HomeMy WebLinkAbout08-17-1987 MinutesMINUTES PASCO CITY COUNCIL REGULAR MEETING AUGUST 17, 1987 EXECUTIVE SESSIONS Executive Session convened at 7 35 P.M for the purpose of discussing personnel. Adjourned at 8 00 P.M with no action taken. CALL TO ORDER Meeting called to order at 8 00 P M by Joe W. Jackson, Mayor. ROLL CALL By City Clerk. Councilmen present were Beverly Green, Ed Hendler, Lee Kraft, E.A. Snider and Joe Jackson. Councilman Emerson Morgan was absent (excused). Also present were Gary Crutchfield, City Manager, Greg Rubstello, City Attorney, Dennis Wright, City Engineer, Donald Francis, Chief of Police, Larry Dickinson, Fire Chief, and David McDonald, Director of Community Development. CONSENT AGENDA Mr. Snider moved to approve Consent Agenda, as amended (Martinez Waiver moved to regular agenda and Road 38 Improvement added to Consent Agenda). Seconded by Mr. Kraft. Motion carried Consent items are as follows a) Approval of Minutes. To approve minutes of regular meeting, held August 3, 1987. b) Bills. To approve General Claims in the amount of $258,144.60; claim warrant nos. 55256 through 55379. c) Resolution No. 1791 A Resolution of the Pasco City Council, declaring its intention to initiate the formation of a Task Force, including representatives from Pasco, Kennewick, Richland, Benton and Franklin Counties, to identify what can and should be done to appropriately and adequately control Water Follies crowds, both during and outside of Water Follies events, the costs of those measures, and how to finance those costs. (Councilwoman Beverly Green named as Pasco's representative) d) Agreement with Franklin County for Rd 38 Improvements. To approve proposed agreement for Road 38 improvements and authorize the Mayor to sign the same. VISITORS There were no visitors wishing to address the council at this time. REPORTS FROM COMMITTEES AND/OR OFFICERS Tr-MATS. Beverly Green reported that they had discussed the opening of Umatilla Bridge in October, higher priority of rebuilding portion of 395 highway due to increased number of accidents, proposed Park & Ride lot at Road 68 and DOT Convention to be held September 9 - 11, 1987 Further, pre-design study for Lewis/Sylvester Street overpass had been put on the back burner and proposed 65 mph speed limit on highways could seriously jeopardize Federal matching funds. At this point, Mr. Hendler read excerpts from Duane Berentson, Secretary of Transportation, as follows- "...We have sections of Interstate Highways in urban areas that are very rural in characteristics and appearance, but are required to be posted at 55 mph. In some cases, the transition between the 65 mph and 55 mph simply does not make sense to the motorist. Currently, the Federal law prohibits raising the speed limit within the Federal Urban area boundary. Any actions by the States outside the authority of that Federal Law would put the State's Federal Funds in jeopardy. We see no way we could make the change which you have requested without a corresponding change in the Federal law." Mr. Hendler urged the City Council to continue contacting our representatives in regard to this matter. No further business, Mr. Snider moved for adjournment. Seconded by Mr. Hendler. Motion carried. Joe .„.0C-ron, Mayor r of PASSED and APPROVED t is day , 1987 MINUTES PASCO CITY COUNCIL REGULAR MEETING AUGUST 17, 1987 PUBLIC HEARING MAYOR JACKSON DECLARED THE PUBLIC HEARING OPEN FOR MODIFICATION OF PARKING ON NORTH 5TH AVENUE BETWEEN PARK AND OCTAVE STREETS. It was noted that the hearing had been duly publicized and all affected property owners notified by mall. Dennis Wright, City Engineer, stated this recommendation was before the council due to complaints of adjacent property owners and Franklin County. At this time, staff had no recommendations. Mr. Snider asked why employees could not be mandated to park in designated parking lot instead of street. Couldn't this be a condition of employment? The City Manager replied that employees had been notified to park in designated lot rather than on the street, but it hadn't worked out. Mr. Joe Balthazor, 704 W Henry, reiterated that traffic and parking continued on the streets over a 24-hour period, not just 9 to 5. Work release inmates park on the street while they are serving evening and weekend sentences. County Department Heads and other employees prefer to be closer to the building, therefore, it causes much congestion in this area. Mr Balthazor felt this should be an enforcement responsibility of the Police Department. Donald Francis, Chief of Police, stated that round the clock enforcement could be a problem for an already over burdened department. He concurred that CSO Officer could mark tires from 8 - 5 00 P.M. as part of her responsibilities. Following three (3) calls from Mayor Jackson for further comments from the floor, either for or against, the public hearing was declared closed. Mr. Snider moved that proposed Ordinance limiting parking to two hours, around the clock, be revised and brought back to council for consideration at the next regular meeting. Seconded by Mr Hendler. Motion carried. NEW BUSINESS Waiver Utility Service Requirement, PMC Chapter 16.06 (MF#87-11-Martinez ) -(Earlier, discussion had ensued over whether or not to add another section to proposed agreement - requiring hook-up to City services within three years. Since further discussion was needed, this item was moved to regular agenda for action). Mr. Cliff Graber, sales representative for Smart Realty, was opposed to adding 3-year provision to agreement as it would place an undue hardship on Martinez family in the formation of their business. Mr. Snider felt it would be poor business on the part of the City to go back to Mr. & Mrs. Martinez and place such a restriction since they agreed to conditions in our agreement in good faith. Mrs. Green concurred that language in agreement should suffice. Mr. Snider moved to approve the Martinez Agreement for waiver of sewer service requirement. Seconded by Mrs. Green. Motion carried by roll call vote of five (5). MISCELLANEOUS - INCLUDING SUGGESTIONS FROM COUNCIL Mrs. Green asked for Pasco City Council's participation in Bi-Centennial Meeting in September, commemorating our nation's centennial. Mr. Hendler replied that he would distribute parchment copies of our Constitution for each councilman.
