESSARY THE PASSAGE OF THIS ORDINANCE AND ITS TAKING EFFECT IMMEDIATELY UPON PUBLICATION. Ordinance No. 2703 was read by title only. Mrs. Green moved to adopt Ordinance No. 2703, an Ordinance relating to Public Safety and Morals, amending chapter 9.36 PMC Loitering; and declaring an emergency to make necessary the passage of this Ordinance and its taking effect immediately upon publication. Seconded by Mr. Jackson. Motion carried. (Mrs. Kathryn Smith, 413 S. Douglas, publicly stated she supported proposed Ordinances as a positive step in cleaning up Pasco.) ORDINANCE NO. 2704: AN ORDINANCE RELATING TO PUBLIC SAFETY AND MORALS, PROHIBITING LOITERING FOR THE PURPOSES OF ENGAGING IN DRUG-RELATED ACTIVITY, ENUMERATING CIRCUMSTANCES WHICH MAY BE CONSIDERED AS MANIFESTING SUCH PURPOSE, DECLARING SUCH CONDUCT AS A MISDEMEANOR, AND PROVIDING A PENALTY THEREFOR; AND AMENDING THE PASCO MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTER, TO BE KNOWN AND DESIGNATED AS CHAPTER 9.37 CONSISTING OF FOUR SECTIONS NUMBERED 9.37.010 THROUGH 9.37.040; AND DECLARING AN EMERGENCY TO MAKE NECESSARY THE PASSAGE OF THIS ORDINANCE AND ITS TAKING EFFECT IMMEDIATELY UPON PUBLICATION. Ordinance No. 2704 was read by title only. Mr. Jackson moved to adopt Ordinance No. 2704, an Ordinance relating to public safety and morals, creating new chapter 9.37 PMC Loitering for the purpose of engaging in drug-related activity; and declaring an emergency to make necessary the passage of this Ordinance and its taking effect immediately upon publication. Seconded by Mr. Garrison. Mr. Greg Rubstello, City Attorney, distributed a revised copy of Ordinance No. 2704, stating the only changes were in No. 9, and they made the language more broadly interpretive. Motion carried after council concurred with changes. ORDINANCE NO. 2705: AN ORDINANCE RELATING TO AND CHANGING THE ZONE CLASSIFICATION OF CERTAIN REAL PROPERTY WITHIN THE CITY OF PASCO FROM C-3 (GENERAL BUSINESS) TO C-2 (CENTRAL BUSINESS DISTRICT). Ordinance No. 2705 was read by title only. Mrs. Green moved to adopt Ordinance No. 2705, rezoning from C-3 to C-2 all of Block 22, Northern Pacific Plat. Seconded by Mr. Morgan. Motion Carried. -3- Hendler, Mayor MINUTES REGULAR MEETING PASCO CITY COUNCIL OCTOBER 3, 1988 NEW BUSINESS: Special Permit - Ben-Franklin Transit Transfer Center (MF#88-18-CUP): Mrs. Green moved to approve the Ben-Franklin Transit Special Permit for bus transfer center upon Lot 3, Short Plat 80-11, with conditions as recommended by the Planning I Commission.
